WHEREAS, the Alabama Electric Vehicle Infrastructure Plan encourages energy 9
10
independence and implant strategies to reduce energy use; and 11
12
WHEREAS, Alabama Power Company, partnering with the City of Prattville, had 13
14
preliminary engineering plans developed for the placement and installation of EV charging 15
16
stations; and 17
18
WHEREAS, grant funding for EV charging stations is available through the US DOE; 19
20
and 21
22
WHEREAS, the City desires to apply for grant funding to install two (2) Level 3 DC 23
24
120kw Dual Output EV charging stations in downtown Prattville; and 25
26
WHEREAS, said application allows for a request of up to $76,260.00 in formula grant 27
28
funding and requires a twenty percent (20%) local match; and 29
30
WHEREAS, any local match will be based on the actual amount awarded through the 31
32
grant and will be paid from the Infrastructure One-Cent funds; and 33
34
WHEREAS, the grant application requires authorization to submit the application and 35
$ 36
commitment to all matching funds required to complete the proposed project. 37

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Prattville 39
40
hereby supports the submission of the EECBG grant application and commits to all matching 41
42
funds. 43

BE IT FURTHER RESOLVED that the City Council does hereby authorize the Mayor to 45
46
submit said grant application and execute any and all documents necessary to carry out the 47
48
intent of this Resolution. 49

WHEREAS, the Fire Department has a need for ambulance collection and billing 8

Services, and the current agreement has expired; and 10

WHEREAS, §41-16-51(b)(5), Code of Alabama, 1975, as amended, allows for contracts 12

for fiscal or financial advice or services to be let without competitive bidding; and 14
15
WHEREAS, Professional Practice Support, Inc. has the expertise to provide said 16
17
services at a rate of 4.25% of net collections; and 18
19
WHEREAS, net collections are defined as total cash collections less refunds. 20
21
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 22
23
that the Mayor is hereby authorized to enter into a three -year agreement with Professional 24
25
Practice Support, Inc. for said services in an amount not to exceed 4.25% of the net collections. 26
27
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 28
29
all documents necessary to carry out the intent of this Resolution. 30

WHEREAS, an abundance of overgrown grass and weeds: 9
10
1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, mosquitoes, and other vermin; 12
2. may cause the further spread of weeds; 13
3. may hide debris, such as glass or metal, that could inflict injury on a person going to such 14
property; 15
4. may also pose a fire hazard and respiratory hazard; and 16
17
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 18
19
the property and determined the existence of an abundance of overgrown grass and weeds 20
21
at 1722 E. Main Street; and 22
23
WHEREAS, the Autauga County tax records list the property own er as HACM INC with 24
25
an address of 103 Par Circle, Fairhope, AL 36532, to Parcel number 19 06 14 1 002 002.000; 26
27
and 28
29
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 30
31
Code Enforcement Officer gave written notice to the owner(s) of said property on February 29, 32
33
2024, to correct, remedy or remove the abundance of overgrown grass and weeds within ten 34
35
(10) days; and 36
37
WHEREAS, the owner(s) of said property have failed and/or refused to correct, remedy 38
39
or remove said condition by the expiration of said notice; and 40
41
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 42
43
Council to declare the abundance of overgrown grass and weeds to be a public nuisance and 44
45
abate the same; and 46
47
WHEREAS, pursuant to Section 46-114 (e), City of Prattville Code of Ordinances, 48
49
declaring the abundance of overgrown grass and weeds to be a public nuisance and ordering 50
51
its abatement by the City Council initiates a fine for the first violation and designation on the 52
53
repeat offender registry. 54
55
NOW, THEREFORE, BE IT RESOLVED THAT: 56
57
1. the City Council of the City of Prattville declares the abundance of overgrown grass and 58
weeds at said property to be a public nuisance and has therefore initiated the abatement 59
process; and 60
2. the owner(s) of said property is ordered to abate said nuisance and appear before the City 61
Council at a Public Hearing at 6:00 p.m. on May 21, 2024, at Prattville City Hall; and 62
3. any objections may be filed, in writing, to the City Clerk at least five (5) days prior to the 63
Public Hearing; and 64
4. the fine of $100.00 shall be assessed to the owner(s) of said property in addition to any 1
costs incurred for the abatement process; and 2
5. said property shall be placed on the repeat offender registry for a period of thre e (3) years; 3
and 4
6. the notice of Public Hearing on the matter, as required by law, will be provided in a 5
publication of general circulation, by certified mail, and by signage on the subject property. 6

WHEREAS, keeping garbage and rubbish: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11

Parcel Number 19 06 14 2 000 001.006; and 26

WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 28
29
Code Enforcement Officer gave written notice to the owner of said property on March 21, 2024, 30
31
to correct, remedy or remove the conditions of garbage and rubbish within ten (10) days; and 32
33
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 34
35
remove said conditions by the expiration of said notice; and 36
37
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 38
39
Council to declare the keeping of garbage and rubbish to be a public nuisance and authorizes 40
41
the City to do such work or make such improvements that are necessary to correct, remedy or 42
43
remove such conditions, pay therefore and charge the expenses incurred for the abatement 44
45
process to the owner of such property. 46
47
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 48
49
declares that the garbage and rubbish at 711 Running Brook Circle continued to be a public 50
51
nuisance at the expiration of the notice of violation. 52
53
BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 54
55
said property removed using City forces or private contractors. The property owner shall have 56
57
the right to remove said nuisance at their expense provided that the removal is done prior to 58
59
the commencement of work by employees or agents of the City of P rattville; however, this does 60
61
not abolish incurred expenses. 62
63
BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 64
to this request and report such costs to the City Council following its abatement. 1

WHEREAS, under the authority of Title 11, Chapter 53B, Code of Alabama, 1975, as 8

amended, on February 22, 2024, the City of Prattville Chief Building Official declared the 10
11
dilapidated structure at 809 Martin Luther King Jr. Drive, Parcel No. 19 03 05 4 011 014.000, 12
13
recorded in the Autauga County Probate Office in Book 2019 Page 630, and more specifically 14
15
described as: 16

A lot or parcel of land in Prattville, Alabama, and being a part of Lot 4 shown on 18
the map or plat of the City of Prattville, Alabama, Metes and Bounds: BEG at 19
appoint at NW Corner of Lot 11 of Alice Russell, Andrews project as recorded in 20
Deed Book 71 Page 520 thence N’W’LY 57” along E ROW of Wilberforce Avenue 21
thence E 185’ thence SE’LY50” thence W 197” to E Row at Point of Beginning SS 22

to be an unsafe structure; and 25

WHEREAS, on February 23, 2024, the City of Prattville Code Enforcement Officer sent 27
28
notice ordering the repair or demolition of the dilapidated structure at 809 Martin Luther King 29
30
Jr. Drive within 45 days of said notice; and 31
32
WHEREAS, said notice was delivered by certified mail in accordance with §11 -53B-3, 33
34
Code of Alabama, 1975, as amended; and 35
36
WHEREAS, Title 11, Chapter 53B allows the property owner or other interested parties 37
38
to file a written appeal within thirty (30) days of the date of notice with the City Clerk requesting 39
40
a hearing before the City Council of the City of Prattville; and 41
42
WHEREAS, no written request for a hearing was received within thirty (30) days of the 43
44
date of the notice; and 45
46
WHEREAS, §11-53B-4, Code of Alabama, 1975, as amended, authorizes the City 47
48
Council to determine whether or not the building or structure is unsafe to the extent that it is a 49
50
public nuisance; and 51
52
WHEREAS, no repairs have been made to the dilapidated structure located at 809 53
54
Martin Luther King Jr. Drive, and the structure remains unsafe and a public nuisance. 55
56
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 57
58
the dilapidated structure located at 809 Martin Luther King Jr. Drive continues to be unsafe and 59
60
a public nuisance that must be repaired or demolished. 61
62
BE IT FURTHER RESOLVED that the City Council instructs the Code Enforcement 63
64
Officer to provide a report of the cost to repair or demolish the dilapidated structure located at 1

BE IT ORDAINED by the City Council of the City of Prattville, that City of Prattville Code 9
10
of Ordinances is amended as follows: 11
12
Article I. – In General 13
Sec. 105-26. Schedule of permit fees. 14
15
(a) Permits—Generally. On all buildings, structures, electrical, plumbing, gas, and mechanical 16
systems, or alterations requiring a permit, an issuance fee of $25 .00 shall be paid plus an 17
additional amount in accordance with following schedules: 18
(1) Building permits. 19
Total Valuation Fee*
Up to $2,000.00 Issuance fee plus $25.00 if inspection required.
$2,001.00 to $15,000.00 Issuance fee for the first $2,000.00 plus $1.50 for each
additional thousand or fraction thereof, to and including
$15,000.00 plus $25.00 inspection fee.
$15,001.00 to $50,000.00 Issuance fee plus $30.00 for the first $15,000.00 plus $1.25
for each additional thousand or fraction thereof to and
including $50,000.00.
$50,001.00 to $100,000.00 Issuance fee plus $75.00 for the first $50,000.00 plus $1.00
for each additional thousand or fraction thereof, to and
including $100,000.00.
$100,001.00 to $500,000.00 Issuance fee plus $125.00 for the first $100,000.00 plus
$0.75 for each additional thousand or fraction thereof, to
and including $500,000.00.
$500,001.00 and up Issuance fee plus $425.00 for the first $500,000.00 plus
$0.50 for each additional thousand or fraction thereof.
*One-quarter of one percent (0.25%) shall be added to the final permit fee. 20

(2) Valuation. All fees for building permits shall be calculated on the basis of the true value 22
of the building, structure, addition or alteration. 23
a. Single-family residential structures. For new one- and two-family residential 24
structures, valuations shall be based o n the square footage of the structure and 25
calculated using the most recent building valuation data table published by the 26
International Code Council, Inc. (ICC) in effect on January 1 of each year. The 27
value per square footage shall be based on type of con struction as classified by 28
the ICC table. 29
b. Valuation for all structures other than single-family and two-family residential shall 30
be based on the actual value or contract price rounded up to next thousand dollars. 31
Permit valuations shall include total value of the contract, including material and 32
labor. 33
c. The building official may request all appraisal or contract information necessary to 34
determine the true value of the building, structure, addition or alteration. If, in the 35
opinion of the building official, the valuation is underestimated on the application, 36
the permit shall be denied, unless the applicant can show detailed estimates to 37
meet the approval of the building official. Final permit valuation shall be set by the 38
building official. 39
d. Projects with multiple general contractors shall designate one contractor or 40
construction manager for obtaining and paying for a building permit. 41

(4) Miscellaneous permits and fees. 1
a. Work prior to permit. Where work for which a permit is required by this chapter 2
commences prior to obtaining said permit, the permit fee herein specified shall be 3
doubled and a $250.00 administrative fee may be charged 4
b. Moving fee. For the relocation of any building or structure, the fee shall be $100.00 5
per section. 6
c. Demolition fee. For the demolition of any building or structure, the fee shall be 7
$25.00 per story. In addition, the application for a demolition shall be accompanied 8
by a $1,000.00 surety, which shall be refunded by the building official when all 9
demolition debris has been properly removed and the site has been properly 10
graded and stabilized. Said bond or cash deposit shall indemnify the City against 11
damage to the public streets and sidewalks, and against unwarranted litter and 12
debris allowed to remain on the premises, which constitutes a public nuisance. 13
Interior demolition shall be based on the contract value provided by the permittee. 14
d. Mobile or manufactured home. For the placement of any manufactured home 15
covered by the National Manufactured Housing Construction and Safety Standards 16
Act of 1974 (commonly known as the HUD Code), a fee of $100.00 shall be paid 17
prior to placement of the structure. The permit fee shall cover the inspection of 18
correct installation, flood hazard determination, electrical connection and plumbing 19
connection. 20
e. Plan review fee. A plan review fee shall be paid for the review of all multi-family, 21
commercial and industrial projects that require architectural plans. Said fee shall 22
be paid at the time said plans are submitted to the City planning and development 23
department. Plan review fee shall be calculated as $2.50 per $1,000.00 of building 24
valuation, with a minimum fee of $250.00 and a maximum of $10,000.00. 25
When determined by the building official or the fire marshal that it is necessary for 26
plan review to be performed by an outside party (e.g., International Code Council), 27
the full fee shall be paid by the owner or contractor to the outside party. 28
f. Re-inspection fee. A fee of $100.00 shall be paid for each re -inspection of a failed 29
second inspection. 30
g. Pursuant to Alabama Act 2015-308, the city shall assess a fee on all non-residential 31
construction work permitted within the City in the amount of $1.00 f or every 32
$1,000.00 of said non-residential construction work permitted. 33
The fees shall be collected by the city and shall be electronically remitted monthly 34
to the department of finance, division of construction management, by the 20th day 35
of the month following the issuance of the applicable permits as required by Act 36
2015-308. 37
h. Roofing permit. All work involving the replacement of a roof covering must be 38
permitted prior to work beginning. If work only involves the roof covering and 39
underlayment (e.g. new shingles) then only the issuance fee will be charged for the 40
permit. If the work includes any changes to decking or sheathing, rafters, or any 41
structural portion of the roof or greater structure, then a building permit must be 42
applied for and issued with applicable fees. 43

(5) Fee refunds. The Building Official shall authorize the refunding of fees as follows: 45
a. The full amount of any fee paid hereunder that was erroneously paid or collected. 46
b. Not more than 80 percent of the permit fee paid when no work has been done under 47
the permit issued in accordance with this chapter. 48
c. Not more than 80 percent of the plan review fee paid when an application for a 49
permit for which a plan review fee has been paid is withdrawn or cancelled before 50
the plan review has been completed. 51

(b) The Building Official shall not authorize the refunding of any fee paid except upon written 53
application filed with the City Planning and Development Department by the original 54
permittee. 55

BE IT FURTHER ORDAINED that the increase in fees shall become effective June 1, 57
