Members present were Mayor Bill Gillespie, Deputy Fire Marshal Craig Allen, Chairman Reuben Gardner, Vice-Chairman Ken Daniel, Mrs. Paula Carpenter, Mr. Seth Hayden, Mr. Robert King, and Mr. Mugs Mullins. Councilman John Chambers was absent. (Quorum present) Staff present: Mr. Scott Stephens, City Planner; Mr. Joshua McKinney and Ms. Bria Hudson, Planners; and Ms. Alisa Morgan, Secretary. Minutes: The minutes of the June 15, 2023 regular meeting and July 12, 2023 work session were unanimously approved. Committee Reports: Old Business: None New Business: 1. Preliminary Plat: Christ Lutheran Church Plat 1 Location: 2175 Cobbs Ford Road Owner: Christ Lutheran Church Representative: Flowers & White Engineering, LLC Mr. Stephens introduced the preliminary plat of Christ Lutheran Church Plat 1. He stated that the proposed plat divides the existing church (Lot 1) and the vacant northern portion (Lot 2) into two lots. The petitioner is requesting waivers to the Subdivision Regulations from the side walk along right of way, lot frontage on public street, and utilities shown on plat. He stated that staff does not object to any of the requested waivers and proposes that the access easement proposed for the frontage to Lot 2 be recorded prior to or with the final plat. Brad Flowers of Flowers & White Engineering, LLC, petitioner’s representative, presented the preliminary plat of Christ Lutheran Church Plat 1. He stated that the property is being subdivided for the sale to Stivers but he does not know what the future use of the proposed Lot 2 will be. The church will remain as is with no changes. Chairman Gardner opened the floor for public comments. There were none to speak. The public hearing was closed. Mr. Mullins introduced a resolution approving the waivers of Christ Lutheran Church Plat 1 and moved for its approval. Mr. Allen seconded the motion. The motion to approve the waivers passed unanimously. Mr. Mullins introduced a resolution approving the preliminary plat of Christ Lutheran Church Plat 1 with waivers and contingency and moved for its approval. Mr. Hayden seconded the motion. Preliminary Plat: Fountain City Baptist Church Plat 1 Location: 323 New Moon Drive and 492 E Main St Owners: Moore Enterprise, LLC Representative: Alabama Land Surveyors, Inc. Mr. Stephens provided the staff report for the preliminary plat of Fountain City Baptist Church Plat 1. He stated that the proposed plat reconfigures an interior property boundary. The rear yard of the lot on New Moon Drive has a playground utilized by the church. The reconfiguration will combine the playground area with the existing church lot. He stated that the petitioner is requesting waivers to the Subdivision Regulations from the sidewalks and utilities shown on the plat. Jamie Monk of Alabama Land Surveyors, Inc., petitioner’s representative, presented the preliminary plat of Fountain City Baptist Church Plat 1. Chairman Gardner opened the floor for public comments. There were none to speak. The public hearing was closed. An email was received from Stacey Jennings, property owner of 475 E Main Street and 411 New Moon Drive in support of the request. (Letter attached and made a part of the minutes). Mrs. Carpenter introduced a resolution approving the waivers of Fountain City Baptist Church Plat 1 and moved for its approval. Mr. Mullins seconded the motion. The motion to approve passed unanimously. Mrs. Carpenter introduced a resolution approving the preliminary plat of Fountain City Baptist Church Plat 1 with waivers and moved for its approval. Mr. Mullins seconded the motion. The motion to approve passed unanimously. 3. Preliminary Plat: LLRR Properties Plat 1 Location: 2091 Fairview Ave Owners: LLRR Properties, LLC Representative: Alabama Land Surveyors, Inc. The petitioner requested that the preliminary plat of LLRR Properties Plat 1 be held to the next meeting (August 17, 2023). Letter attached and made a part of the minutes. 4. Preliminary Plat: King Plat 1 Location: 895 Lower Kingston Road Owners: Wanda King Representative: Alabama Land Surveyors, Inc. Mr. Stephens provided the staff report for the preliminary plat of King Plat 1. He stated that the property is zoned T-2 for mobile home use. The petitioner is requesting to divide the approximately 3.61 acre property into two lots. He stated that the subdivision meets the zoning requirements. The petitioner is requesting waiver to the Subdivision Regulations from the street improvements and utilities shown on plat. Jamie Monk of Alabama Land Surveyors, Inc., petitioner’s representative, presented the preliminary plat of King Plat 1. He stated that the future use of the two lots is residential. Mr. Daniel introduced a resolution approving the waivers of King Plat 1 and moved for its approval. Mr. King seconded the motion. The motion to approve passed unanimously. Chairman Gardner opened the floor for public comments. Gina Dunbar, adjacent property, asked questions about the zoning map and the time frame that the property was zoned for mobile home use. Mr. Stephens stated that the staff can look into the zoning map questions and reiterated that the subdivision meets the regulation requirements. After no further comments, the public hearing was closed. Mr. Monk asked that the replat move forward with approval and development issues be addressed at the time of future development. Mayor Gillespie moved to postpone the request to the August meeting. Mr. Daniel seconded the motion. The motion to postponed passed unanimously. Miscellaneous: Mr. Stephens discussed the success of the work session that was held by the Commission on July 12, 2023. The church is in negotiations to sell Lot 2 to an adjacent property owner and it will be combined with the adjacent property at a later date. We would like to request three waivers for this plat. 1) Waiver to the requirement for the installation of a sidewalk along the frontage of Lot 1 at Cobbs Ford Road. 2) Waiver for Lot 2 as it does not front a public street. 3) Waiver for contours and utilities. Sidewalk Waiver: There is no sidewalk on either side of Cobbs Ford Road from the interstate to the downtown area of Prattville. The church is not doing anything to their property (Lot 1) that would change the use or functionality of the lot and they are not a “walking membership” that will change their means of access to the building if a sidewalk is installed. Please consider waiving this requirement. Street Frontage Waiver: As I discussed with the Planning Commission in the rezoning hearing for this property, the ultimate goal for Lot 2 is the combination with the Stivers property to the east. However, for this plat, the lot is a standalone lot until the property sale takes place. At the time Stivers brings a master plan to the city, Lot 2 will be combined with the existing Stivers property and thus it will have frontage. For this plat, we have provided an offsite access easement that will be dedicated by Stivers for means of legal access to Lot 2. This provides a means to keep the lot from being land locked and thus giving it “access to a public street” to meet the intent of the subdivision requirement. I have attached all of the submittal forms for the platting as well as a check in the amount of $ 250.00 for the submittal fee and six copies of the proposed plat.
