WHEREAS, the City Attorney has recommended that the bid received from Dixie 15

Electric Company be rejected because of the written statement from the company advising 17

that not all specifications were accounted for in their bid, which is required for a successful 19

WHEREAS, an abundance of overgrown grass and weeds: 9
10
1. is injurious to the public health, safety and general welfare of the community by providing a11
breeding ground and shelter for rats, mice, snakes, mosquitoes, and other vermin;12
2. may cause the further spread of weeds;13
3. may hide debris, such as glass or metal, that could inflict injury on a person going to such14
property;15
4. may also pose a fire hazard and respiratory hazard; and16
17
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 18
19
the properties and determined the existence of an abundance of overgrown grass and weeds 20
21
at 260 Murfee Drive and 138 Lina Drive; and 22
23
WHEREAS, the Elmore and Autauga County tax records list the property owner(s) as 24
25
follows: 26

x 260 Murfee Drive – ANA 2 LLC with an address of 3233 S Torrey Pines Drive, Las28
Vegas, NV 89146, to Parcel Number 26 04 19 0 001 012.000; and29
x 138 Lina Drive – Brown Bradford W and Glenda D Brown with an address of 138 Lina30
Drive, Prattville, AL 36067, to Parcel number 19 05 16 4 006 051.000; and31

WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 33

Code Enforcement Officer gave written notice to the owner(s) of said properties on August 15, 35

2023 and August 17, 2023, respectively, to correct, remedy or remove the abundance of 37

overgrown grass and weeds within ten (10) days; and 39

WHEREAS, the owner(s) of said properties have failed and/or refused to correct, 41

remedy or remove said condition by the expiration of said notice; and 43

WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 45

Council to declare the abundance of overgrown grass and weeds to be a public nuisance and 47

WHEREAS, pursuant to Section 46-114 (e), City of Prattville Code of Ordinances, 51

declaring the abundance of overgrown grass and weeds to be a public nuisance and ordering 53

their abatement by the City Council initiates a fine for the first violation and designation on the 55

repeat offender registry. 57

WHEREAS, the owners of certain property located at 879 Washington Ferry Road, 7

Prattville, Alabama, filed a petition requesting the City of Prattville vacate the unimproved Right- 9

of-Way, known as the “Magnolia Drive ROW”, and 11

WHEREAS, said unimproved Right-of-Way, located off Washington Ferry Road, was created 13

as part of the Castlevale Subdivision Plat dated May 4, 1957, and recorded in the Office of the 15

sidewalk improvements along East Main Street; and 11

WHEREAS, the Engineering Department had specifications drafted for said project; and 13

WHEREAS, two (2) sealed bids were received, opened and read in public on August 15

22, 2023, at 2:00 p.m. in the Council Chambers at City Hall, and SDAC was the lowest 17
18
responsible bidder at a cost of $1,195,837.38 for said project. 19

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 21

the FY2024 Budget is hereby amended as follows: 23

services expires on September 30, 2023; and 11

WHEREAS, the City of Prattville has identified a need for continued HVAC preventative 13

maintenance services for City owned facilities; and 15

WHEREAS, specifications were drafted for said services; and 17

WHEREAS, four (4) sealed bids were received, opened and read in public on August 19

31, 2023, at 2:00 p.m., in the Council Chambers at Prattville City Hall; and 21

WHEREAS, Dixie Electric Company was the lowest bidder with a cost of $216,000.00, 23

but was deemed a non-responsible bidder due to non-compliance with the bid specifications; 25

WHEREAS, Johnson Controls, Inc. was the lowest responsible bidder at a cost of 29

WHEREAS, the City of Prattville Building Inspector declared the structures at 902 9

Washington Ferry Road to be unsafe and a public nuisance on June 21, 2023, pursuant to §11- 11
12
53B of the Code of Alabama, 1975, as amended; and 13
14
WHEREAS, on June 21, 2023, notice was sent by certified mail to the last known 15
16
property owners and to all parties having interest in the property, ordering the repair or 17
18
demolition of the structures at 902 Washington Ferry Road within 45 days of said notice; and 19
20
WHEREAS, in Resolution Book 2023-A, Page 191 on September 5, 2023, the City 21
22
Council of the City of Prattville declared that the structures located at 902 Washington Ferry 23
24
Road continued to be unsafe and a public nuisance that must be repaired or demolished; and 25
26
WHEREAS, despite said notice, no repairs have been made to the structures, and they 27
28
remain unsafe and a public nuisance. 29
30
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 31
32
hereby authorizes the Mayor to take whatever steps are necessary to remove the unsafe 33
34
structures located at 902 Washington Ferry Road. 35

BE IT FURTHER RESOLVED that a contract in an amount not to exceed $7,800.00 is 37

awarded to 82 Auto Parts and Wrecker Service LLC for demolition and removal of said 39

structures located at 902 Washington Ferry Road, and said funds are hereby approved and 41
