WHEREAS, the Parks and Recreation Department has personal property that is no 7

longer needed for public or municipal purposes; and 9

WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the municipal 11
12
governing body to dispose of unneeded personal property. 13
14
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 15
16
the following personal property owned by the City is no longer needed for public or municipal 17
18
purposes, and said property shall be removed from the inventory of the Parks and Recreation 19
20

WHEREAS, § 6-5-122 et Seq., of the Code of Alabama, 1975, as amended, permits the 8
9
City Council of the City of Prattville to declare a public nuisance and have the violation resolved; 10
11
and 12
13
WHEREAS, in Resolution Book 2023-B, Page 226, on October 17, 2023, the City 14
15
Council of the City of Prattville declared garbage and rubbish and the abundance of overgrown 16
17
grass and weeds at 222 Moncrief Street continued to be a public nuisance; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Infusion 20
21
Properties LLC, with an address of 220 Elba Highway, Troy, AL 36079, to Parcel Number 22
23
19 02 09 3 0 018 005.000; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on September 14, 28
29
2023, to correct, remedy or remove the conditions of garbage and rubbish within ten (10) days; 30
31
and 32
33
WHEREAS, the owner/operator of said property failed and/or refused to correct, remedy 34
35
or remove said nuisance conditions by the expiration of said notice; and 36
37
WHEREAS, Section 46-32 of the City of Prattville Code of Ordinances authorizes the 38
39
City to do such work or make such improvements that are necessary to correct, remedy or 40
41
remove such condition, pay therefore and charge the expenses incurred to the owner/operator 42
43
of such property to the fullest extent authorized by law. 44
45
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 46
47
the cost totaling $3,497.50.00 for the removal of garbage and rubbish at 222 Moncrief Street is 48
49
accurate and shall be established as a lien against the property. 50
51
BE IT FURTHER RESOLVED that the City Attorney is authorized to file any actions 52
53
necessary to recover costs of said removal. 54

WHEREAS, the Finance Department has identified a need for business license 9

discovery and recovery administration; and 11

WHEREAS, Avenu Insights and Analytics, LLC has the expertise to provide said 13
14
services at an expense of fifty percent (50%) of the first year’s business license fees collected; 15
16
and 17
18
WHEREAS, said expenses will be recovered from money collected before distribution 19
20
to the City. 21

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 23
24
that the Mayor is hereby authorized to enter into a three-year tax revenue enhancement 25
26
agreement, starting May 1, 2024, with Avenu Insights & Analytics, LLC for said services in an 27
28
amount not to exceed fifty percent (50%) of the first year’s business license fees collected. 29

WHEREAS, the Prattville Area Chamber of Commerce desires to hold a special event, 9
10
“The Perfect Pour”, to include alcohol and live entertainment on Maple Street under the covered 11
12
area, “The Shed”, next to The Mill at Prattville apartments, more specifically depicted in Exhibit 13
14
“A” attached hereto; and 15
16
WHEREAS, pursuant to Ordinance Book 2022, Page 042, adopted on October 18, 17
18
2022, special permission must be obtained to allow alcohol use on public property; and 19
20
WHEREAS, the City Council of the City of Prattville desires to support the Prattville Area 21
22
Chamber of Commerce in this event and encourage overall economic growth and development 23
24
in the City of Prattville; and 25
26
WHEREAS, the Prattville Area Chamber of Commerce will be responsible for securing 27
28
all requisite approvals from the State of Alabama Alcoholic Beverage Control Board (ABC) if 29
30
so, required. 31

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 33
34
that the Mayor is hereby authorized to issue a special event permit to allow alcohol to the 35
36
Prattville Area Chamber of Commerce for “The Perfect Pour” event at “The Shed” for April 12, 37

WHEREAS, a need has been identified for a Police and Fire Training Facility; and 8

WHEREAS, the Police and Fire Departments have specifications drafted for said 10

project; and 12

WHEREAS, nine (9) sealed bids were received, opened and read in public on March 14
15
7, 2024, at 2:00 p.m. in the Council Chambers at City Hall, and Webb Builders, Inc. was the 16
17
lowest responsible bidder at a cost not to exceed $3,911,206.00 for said project; and 18
19
WHEREAS, this is a budgeted expense for the Capital Projects Fund. 20
21
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 22
23
hereby awards Bid No. 024-002 to Webb Builders, Inc. in an amount not to exceed 24
25
$3,911,206.00 for said project, and said funds are approved and appropriated from the FY2024 26
27
Budget Line Item Capital Projects Fund/ Public Safety Training Facility. 28

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 30
31
all documents necessary to carry out the intent of this Resolution. 32

WHEREAS, a vacancy currently exists on the HPRA due to the resignation of Bradley 7

Neave on May 18, 2021, due to residency requirements; and 9

WHEREAS, §11-54A-7, Code of Alabama, 1975, as amended, passed and became 11
12
effective on or about August 1, 2023, which authorized municipal governing bodies to allow for 13
14
members of historic redevelopment authorities to be duly qualified electors of the City or own 15
16
property within the redevelopment district to serve on the board, provided that at least seventy- 17
18
five percent (75%) of the board members are duly qualified electors of the City; and 19
20
WHEREAS, in Resolution Book 2024, Page 052, adopted on March 5, 2024, the City 21
22
Council authorized members of the Historic Prattville Redevelopment Authority to live within 23
24
the Corporate Limits or own property within the City of Prattville’s historic redevelopment 25
26
district, consistent with state law; and 27
28
WHEREAS, Bradley Neave has submitted an application to serve on the HPRA as he 29
30
owns property within the City of Prattville historic redevelopment district; and 31
32
WHEREAS, it is the desire of the City Council of the City of Prattville to fill said vacancy 33
34
to ensure the continuity of the Board’s operation. 35
36
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 37
38
Bradley Neave is hereby appointed to fill said vacancy on the HPRA effective immediately, and 39
40
said term shall expire on November 1, 2029, or until a successor is duly qualified and 41
42
appointed. 43

BE IT FURTHER RESOLVED that this appointment shall serve toward the twenty-five 45
46
percent (25%) of the allowed members owing property as a qualification for serving, and there 47
48
still exists at least seventy-five (75%) of board members being duly qualified electors of the 49

WHEREAS, the State and the City desire to enter into a Preliminary Engineering and 20
21
Construction Agreement for a TAP Project for said Streetscape improvements for Project No. 22
23
TAPMN-TA24(941), CPMS Ref # 100078230 at a total cost not to exceed $683,173.60 (Net 24
25
Cost to City Not to Exceed $170,793.40); and 26
27
WHEREAS, this is a budgeted expense in the Capital Projects Fund. 28

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 30

WHEREAS, there is a need to acquire additional property to continue downtown 9

revitalization through Project Star; and 11

WHEREAS, HPRA owns the property at 234 S. Chestnut Street; and 13

WHEREAS, the City desires to purchase said property from HPRA; and 15
16
WHEREAS, 234 S. Chestnut Street, containing 0.57 acres, more or less, is more 17
18
specifically described as parcel # 19 03 08 4 017 017.001; and 19
20
WHEREAS, HPRA has agreed to convey said real property to the City of Prattville at a 21
22
cost not to exceed $270,000.00, plus closing costs. 23

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 25
26
the FY2024 Budget is hereby amended as follows: 27

Decrease Economic Development Reserves $285,000.00 29
Increase Executive/ Capital Outlay $285,000.00 30

BE IT FURTHER RESOLVED that funds in an amount not to exceed $270,000.00, plus 33
34
closing costs, are hereby authorized and approved to be paid to HPRA for the purchase of said 35
36
property located 234 S. Chestnut Street, and said funds are approved and appropriated from 37

FY2024 Budget Line Item Executive/ Capital Outlay. 39

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 41
