CITY OF PRATTVILLE PLANNING COMMISSION MINUTES May 18, 2023 Call to order:
Chairman Reuben Gardner called the regular meeting to order at 3:00 p.m. Roll Call: Ms. Morgan called the roll. Members present were Mayor Bill Gillespie, Vice-Chairman Ken Daniel, Deputy Fire Marshal Craig Allen, Mrs. Paula Carpenter, Mr. Seth Hayden, Mr. Robert King, and Mr. Mugs Mullins. Councilman John Chambers and Chairman Reuben Gardner were absent. (Quorum present) Staff present: Mr. Scott Stephens, City Planner and Ms. Alisa Morgan, Secretary. Minutes: Mr. King moved to approve the minutes of the April 20, 2023 regular meeting and the May 1, 2023 special meeting. Mrs. Carpenter seconded the motion. The motion passed unanimously.
Committee Reports: Old Business: 1. Preliminary Plat: S Industrial Park Plat 3 Location: County Road 4 E, South Industrial Park Petitioner: City of Prattville This item was postponed from the April meeting at the petitioner’s request. Mr. Stephens introduced the preliminary plat of S Industrial Park Plat 3. He stated that the City of Prattville and James Hardie Corporation are the owners of the property being platted. The proposed plat will establish the right-of-way for the eastward extension of Sid Thompson Drive, establish the right-of-way for the existing Bowen Way, and establish the right-of-way for a new access road to the west of the James Hardie facility. He stated that the plat will consolidate the various parcels currently owned by James Hardie, and further plat the remainder of the City-owned property in the industrial park. He stated that the petitioners are requesting the following waivers from the Subdivision Regulations: 1) Streets, 2) Stormwater & Drainage, 3) Sanitary Sewer, 4) Water, and 5) Locations of all existing utilities, existing buildings.
Robby Anderson, City Engineer, petitioner’s representative, presented the preliminary plat of S Industrial Park Plat 3. He stated that the plat will clean up some issues that have grown over time as the Industrial
Park has developed. Vice-Chairman Daniel opened the floor for public comments. There were none to speak. The public
hearing was closed. Mr. King introduced a resolution approving the preliminary plat of S Industrial Park Plat 3 with waivers and moved for its approval. Mr. Hayden seconded the motion. The motion to approve passed unanimously. New Business: 2. Preliminary Plat Time Extension: Park Lane (Time Extension) Location: Ridgewood Road, west of Mt. Airy Drive Representative: Larry E. Representative: Flowers & White Engineering, LLC There was no action taken on this item. The petitioner’s request for rezoning was withdrawn. 5. Rezoning: FAR (Forest, Agricultural, Recreation) to R-2 (Single Family Residential) Location: East of Bridge Creek Road and West of Parkview Drive Owner: Frances Carter Representative: Larry E. Speaks & Associates, Inc.
Mr. Stephens provided the staff report for the rezoning request from FAR to R-2 of the property located at the Bridge Creek Road and Parkview Drive. He stated that the proposed R-2 zoning is consistent with the Future Land Use Map and the general pattern of development in the area.
Greg Gillian of Larry E. Speaks & Associates, Inc., petitioners’ representative, presented the rezoning of property from FAR to R-2. He stated that the rezoning is for future development of four single-family
lots. Vice-Chairman Daniel opened the floor for public comments. The public comments were made by the following in regards to current storm water drainage issues in the area of Bridge Creek. Thomas Myrick, Greg Moates, Elaine Wilkes, and Joseph Brandt. Also, a letter was received from Beth Moates. (Attached and made a part of the minutes). After no further comments, the public hearing was closed. Mayor Gillespie addressed the public comments stating that the City is under different regulations since
Bridge Creek Reserve was built. He stated that the City will take a closer look at the issues that have been presented.
Mr. Mullins introduced a resolution recommending approval of the zoning amendment of property located at the east of Bridge Creek Road and west of Parkview Drive and moved for its approval. Mrs. Carpenter seconded the motion. The motion to approve passed unanimously.

Please see attached letter requesting a time extension on Park Lane Subdivision.
Under the Planning Commission’s previously adopted Subdivision Regulations (prior to July 21,
2022) preliminary plat approval was valid for one year, which is what this subdivision was approved
under.
Park Lane preliminary plat (which includes Phases I, II, &, III) was first approved at the May 21,
2020 meeting.
Park Lane Phase 1 was recorded on November 25, 2020
Park Lane Phase 2 was recorded on December 22, 2021. See timeline below
May 21, 2020- Park Lane Preliminary Plat (Phases I, II, &, III) approved
November 25, 2020-Park Lane Phase I was recorded
May 20, 2021- Time extension approved
December 22, 2021- Park Lane Phase 2 was recorded
May 19, 2022 – Time extension approved
In an effort to keep preliminary plats from lingering without development action, the Commission
previously offered a solution by placing a limit on the renewal of time extension for preliminary plats. The commission voted to allow up to three (3) time extension approvals for preliminary plats, upon the fourth request the preliminary plat would be referred to a special committee for review.

Please see attached letter requesting a time extension on Dawson’s Mill Plats (Phases) I, II, and III.
Under the Planning Commission’s previously adopted Subdivision Regulations (prior to July 21,

EVALUATION:
Proposed Use: The applicant is proposing a future residential subdivision.
Street Connectivity: Proposed area is situated between and connected to Bridge Creek Road and Parkview Drive
Water/Sewer: Public water is in the area. Parkview Drive has sewer, Bridge Creek Road does not.
COMPREHENSIVE PLAN / FUTURE LAND USE MAP:
On April 15, 2021, the Planning Commission adopted an updated Prattville Comprehensive Plan. The Future Land
Use Plan and Map in Land Use + Transportation section (pg. 40) of the document shows the subject parcel in Medium-Density Residential zones and surrounded by Medium Density Residential to the north and east and south, Low Density Residential to the south.
The boundaries of land use categories shown on the Future Land Use map should not be interpreted rigidly, but the general pattern should be observed to support comfortable transitions between uses.
PLANNING STAFF COMMENTS The R-2 zoning district has a minimum lot size of 10,500sqft and minimum lot width of 75ft. The subject property is adjacent to the existing Windrose subdivision which is zoned R-2. R-2 zoning is consistent with the FLUM and
the general pattern of development in the area.

Good morning,I will not be able to attend the public hearing today due to work commitments. However, I do
have concerns with this rezoning. I have lived at 1273 Bridge Creek Road for almost 30 years.When Bridge Creek Reserve was built, it caused and still causes a tremendous amount of
water to wash through the side of our property causing erosion. It is my hope that whoever isresponsible would make sure that excess water would not be directed through our property.
