WHEREAS, under the authority of Title 11, Chapter 53B, Code of Alabama, 1975, as 8
9
amended, on December 18, 2023, the City of Prattville Chief Building Official declared the 10
11
dilapidated residential structure at 156 Durden Road, Parcel No. 19 03 08 2 003 003.000, to 12
13
be an unsafe structure; and 14
15
WHEREAS, on January 31, 2024, the City of Prattville Code Enforcement Officer sent 16
17
notice ordering the repair or demolition of the dilapidated residential structure at 156 Durden 18
19
Road within 45 days of said notice; and 20
21
WHEREAS, said notice was delivered by certified mail in accordance with §11-53B-3, 22
23
Code of Alabama, 1975, as amended; and 24
25
WHEREAS, Title 11, Chapter 53B allows the property owner or other interested parties 26
27
to file a written appeal within thirty (30) days of the date of notice with the City Clerk requesting 28
29
a hearing before the City Council of the City of Prattville; and 30
31
WHEREAS, no written request for a hearing was received within thirty (30) days of the 32
33
date of the notice; and 34
35
WHEREAS, §11-53B-4, Code of Alabama, 1975, as amended, authorizes the City 36
37
Council to determine whether or not the building or structure is unsafe to the extent that it is a 38
39
public nuisance; and 40
41
WHEREAS, no repairs have been made to the dilapidated residential structure located 42
43
at 156 Durden Road, and the residential structure remains unsafe and a public nuisance. 44
45
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 46
47
the dilapidated residential structure located at 156 Durden Road continues to be unsafe and 48
49
a public nuisance that must be repaired or demolished. 50
51
BE IT FURTHER RESOLVED that the City Council instructs the Code Enforcement 52
53
Officer to provide a report of the cost to repair or demolish the dilapidated residential structure 54
55
located at 156 Durden Road to the City Council. 56

WHEREAS, keeping garbage and rubbish: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 507 Boxwood Road; and 18
19
WHEREAS, the Autauga County tax records list the property owner as PRS Properties 20
21
LLC, with an address of 3983 Nash Creek Drive, Opelika, AL 36804, to Parcel Number 19 02 22
23
09 1 003 005.000; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on February 7, 28
29
2024, to correct, remedy or remove the conditions of garbage and rubbish within ten (10) days; 30
31
and 32
33
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 34
35
remove said conditions by the expiration of said notice; and 36
37
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 38
39
Council to declare keeping garbage and rubbish to be a public nuisance and authorizes the 40
41
City to do such work or make such improvements that are necessary to correct, remedy or 42
43
remove such conditions, pay therefore and charge the expenses incurred for the abatement 44
45
process to the owner of such property. 46
47
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 48
49
declares that the garbage and rubbish at 507 Boxwood Road continued to be a public nuisance 50
51
at the expiration of the notice of violation. 52
53
BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 54
55
said property removed using City forces or private contractors. The property owner shall have 56
57
the right to remove said nuisance at their expense provided that the removal is done prior to 58
59
the commencement of work by employees or agents of the City of Prattville; however, this does 60
61
not abolish incurred expenses. 62

BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 64
to this request and report such costs to the City Council following its abatement. 1

WHEREAS, §11-53B-1 through §11-53B-16, Code of Alabama, 1975, as amended, 8
9
details the process for the City of Prattville to declare certain unsafe structures a public 10
11
nuisance and order repair or demolition; and 12
13
WHEREAS, §11-53B-3, Code of Alabama, 1975 as amended, requires the City’s order 14
15
to repair or demolish an unsafe structure be sent to the owner of the property and those having 16
17
legal interest in the property; and 18
19
WHEREAS, §11-53B-3 and §11-53B-4, Code of Alabama, 1975, as amended, requires 20
21
the owners to repair or demolish the unsafe structure within forty-five (45) days of being issued 22
23
an order from the City or to request a hearing before the City Council of the City of Prattville 24
25
within thirty (30) days of the order; and 26
27
WHEREAS, §11-53B-3, Code of Alabama, 1975, as amended, permits the City to repair 28
29
or demolish an unsafe structure if the owner fails to comply with the City order; and 30
31
WHEREAS, §11-53B-5, Code of Alabama, 1975, as amended, permits the City Council 32
33
to adopt a resolution affixing the cost of demolition and establishing a lien against the property; 34
35
and 36
37
WHEREAS, the City Council finds that: 38
39
1. The City’s Chief Building Official declared the residential structure at 912 Wilberforce 40
Avenue to be an unsafe structure on August 24, 2023; and 41
2. The City’s Code Enforcement Officer issued an order to Callie Lewis, on August 28, 2023, 42
to have the property repaired or demolished within forty-five (45) days of the notice; and 43
3. Callie Lewis did not request a hearing before the City Council within thirty (30) days 44
of the notice nor repair or demolish the structure within forty-five (45) days of the 45
notice; and 46
4. The City Council declared the structure located at 912 Wilberforce Avenue to be 47
unsafe and a public nuisance in Resolution Book 2023-B, Page 233, on November 48
7, 2023; and 49
5. The City Council authorized the demolition of the structure and awarded the contract 50
for complete demolition in Resolution Book 2023-B, Page 257, on December 5, 51
2023; and 52
6. The total cost of demolition was determined to be $10,500.00; and 53
54
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 55
56
the total amount of $10,858.03 for the demolition of the structure located at 912 Wilberforce 57
58
Avenue is accurate and shall be established as an assessment against the property. 59
60
BE IT FURTHER RESOLVED that the City Attorney is authorized to file any actions 61
62
necessary to recover costs to demolish the structure pursuant to §11-53B et seq., Code 63
64
of Alabama, 1975, as amended. 1

WHEREAS, the Parks and Recreation Department has identified a need to purchase 9

two (2) Ford Transit Passenger vans; and 11

WHEREAS, said vans are available through State Contract No. MA220000003123 from 13
14
Long-Lewis of the Shoals, Inc. at a cost not to exceed $107,365.00; and 15
16
WHEREAS, this is a budgeted expense for the Parks and Recreation Department. 17
18
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 19
20
funds in an amount not to exceed $107,365.00 for the purchase of said vans are hereby 21
22
authorized and approved to be paid to Long-Lewis of the Shoals, Inc., and said funds are 23
24
approved and appropriated from FY2024 Budget Line Item Parks and Recreation/ Capital 25
26
Outlay. 27

BE IT ORDAINED by the City Council of the City of Prattville, that City of Prattville Code 8
9
of Ordinances is amended as follows: 10
11
Article I. - In General 12
Sec. 105-26. - Schedule of permit fees. 13
14
(a) Permits—Generally. On all buildings, structures, electrical, plumbing, gas, and mechanical 15
systems, or alterations requiring a permit, an issuance fee of $25 shall be paid plus an 16
additional amount in accordance with following schedules: 17
(1) Building permits. 18
Total Valuation Fee*
Up to $2,000.00 Issuance fee plus $25.00 if inspection required.
$2,001.00 to $15,000.00 Issuance fee for the first $2,000.00 plus $1.50 for each
additional thousand or fraction thereof, to and including
$15,000.00 plus $25.00 inspection fee.
$15,001.00 to $50,000.00 Issuance fee plus $30.00 for the first $15,000.00 plus $1.25
for each additional thousand or fraction thereof to and
including $50,000.00.
$50,001.00 to $100,000.00 Issuance fee plus $75.00 for the first $50,000.00 plus $1.00
for each additional thousand or fraction thereof, to and
including $100,000.00.
$100,001.00 to $500,000.00 Issuance fee plus $125.00 for the first $100,000.00 plus
$0.75 for each additional thousand or fraction thereof, to
and including $500,000.00.
$500,001.00 and up Issuance fee plus $425.00 for the first $500,000.00 plus
$0.50 for each additional thousand or fraction thereof.
*One-quarter of one percent (0.25%) shall be added to the final permit fee. 19

(2) Valuation. All fees for building permits shall be calculated on the basis of the true value 21
of the building, structure, addition or alteration. 22
a. Single-family residential structures. For new one- and two-family residential 23
structures, valuations shall be based on the square footage of the structure and 24
calculated using the most recent building valuation data table published by the 25
International Code Council, Inc. (ICC) in effect on January 1 of each year. The 26
value per square footage shall be based on type of construction as classified by 27
the ICC table. 28
b. Valuation for all structures other than single-family and two-family residential shall 29
be based on the actual value or contract price rounded up to next thousand dollars. 30
Permit valuations shall include total value of the contract, including material and 31
labor. 32
c. The building official may request all appraisal or contract information necessary to 33
determine the true value of the building, structure, addition or alteration. If, in the 34
opinion of the building official, the valuation is underestimated on the application, 35
the permit shall be denied, unless the applicant can show detailed estimates to 36
meet the approval of the building official. Final permit valuation shall be set by the 37

(4) Miscellaneous permits and fees. 1
a. Work prior to permit. Where work for which a permit is required by this chapter 2
commences prior to obtaining said permit, the permit fee herein specified shall be 3
doubled and a $250 administrative fee may be charged 4
b. Moving fee. For the relocation of any building or structure, the fee shall be $100.00 5
per section. 6
c. Demolition fee. For the demolition of any building or structure, the fee shall be 7
$25.00 per story. In addition, the application for a demolition shall be accompanied 8
by a $1,000.00 surety, which shall be refunded by the building official when all 9
demolition debris has been properly removed and the site has been properly 10
graded and stabilized. Said bond or cash deposit shall indemnify the City against 11
damage to the public streets and sidewalks, and against unwarranted litter and 12
debris allowed to remain on the premises, which constitutes a public nuisance. 13
Interior demolition shall be based on the contract value provided by the permittee. 14
d. Mobile or manufactured home. For the placement of any manufactured home 15
covered by the National Manufactured Housing Construction and Safety Standards 16
Act of 1974 (commonly known as the HUD Code), a fee of $100.00 shall be paid 17
prior to placement of the structure. The permit fee shall cover the inspection of 18
correct installation, flood hazard determination, electrical connection and plumbing 19
connection. 20
e. Plan review fee. A plan review fee shall be paid for the review of all multi-family, 21
commercial and industrial projects that require architectural plans. Said fee shall 22
be paid at the time said plans are submitted to the City planning and development 23
department. Plan review fee shall be calculated as $2.50 per $1,000.00 of building 24
valuation, with a minimum fee of $250.00 and a maximum of $10,000.00. 25
When determined by the building official or the fire marshal that it is necessary for 26
plan review to be performed by an outside party (e.g., International Code Council), 27
the full fee shall be paid by the owner or contractor to the outside party. 28
f. Re-inspection fee. A fee of $100.00 shall be paid for each re-inspection of a failed 29
second inspection. 30
g. Pursuant to Alabama Act 2015-308, the city shall assess a fee on all non-residential 31
construction work permitted within the City in the amount of $1.00 for every 32
$1,000.00 of said non-residential construction work permitted. 33
The fees shall be collected by the city and shall be electronically remitted monthly 34
to the department of finance, division of construction management, by the 20th day 35
of the month following the issuance of the applicable permits as required by Act 36
2015-308. 37
h. Roofing permit. All work involving the replacement of a roof covering must be 38
permitted prior to work beginning. If work only involves the roof covering and 39
underlayment (e.g. new shingles) then only the issuance fee will be charged for the 40
permit. If the work includes any changes to decking or sheathing, rafters, or any 41
structural portion of the roof or greater structure, then a building permit must be 42
applied for and issued with applicable fees. 43

(5) Fee refunds. The Building Official shall authorize the refunding of fees as follows: 45
a. The full amount of any fee paid hereunder that was erroneously paid or collected. 46
b. Not more than 80 percent of the permit fee paid when no work has been done under 47
the permit issued in accordance with this chapter. 48
c. Not more than 80 percent of the plan review fee paid when an application for a 49
permit for which a plan review fee has been paid is withdrawn or cancelled before 50
the plan review has been completed. 51

(b) The Building Official shall not authorize the refunding of any fee paid except upon written 53
application filed with the City Planning and Development Department by the original 54
permittee. 55

BE IT ORDAINED by the City Council of the City of Prattville, that City of Prattville Code 9

of Ordinances is amended as follows: 11

Article I. - In General 13
Sec. 46-4. - Keeping garbage and rubbish; inspection by Code Enforcement Officer or 14
designee. 15

It shall be unlawful for any person in possession, charge or control of any premises to keep, 17
cause to be kept or allow the keeping on any premises of litter, garbage, rubbish, waste, 18
offensive materials or substances or other refuse in such a manner that it will become offensive 19
or deleterious to health or likely to cause disease, and the same is hereby declared a public 20
nuisance. The Code Enforcement Officer or designee is hereby authorized to inspect any 21
premises for the purpose of enforcement of the requirements of this section, and it shall be 22
unlawful for any person to resist or interfere with such representative by word, deed or act in 23
the performance of such inspection. 24

It shall be an exception to this section as long as materials are stacked neatly off the ground 26
and such materials are actively being used in an ongoing project for construction, remodeling 27
or rebuilding. 28
