Barlow 45 City Clerk 46 47 APPROVED: 48 49 50 51 By: Bill Gillespie, Jr. 52 Mayor 53 54 55 56 57 58 59 60 61 62 63 RESOLUTION BOOK 2024, PAGE ___ 64 RESOLUTION 1 2 [To Declare the Dilapidated Structure at 930 Wilberforce Avenue to Be Unsafe and a Public 3 Nuisance.] 4 5 {Sponsored By: Council President Pro Tempore Strichik} 6 7 WHEREAS, under the authority of Title 11, Chapter 53B, Code of Alabama, 1975, as 8 9 amended, on August 24, 2023, the City of Prattville Chief Building Official declared the 10 11 dilapidated structure at 930 Wilberforce Avenue, Parcel No. 19 03 05 4 001 005.000, to be an 12 13 unsafe structure; and 14 15 WHEREAS, on August 28, 2023, the City of Prattville Code Enforcement Officer sent 16 17 notice ordering the repair or demolition of the dilapidated structure at 930 Wilberforce Avenue 18 19 within 45 days of said notice; and 20 21 WHEREAS, said notice was delivered by certified mail in accordance with §11-53B-3, 22 23 Code of Alabama, 1975, as amended; and 24 25 WHEREAS, Title 11, Chapter 53B allows the property owner or other interested parties 26 27 to file a written appeal within thirty (30) days of the date of notice with the City Clerk requesting 28 29 a hearing before the City Council of the City of Prattville; and 30 31 WHEREAS, no written request for a hearing was received within thirty (30) days of the 32 33 date of the notice; and 34 35 WHEREAS, §11-53B-4, Code of Alabama, 1975, as amended, authorizes the City 36 37 Council to determine whether or not the building or structure is unsafe to the extent that it is a 38 39 public nuisance; and 40 41 WHEREAS, no repairs have been made to the dilapidated structure located at 930 42 43 Wilberforce Avenue, and the structure remains unsafe and a public nuisance. 44 45 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 46 47 the dilapidated structure located at 930 Wilberforce Avenue continues to be unsafe and a public 48 49 nuisance that must be repaired or demolished. 50 51 BE IT FURTHER RESOLVED that the City Council instructs the Code Enforcement 52 53 Officer to provide a report of the cost to repair or demolish the dilapidated structure located at 54 55 930 Wilberforce Avenue to the City Council. 56 57 ADOPTED THIS 2ND DAY OF JANUARY, 2024. 58 59 60 61 By: Lora Lee Boone, President 62 Prattville City Council 63 64 AUTHENTICATED THIS 2ND DAY OF JANUARY, 2024. 1 2 3 4 By: Paula G. Barlow 5 City Clerk 6 7 APPROVED: 8 9 10 11 By: Bill Gillespie, Jr. 12 Mayor 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 RESOLUTION BOOK 2024, PAGE ___ 64 RESOLUTION 1 2 [To Amend the FY2024 Budget and Authorize the Mayor to Enter into an Election Agreement 3 between the City of Prattville, the Elmore County Commission, the Elmore County Board of 4 Registrars, and the Elmore County Probate Judge at an Estimated Cost of $2,000.00 Per 5 Election.] 6 7 {Sponsored By: Councilor Chambers} 8 9 WHEREAS, Alabama Ethics Commission Advisory Opinion No. 2018-03 provides that 10 11 counties and municipalities may enter into a contract through which the municipality reimburses 12 13 the county for the use of the county’s election equipment and county employees who possess 14 15 the requisite skill and knowledge to operate the equipment; and 16 17 WHEREAS, the City of Prattville, the Elmore County Commission, the Elmore County 18 19 Board of Registrars, and the Elmore County Probate Judge desire to enter into an Election 20 21 Agreement for the Special Election of Council District 5 based on the requirements of said 22 23 Ethics opinion; and 24 25 WHEREAS, the cost to reimburse the County for said services is estimated at $2,000.00 26 27 per election; and 28 29 WHEREAS, the Finance Director has identified a certain sum of surplus funds available 30 31 for departments that came in under budget in prior fiscal years. 32 33 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 34 35 the FY2024 Budget is hereby amended as follows: 36 37 Decrease Legislative/ Departmental Reserves $4,000.00 38 Increase City Clerk/ Election Supplies $4,000.00 39 40 BE IT FURTHER RESOLVED that the City Council of the City of Prattville hereby 41 42 authorizes the Mayor to enter into said election agreement between the City of Prattville, the 43 44 Elmore County Commission, the Elmore County Board of Registrars, and the Elmore County 45 46 Probate Judge. 47 48 BE IT FURTHER RESOLVED that funds estimated at $2,000.00 per election are hereby 49 50 authorized and approved to be paid to the Elmore County Commission to reimburse the County 51 52 for said services, and said funds are approved and appropriated from FY2024 Budget Line 53 54 Item City Clerk/ Election Supplies. 55 56 BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and all 57 58 documents necessary to carry out the intention of this resolution. 59 60 ADOPTED THIS 2ND DAY OF JANUARY, 2024. 61 62 By: Lora Lee Boone, President 63 Prattville City Council 64 AUTHENTICATED THIS 2ND DAY OF JANUARY, 2024. 1 2 3 4 By: Paula G.
