WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2023- 10
11
A, Page 193, that the abundance of overgrown grass and weeds at 116 Abney Drive, 423 12
13
Summerhill Road and 122 Kingswood Drive constituted a public nuisance and set a Public 14
15
Hearing on said nuisance; and 16
17
WHEREAS, the Autauga County tax records list the property owners as follows: 18
19
116 Abney Drive - O’Connell Elzora P with an address of 116 Abney Drive, Prattville, 20
36067, to Parcel Number 19 05 16 4 009 007.000; and 21
423 Summerhill Road - TL Investment with an address of 8631 Al Hwy 22, Maplesville, 22
AL 36750, to Parcel number 19 05 16 4 010 001.072 23
122 Kingswood Drive - Brumett Howard D and Tanya M., with an address of 122 24
Kingswood Drive Prattville, AL 36067, to Parcel Number 19 04 20 1 005 019.000; and 25
26
WHEREAS, notice was provided to correct, remedy or remove the overgrown grass and 27
28
weeds; and 29
30
WHEREAS, the owners of said properties have failed and/or refused to correct, remedy 31
32
or remove said nuisance by the expiration of said notice; and 33
34
WHEREAS, the owners of said properties did not file written objections with the City 35
36
Clerk’s Office within the time prescribed by City of Prattville Code of Ordinances, Section 46- 37
38
114 (c); and 39
40
WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on October 41
42
3, 2023, permitting the owners of said properties to present evidence, objections and protest 43
44
regarding said nuisance; and 45
46
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, authorizes the 47
48
City to do such work or make such improvements that are necessary to correct, remedy or 49
50
remove such condition, pay therefore and charge any expenses incurred for the abatement 51
52
process to the owners of such properties. 53
54
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 55
56
declares that the overgrown grass and weeds at said properties continued to be a 57
58
public nuisance at the expiration of the notice of violation. 59
60
BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds 61
62
at said properties removed using City forces or private contractors. The property owners shall 63
64
have the right to remove said nuisance at their expense provided that the removal is done 1
2
prior to the commencement of work by employees or agents of the City of Prattville; however, 3
4
this does not abolish incurred fines and expenses. 5
6
BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 7
8
to this request and report such costs to the City Council following its abatement. 9

WHEREAS, on November 15, 2022, the City Council of the City of Prattville authorized 10

the purchase of five (5) 2023 Ford Explorers; and 12

WHEREAS, said vehicles are no longer available due to supply constraints; and 14

WHEREAS, the resolution authorizing the purchase of said vehicles has been 16
17
rescinded; and 18

WHEREAS, in Resolution Book 2023, Page 046, the upfitting of the five (5) new police 20
21
vehicles was authorized; and 22
23
WHEREAS, there is no longer a need to upfit said vehicles. 24

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 26

WHEREAS, the Executive Department has identified a need for architectural 9

construction management services for the exterior venue project around 124 W. Main Street 11

WHEREAS, McKee & Associates Architects, Inc. has the expertise to provide said 15
16
architectural services at a cost not to exceed $211,200.00; and 17
18
WHEREAS, §41-16-51(a)(3), Code of Alabama, 1975, as amended, allows contracts to 19
20
secure services with architects possessing a high degree of professional skill to be let without 21
22
competitive bidding; and 23
24
WHEREAS, this is a budgeted expense for Capital Projects Fund. 25
26
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 27
28
the Mayor is hereby authorized to enter into an agreement with McKee & Associates Architects, 29
30
Inc. for said architectural services at a cost not to exceed $211,200.00, and funds are approved31
32
and appropriated from FY2024 Budget Line Item Capital Projects Fund/ Bank Building33

WHEREAS, the Engineering Department had specifications drafted for said 16
17
improvement project; and 18

WHEREAS, two (2) sealed bids were received, opened and read aloud on September 20
21
12, 2023, at 10:00 a.m. in the Council Chambers at City Hall, and Smitherman Brothers 22
23
Construction Company was the lowest responsible bidder at a cost of $379,460.00 for said 24
25
improvement project; and 26
27
WHEREAS, said improvement project is a budgeted expense. 28

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 30
31
hereby awards Bid No. 023-014 to Smitherman Brothers Construction Company in an 32

LLC was the lowest responsible bidder with a unit cost of $44.00 per ton; and 22

WHEREAS, this is a budgeted expense of the Sanitation Department. 24

WHEREAS, due to supply constraints, Ford Explorers are not currently available and 13

that Resolution was rescinded; and 15

WHEREAS, there is still a need for police vehicles; and 17
18
WHEREAS, Ford F150s are currently in production; and 19
20
WHEREAS, the Police Department desires to purchase five (5) Ford F150s from the 21
22
FY2023 budget and five (5) more from the FY2024 budget; and 23
24
WHEREAS, said vehicles are available through State Contract No. MA220000003121 25
26
from Stivers Ford Lincoln at a cost not to exceed $419,033.00; and 27
28
WHEREAS, this is a partially budgeted expense for the Police Department; and 29
30
WHEREAS, the Finance Director has identified a certain sum of surplus funds available 31
32
for departments that came in under budget in prior fiscal years. 33
34
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 35
36
the FY2024 Budget is hereby amended as follows: 37

Decrease Police/ Departmental Reserves $23,350.00 39
Increase Police/ Capital Outlay $23,350.00 40

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 42
43
funds in an amount not to exceed $419,033.00 for the purchase of said vehicles are hereby 44
45
authorized and approved to be paid to Stivers Ford Lincoln, and said funds are approved and 46
47
appropriated from FY2023 and FY2024 Budget Line Item Police Department/ Capital Outlay. 48
