RESOLUTION: To Authorize the Mayor to Enter into an Agreement with MBA Engineers, Incorporated for Engineering Services for the Extension of Interstate Court for the Engineering Department at a Cost Not to Exceed $57,000.00. {Sponsored By: Councilor Jackson} COMMENTS FROM PERSONS PRESENT: CLOSING COMMENTS: ADJOURN: The next City Council meeting is scheduled for Tuesday, August 8, 2023. 1 RESOLUTION 2 3 [To Authorize the Mayor to have Overgrown Grass and Weeds at 130 Lee Circle and 212 4 Edgewood Avenue Abated Pursuant to Chapter 46 et seq., City of Prattville Code of 5 Ordinances.] 6 7 {Sponsored By: Council President Pro Tempore Strichik} 8 9 WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2023- 10 11 A, Page 121 that the abundance of overgrown grass and weeds at 130 Lee Circle and 212 12 13 Edgewood Avenue constituted a public nuisance and set a Public Hearing on said nuisance; 14 1s and 16 17 WHEREAS, the Autauga County tax records list the property owners as follows: 18 19 • 130 Lee Circle -Jacks William K, with an address of 130 Lee Circle, Prattville, AL 20 36067, to Parcel Number 19 05 212009 012.000; 21 • 212 Edgewood Avenue -Strength Margaret B Marion Hill, with an address of 1493 22 County Road 39, Deatsville, AL 36022, to Parcel Number 19 02 10 2 002 006.000; and 23 24 WHEREAS, notice was provided to correct, remedy or remove the overgrown grass and 25 26 weeds; and 27 28 WHEREAS, the owners of said properties have failed and/or refused to correct, remedy 29 30 or remove said nuisance by the expiration of said notice; and 31 32 WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on July 18, 33 34 2023, permitting the owners of said properties to present evidence, objections and protest 35 36 regarding said nuisance; and 37 38 WHEREAS, Chapter 46 et seq .. City of Prattville Code of Ordinances, authorizes the 39 40 City to do such work or make such improvements that are necessary to correct, remedy or 41 42 remove such conditions, pay therefore and charge the expenses incurred to the owner of such 43 44 property. 45 46 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 47 48 declares that the overgrown grass and weeds at said properties continue to be a public 49 so nuisance. 51 52 BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds 53 54 at said properties removed using City forces or private contractors. The property owners shall 55 56 have the right to remove said nuisance at their expense provided that the removal is done prior 57 58 to the commencement of work by employees or agents of the City of Prattville. Barlow 53 City Clerk 54 ss APPROVED: 56 57 58 59 By: Bill Gillespie, Jr. 60 Mayor 61 62 63 64 RESOLUTION BOOK 2023-A, PAGE __ RESOLUTION 1 2 3 4 s 6 [To Reclaim Property from the Prattville Solid Waste Authority.] {Sponsored By: Council President Boone} 7 WHEREAS, in Resolution Book 2002-A, Page 17, on July 16, 2002, the City of Prattville 8 9 established the Prattville Solid Waste Authority, later changed to the Prattville Solid Waste 10 11 Disposal Authority (PSWDA); and 12 13 WHEREAS, the purpose of this Authority was to assist the City in continuing quality 14 15 service and operation of the transfer station and inert landfill; and 16 17 WHEREAS, in Resolution Book 2003, Page 031, on May 6, 2003, the PSWDA18 19 established criteria for a solution for Municipal Solid Waste & Municipal Inert Waste Disposal 20 21 for the benefit of the citizens of Prattville and authorized the Mayor to enter into a contract for 22 23 services for the operation of the C&D Inert Landfill and Transfer Station; and 24 2s WHEREAS, on February 17, 2008, an EF-3 tornado hit the area described in Attachment 26 27 A, rendering the transfer station inoperable; and 28 29 WHEREAS, the PSWDA has ceased any operations at said site since that time; and 30 31 WHEREAS, in RPL Y Book 2004, Page 10392, recorded on November 12, 2004, in the 32 33 Office of the Autauga County Probate Judge, the warranty deed states in the event the Prattville 34 35 Solid Waste Disposal Authority is unable to perform the provisions of the Contract for Services 36 37 between the City of Prattville and the Prattville Solid Waste Disposal Authority, this property 38 39 shall immediately revert back to the grantor. 40 41 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 42 43 hereby acknowledges the clear provisions of said deed and thus reclaims ownership of said 44 45 property described in Attachment A from the Prattville Solid Waste Disposal Authority. 46 47 BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 48 49 all documents necessary to carry out the intent of this Resolution. so 51 ADOPTED THIS 181H DAY OF JULY, 2023.52 53 54 ss By: 56 57 Lora Lee Boone, President Prattville City Council 58 AUTHENTICATED THIS 181H DAY OF JULY, 2023.59 60 61 62 By: Paula G.
