WHEREAS, the City of Prattville has a vacancy on the City Council in District 5 due to 8
9
the resignation of Blair Gornto, which was effective October 31, 2023; and 10
11
WHEREAS, the City Council declared said vacancy in Resolution Book 2023-B, Page 12
13
244, on November 7, 2023; and 14
15
WHEREAS, said resolution stated that the City Council intended to hold a Special 16
17
Municipal Election to fill said vacancy; and 18
19
WHEREAS, in Resolution Book 2023-B, Page 258 on December 5, 2023, the Special 20
21
Municipal Election was announced and subsequently held on Tuesday, February 13, 2024; and 22
23
WHEREAS, Michael P. Whaley was certified as receiving a majority of the votes cast 24
25
on February 13, 2024, for the position of Councilor of District 5; and 26
27
WHEREAS, Michael P. Whaley was declared as duly elected to said position at the 28
29
Canvass Meeting held at 7:00 a.m. on February 20, 2024, for the remainder of the 2020-2024 30
31
Quadrennium. 32

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 34

WHEREAS, under the provisions of §11-51-40, et seq., Code of Alabama, 1975, as 8

amended, it is necessary for the City Council of the City of Prattville to levy Ad Valorem taxes 10

on property situated in the City of Prattville for the ensuing tax year; and 12
13
WHEREAS, the City Council adopted Ordinance Book 95, Page 012, to confirm 7 Mills 14
15
Ad Valorem Tax in the City of Prattville, on April 18, 1995. 16
17
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 18
19
hereby ratifies and affirms Ordinance Book 95, Page 012, for the levy of the Ad Valorem tax 20

WHEREAS, the Parks and Recreation Department has personal property that is no 7

longer needed for public or municipal purposes; and 9

WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the municipal 11

governing body to dispose of unneeded personal property. 13

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 15
16
the following personal property owned by the City is no longer needed for public or municipal 17
18
purposes, and said property shall be removed from the inventory of the Parks and Recreation 19
20

WHEREAS, keeping garbage and rubbish: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 105 Colonial Court; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Edwards Mary 20
21
A & Edwards James S, with an address of 105 Colonial Court Prattville, AL 36066, to Parcel 22
23
Number 19 02 10 2 010 014.000; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on February 6, 28
29
2024, to correct, remedy or remove the conditions of garbage and rubbish within ten (10) days; 30
31
and 32
33
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 34
35
remove said conditions by the expiration of said notice; and 36
37
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 38
39
Council to declare keeping garbage and rubbish to be a public nuisance and authorizes the 40
41
City to do such work or make such improvements that are necessary to correct, remedy or 42
43
remove such conditions, pay therefore and charge the expenses incurred for the abatement 44
45
process to the owner of such property. 46

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 48
49
declares that the garbage and rubbish at 105 Colonial Court continued to be a public nuisance 50
51
at the expiration of the notice of violation. 52
53
BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 54
55
said property removed using City forces or private contractors. The property owner shall have 56
57
the right to remove said nuisance at their expense provided that the removal is done prior to 58
59
the commencement of work by employees or agents of the City of Prattville; however, this does 60
61
not abolish incurred expenses. 62

BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 64
to this request and report such costs to the City Council following its abatement. 1

WHEREAS, Facilities Maintenance had specifications drafted for said project; and 11

WHEREAS, six (6) sealed bids were received, opened and read in public on February 13

22, 2024, at 2:00 p.m., in the Council Chambers at Prattville City Hall, and Old South 15
16
Construction Co., LLC was the lowest responsible bidder at a cost of $236,000.00; and 17
18
WHEREAS, this a budgeted expense in Facilities Maintenance. 19

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 21
22
hereby awards Bid No.024-001 to Old South Construction Co., LLC at a cost of $236,000.00 23
24
for said project, and said funds are approved and appropriated from FY2024 Budget Line Item 25
26
Facilities Maintenance/ Capital Outlay. 27

Revenue Code for Prattville Christian Academy, Inc. Upon the Delivery of the Special Opinion 4
and the Indemnity Letter to the City.] 5

WHEREAS, Prattville Christian Academy, Inc., an Alabama nonprofit corporation 9
10
(the “User”), is refinancing existing indebtedness to take advantage of a more favorable 11
12
interest rate environment and has requested that the Educational Building Authority of the 13
14
City of Prattville, Alabama (the “Issuer”) serve as the conduit governmental issuer for its 15
16
refinancing project; and issue a tax-exempt obligation for the foregoing purpose (the 17
18
“Obligation”); and 19
20
WHEREAS, the indebtedness being refinanced originally financed educational 21
22
facilities located at 322 Old Farm Lane North, Prattville, Alabama 36066; and 23
24
WHEREAS, the City of Prattville (the “City”) is not liable in any way in connection 25
26
with the indebtedness (whether direct, indirect, or contingent); and 27
28
WHEREAS, Section 147 of the Internal Revenue Code of 1986, as amended, requires 29
30
as a condition for indebtedness to qualify as a tax-exempt obligation, that either the chief 31
32
elected official or the governing body to approve the incurrence of indebtedness for the 33
34
proposed project in order for said indebtedness to qualify as tax-exempt indebtedness even 35
36
though the City of Prattville (i.e. the host city) is not liable in any way in connection with said 37
38
indebtedness; and 39
40
WHEREAS, the Issuer, the User and Maynard Nexsen PC, bond counsel to the 41
42
Issuer, have all represented to the City that the issuance of the Obligation, and the City’s 43
44
approval thereof for purposes of Section 147 of the Internal Revenue Code will not affect 45
46
either the City’s qualified small issuer limitation or designation limitation pursuant to Section 47
48
265(b)(3) of the Internal Revenue Code for the 2024 calendar year; and 49
50
WHEREAS, Maynard Nexsen PC has agreed to provide the City with an opinion 51
52
(the “Special Opinion”) stating the City’s approval thereof for purposes of Section 147 of the 53
54
Internal Revenue Code will not affect either the City’s qualified small issuer limitation or 55
56
designation limitation pursuant to Section 265(b)(3) of the Internal Revenue Code for the 57
58
2024 calendar year; and 59
60
WHEREAS, in accordance with the terms of that certain letter (the “Indemnity 61
62
Letter”) from the User to the City dated the date of issuance of the Obligation, the User has 63
64
agreed to indemnify the City (and any entity that issues tax-exempt obligations on behalf of 1
2
the City) for any loss, liability or expense incurred due to any increase in interest cost as a 3
4
consequence of the designation of the Obligation as a “qualified tax-exempt obligation” under 5
6
Section 265(b) of the Internal Revenue Code; and 7
8
WHEREAS, a public hearing was held on the proposed project and the incurrence of 9
10
tax-exempt indebtedness for the project on Tuesday, February 27, 2024, following publication 11
12
of notice of said public hearing at least seven (7) days prior thereto in the Prattville Progress. 13
14
NOW, THEREFORE, BE IT RESOLVED, upon the delivery of the Special Opinion 15
16
and the Indemnity Letter to the City, the Mayor, in his capacity as the Chief Elected Official of 17
18
the City of Prattville, is hereby authorized to execute and deliver any and all certificates 19
20
required by Section 147 to approve of the foregoing project and proposed refinancing subject 21
22
to the requirements of said public hearing being held in accordance with the requirements of 23
24
Section 147 and approval by the City Attorney of the form of said Certificate. 25
26

the City of Prattville established guidelines for making appointments to City Boards; and 11

WHEREAS, the established guidelines mandate that members of City Boards live within 13

the Corporate Limits of the City of Prattville; and 15
16
WHEREAS, §11-54A-7, Code of Alabama, 1975, as amended, passed authorizing 17
18
municipal governing bodies to allow for members of Historic Redevelopment Authorities to be 19
20
duly qualified electors of the City or own property within the redevelopment district to serve on 21
22
the board, provided that at least seventy-five percent (75%) of the board members are duly 23
24
qualified electors of the City. 25

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 27
28
pursuant to §11-54A-7, Code of Alabama, 1975, as amended, the City of Prattville hereby 29

authorizes members of the Historic Prattville Redevelopment Authority to live within the 31

[To Adopt an Electronic Meeting Policy to Allow City Councilors to Participate in City Council 3
Meetings “Remotely” Under Certain Circumstances.] 4

WHEREAS, §36-25A-5.2 of the Code of Alabama, 1975, as amended provides that the 8
9
City Council of the City of Prattville may allow its Councilors, when unable to be physically 10
11
present at the meeting due to illness, to participate in the City Council meetings “remotely” by 12
13
means of electronic communications (such as a telephone or video conference) under certain 14
15
circumstances; and 16
17
WHEREAS, said statute requires the City Council to adopt a policy, at least 45 days 18
19
before the first meeting the council uses electronic means of communication as described 20
21
above, which details the procedures and communications equipment that will be used, how the 22
23
public may access the meeting and how voting will be conducted. 24
25
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Prattville while 26
27
in regular session starting on or after April 19, 2024, as follows: 28
29
Section 1. One or more Councilors of the City Council may participate in a City Council 30
meeting by means of electronic communications equipment, provided that both of the 31
following are fulfilled: 32
33
(a) No less than a quorum of Councilors are physically present at the physical location 34
of the meeting; and 35
(b) The Councilors participating by means of electronic communications are unable to 36
be physically present at the meeting due only to their illness. “Illness” is defined as a 37
disease or period of sickness affecting the body or mind such that physical presence 38
at a Council Meeting is not advised by a licensed medical doctor. A Councilor 39
participating by electronic means shall further certify that he or she is not under the 40
influence of any medications that would impair their judgment for purposes of attending 41
the meeting, considering and voting on matters. 42
43
Section 2. A Councilor that participates in a Council meeting by means of electronic 44
communications shall be deemed to be present for all purposes, except for the establishment 45
of a quorum. 46
47
Section 3. A Councilor that wishes to participate by electronic means must provide 48
actual written notice to the City Clerk at least twenty-four (24) hours in advance of the Council 49
meeting so that appropriate arrangements can be made in advance of said meeting. At the 50
time of the notice, the Councilor will provide appropriate information on how/where the 51
Councilor can be reached for the purposes of participating in the meeting. 52

Section 4. At the commencement of the City Council meeting, the City’s audio, 54
computer and/or telephone equipment at the City Council meeting location will be used to 55
ensure that all Councilors participating in the meeting can hear one another at the same time 56
and can be heard by the members of the public who are in physical attendance at the meeting. 57
58
Section 5. The public may access the Council meeting through physical attendance 59
at the meeting. In addition, if the City Council meetings are recorded for later broadcast, then 60
the City’s audio, computer and/or telephone equipment will be used to ensure that the 61
Councilor(s) participating by electronic means can be heard by the members of the public 62
who are viewing the meeting through the recording (unless unexpected technical difficulties 63
interfere with/or prevent the same). 64
Section 6. Any vote taken at a City Council meeting where one or more Councilors 1
are participating through electronic means shall be taken as a roll call vote that allows each 2
Councilor to vote individually. 3

Section 7. A Councilor participating in a Council meeting by electronic means may not 5
serve as the presiding officer of that meeting. 6
7
Section 8. If a Councilor’s participation by electronic means is interrupted by problems 8
with the related electronic communications equipment and/or its connection, then the meeting 9
shall be temporarily suspended or recessed in order to allow City personnel to make 10
reasonable attempts to restore the participation. 11
12
Section 9. Notwithstanding anything in this Ordinance to the contrary, a Councilor may 13
not participate in a Council meeting by electronic means in the event that the presiding officer 14
of the Council meeting (who is in physical attendance at the meeting) determines that 15
technical difficulties/issues preclude that Councilor from participating as set forth in this 16
Ordinance (although such a determination may be overruled during that meeting by a majority 17
vote of those Councilors in physical attendance at the meeting). 18
19
Section 10. If the electronic communications equipment referenced in this Ordinance 20
fails or is in any way interrupted during a Council meeting, that failure shall not be grounds to 21
challenge any action taken during the meeting. 22
23
THIS Ordinance shall become effective upon its passage and execution as provided by 24
25
law. Each of the provisions of this Ordinance is severable; if any provision shall be declared to 26
27
be invalid, the remaining provisions shall not be affected but shall remain in full force. All 28
29
Ordinances, or parts of Ordinances, in any manner, conflicting herewith are hereby repealed. 30
31
