WHEREAS, keeping garbage and rubbish: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 839 Heather Drive; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Martin David Lee 20
21
& Sarah L, with an address of 839 Heather Drive Prattville, AL 36066, to Parcel Number 19 06 22
23
13 1 000 001.087; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on January 25, 28
29
2024, to correct, remedy or remove the conditions of garbage and rubbish within ten (10) days; 30
31
and 32
33
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 34
35
remove said conditions by the expiration of said notice; and 36
37
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 38
39
Council to declare keeping garbage and rubbish to be a public nuisance and authorizes the 40
41
City to do such work or make such improvements that are necessary to correct, remedy or 42
43
remove such conditions, pay therefore and charge the expenses incurred for the abatement 44
45
process to the owner of such property. 46

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 48
49
declares that the garbage and rubbish at 839 Heather Drive continued to be a public nuisance 50
51
at the expiration of the notice of violation. 52

BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 54
55
said property removed using City forces or private contractors. The property owner shall have 56
57
the right to remove said nuisance at their expense provided that the removal is done prior to 58
59
the commencement of work by employees or agents of the City of Prattville; however, this does 60
61
not abolish incurred expenses. 62

BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 64
to this request and report such costs to the City Council following its abatement. 1

WHEREAS, stagnant water is injurious to the public health, safety and general welfare 9

of the community by providing a breeding ground for pests, insects and harmful bacteria; and 11

WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 13
14
the property and determined the existence of stagnant water at 1714 E. Main Street; and 15
16
WHEREAS, the Autauga County tax records list the property owner as Landers 17
18
Properties Attn: Steven T Lander, with an address of 3020 Atlanta Hwy Montgomery, AL 36109, 19
20
to Parcel Number 19 06 14 1 002 004.000; and 21
22
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 23
24
Code Enforcement Officer gave written notice to the owner of said property on January 26, 25

2024, to correct, remedy or remove the conditions of stagnant water within ten (10) days; and 27

WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 29

improvements in the area along the Autauga Creekwalk adjacent to the downtown area of Main 11

WHEREAS, Krebs Engineering, Inc. has the expertise to provide said services at a total 15
16
cost not to exceed $120,000.00; and 17

WHEREAS, §39-2-2(d)(1), Code of Alabama, 1975, as amended, allows contracts to 19
20
secure services with engineers possessing a high degree of professional skill to be let without 21
22
bidding; and 23

WHEREAS, said improvements are a budgeted expense in the Wastewater Enterprise 25

WHEREAS, the need has been identified to purchase one (1) KUHN SLC 126 Manure 9

WHEREAS, §41-16-51(b)(7), Code of Alabama, 1975, as amended, allows for 13

equipment used in the normal operation of sanitary sewer systems to be let without competitive 15
16
bidding; and 17

WHEREAS, this is a budgeted expense for the Wastewater Enterprise Fund. 19

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 21

WHEREAS, the release of the 2020 Census gave new population figures for every state 8

and cited population growth for the City of Prattville; and 10

WHEREAS, the population must be distributed evenly among the districts so that the 12
13
number of people living in each district is as close to the same as practicable; and 14
15
WHEREAS, the City of Prattville has a need to have Council district lines redrawn; and 16
17
WHEREAS, in Resolution Book 2023-B, Page 272, on December 19, 2023, guidelines 18
19
and milestones for the 2024 redistricting process were established; and 20
21
WHEREAS, Slaughter & Associates, PLLC is capable of supporting the redistricting 22
23
guidelines and milestones for the City at a cost of $25,000.00. 24
25
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 26
27
authorizes the Mayor to enter into an agreement with Slaughter & Associates, PLLC to have 28
29
City Council district lines redrawn. 30

BE IT FURTHER RESOLVED that funds in the amount of $25,000.00 are hereby 32
33
authorized and approved to be paid to Slaughter & Associates, PLLC for said redrawing of 34

City Council district lines, and said funds are hereby approved and appropriated from 36

WHEREAS, a need has been identified to purchase land adjoining current City-owned 9

property used by the Sanitation Enterprise Fund; and 11

WHEREAS, said proposed property adjoins the City-owned property located at 691 13
14
Doster Road; and 15

WHEREAS, said property containing approximately 0.95 acres more or less, is more 17
18
specifically described as Parcel Number 19 05 16 3 001 001.098; and 19
20
WHEREAS, said property is owned by William Lynam; and 21
22
WHEREAS, Mr. Lynam has agreed to convey said real property to the City of Prattville 23
24
at a cost of $1,500.00, plus closing costs. 25
26
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 27
28
the FY2024 Budget is hereby amended as follows: 29

Decrease Sanitation Enterprise Fund/ Operating Supplies $2,000.00 31
Increase Sanitation Enterprise Fund/ Capital Outlay $2,000.00 32

BE IT FURTHER RESOLVED that funds in the amount of $1,500.00, plus closing costs, 34
35
are hereby authorized and approved to be paid to William Lynam for the purchase of said 36
37
property, and said funds are approved and appropriated from FY2024 Budget Line Item 38
39
Sanitation Enterprise Fund/ Capital Outlay. 40

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 42
43
all documents necessary to carry out the intent of this Resolution. 44
