WHEREAS, pursuant to Resolution Book 2023-B, Page 258, a Special Election filling 7

the vacancy in Council District 5 was called to be held on February 13, 2024, and a run-off 9
10
election (if necessary) on March 12, 2024; and 11
12
WHEREAS, §11-46-27, Code of Alabama, 1975, as amended, provides in part that the 13
14
municipal governing body, not less than 15 days before holding of a Municipal Election, appoint 15
16
from the qualified electors of the municipality, officials to hold the elections as follows: where 17
18
electronic vote counters are used, an Inspector and at least three Clerks are required for each 19
20
electronic vote counter. 21

NOW THEREFORE BE IT RESOLVED by the City Council of the City of Prattville, that 23
24

BE IT FURTHER RESOLVED that notice be given to each such official as required by 59

law, and that the Prattville City Clerk publish the foregoing list of Election Officials so appointed, 61

showing the voting precincts and the Election Officials appointed for each such voting place by 63

publication in the Montgomery Advertiser, a newspaper of general circulation published in the 1

City of Prattville, and posting in three public places at least 10 days prior to such election. 3

BE IT FURTHER RESOLVED that a School of Instruction shall be held at Prattville City 5
6
Hall located at 101 West Main Street on Thursday, February 8, 2024, at 9:00 a.m. Election 7
8
Officials will be compensated $25.00 for the approximate 1.5 hours session. 9

BE IT FURTHER RESOLVED that each Election Official shall be compensated for their 11
12
service at the polling center on Election Day, February 13, 2024, and Run-Off Day, March 12, 13
14
2024 (if necessary), at the rate of $100.00 per day, except for Inspectors who will receive 15
16
$125.00 per day. 17

WHEREAS, in Resolution Book 2021, Pages 011 and 012, on January 5, 2021, and 8

Resolution Book 2023, Page 063, on April 4, 2023, the City Council of the City of Prattville 10

authorized the appointment of two City Attorneys; and 12
13
WHEREAS, in Resolution Book 2022-B, Pages 250 and 251, on December 20, 2022, 14
15
the City Council re-appointed the Municipal Court Judge and City Prosecutor; and 16
17
WHEREAS, the duties and responsibilities for each position are described in said 18
19
Resolutions; and 20
21
WHEREAS, a need has been identified to describe the duties and responsibilities in the 22
23
form of a written agreement; and 24
25
WHEREAS, no changes are desired or anticipated in the prescribed duties; and 26
27
WHEREAS, FY2023-2024 Budget passed on September 5, 2023, reflects associated 28
29
salaries and benefits. 30

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 32
33
hereby ratifies and affirms said agreements with the City Attorneys, Municipal Court Judge and 34

City Prosecutor to restate the prescribed duties in the form of a written agreement. 36

WHEREAS, pursuant to Resolution Book 2022-B, Page 246, on December 6, 2022, and 11

Resolution Book 2023, Page 033, on February 21, 2023, the City of Prattville plans to proceed 13
14
with ALDOT Project No. TAPAA-TA23(923) for sidewalk improvements along Old Ridge Road, 15
16
Old Farm Lane & Boardroom Drive; and 17
18
WHEREAS, the Engineering Department had specifications drafted for said 19
20
improvement project; and 21
22
WHEREAS, seven (7) sealed bids were received, opened and read aloud on January 23
24
9, 2024, at 10:00 a.m. in the Council Chambers at City Hall, and Smitherman Brothers 25
26
Construction Company, Inc. was the lowest responsible bidder at a cost of $679,580.00 for 27
28
said improvement project; and 29
30
WHEREAS, this is a budgeted expense in the Capital Projects Fund. 31
32
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 33
34
hereby awards Bid No. 023-020 to Smitherman Brothers Construction Company, Inc. in an 35
36
amount not to exceed $679,580.00 (net cost to City not to exceed $135,916.00) for said 37
38
improvement project, and said funds are approved and appropriated from the FY2024 Budget 39
40
Line Item Capital Projects Fund/ TAP 2023 – Old Ridge Sidewalks. 41

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 43

all documents necessary to carry out the intent of this resolution. 45

engineering and inspection services for sidewalk improvements along Old Ridge Road, Old 13

Farm Lane & Boardroom Drive for ALDOT Project No. TAPAA-TA23(923); and 15

WHEREAS, Civil Southeast, LLC has the expertise to provide said services at a cost 17
18
not to exceed $101,937.00; and 19

WHEREAS, §41-16-51(a)(3), Code of Alabama, 1975, as amended, allows contracts to 21
22
secure services with engineers possessing a high degree of professional skill to be let without 23
24
competitive bidding; and 25
26
WHEREAS, this is a budgeted expense in the Capital Projects Fund. 27

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 29

WHEREAS, the host fee for said event shall be $8,500.00; and 15

WHEREAS, this is a budgeted expense in the Parks and Recreation Department. 17

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 19

the Mayor is hereby authorized to enter into an agreement with Alabama Bass Trail to host 21

said tournament on May 11, 2024. 23

BE IT FURTHER RESOLVED that funds in an amount not to exceed $8,500.00 are 25

hereby authorized and approved to be paid to Alabama Bass Trail for said tournament, and 27
