Members present were Mayor Bill Gillespie, Deputy Fire Marshal Craig Allen, Chairman Reuben Gardner, Mr. Seth Hayden, Mr. Robert King, and Mr. Mugs Mullins. Vice-Chairman Ken Daniel, and Councilman John Chambers, and Mrs. Paula Carpenter were absent. (Quorum present) Staff present: Mr. Scott Stephens, City Planner; Mr. Joshua McKinney, Ms. Bria Hudson; Planners, and Ms. Alisa Morgan, Secretary. Minutes: The minutes of the August 17, 2023 regular meeting were unanimously approved. Committee Reports: None Old Business: None New Business: 1.Preliminary Plat: Johnson-Davis Plat 1Location: 324 Golson RoadOwner: Estate of Marion Odette JohnsonRepresentative: Pilgreen & Bostick Engineering, Inc. Mr. McKinney introduced the preliminary plat of Johnson-Davis Plat 1. The lot currently does not have public street frontage, but has an easement for access to Golson Road. The proposed preliminary plat will split the existing lot into two lots and create an additional lot without street frontage. He stated that the property is currently zoned FAR which allows for residential use. Grant Wadsworth, petitioner’s representative, stated that the 15 acres is proposed to be divided from the approximately 57-acre lot. The larger lot is to remain to the family. He stated that there is a dedicated easement provided for access to the lot. Mr. Stephens stated that the petitioner is requesting waivers to the subdivision regulations to address the lack of street frontage. Chairman Gardner opened the floor for public comments. There were none. The public hearing was closed. Mr. King introduced a resolution approving the requested waivers and moved for its approval. Mr. Mullins seconded the motion. The motion to approve passed unanimously. Mayor Gillespie introduced a resolution approving the preliminary plat of Johnson-Davis Plat 1 with requested waivers and moved for its approval. Preliminary Plat: Allenville Lands Plat 1 Location: 653 W 4th Street Owner: James Crowley Representative: Alabama Land Surveyors, Inc. Mr. McKinney introduced the preliminary plat of Allenville Lands Plat 1. He stated that the proposed preliminary plat creates a new lot (Lot 2) and plats an existing unplatted parcel (Lot 3). Lot 2 will have frontage on Hwy 82, but will be accessed by Allenville Rd via an access easement. Lot 3 is already existing without street frontage, but will be platted as part of the subdivision. He stated that the lots will comply with the requirements of the underlying zoning of FAR and R-3. The applicant is requesting waivers for sidewalk and street frontage requirements. Chairman Gardner opened the floor for public comments. Doris Little, 709 W 4th Street asked about the proposed use for the subdivision. Peggy Crowley, petitioner, stated that the property is being subdivided to allow her son to develop a single-family residence. Jamie Monk of Alabama Land Surveyors, Inc., petitioner’s representative provided comments about the proposed subdivision. After no further comments, the public hearing was closed. Mr. Hayden introduced a resolution approving the requested waivers and moved for its approval. Mr. Mullins seconded the motion. The motion to approve passed unanimously. Chief Allen introduced a resolution approving the preliminary plat of Allenville Lands Plat 1 with requested waivers and moved for its approval. Mr. King seconded the motion. The motion to approve passed unanimously. 3. Preliminary Plat: FNL Consulting LLC Plat 1 Location: 427 E Main Street Owner: FNL Consulting LLC Representative: Alabama Land Surveyors, Inc. Ms. Hudson provided the staff report for the preliminary plat for FNL Consulting LLC Plat 1. She stated the property is zoned B-2, R-3, and located in the Downtown Overlay District. The applicant is requesting to create two lots. Lot 1 will have an access easement for the benefit of Lot 2. The applicant is requesting waivers from sidewalks. Chairman Gardner opened the floor for the public comments. James Ragsdale, 425 E Main St, representative for Autauga Home Supply, concerned about possible access problems for shipment to their property. Jeff Myers, 328 E 3rd Street, concerned about possible increase in flooding and drainage problems. Mayor Gillespie addressed the comments stating that measures have been taken to help eliminate and control some of the drainage and flooding issues in the area. Johnny Myers spoke on behalf of Bobby McCord, 325 E Main having questions about the proposed development. After no further comments, the public hearing was closed. Mr. Mullins introduced a resolution approving the requested waivers and moved for its approval. Mr. King seconded the motion. The motion to approve passed unanimously. Mr. Mullins introduced a resolution approving the preliminary plat of FNL Consulting LLC Plat 1 with requested waivers and moved for its approval. Chief Allen seconded the motion. The motion to approve passed unanimously. 4. Prattville Square Shopping Center Plat 3 Location: Northwest corner of North Memorial Drive and Wetumpka Street Owner: McIntyre Land Company, Inc. She stated the proposed subdivision creates three lots. An access easement through Lot 1 will serve Lot 2 as well. She stated that the applicant is requesting waivers from sidewalks. Bradley Flowers of Flowers and White Engineering, LLC, petitioner’s representative, presented the preliminary plat of Prattville Square Shopping Center Plat 3. He stated that Lot 3 has not been previously platted and a replat of Lot 2 divides into two lots. Access easements will remain to allow cross parking. Chairman Gardner opened the floor for the public comments. There were none. The public hearing was closed. Mayor Gillespie expressed concerns about parking. Mr. Hayden introduced a resolution approving the requested waivers and moved for its approval. Mr. Mullins seconded the motion. The motion to approve passed unanimously. Mr. Hayden introduced a resolution approving the preliminary plat of Prattville Square Shopping Center Plat 3 with requested waivers contingent that the parking requirements are met and moved for its approval. Mr. Mullins seconded the motion. The motion to approve passed unanimously. 5. Redfield Ridge Subdivision Location: Redfield Road, north of Eastwood Owner: Redfield Prattville, LLC Representative: Flowers & White Engineering, LLC Mr. McKinney introduced the preliminary plat of Redfield Ridge Subdivision. He stated that the proposed preliminary plat received approval in May 2022 but expired before construction. Ken White of Flowers & White Engineering, LLC, petitioner’s representative, presented the preliminary Plat of Redfield Ridge Subdivision. He stated that there have been no changes from the previous approved plat. Chairman Gardner opened the floor for public comments. William Barrett, 2455 Eastwood, HOA representative, stated that they are not opposed to development of the property requests that the development is consistent with the existing Eastwood Subdivision. He also expressed concerns about the existing stream run off into the retention pond causing property damage to common areas and wanted an agreement on repairs prior to construction of this development. Mayor Gillespie addressed the comments stating that the Subdivision Regulations will address the lot sizes and suggested that the current storm water issues be addressed with him and other city personnel. Kristi Rollins, 1314 Nina Drive, asked about street connection to the state’s Health Department Lab facility. Mr. White addressed the comment. After no further comments, the public hearing was closed. Mr. Mullins introduced a resolution approving the preliminary plat of Redfield Ridge Subdivision moved for its approval. Mr. Hayden seconded the motion. The motion to approve passed unanimously. 6. This item has been postponed to the October meeting date at the request of the applicant. Miscellaneous: Mayor Gillespie addressed the Commission regarding mobile home parks and maintenance of their properties. Water/Sewer: Public water is available. Public sewer is not. Zoning District Standards for Lots in Underlying District: The F.A.R district requirements under the old zoning are as follows: Staff Comments: The existing 57 +/- acre lot currently does not have public street frontage, but has an easement for access to Golson Road. The proposed preliminary plat will split the existing lot into two lots and create an additional lot without street frontage. The applicant is requesting a waiver from the requirements for utilities shown on plat and for the lots to have frontage on a public street. Staff has no objection to the waiver request for not showing utilities. The Planning Commission should consider whether granting the waiver to allow an additional lot without street frontage is in the best interest of the City and is keeping in the spirit of the Subdivision Regulations. This proposed plat is on the “edge” of town and in a relatively rural setting. There is an established drive (with access easement) and a few existing homes.
