[To Vacate the Unimproved Magnolia Drive Right-Of-Way (ROW).] 3

WHEREAS, the City of Prattville received a Petition for vacation of the unimproved 7
8
ROW described in Attachment A, created May 4, 1957, and recorded in the Office of the Judge 9
10
of Probate of Autauga County, Alabama, in Book 86, at Page 122 described as the “Magnolia 11
12
Drive ROW”; and 13
14
WHEREAS, the petitioner owns all property surrounding the proposed ROW to be 15
16
vacated; and 17
18
WHEREAS, the City Council held the required public hearing at 6:00 pm on November 19
20
7, 2023, at which time all persons were given an opportunity to be heard in favor of or opposition 21
22
to the proposed ROW vacation; and 23
24
WHEREAS, the City of Prattville does not have plans to develop the portion of the 25
26
unimproved Magnolia Drive ROW; and 27
28
WHEREAS, the City of Prattville concurs with the request to vacate the unimproved 29
30
Magnolia Drive ROW. 31

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 33
34
does hereby assent to the ROW vacation of that portion of the unimproved Magnolia Drive 35
36
ROW. 37

BE IT FURTHER RESOLVED that the City of Prattville does hereby remise, release 39
40
and quitclaim to the aforesaid parties whatever right, title and interest the City of Prattville may 41
42
have acquired in the property, and the Mayor is authorized to execute and deliver quitclaim 43
44
deeds to First Pentecostal Church. 45
46
BE IT FURTHER RESOLVED that the City Clerk shall cause a copy of this resolution 47
48
to be filed in the Probate Court of Autauga County, Alabama, and publish as required. 49

Ordinances, a public hearing shall be set to allow public comment for licenses including 10

Restaurant Retail Liquor licenses; and 12

WHEREAS, PRA Management, LLC d/b/a The Goat Bar and Grill, located at 2641 14
15
Legends Parkway, Prattville, AL 36066, has made application for said license. 16

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 18

WHEREAS, the final subdivision plat was recorded for HD&D Land Company Plat No. 7

1 on August 12, 2021; and 9

WHEREAS, the developer of said subdivision must maintain the public utilities, rights- 11
12
of-way and easements in the subdivision until accepted by the City Council of the City of 13
14
Prattville; and 15
16
WHEREAS, the owner of said subdivision has maintained the public utilities and public 17
18
improvements in the subdivision for the minimum period required by the Prattville Subdivision 19
20
Regulations and has corrected all deficiencies presented by the City of Prattville Engineering 21
22
Department; and 23
24
WHEREAS, all public utilities and public improvements in said subdivision were 25
26
inspected and approved by the City of Prattville Engineering, Planning and Development, and 27
28
Public Works departments. 29

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 31

all public utilities and public improvements in HD&D Land Company Plat No. 1 are hereby 33

WHEREAS, under the authority of Title 11, Chapter 53B, Code of Alabama, 1975, as 8
9
amended, on August 24, 2023, the City of Prattville Chief Building Official declared the 10
11
dilapidated structure at 912 Wilberforce Avenue, Parcel No. 19 03 05 4 001 006.000, to be an 12
13
unsafe structure; and 14
15
WHEREAS, on August 28, 2023, the City of Prattville Code Enforcement Officer sent 16
17
notice ordering the repair or demolition of the dilapidated structure at 912 Wilberforce Avenue 18
19
within 45 days of said notice; and 20
21
WHEREAS, said notice was sent by certified mail in accordance with §11-53B-3, Code 22
23
of Alabama, 1975, as amended; and 24
25
WHEREAS, Title 11, Chapter 53B allows the property owner or other interested parties 26
27
to file a written appeal within thirty (30) days of the date of notice with the City Clerk requesting 28
29
a hearing before the City Council of the City of Prattville; and 30
31
WHEREAS, no written request for a hearing was received within thirty (30) days of the 32
33
date of the notice; and 34
35
WHEREAS, §11-53B-4, Code of Alabama, 1975, as amended, authorizes the City 36
37
Council to determine whether or not the building or structure is unsafe to the extent that it is a 38
39
public nuisance; and 40
41
WHEREAS, no repairs have been made to the dilapidated structure located at 912 42
43
Wilberforce Avenue, and the structure remains unsafe and a public nuisance. 44
45
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 46
47
the dilapidated structure located at 912 Wilberforce Avenue continues to be unsafe and a public 48
49
nuisance that must be repaired or demolished. 50
51
BE IT FURTHER RESOLVED that the City Council instructs the Code Enforcement 52
53
Officer to provide a report of the cost to repair or demolish the dilapidated structure located at 54
55
912 Wilberforce Avenue to the City Council. 56

WHEREAS, an abundance of overgrown grass and weeds: 9
10
1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, mosquitoes, and other vermin; 12
2. may cause the further spread of weeds; 13
3. may hide debris, such as glass or metal, that could inflict injury on a person going to such 14
property; 15
4. may also pose a fire hazard and respiratory hazard; and 16
17
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 18
19
the property and determined the existence of an abundance of overgrown grass and weeds 20
21
at 870 Wilberforce Avenue; and 22
23
WHEREAS, the Autauga County tax records list the property owner as Thomas 24
25
Frederick Eugene & Barbara Jean with an address of 870 Wilberforce Avenue, Prattville, AL 26
27
36067, to Parcel number 19 03 05 4 011 007.000; and 28
29
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 30
31
Code Enforcement Officer gave written notice to the owner(s) of said property on October 9, 32
33
2023, to correct, remedy or remove the abundance of overgrown grass and weeds within ten 34
35
(10) days; and 36
37
WHEREAS, the owner(s) of said property have failed and/or refused to correct, remedy 38
39
or remove said condition by the expiration of said notice; and 40
41
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 42
43
Council to declare the abundance of overgrown grass and weeds to be a public nuisance and 44
45
abate the same; and 46
47
WHEREAS, pursuant to Section 46-114 (e), City of Prattville Code of Ordinances, 48
49
declaring the abundance of overgrown grass and weeds to be a public nuisance and ordering 50
51
its abatement by the City Council initiates a fine for the first violation and designation on the 52
53
repeat offender registry. 54
55
NOW, THEREFORE, BE IT RESOLVED THAT: 56
57
1. the City Council of the City of Prattville declares the abundance of overgrown grass and 58
weeds at said property to be a public nuisance and has therefore initiated the abatement 59
process; and 60
2. the owner(s) of said property is ordered to abate said nuisance and appear before the City 61
Council at a Public Hearing at 6:00 p.m. on December 5, 2023, at Prattville City Hall; and 62
3. any objections may be filed, in writing, to the City Clerk at least five (5) days prior to the 63
Public Hearing; and 64
4. the fine of $100.00 shall be assessed to the owner(s) of said property in addition to any 1
costs incurred for the abatement process; and 2
5. said property shall be placed on the repeat offender registry for a period of three (3) years; 3
and 4
6. the notice of Public Hearing on the matter, as required by law, will be provided in a 5
publication of general circulation, by certified mail, and by signage on the subject property. 6

WHEREAS, the City of Prattville Fire Department has a Stryker EMS Cot which is no 8
9
longer needed for public or municipal purposes; and 10
11
WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the municipal 12
13
governing body to dispose of unneeded personal property; and 14
15
WHEREAS, the ACBOE has a need for a cot for the ACTC for use in the Fire Science 16
17
and Health Science programs; and 18
19
WHEREAS, in an effort to better simulate workforce skills to prepare the future 20
21
workforce in the nation, the Prattville Fire Department desires to donate a Stryker EMS 22
23
Cot to ACTC for use in said programs. 24
25
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 26
27
the following personal property is no longer needed for public or municipal purposes, and said 28
29
property shall be removed from the inventory of the Fire Department: 30
31

33
BE IT FURTHER RESOLVED that the Mayor is authorized to donate said cot to 34
35
the Autauga County Board of Education for the Autauga County Technology Center. 36

WHEREAS, § 6-5-122 et Seq., of the Code of Alabama, 1975, as amended, permits the 8
9
City Council of the City of Prattville to declare a public nuisance and have the violation resolved; 10
11
and 12
13
WHEREAS, in Resolution Book 2023-A, Page 156, on July 18, 2023, the City Council 14
15
of the City of Prattville declared the garbage and rubbish at 902 Washington Ferry Road 16
17
continued to be a public nuisance; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Walthall, Jr. 20
21
George P., with an address of 216 Evergreen Street, Prattville, AL 36067, to Parcel Number 22
23
19 05 21 3 000 015.003; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on June 21, 2023, 28
29
to correct, remedy or remove the conditions of garbage and rubbish within ten (10) days; and 30
31
WHEREAS, the owner/operator of said property failed and/or refused to correct, remedy 32
33
or remove the said condition after the expiration of said notice; and 34
35
WHEREAS, Section 46-32 of the City of Prattville Code of Ordinances authorizes the 36
37
City to do such work or make such improvements that are necessary to correct, remedy or 38
39
remove such condition, pay therefore and charge the expenses incurred to the owner/operator 40
41
of such property to the fullest extent authorized by law. 42
43
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 44
45
the cost totaling $4,544.06 for the removal of garbage and rubbish at 902 Washington Ferry 46
47
Road is accurate and shall be established as a lien against the property. 48
49
BE IT FURTHER RESOLVED that the City Attorney is authorized to file any actions 50
51
necessary to recover costs of said removal. 52

WHEREAS, the City of Prattville encourages a healthy lifestyle and outdoor recreational 9
10
opportunities within the community; and 11
12
WHEREAS, the City continues to integrate and upgrade areas with access to outdoor 13
14
recreational opportunities; and 15
16
WHEREAS, the City had preliminary engineering plans developed for Upper Kingston 17
18
Park Tier II renovations; and 19
20
WHEREAS, grant funding is available through ADECA’s LWCF; and 21
22
WHEREAS, said grant funding would assist in the repair, expansion and renovation of 23
24
the existing walking trail, soccer fields, playground, concession, restrooms, parking, and 25
26
lighting as well as adding four (4) additional soccer fields and two (2) pavilions; and 27
28
WHEREAS, said application allows for a request of up to $500,000.00 and requires an 29
30
equal local match; and 31
32
WHEREAS, any local match will be based on the actual amount awarded through the 33
34
grant and will be paid from the Parks & Recreation One Cent funds; and 35
36
WHEREAS, the FY2024 LWCF application requires authorization to submit the 37
38
application and commitment to all matching funds required to complete the proposed project. 39
40
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Prattville 41
42
hereby supports the submission of the FY2024 LWCF grant application and commits to all 43
44
matching funds. 45
46
BE IT FURTHER RESOLVED that the City Council does hereby authorize the Mayor to 47
48
submit said grant application and execute any and all documents necessary to carry out the 49
50
intent of this Resolution. 51

WHEREAS, the Wastewater Division of the Public Works Department has identified a 10

need to purchase one (1) 2023 912 Hydrema Articulated dump truck; and 12

WHEREAS, said dump truck is available through the Sourcewell Purchasing 14

Cooperative, Contract No. 032119-CAT, from Thompson Rents: Montgomery-Mobile, LLC at 16

a cost not to exceed $233,162.20; and 18

WHEREAS, this is a budgeted expense for the Wastewater Enterprise Fund. 20

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 22

funds in an amount not to exceed $233,162.20 for the purchase of said dump truck are hereby 24

WHEREAS, in Resolution Book 2023, Page 094, on May 16, 2023, the City Council 12

authorized that an application be submitted to (ALDOT) for the FY2024 Transportation 14

Alternative Set-Aside Program for Comprehensive ADA Compliance for Downtown Pedestrian 16
17
Paths and Sidewalks; and 18
19
WHEREAS, the State and the City desire to enter into a Preliminary Engineering and 20
21
Construction Agreement for a TAP Project for said ADA compliance improvements for Project 22
23
No. TAPAA-TA24(925), CPMS Ref #’s 100077818 and 100077819 at a total cost not to exceed 24
25
$642,607.00 (net cost to City not to exceed $128,521.40); and 26
27
WHEREAS, this is a budgeted expense in the Capital Projects Fund. 28

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 30
31
the City enter into said preliminary engineering and construction agreement with the State of 32
33
Alabama, acting by and through ALDOT, relating to said ADA compliance project. 34

BE IT FURTHER RESOLVED that said agreement be executed in the name of the City, 36
37
by the Mayor, for and on its behalf and that it be attested by the City Clerk and the official seal 38
39
of the City, be affixed thereto. 40

BE IT FURTHER RESOLVED that funds in the amount not to exceed $128,521.40 are 42
43
hereby authorized and approved to be paid for said project, and said funds are hereby 44
45
approved and appropriated from the FY2024 Budget Line Item Capital Projects Fund/ 46

BE IT FURTHER RESOLVED that upon completion of the execution of said agreement 50

construction of said project unless they are relocated; and 19

WHEREAS, these are budgeted expenses in the Capital Projects Fund. 25

Transportation Alternatives Program (TAP) project between the State of Alabama, acting by 15

and through ALDOT for Project No. TAPMN-TA23(934), CPMS Ref # 100076030, for Doster 17

Road Sidewalk Improvements from Selma Highway to Pratt Street; and 19

WHEREAS, the Engineering Department has identified a need for construction 21
22
engineering services for said sidewalk improvement project; and 23
24
WHEREAS, Krebs Engineering, Inc. has the expertise to provide said construction 25
26
engineering services at a total cost not to exceed $56,853.00 (net cost to City not to exceed 27
28
$11,370.60); and 29
30
WHEREAS, §41-16-51(a)(3), Code of Alabama, 1975, as amended, allows contracts to 31
32
secure services with engineers possessing a high degree of professional skill to be let without 33
34
competitive bidding; and 35

WHEREAS, said improvement is a budgeted expense in the Capital Projects Fund. 37

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 39
