RESOLUTION: To Appoint Christine Sellers to the Autauga-Prattville Library Board of Trustees. {Sponsored By: Councilor Striplin} COMMENTS FROM PERSONS PRESENT: CLOSING COMMENTS: ADJOURN: The next City Council meeting is scheduled for Tuesday, December 5, 2023 RESOLUTION 1 2 [To Authorize the Mayor to have Garbage and Rubbish at 153 Lancelot Circle Abated and 3 Charge Any Incurred Expenses for the Abatement Process Pursuant to Chapter 46 et seq., 4 City of Prattville Code of Ordinances.] 5 6 {Sponsored By: Council President Pro Tempore Strichik} 7 8 WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2023- 9 10 B, Page 225 that keeping garbage and rubbish at 153 Lancelot Circle constituted a public 11 12 nuisance and set a Public Hearing on said nuisance; and 13 14 WHEREAS, the Autauga County tax records list the property owner as Camelot Village 15 16 MHC Land LLC c/o Tarawa Management LLC, 1150 Hungry Neck Blvd. Suite C-359, Mount 17 18 Pleasant, SC 29465, to Parcel Number 19 04 20 4 002 001.000; and 19 20 WHEREAS, notice was provided to correct, remedy or remove the garbage and rubbish; 21 22 and 23 24 WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 25 26 remove said nuisance by the expiration of said notice; and 27 28 WHEREAS, the owner of said property did not file written objections with the City Clerk’s 29 30 Office within the time prescribed by City of Prattville Code of Ordinances, Section 46-114 (c); 31 32 and 33 34 WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on November 35 36 21, 2023, permitting the owner of said property to present evidence, objections and protest 37 38 regarding said nuisance; and 39 40 WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, authorizes the 41 42 City to do such work or make such improvements that are necessary to correct, remedy or 43 44 remove such conditions, pay therefore and charge the expenses incurred for the abatement 45 46 process to the owner of such property. 47 48 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 49 50 declares that the garbage and rubbish at 153 Lancelot Circle continued to be a public nuisance 51 52 at the expiration of the notice of violation. 53 54 BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 55 56 said property removed using City forces or private contractors. Barlow 16 City Clerk 17 18 APPROVED: 19 20 21 22 By: Bill Gillespie, Jr. 23 Mayor 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 RESOLUTION BOOK 2023-B, PAGE ___ 64 RESOLUTION 1 2 [To Set a Public Hearing to Declare the Abundance of Overgrown Grass and Weeds at 1607 3 Buena Vista Boulevard to be Unsafe and a Public Nuisance and Order Their Abatement 4 Pursuant to Chapter 46 et seq., City of Prattville Code of Ordinances.] 5 6 {Sponsored By: Council President Pro Tempore Strichik} 7 8 WHEREAS, an abundance of overgrown grass and weeds: 9 10 1.is injurious to the public health, safety and general welfare of the community by providing a11 breeding ground and shelter for rats, mice, snakes, mosquitoes, and other vermin;12 2.may cause the further spread of weeds;13 3.may hide debris, such as glass or metal, that could inflict injury on a person going to such14 property;15 4.may also pose a fire hazard and respiratory hazard; and16 17 WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 18 19 the property and determined the existence of an abundance of overgrown grass and weeds 20 21 at 1607 Buena Vista Boulevard; and 22 23 WHEREAS, the Autauga County tax records list the property owner(s) as Roberts 24 25 Brenda D with an address of 1607 Buena Vista Blvd, Prattville, AL 36067, to Parcel Number 26 27 19 08 27 2 000 002.004; and 28 29 WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 30 31 Code Enforcement Officer sent written notice to the owner(s) of said property on October 13, 32 33 2023, to correct, remedy or remove the abundance of overgrown grass and weeds within ten 34 35 (10) days; and36 37 WHEREAS, the owner(s) of said property has failed and/or refused to correct, remedy 38 39 or remove said condition by the expiration of said notice; and 40 41 WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 42 43 Council to declare the abundance of overgrown grass and weeds to be a public nuisance and 44 45 abate the same; and 46 47 WHEREAS, pursuant to Section 46-114 (e), City of Prattville Code of Ordinances, 48 49 declaring the abundance of overgrown grass and weeds to be a public nuisance and ordering 50 51 their abatement by the City Council initiates a fine for the first violation and designation on the 52 53 repeat offender registry. 54 55 NOW, THEREFORE, BE IT RESOLVED THAT: 56 57 1.the City Council of the City of Prattville declares the abundance of overgrown grass and58 weeds at said property to be a public nuisance and has therefore initiated the abatement59 process; and60 2.the owner(s) of said property are ordered to abate said nuisance and appear before the City61 Council at a Public Hearing at 6:00 p.m. on December 19, 2023, at Prattville City Hall; and62 3.any objections may be filed, in writing, to the City Clerk at least five (5) days prior to the63 Public Hearing; and64 4. the fine of $100.00 shall be assessed to the owner(s) of said property in addition to any 1 costs incurred for the abatement process; and 2 5. said property shall be placed on the repeat offender registry for a period of three (3) years; 3 and 4 6. the notice of Public Hearing on the matter, as required by law, will be provided in a 5 publication of general circulation, by certified mail, and by signage on the subject property. 6 7 ADOPTED THIS 21ST DAY OF NOVEMBER, 2023. 8 9 10 11 By: Lora Lee Boone, President 12 Prattville City Council 13 14 AUTHENTICATED THIS THIS 21ST DAY OF NOVEMBER, 2023. 15 16 17 18 By: Paula G. Barlow 41 City Clerk 42 43 APPROVED: 44 45 46 47 By: Bill Gillespie, Jr. 48 Mayor 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 RESOLUTION BOOK 2023-B, PAGE ___ 64 RESOLUTION 1 2 [To Authorize the City Attorney to Affix the Cost of Demolition of the Dilapidated and Unsafe 3 Structure at 348 Doster Street.] 4 5 {Sponsored By: Council President Pro Tempore Strichik} 6 7 WHEREAS, §11-53B-1 through §11-53B-16, Code of Alabama, 1975, as amended, 8 9 details the process for the City of Prattville to declare certain unsafe structures a public 10 11 nuisance and order repair or demolition; and 12 13 WHEREAS, §11-53B-3, Code of Alabama, 1975 as amended, requires the City’s order 14 15 to repair or demolish an unsafe structure be sent to the owner of the property and those having 16 17 legal interest in the property; and 18 19 WHEREAS, §11-53B-3 and §11-53B-4, Code of Alabama, 1975, as amended, requires 20 21 the owners to repair or demolish the unsafe structure within forty-five (45) days of being issued 22 23 an order from the City or to request a hearing before the City Council of the City of Prattville 24 25 within thirty (30) days of the order; and 26 27 WHEREAS, §11-53B-3, Code of Alabama, 1975, as amended, permits the City to repair 28 29 or demolish an unsafe structure if the owner fails to comply with the City order; and 30 31 WHEREAS, §11-53B-5, Code of Alabama, 1975, as amended, permits the City Council 32 33 to adopt a resolution affixing the cost of demolition and establishing a lien against the property; 34 35 and 36 37 WHEREAS, the City Council finds that: 38 39 1. The City’s Chief Building Official declared the residential structure at 348 Doster 40 Street to be an unsafe structure on May 22, 2023; and 41 2. The City’s Code Enforcement Officer issued an order to Stoudenmire, Sherwood A 42 c/o Porter Florence, on May 22, 2023, to have the property repaired or demolished 43 within forty-five (45) days of the notice; and 44 3. Sherwood Stoudenmire did not request a hearing before the City Council within thirty 45 (30) days of the notice nor repair or demolish the structure within forty-five (45) days 46 of the notice; and 47 4. The City Council declared the structure located at 348 Doster Street to be unsafe 48 and a public nuisance in Resolution Book 2023-A, Page 155 on July 18, 2023; and 49 5. The City Council authorized the demolition of the structure and awarded the contract 50 for complete demolition in Resolution Book 2023-A, Page 204 on September 5, 51 2023; and 52 6. The total cost of demolition was determined to be $15,330.46; and 53 54 WHEREAS, §11-53B-7, Code of Alabama, 1975, as amended, allows for the option of 55 56 ten (10) equal annual installments for assessments over $10,000; and 57 58 WHEREAS, the owners have elected this option to pay the equal yearly installments 59 60 plus interest for the said assessment. 61 62 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 63 64 the total amount of $16,073.98 (to include interest) for the demolition of the structure located 1 2 at 348 Doster Street is accurate and shall be established as an assessment against the 3 4 property. 5 6 BE IT FURTHER RESOLVED that the City Attorney is authorized to file any actions 7 8 necessary to recover costs to demolish the structure pursuant to §11-53B et seq., Code 9 10 of Alabama, 1975, as amended. 11 12 ADOPTED THIS 21ST DAY OF NOVEMBER, 2023. 13 14 15 16 By: Lora Lee Boone, President 17 Prattville City Council 18 19 AUTHENTICATED THIS THIS 21ST DAY OF NOVEMBER, 2023. 20 21 22 23 By: Paula G.
