Restaurant Retail Liquor License for a business located at 2641 Legends Parkway, Prattville, 10

WHEREAS, a public hearing was set by Resolution Book 2023-B, Page 231, and held 14

December 5, 2023, at 6:00 p.m., and that at such time and place all persons who desired had 16

WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2023- 9
10
B, Page 234, that the abundance of overgrown grass and weeds at 870 Wilberforce Avenue 11
12
constituted a public nuisance and set a Public Hearing on said nuisance; and 13
14
WHEREAS, the Autauga County tax records lists the property owners as Thomas 15
16
Frederick Eugene & Barbara Jean with an address of 870 Wilberforce Avenue, Prattville, AL 17
18
36067, to Parcel number 19 03 05 4 011 007.000; and 19
20
WHEREAS, notice was provided to correct, remedy or remove overgrown grass and 21
22
weeds; and 23
24
WHEREAS, the owner of 870 Wilberforce Avenue has failed and/or refused to correct, 25
26
remedy or remove said nuisance by the expiration of said notice; and 27
28
WHEREAS, the owner of said property did not file written objections with the City Clerk’s 29
30
Office within the time prescribed by City of Prattville Code of Ordinances, Section 46-114 (c); 31
32
and 33
34
WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on December 35
36
5, 2023, permitting the owner of said property to present evidence, objections and protest 37
38
regarding said nuisance; and 39
40
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, authorizes the 41
42
City to do such work or make such improvements that are necessary to correct, remedy or 43
44
remove such conditions, pay therefore and charge the expenses incurred to the owner of such 45
46
property. 47
48
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 49
50
declares that the overgrown grass and weeds at 870 Wilberforce Avenue continues to be a 51
52
public nuisance at the expiration of the notice of violation. 53
54
BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds 55
56
at said property removed using City forces or private contractors. The property owner shall 57
58
have the right to remove said nuisances at their expense provided that the removal is done 59
60
prior to the commencement of work by employees or agents of the City of Prattville; however, 61
62
this does not abolish incurred fines and expenses. 63
64
BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 1
2
to this request and report such costs to the City Council following its abatement. 3

WHEREAS, in Resolution Book 2022, Page 081, on May 3, 2022, the City of Prattville 9

entered into a one-year lease agreement with ACIC for property located on West 4th Street 11
12
for storage of kayaks and equipment, more specifically described as: 13
14
Commencing at the southeast corner of Lot 8 of A.G. Carter Plat as recorded in Map 15
Book 3, Page 69, thence North 85 feet to a point of beginning. Thence North 60’ thence 16
East 75’ thence South 60’ thence West 75’ to the point of beginning; and 17
18
WHEREAS, the City desires to continue to lease said property to ACIC for a period of 19
20
five years. 21
22
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 23
24
hereby authorizes the Mayor to enter into a lease agreement between the City of Prattville 25
26
and ACIC for the storage of said kayaks and equipment, and hereby ratifies and affirms said 27
28
agreement’s term from June 1, 2023 through May 31, 2028. 29

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 31
32
all documents necessary to carry out the intent of this Resolution. 33

WHEREAS, §11-53B-1 through §11-53B-16, Code of Alabama, 1975, as amended, 8
9
details the process for the City of Prattville to declare certain unsafe structures a public 10
11
nuisance and order repair or demolition; and 12
13
WHEREAS, §11-53B-3, Code of Alabama, 1975, as amended, requires the City’s order 14
15
to repair or demolish an unsafe structure be sent to the owner of the property and those having 16
17
legal interest in the property; and 18
19
WHEREAS, §11-53B-3 and §11-53B-4, Code of Alabama, 1975, as amended, requires 20
21
the owners to repair or demolish the unsafe structure within forty-five (45) days of being issued 22
23
an order from the City or to request a hearing before the City Council of the City of Prattville 24
25
within thirty (30) days of the order; and 26
27
WHEREAS, §11-53B-3, Code of Alabama, 1975, as amended, permits the City to repair 28
29
or demolish an unsafe structure if the owner fails to comply with the City order; and 30
31
WHEREAS, §11-53B-5, Code of Alabama, 1975, as amended, permits the City Council 32
33
to adopt a resolution affixing the cost of demolition and establishing a lien against the property; 34
35
and 36
37
WHEREAS, the City Council finds that: 38
39
1. The City’s Chief Building Official declared the residential structures at 902 40
Washington Ferry Road to be a dilapidated structure on June 21, 2023; and 41
2. The City’s Code Enforcement Officer issued an order to George P. Walthall Jr., on 42
June 21, 2023, to have the structures repaired or demolished within forty-five (45) 43
days of the notice; and 44
3. George P. Walthall Jr. did not request a hearing before the City Council within thirty 45
(30) days of the notice nor repair or demolish the structures within forty-five (45) days 46
of the notice; and 47
4. The City Council declared the dilapidated structures located at 902 Washington Ferry 48
Road to be unsafe and a public nuisance in Resolution Book 2023-A, Page 191, on 49
September 5, 2023; and 50
5. The City Council authorized the demolition of the dilapidated structures and awarded 51
the contract for complete demolition to 82 Auto Parts and Wrecker Service, LLC in 52
Resolution Book 2023-A, Page 214, on September 19, 2023; and 53
6. The total cost of demolition was determined to be $8,157.60. 54

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 56
57
the cost totaling $8,157.60 for demolition of the dilapidated structures located at 902 58
59
Washington Ferry Road is accurate and shall be established as a lien against the property. 60
61
BE IT FURTHER RESOLVED that the City Attorney is authorized to file any actions 62
63
necessary to recover costs to demolish the dilapidated structures pursuant to §11-53B et seq., 64
Code of Alabama, 1975, as amended. 1

Industrial Development Authority (SIDA), Site Evaluation and Economic Development 4

WHEREAS, Act 2023-035, referred to as the SEEDS Act, addresses the need for 9
10
industry ready industrial sites in the state; and 11
12
WHEREAS, SIDA has grant money available to municipalities for site assessments; and 13
14
WHEREAS, the City of Prattville desires to submit a grant application for re- 15
16
assessments and new assessments in the South Industrial Park; and 17
18
WHEREAS, said application allows for a request of up to $82,000.00 and requires a 19
20
50% local match; and 21
22
WHEREAS, any local match will be based on the actual amount awarded through the 23
24
grant and will need to be authorized to be paid from the Economic Development Budget; and 25
26
WHEREAS, the grant application requires authorization to submit the application and 27
28
commitment to all matching funds required to complete the proposed project. 29
30
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 31
32
hereby supports the submission of the FY2024 SEEDS grant application and commits to all 33
34
matching funds. 35

BE IT FURTHER RESOLVED that the City Council does hereby authorize the Mayor to 37
38
submit said grant application and execute any and all documents necessary to carry out the 39
40
intent of this Resolution. 41

WHEREAS, the City of Prattville Building Inspector declared the structure at 912 9

Wilberforce Avenue to be unsafe and a public nuisance on August 24, 2023, pursuant to § 11- 11

53B of the Code of Alabama, 1975, as amended; and 13
14
WHEREAS, on August 28, 2023, notice was sent by certified mail to the last known 15
16
property owner(s) and to all parties having interest in the property, ordering the repair or 17
18
demolition of the structure at 912 Wilberforce Avenue within 45 days of said notice; and 19
20
WHEREAS, in Resolution Book 2023-B, Page 233, on November 7, 2023, the City 21
22
Council of the City of Prattville declared that the structure located at 912 Wilberforce Avenue 23
24
continued to be unsafe and a public nuisance that must be repaired or demolished; and 25
26
WHEREAS, no repairs have been made to the structure, and it remains unsafe and a 27
28
public nuisance. 29

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 31
32
hereby authorizes the Mayor to take whatever steps are necessary to remove the unsafe 33
34
structure located at 912 Wilberforce Avenue. 35

BE IT FURTHER RESOLVED that a contract in an amount not to exceed $10,500.00 is 37
38
awarded to RCR Excavating, LLC for demolition and removal of said structure located 39
40
at 912 Wilberforce Avenue, and said funds are hereby approved and appropriated from FY2024 41
42
Budget Line Item Police/ Dilapidated House Demolition. 43

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 45

WHEREAS, in Resolution Book 2023-B, Page 244, on November 7, 2023, the City 7

Council of the City of Prattville declared a vacancy in Council District 5; and 9

WHEREAS, pursuant to §11-43-65, Code of Alabama, 1975, as amended, the City 11
12
Council announced its intent to hold a special election to fill said vacancy for the remainder of 13
14
the unexpired term. 15

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 17
18
notice is hereby given that on Tuesday, February 13, 2024, an election for the purpose of 19
20
electing a Councilor for District 5 for the City of Prattville, AL, will be held and that all registered 21
22
and qualified electors of the State, who reside within the limits of District 5 of Prattville, AL, and 23
24
have resided therein for 30 days or more immediately preceding the date of the election, and 25
26
who are qualified to vote will be authorized to participate in the election. 27

BE IT FURTHER RESOLVED the polls will be opened at 7:00 a.m. and remain open 29

continuously until 7:00 p.m. at 1357 S. Memorial Drive, Heritage Baptist Church. 31

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows: 3

THAT the zoning ordinance of the City of Prattville, Alabama, and the zoning map are 5

hereby amended to reclassify the property described in Attachment “A” from FAR to O-1; and 7
8
THAT this proposed Ordinance and a synopsis were advertised for two (2) weeks in the 9
10
Montgomery Advertiser, a newspaper of general circulation within the Corporate Limits of the 11
12
City of Prattville, and that the City Council at its Public Hearing on January 2, 2024, at 6:00 13
14
p.m., considered said proposed Ordinance and that at such time and place all persons who 15
16
desired had an opportunity to be heard in favor of or in opposition to such Ordinance. 17
18
ALL other items and provisions of the zoning ordinance not herein specifically amended 19
20
shall remain in full force and effect. 21

THE amendments herein contained were considered and recommended by the City of 23
24

[To Establish 2024 Redistricting Guidelines and Milestones.] 3

WHEREAS, §11-40-8, Code of Alabama, 1975, as amended requires that City Councils 7
8
divide their jurisdictions into districts having an equal number of residents with the lines thereof 9
10
conforming to the center of the streets or alleys and being rectangular as far as practicable; 11
12
and 13
14
WHEREAS, the 2020 Decennial Federal Census indicates the City of Prattville 15
16
experienced a population increase over the past decade, specifically a 2020 census population 17
18
of 37,781, an increase from the 2010 census population of 33,960; and 19
20
WHEREAS, an analysis of the City Council Districts designated by Ordinance 2011- 21
22
024 and amended by Ordinance 2016-A, Page 009 and Ordinance Book 2020, Page 005 23
24
using data from the 2020 Decennial Census indicates that Prattville’s population is unequally 25
26
distributed among the seven council districts; and 27
28
WHEREAS, §11-46-23, Code of Alabama, 1975, as amended gives authority to the 29
30
municipal governing body to readjust boundary lines; and 31
32
WHEREAS, the Council is initiating a process to adjust the district boundaries and 33
34
equalize the population in the seven districts; and 35
36
WHEREAS, there is a need to establish the guidelines to be utilized for the redistricting 37
38
process. 39

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of 41
42
Prattville that the following guidelines are established for the 2024 redistricting process: 43
44
1. All districts shall have equal representation. Districts will be drawn so that council 45
districts provide “one person-one vote” representation. The deviation of plus or minus 46
five percent from the ideal district population maintains an acceptable level of 47
representation. 48

2. The plan shall comply with the Voting Rights Act of 1965. According to the Voting Rights 50
Act, districts shall be drawn in such a way that assures all voters have an equal 51
opportunity to participate in the political process and to elect representatives of their 52
choice. 53

3. Where possible, existing district boundaries shall be maintained. Traditional lines should 55
not be redrawn if their existing locations can be reasonably accommodated and equal 56
representation achieved. 57
58
4. The plan shall strive to be non-retrogressive, meaning the ability of minority voters to 59
participate in the political process and to elect candidates of choice is not diminished by 60
the resulting redistricting. 61

5. As much as reasonably possible, council districts should be a compact and contiguous 63
geographic unit. 64

6.The 2020 U. S. Census of Population shall be the source of data for determining
population and representation.
7.To the maximum extent possible, district boundaries in the redistricting plan should
strive to include whole neighborhoods.
8.Existing voting centers should be maintained, if possible, for voter convenience and
efficient election administration.
9.District boundaries should be easily identifiable physical features such as the centerlines
of streets, alleys, roadways, streams, or other well-defined natural or manmade
landmarks as boundaries.
10. Proposed redistricting plans requiring less change to current districts in order to balance
population and comply with the criteria set forth herein will be generally preferred over
plans which require more change to achieve such balance and compliance, so long as
other rational municipal policies are not jeopardized.
11. All citizens and interested groups shall be given the opportunity to use the official data
and to present alternative district plans. All submitted plans will be evaluated and
considered by the City Council. 22

BE IT FURTHER RESOLVED that the City Council shall: 24
25
1.Endeavor to engage a consultant and cartographer by December 19, 2023, present a26
draft plan by April 16, 2024, and complete the redistricting process by July 23, 2024.27
28
2.Interact and provide feedback to the consultant and cartographer regarding each29
Council district for the purpose of developing a draft redistricting plan.30
31
3.Seek input on all proposed redistricting plans through the use of the city website and at32
least two (2) public hearings wherein the public can provide input regarding the proposed33
redistricting plans.34
35
4.Openly solicit and consider alternative redistricting plans provided by members of the36
public.37
