WHEREAS, ALDOT and the City desire to enter into an Agreement for relocation of utility facilities on public rights-of-way work to be performed by a state contractor at no cost to the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that the City of Prattville enter into said agreement with ALDOT relating to said project. BE IT FURTHER RESOLVED that said agreement be executed by the Mayor in the name of the City for and on its behalf and that it be attested by the City Clerk and the official seal of the City be affixed thereto. In conformity with the provisions Act 2012-256 enacted by the Alabama Legislature during the 2012 Regular Session, providing for a State Severe Weather Preparedness Sales Tax Holiday, the City of Prattville, Alabama, exempts “covered items” from municipal sales and use tax during the same period, beginning at 12:01 a.m. on Friday, February 23, 2024, and ending at twelve midnight on the following Sunday, February 25, 2024. Section 2. This Ordinance shall be subject to all terms, conditions, definitions, time periods, and rules as provided by Act 2012-256, except that the time period shall only be as specified in Section 1 above and not for all years thereafter. Section 3. The City Clerk is hereby authorized and directed to certify a copy of this Ordinance under the seal of the City of Prattville, Alabama, and to forward said certified copy to the Alabama Department of Revenue to be recorded and posted on the Department website. Parking of trucks, tractors, etc. - In certain areas. It shall be unlawful for any person to park, except while loading or unloading, any commercial vehicle as defined in Sec. 62-140, upon any street or in any area of the City which is zoned for residential use. BE IT FURTHER ORDAINED by the City Council that Chapter 62, Traffic and Vehicles, Article IV. – Stopping, Standing and Parking, Sec. 62-140.- Commercial vehicle parking; parking or leaving unattended prohibited, is amended as follows: Sec. 62-140. Commercial vehicle parking; parking or leaving unattended prohibited. It shall be unlawful for any person to park or leave unattended, in excess of 24 hours, any commercial motor vehicle or trailer or combination thereof, on any private or public lot within the Corporate Limits of the City of Prattville, regardless of whether a sign is posted, or on any property within the public right-of-way within the City of Prattville, or in any City park or City facility. Commercial motor vehicle is defined as a motor vehicle or combination of motor vehicles, semi-trailers, or truck tractors, used to transport passengers or property when the motor vehicle: (1) Has a gross vehicle weight of more than 26,000 pounds; or (2) Has a towed unit with a gross vehicle weight of more than 10,000 pounds; or (3) The combination of vehicles has a combined weight of more than 26,000 pounds. Nothing within this section shall prevent the owner or proprietor of the premises to utilize trailers for temporary or seasonal onsite storage if otherwise allowed by law or ordinance. THIS ordinance shall become effective upon its passage and execution as provided by law. Each of the provisions of this ordinance is severable; if any provision shall be declared to be invalid, the remaining provisions shall not be affected but shall remain in full force. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that Bid No. 023-018 is hereby awarded to Webb Builders, Inc. at a cost not to exceed $1,425,000.00 for said project, and said funds are approved and appropriated from the FY2024 Budget Line Item Capital Projects Fund/ Engineering Building. BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and all documents necessary to carry out the intent of this Resolution.
