WHEREAS, funds have been allocated for ALDOT Project Number STPMN-0115(252)
Widening to Add Turn Lanes, Resurfacing and Traffic Signal Improvements on Fairview
Avenue from SR-3 to Jasmine Trail; and
WHEREAS, certain utilities are currently located where they will interfere with the
construction of said project unless they are relocated; and
AUTHENTICATED THIS 17TH DAY OF OCTOBER, 2023.
WHEREAS, ALDOT and the City desire to enter into an Agreement for relocation of
utility facilities on public rights-of-way work to be performed by a state contractor at no cost to
the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville,
that the City of Prattville enter into said agreement with ALDOT relating to said project.
BE IT FURTHER RESOLVED that said agreement be executed by the Mayor in the
name of the City for and on its behalf and that it be attested by the City Clerk and the official
seal of the City be affixed thereto.
BE IT FURTHER RESOLVED that upon completion of the execution of said agreement
by all parties that a copy of such agreement be kept on file by the City Clerk.

WHEREAS, keeping garbage and rubbish:
1. is injurious to the public health, safety and general welfare of the community by providing a
breeding ground and shelter for rats, mice, snakes and other vermin;
2. may inflict injury on a person going to such property;
3. may also pose a fire and environmental hazard; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
the property and determined the existence of garbage and rubbish at 153 Lancelot Circle; and
WHEREAS, the Autauga County tax records list the property owner as Camelot Village
MHC Land LLC c/o Tarawa Management LLC, 1150 Hungry Neck Blvd. Suite C-359, Mount
Pleasant, SC 29465, to Parcel Number 19 04 20 4 002 001.000; and
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the
Code Enforcement Officer gave written notice to the owner of said property on September 21,
2023, to correct, remedy or remove the conditions of garbage and rubbish within ten (10) days;
and
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or
remove said conditions by the expiration of said notice; and
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City
Council to declare keeping garbage and rubbish to be a public nuisance and abate the same.
NOW, THEREFORE, BE IT RESOLVED that:
1. the City Council of the City of Prattville declares the garbage and rubbish at the above-listed
address to be a public nuisance that is due to be abated; and
2. the owner of said property is ordered to abate said nuisance and appear before the City
Council at a Public Hearing at 6:00 p.m. on November 21, 2023, in Prattville City Hall; and
3. the notice of a Public Hearing on the matter, as required by law, will be provided in a
publication of general circulation, by certified mail, and by signage on the subject property.

2. may cause the further spread of weeds;
3. may hide debris, such as glass or metal, that could inflict injury on a person going to such
property;
4. may also pose a fire hazard and respiratory hazard; and
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
the property and determined the existence of garbage and rubbish and the abundance of
overgrown grass and weeds at 222 Moncrief Street; and
WHEREAS, the Autauga County tax records list the property owner as Infusion
Properties LLC, with an address of 220 Elba Highway, Troy, AL 36079, to Parcel Number
19 02 09 3 018 005.000; and
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the
Code Enforcement Officer gave written notice to the owner of said property on September 14,
2023, to correct, remedy or remove the conditions of garbage and rubbish and the abundance
of overgrown grass and weeds within ten (10) days; and
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or
remove said conditions by the expiration of said notice; and
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City
Council to declare keeping garbage and rubbish and the abundance of overgrown grass and
weeds to be a public nuisance and abate the same.
WHEREAS, pursuant to Section 46-114 (e), City of Prattville Code of Ordinances,
declaring the abundance of overgrown grass and weeds to be a public nuisance and ordering
their abatement by the City Council initiates a fine for the first violation and designation on the
repeat offender registry.

NOW, THEREFORE, BE IT RESOLVED that:
1. the City Council of the City of Prattville declares the garbage and rubbish and the
abundance of overgrown grass and weeds at the above-listed address to be public

BE IT ORDAINED by the City Council of Prattville, Alabama, as follows:
Section 1.
In conformity with the provisions Act 2012-256 enacted by the Alabama Legislature during the
2012 Regular Session, providing for a State Severe Weather Preparedness Sales Tax Holiday,
the City of Prattville, Alabama, exempts “covered items” from municipal sales and use tax
during the same period, beginning at 12:01 a.m. on Friday, February 23, 2024, and ending at
twelve midnight on the following Sunday, February 25, 2024.
Section 2.
This Ordinance shall be subject to all terms, conditions, definitions, time periods, and rules as
provided by Act 2012-256, except that the time period shall only be as specified in Section 1
above and not for all years thereafter.
Section 3.
The City Clerk is hereby authorized and directed to certify a copy of this Ordinance under the
seal of the City of Prattville, Alabama, and to forward said certified copy to the Alabama
Department of Revenue to be recorded and posted on the Department website.
THIS Ordinance shall become effective upon its passage and publication as required by
law.

8 BE IT ORDAINED by the City Council of the City of Prattville that Chapter 42,

10 Municipal Court, Sec. 3.- Schedule of Fines -Traffic Infractions and Offenses, is amended as
11
12 follows:

14 Sec. 42.3.- Schedule of Fines -Traffic Infractions and Offenses
15 (a) The city hereby establishes a schedule of fines for traffic infractions. In the event the
16 defendant elects to plead guilty before a magistrate to any one of the traffic offenses listed
17 in the schedule, the fine established shall apply in the municipal court of the city.

31 (b) Magistrates may not accept pleas on traffic offenses if the defendant has been convicted
32 of two or more traffic violations during the preceding 12 months.
33 (c) Additional court costs. Pursuant to Code of Ala. 1975, § 11-47-7.1, additional court costs
34 in the amount equal to the court costs and fees levied in the district court for a similar case
35 shall apply to traffic cases. This cost is in addition to all other court costs currently assessed
36 as prescribed under state law or this Code.

38 THIS ordinance shall become effective upon its passage and execution as provided by
39
40 law. Each of the provisions of this ordinance is severable; if any provision shall be declared to
41
42 be invalid, the remaining provisions shall not be affected but shall remain in full force. All
43
44 Ordinances, or parts of Ordinances, in any manner, conflicting herewith are hereby repealed.

BE IT ORDAINED by the City Council of the City of Prattville that Chapter 62, Traffic
and Vehicles, Article IV.– Stopping, Standing and Parking, Sec. 62-138.- Parking of trucks,
tractors, etc.- In certain areas, is amended as follows:
Sec. 62-138. Parking of trucks, tractors, etc. - In certain areas.
It shall be unlawful for any person to park, except while loading or unloading, any
commercial vehicle as defined in Sec. 62-140, upon any street or in any area of the City which
is zoned for residential use.
BE IT FURTHER ORDAINED by the City Council that Chapter 62, Traffic and Vehicles,
Article IV. – Stopping, Standing and Parking, Sec. 62-140.- Commercial vehicle parking;
parking or leaving unattended prohibited, is amended as follows:
Sec. 62-140. Commercial vehicle parking; parking or leaving unattended prohibited.
It shall be unlawful for any person to park or leave unattended, in excess of 24 hours, any
commercial motor vehicle or trailer or combination thereof, on any private or public lot within
the Corporate Limits of the City of Prattville, regardless of whether a sign is posted, or on any
property within the public right-of-way within the City of Prattville, or in any City park or City
facility.
Commercial motor vehicle is defined as a motor vehicle or combination of motor vehicles,
semi-trailers, or truck tractors, used to transport passengers or property when the motor
vehicle:
(1) Has a gross vehicle weight of more than 26,000 pounds; or
(2) Has a towed unit with a gross vehicle weight of more than 10,000 pounds; or
(3) The combination of vehicles has a combined weight of more than 26,000 pounds.
Nothing within this section shall prevent the owner or proprietor of the premises to utilize
trailers for temporary or seasonal onsite storage if otherwise allowed by law or ordinance.
THIS ordinance shall become effective upon its passage and execution as provided by
law. Each of the provisions of this ordinance is severable; if any provision shall be declared to
be invalid, the remaining provisions shall not be affected but shall remain in full force. All
Ordinances, or parts of Ordinances, in any manner, conflicting herewith are hereby repealed.

WHEREAS, the City of Prattville has identified a need for a new Public Works Street
Facility Building; and
WHEREAS, the Engineering Department had specifications drafted for said project; and
WHEREAS, six (6) sealed bids were received, opened and read in public on October
10, 2023, at 2:30 p.m. in the Council Chambers at City Hall, and Webb Builders, Inc. was the
lowest responsible bidder at a cost not to exceed $1,425,000.00 for said project; and
WHEREAS, this is a budgeted expense for the Capital Projects Fund.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
Bid No. 023-018 is hereby awarded to Webb Builders, Inc. at a cost not to exceed
$1,425,000.00 for said project, and said funds are approved and appropriated from the FY2024
Budget Line Item Capital Projects Fund/ Engineering Building.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and
all documents necessary to carry out the intent of this Resolution.

WHEREAS, the City of Prattville has identified a need for building renovations for the
Premise Health Suite; and
WHEREAS, specifications were drafted for said project; and
WHEREAS, one (1) sealed bid was received, opened and read in public on October 10,
2023, at 2:00 p.m. in the Council Chambers at City Hall, and Webb Builders, Inc. was the lowest
responsible bidder at a cost not to exceed $268,378.00 for said project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that
Bid No. 023-019 is hereby awarded to Webb Builders, Inc. at a cost not to exceed $268,378.00
for said project, and said funds are approved and appropriated from line item Group Health
Internal Service Fund/ Clinic Space Buildout.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and
all documents necessary to carry out the intent of this Resolution.

RESOLUTION
[To Authorize the Mayor to Enter into an Agreement with Civil Southeast LLC for Construction
Engineering and Inspection Services for the Public Works Street Facility Building for the
Engineering Department at a Cost Not to Exceed $53,500.00.]

WHEREAS, the City of Prattville has identified a need for construction engineering and
inspection services for the construction of a Public Works Street Facility Building; and
WHEREAS, Civil Southeast LLC has the expertise to provide said engineering services
at a cost not to exceed $53,500.00; and
WHEREAS, §41-16-51(a)(3), Code of Alabama, 1975, as amended, allows contracts to
secure services with engineers possessing a high degree of professional skill to be let without
competitive bidding; and
WHEREAS, this is a budgeted expense for the Capital Projects Fund.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that
the Mayor is hereby authorized to enter into said agreement with Civil Southeast LLC for said
engineering services at a cost not to exceed $ 53,500.00, and funds are approved and
appropriated from FY2024 Budget Line Item Capital Projects Fund/ Engineering Building.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and
all documents necessary to carry out the intent of this Resolution.
