After the Pledge of Allegiance and 8 reading the Character Trait, Chairman Knapp gave the invocation. 9
10 ROLL CALL: 11 All members were present. Chairman Charles Knapp, Vice-Chairman Billy Barrett, Mr. Jerry Crosby, 12
Mr. Greg Duke, and Ms. Sarah Johnson. 13 14 Quorum Present 15
16 Staff present were Mr. Scott Stephens, City Planner and Ms. Alisa Morgan, Secretary. 17 18 CHARACTER TRAIT OF THE MONTH: 19 The Character Trait of the Month is Obedience… Quickly and cheerfully carrying out the direction of 20 those who are responsible for me. 21 22 Chairman Knapp stated the governing rules for the Prattville Board of Zoning Adjustment and the 23 procedure of the meeting. 24 25 COMMITTEE REPORTS: 26 There were no reports to be made. 27 28 OLD BUSINESS: 29
There was no old business to discuss. 30 31 NEW BUSINESS: 32 VARIANCE: 33 Rear Yard Encroachment 34 1018 Allison Drive 35 Morris Builders, Petitioner 36 37 Mr. Stephens introduced the variance request to allow a rear yard encroachment on property located at 38 1018 Allison Drive. He stated that the proposed covered patio will encroach 7.22ft. into the 30ft rear yard 39 setback. 40 41 Jamye Morris, petitioner’s representative, presented the request to allow a rear yard encroachment on 42 property located at 1018 Allison Drive. He stated that the HOA has approved for the patio cover. 43 44 Chairman Knapp opened the floor for public comments. There were none. The public hearing was closed. 45 46
Chairman Knapp opened the discussion for the Board. Mr. Crosby moved to establish the findings of fact 47 stating that 1) the special conditions and circumstances do not result from actions of the applicant (self-48 imposed hardship); 2) that granting of a variance will not confer a special privilege on the applicant that 49
is denied by this ordinance to other lands, structures, or buildings in the same district; 3) that granting of 50 a variance is in harmony with the intent and purposes of the zoning ordinance; 4) that a variance will not 51 adversely affect the surrounding property, the general neighborhood, or the community as a whole. Ms. 52
Johnson seconded the motion. The motion to approve the findings of fact passed unanimously. 53 After no further discussion, the vote was called. Mr. Barrett moved to approve the request as submitted 54

based on the approved findings of fact. Mr. Duke seconded the motion. The motion to approve passed 55 unanimously. 56 57 SPECIAL EXCEPTION: 58 Outdoor Entertainment 59 (496-Vacant Lot) Old Farm Lane N 60 Moving Forward Properties, Inc., Petitioner 61 62 Mr. Stephens introduced the special exception request to allow outdoor entertainment on property located 63
at Old Farm Lane N. He stated that the vacant property is zoned for highway commercial use and is 64 surrounded by commercial property. 65 66
Rob Swinning along with Anthony Allegro, petitioners, presented the request to allow outdoor 67 entertainment on property located at Old Farm Lane N. They stated that the outdoor area will be used to 68 play recreational sports and serve food/drink. There will be no live music on the outside, operating as 69
late as 2:00 am on the weekends. 70 71 Chairman Knapp opened the floor for public comments. There were none. The public hearing was closed. 72 There was an email received from Jay Patel with questions. (Email attached and made a part of the 73 minutes). 74 75 Chairman Knapp opened the discussion for the Board. Mr. Crosby moved to establish the findings of fact 76 stating that 1) development of the proposed use is in the public interest and meets the spirit of the City of 77 Prattville Zoning Ordinance; 2) the proposed Outdoor Entertainment/Outdoor Recreation is an allowable 78 special exception, and is not a prohibited use in a B-4 district; and 3) the proposed use will not cause 79 substantial adverse impact to adjacent or nearby properties or uses. Mr. Duke seconded the motion. The 80 motion to approve the findings of fact passed unanimously. 81 82 After no further discussion, the vote was called. Mr. Barrett moved to approve the request as submitted 83
based on the approved findings of fact. Mr. Crosby seconded the motion. The motion to approve passed 84 unanimously. 85 86 VARIANCE: 87 Side Yard and Principal Structure Yard Encroachment 88 1472 Trolley Road 89 Eric & Vinecia Jackson, Petitioners 90 91 Mr. Stephens introduced the variance request to allow a side yard encroachment and primary structure 92 yard encroachment on property located at 1472 Trolley Road. He stated that the proposed structure will 93 be encroaching into the required 5ft side yard and the required 10ft from the primary structure. 94 95 Eric Jackson, petitioner, presented the request to allow encroachments on property located at 1472 Trolley 96 Road. He stated that the excessive sloping makes it difficult to place the structure within the required 97 designated area. He stated that he has received HOA approval for the placement of the structure. 98 99 Chairman Knapp opened the floor for public comments. There were none. The public hearing was closed. 100
101 Chairman Knapp opened the discussion for the Board. Mr. Duke moved to establish the findings of fact 102 stating that 1) special conditions and circumstances exist which are peculiar to the land, structure, or 103
building involved and which are not applicable to other lands structures, or buildings in the same zoning 104 district; 2) that a literal interpretation of the zoning ordinance would deprive the applicant of rights 105 commonly enjoyed by other properties in the same district under the terms of the zoning ordinance; 3) 106
that the special conditions and circumstances do not result from actions of the applicant (self-imposed 107 hardship); 4) that granting of a variance will not confer a special privilege on the applicant that is denied 108

ZONING ORDINANCE REFERENCED:
Article 5 Nonresidential Districts, §5.01 General Regulations, §5.01.03 Additional Regulations:
Appearance Standards. The following standards apply except the M-1 and M-2 Districts:
a. The use of metal siding on any street-facing and side facades is subject to approval by the Board of
Adjustment in accordance with §12.03 Special Exceptions.
Section 12.03 Special Exceptions
The Board shall review the application for compliance with this ordinance and all other applicable codes and ordinances
of the city. The Board must make written findings determining that the proposed use-on-appeal will not:
1. Be contrary to the public interest and will ensure that the spirit of this ordinance is observed;
2. Permit the establishment of a use prohibited in the zoning district; or
3. Cause a substantial adverse impact on property or improvements in the vicinity or in the district in which the
proposed use is located.

Petitioner is proposing a new building for a swim facility on the north side of Howard Murfee Dr near the cul-de-sac.
They are requesting a special exception to allow metal siding on the side facades. They are proposing street facing façade
of brick..
