WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2024, 9
10
Page 080, that the abundance of overgrown grass and weeds at 1722 E. Main Street 11
12
constituted a public nuisance and set a Public Hearing on said nuisance; and 13
14
WHEREAS, the Autauga County tax records lists the property owners as HACM INC 15
16
with an address of 103 Par Circle, Fairhope, AL 36532, to Parcel number 19 06 14 1 002 17
18
002.000; and 19
20
WHEREAS, notice was provided to correct, remedy or remove overgrown grass and 21
22
weeds; and 23
24
WHEREAS, the owner of 1722 E. Main Street has failed and/or refused to correct, 25
26
remedy or remove said nuisance by the expiration of said notice; and 27
28
WHEREAS, the owner of said property did not file written objections with the City Clerk’s 29
30
Office within the time prescribed by City of Prattville Code of Ordinances, Section 46-114 (c); 31
32
and 33
34
WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on May 21, 35
36
2024, permitting the owner of said property to present evidence, objections and protest 37
38
regarding said nuisance; and 39
40
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, authorizes the 41
42
City to do such work or make such improvements that are necessary to correct, remedy or 43
44
remove such conditions, pay therefore and charge the expenses incurred to the owner of such 45
46
property. 47
48
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 49
50
declares that the overgrown grass and weeds at 1722 E. Main Street continues to be a 51
52
public nuisance at the expiration of the notice of violation. 53
54
BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds 55
56
at said property removed using City forces or private contractors. The property owner shall 57
58
have the right to remove said nuisance at their expense provided that the removal is done 59
60
prior to the commencement of work by employees or agents of the City of Prattville; however, 61
62
this does not abolish incurred fines and expenses. 63

BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 1

to this request and report such costs to the City Council following its abatement. 3

WHEREAS, keeping garbage and rubbish: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 625 E. Main Street; 18
19
and 20
21
WHEREAS, the Autauga County tax records list the property owner as Dorsey Motor 22
23
Sales Inc, with an address of P.O. Box 680738, Prattville, AL 36068, to Parcel Number 19 02 24
25
09 4 007 054.001; and 26
27
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 28
29
Code Enforcement Officer gave written notice to the owner of said property on April 23, 2024, 30
31
to correct, remedy or remove the condition of garbage and rubbish within ten (10) days; and 32
33
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 34
35
remove said condition by the expiration of said notice; and 36
37
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 38
39
Council to declare the keeping of garbage and rubbish to be a public nuisance and authorizes 40
41
the City to do such work or make such improvements that are necessary to correct, remedy or 42

WHEREAS, the City of Prattville operates the Pine Creek and Autauga Creek 9

Wastewater Treatment Facilities; and 11
12
WHEREAS, the City has implemented a MWPP Program as directed by law; and 13
14
WHEREAS, the Public Works Department staff has prepared the 2023 MWPP annual 15
16
reports for said wastewater treatment facilities. 17
18
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 19
20
does hereby acknowledge that the City Council has reviewed and submits the 2023 MWPP 21
22
annual reports for the City to ADEM. 23
24
BE IT FURTHER RESOLVED that the City, through its staff in the Wastewater Division 25
26
of the Public Works Department, shall continue to maintain the diligent monitoring of effluent 27
28
from the wastewater system and shall continue to treat wastewater effluent in the same manner 29
30
as they have in the past, in accordance with all Federal and State regulations. 31
32
BE IT FURTHER RESOLVED that the City will continue training programs as 33
34
recommended by the Public Works Director and as required by all applicable Federal or State 35
36
Government regulatory agencies. 37

longer needed for public or municipal purposes; and 9

WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the municipal 11

governing body to dispose of unneeded personal property. 13

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 15
16

needed for public or municipal purposes; and 9

WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the municipal 11

governing body to dispose of unneeded personal property. 13

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 15
16
the following personal property owned by the City of Prattville is no longer needed for public or 17
18
municipal purposes, and said property shall be removed from the inventory of Wastewater: 19

has authority to scrap or dispose of said vehicles for and on behalf of the City of Prattville. 30

WHEREAS, under the authority of Title 11, Chapter 53B, Code of Alabama, 1975, as 7

amended, on March 14, 2024, the City of Prattville Chief Building Official declared the 9
10
dilapidated structure at 114 8th Street, Parcel No. 19 03 08 1 007 017.000, to be an unsafe 11
12
structure; and 13
14
WHEREAS, on March 18, 2024, the City of Prattville Code Enforcement Officer sent 15
16
notice ordering the repair or demolition of the dilapidated structure at 114 8th Street within 45 17
18
days of said notice; and 19
20
WHEREAS, said notice was delivered by certified mail in accordance with §11-53B-3, 21
22
Code of Alabama, 1975, as amended; and 23
24
WHEREAS, Title 11, Chapter 53B allows the property owner or other interested parties 25
26
to file a written appeal within thirty (30) days of the date of notice with the City Clerk requesting 27
28
a hearing before the City Council of the City of Prattville; and 29
30
WHEREAS, no written request for a hearing was received within thirty (30) days of the 31
32
date of the notice; and 33
34
WHEREAS, §11-53B-4, Code of Alabama, 1975, as amended, authorizes the City 35
36
Council to determine whether or not the building or structure is unsafe to the extent that it is a 37
38
public nuisance; and 39
40
WHEREAS, no repairs have been made to the dilapidated structure located at 114 8th 41
42
Street, and the structure remains unsafe and a public nuisance. 43

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 45
46
the dilapidated structure located at 114 8th Street continues to be unsafe and a public nuisance 47
48
that must be repaired or demolished. 49

BE IT FURTHER RESOLVED that the City Council instructs the Code Enforcement 51
52
Officer to provide a report of the cost to repair or demolish the dilapidated structure located at 53
54
114 8th Street to the City Council. 55

WHEREAS, an abundance of overgrown grass and weeds: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 12
2. may cause the further spread of weeds; 13
3. may hide debris, such as glass or metal, that could inflict injury on a person going to such 14
property; 15
4. may also pose a fire hazard and respiratory hazard; and 16
17
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 18
19
the property and determined the existence of an abundance of overgrown grass and weeds 20
21
at 2305 Cobbs Ford Road and 119 Overlook Drive; and 22
23
WHEREAS, the Autauga/Elmore County tax records list the property owner(s) as 24
25
follows: 26
27
• 2305 Cobbs Ford Road – Store Master Funding VIII LLC, with an address of 828 28
Columbiana Road, Homewood, AL 35209, to Parcel Number 26 03 07 0 001 020.002 29
• 119 Overlook Drive – Cooper Harris E. & Christine with an address of 3523 Little John 30
Drive, Montgomery, AL 36109, to Parcel Number 19 05 15 4 001 013.000; and 31

WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 33
34
Code Enforcement Officer gave written notice to the owner(s) of said property on April 12, 35
36
2024 and April 25, 2024 respectively, to correct, remedy or remove the abundance of 37
38
overgrown grass and weeds within ten (10) days; and 39
40
WHEREAS, the owner(s) of said property has failed and/or refused to correct, remedy 41
42
or remove said condition by the expiration of said notice; and 43
44
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 45
46
Council to declare the abundance of overgrown grass and weeds to be a public nuisance and 47
48
abate the same; and 49
50
WHEREAS, pursuant to Section 46-114 (e), City of Prattville Code of Ordinances, 51
52
declaring the abundance of overgrown grass and weeds to be a public nuisance and ordering 53
54
their abatement by the City Council initiates a fine for the first violation and designation on the 55
56
repeat offender registry. 57
58
NOW, THEREFORE, BE IT RESOLVED THAT: 59
60
1. the City Council of the City of Prattville declares the abundance of overgrown grass and 61
weeds at said properties to be a public nuisance and has therefore initiated the abatement 62
process; and 63
2. the owner(s) of said properties are ordered to abate said nuisance and appear before the 1
City Council at a Public Hearing at 6:00 p.m. on June 18, 2024, at Prattville City Hall; and 2
3. any objections may be filed, in writing, to the City Clerk at least five (5) days prior to the 3
Public Hearing; and 4
4. the fine of $100.00 shall be assessed to the owner(s) of said properties in addition to any 5
costs incurred for the abatement process; and 6
5. said properties shall be placed on the repeat offender registry for a period of three (3) years; 7
and 8
6. the notice of Public Hearing on the matter, as required by law, will be provided in a 9
publication of general circulation, by certified mail, and by signage on the subject property. 10

WHEREAS, an application was filed with the Elmore County Commission (the 7
8
“Commission”), the governing body of Elmore County (the “County”), requesting authority to 9
10
incorporate and organize a public corporation as an improvement district under the name of 11
12
“The Riverfell Improvement District” (the “District”) pursuant to the provisions of the statutes 13
14
codified as Chapter 99A of Title 11 of the Code of Alabama 1975, as amended, as heretofore 15
16
or hereafter amended or supplemented (the “Act”); 17
18
WHEREAS, the Commission has authorized the formation of the District; 19
20
WHEREAS, Section 11-99A-4(b) of the Act provides that (i) no land proposed to be 21
22
included within the District may be within the municipal limits of any municipality or (ii) no land 23
24
proposed to be included within the District may be within the territorial jurisdiction under 25
26
Section 11-52-30(a) of the Code of Alabama, 1975, as amended, of any municipal planning 27
28
commission except with the consent of that municipality; 29
30
WHEREAS, portions of the land proposed to be included within the District may be 31
32
within the municipal limits and/or the territorial jurisdiction under Section 11-52-30(a) of the 33
34
Code of Alabama, 1975, as amended, of the municipal planning commission of the City of 35
36
Prattville, Alabama (the “City”); 37
38
WHEREAS, the City Council believes it is expedient that the City consent to formation 39
40
of the District in accordance with Section 11-99A-4 of the Act. 41
42
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 43
44
does hereby consent to the formation of the District in accordance with Section 11-99A-4 of the 45
46
Act, notwithstanding the fact that portions of the land proposed to be included within the its 47
48
and/or the territorial jurisdiction under Section 11-52-30(a) of the Code of Alabama, 1975, as 49
50
amended, of the municipal planning commission of the City. 51

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 53
54
all documents necessary to carry out the intent of this Resolution. 55

BE IT ORDAINED by the City Council of the City of Prattville, that Chapter 46, Article 9
10
IV., City of Prattville Code of Ordinances is hereby amended as follows: 11
12
Sec. 46-98. - Definitions. 13
The following words, terms and phrases, when used in this article, shall have the meanings 14
ascribed to them in this section, except where the context clearly indicates a different 15
meaning: 16
Property means any real property which is not a street or highway. 17
Street or highway means the entire width between the boundary lines of every way 18
publicly maintained when any part thereof is open to the use of the public for purposes 19
of vehicular travel. 20
Vehicle means a machine propelled by power other than human power designed to 21
travel along the ground by use of wheels, treads, runners, or slides, and transport 22
persons or property or pull machinery and shall include, without limitation, automobile, 23
truck, trailer, motorcycle, tractor, buggy and wagon. The term "vehicle" includes any 24
boat or vehicle designed to be used on waterways, lakes, rivers, or any other large 25
body of water. The term "vehicle" refers to a vehicle legally or physically incapable of 26
being operated, which includes one that does not have an attached current tag. 27
28
Sec. 46-99. - Maximum time on streets. 29
No person shall abandon any vehicle. It shall be presumed that any vehicle that has been left 30
at any place on a street or highway within the City for a period of 72 hours consecutively is 31
an abandoned vehicle. 32
33
Sec. 46-100. - Leaving wrecked, nonoperating vehicle on street. 34
No person shall leave any partially dismantled, nonoperating, wrecked or junked vehicle on 35
any street or highway within the City. 36
37
Sec. 46-101. - Disposition of wrecked or discarded vehicles on property; exceptions. 38
No person in charge or control of any property within the City, whether as owner, tenant, 39
occupant, lessee, or otherwise, shall allow any partially dismantled, nonoperating, wrecked, 40
junked, or discarded vehicle to remain on such property longer than seven days; and no 41
person shall leave any such vehicle on any property within the City for a time longer than 42
seven days; except that this section shall not apply with regard to a vehicle in an enclosed 43
building, a vehicle on the premises of a business enterprise operated in a lawful place and 44
manner when necessary to the operation of such business enterprise or a vehicle in an 45
appropriate storage place or depository maintained in a lawful place and manner by the City, 46
or to vehicles in a duly licensed junkyard. 47
48
Sec. 46-102. - Impounding. 49
The Chief of Police or any member of the Police Department designated by the Chief is 50
hereby authorized to remove or have removed by a local wrecker service any vehicle left at 51
any place within the City which reasonably appears to be in violation of this article. Any 52
vehicle so taken up and removed shall be stored at a secured local wrecker lot. A permanent 53
record giving the date of the taking of each vehicle shall be kept by the Prattville Police 54
Department. The owner of any vehicle so impounded will be solely responsible for all costs 55
and fees associated with such impoundment. 56
57
Sec. 46-103. - Reclamation by owner. 58
The owner of any abandoned vehicle removed by the Police Department as provided 59
in Section 46-102 may regain possession thereof from the City by making application therefor 60
within two months after its receipt by the City upon paying to the City all reasonable costs of 61
removal, which shall be repaid to the person who paid or incurred such charges, plus any 62
additional charges levied by the local wrecker service for storage charges of the vehicle while 63
in possession of the local wrecker. 64
Sec. 46-104. - Sale of unclaimed vehicles; disposition of proceeds. 1
If no claim for the abandoned vehicle is made within two months after it is received by the 2
City, the City may sell the vehicle for the best price obtainable as junk or otherwise, as 3
provided in Code of Alabama 1975, as amended, § 32-13-1 et seq. The proceeds shall be 4
available to pay the reasonable charges of delivering the same to the City if a claim therefor 5
is made by the person who paid the charges and the expense of keeping and disposing of 6
the vehicle; any balance shall be held and disposed of as provided in Code of Ala. 1975, § 7
32-13-6. 8

Sec. 46-105. - Liability for damage following removal. 10
Neither the owner, lessee or occupant of the premises from which any abandoned vehicle 11
shall be removed under the provisions of this article, or any servant or agent thereof, or the 12
City, shall be liable for any loss or damage to such vehicle while being removed, or while in 13
the possession of the City, or as a result of any subsequent sale or other disposition. 14
15
BE IT FURTHER ORDAINED by the City Council that Chapter 46, Article IV., City of 16
17
Prattville Code of Ordinances is hereby amended to establish the following: 18
19
Sec. 46-106. – Regulation of Vehicles in Residential Areas. 20
A. Prohibition. It shall be unlawful for any person, either as owner, agent, occupant, 21
lessee, tenant, invitee, licensee, or otherwise to park, store, keep, harbor, stop, deposit 22
a vehicle or allow, cause or permit such a vehicle to be parked, stored, kept, harbored, 23
stopped, or deposited within any zoned residential area of the City of Prattville in the 24
following manners: 25
1. In front of a residence, except under the following conditions: 26
a. Within the boundaries of the designated driveway. 27
b. Adjacent to the driveway along the street, opposite the front door of the 28
residence, and with the flow of traffic provided such vehicles do not 29
violate section 46-99 for maximum time on streets. 30
2. In the rear of a residence, for no more than 72 consecutive hours, unless the 31
rear yard is enclosed by a 6-foot-tall opaque fence. 32
3. No vehicle shall be parked or stored upon a vacant parcel of land that does not 33
have a principal structure for no more than 72 consecutive hours. 34
4. No vehicle shall, at any time, be in a state of major disassembly, disrepair, or in 35
the process of being stripped or dismantled, unless such work is being 36
performed inside of an enclosed garage or similarly enclosed area designed for 37
such purposes or concealed to the rear of the residence behind a 6-foot-tall 38
opaque fence as listed above. 39

B. Exceptions. 41
1. Limited Use. For the purposes of this section, parking in the front yard, as 42
restricted by subsection (A)(1), shall not be prohibited where the motor vehicle is 43
parked for the limited purpose of loading, unloading, or washing. This exception 44
shall only apply while the owner or operator of the motor vehicle is actively 45
engaged in the said task, and in no event shall this exception apply for no more 46
than a 72 consecutive hour time period. 47
2. Special Events / Functions. The prohibitions of this section shall not apply to 48
vehicles legally parked for the purposes of a special event or organized function 49
(including but not limited to holiday gatherings, birthday parties, celebrations of 50
life, etc.). This exception shall only apply while the owner or operator of the motor 51
vehicle in question is in physical attendance of such an event or function and the 52
parking of the vehicle for no more than 72 consecutive hours. 53
3. Emergency Vehicles. Furthermore, the prohibitions of this section shall not 54
apply to authorized emergency vehicles parked while emergency personnel are 55
engaged in answering a call or rendering assistance. Authorized emergency 56
vehicles shall include police and fire vehicles, as well as ambulances and 57
hearses. 58
4. Historic Districts. The provisions of this section shall not operate to allow the 59
construction of driveways or the use of property in historic districts which 60
conflicts with the rules and regulations governing land use in those districts. 61

C. Enforcement. The Chief of Police, or his duly appointed designee, shall be charged with 1
the enforcement of this section. For any property found to be in violation, notice shall be 2
given, and the registered owner of the vehicle shall have ten (10) calendar days within 3
which to bring the property into compliance. 4
1. Impounding. Refer to Section 46-102. 5
a. Liability for Damage Following Removal. No agent or servant of the City, 6
shall be liable for any loss or damage to such vehicle while being 7
removed, or while being stored in accordance with this Ordinance or 8
other disposition as defined in Sec. 46-105. 9
2. Penalty for violation. In addition to any cost incurred for the removal of any 10
vehicle by a local wrecker service in Section C(1), there shall be assessed the 11
following fines to the owner of the vehicle: 12
• For the first violation, a fine of $100.00 shall be assessed. 13
• For the second violation, a fine of $200.00 shall be assessed. 14
• For the third or any subsequent violation a fine of $300.00 shall be 15
assessed. 16
a. The fines for this violation will be paid to the City of Prattville Municipal Court. 17
After the Municipal Court has received payment and issued a receipt for said 18
fine, the owner of the vehicle will be able to retrieve his/her vehicle from the 19
local wrecker service where it is stored. The above fines apply individually 20
for each vehicle for this section. 21

THIS Ordinance shall become effective upon its passage and execution as provided by 23
24
law. 25

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows: 10

Section 1. In conformity with the provisions of §40-23-210 through §40-23-213, Code of 12
Alabama, 1975, as amended, providing for a State Sales Tax Holiday, the City of Prattville, 13
Alabama, exempts “covered items” from municipal sales and use tax during the same period, 14
beginning at 12:01 a.m. on the third Friday in July (July 19, 2024) and ending at twelve midnight 15
the following Sunday (July 21, 2024). 16

Section 2. This Ordinance shall be subject to all terms, conditions, definitions, time periods, 18
and rules as provided by §40-23-210 through §40-23-213, Code of Alabama, 1975, as 19
amended, except that the time period shall only be as specified in Section 1 above and not for 20
all years thereafter. 21

Section 3. The City Clerk is hereby authorized and directed to certify a copy of this Ordinance 23
under the seal of the City of Prattville, Alabama, and to forward said certified copy to the 24
Alabama Department of Revenue to be recorded and posted on the department website. 25

Montgomery Metropolitan Organization through ALDOT for Project Number STPMN-0115(252) 16

to make improvements to Fairview Avenue from SR-3 to Jasmine Trail to include the widening 18

to add turn lanes, resurfacing and traffic signal improvements; and 20

WHEREAS, in Resolution Book 2020-A, Page 151, on October 6, 2020, the City Council 22

authorized the Mayor to enter into a funding agreement with the State of Alabama through 24
25
ALDOT for Project # STPMN-0115(252) for said project; and 26

WHEREAS, the total project cost is $6,044,625.06 (net cost to City $2,844,625.06); 28

WHEREAS, funds have been budgeted in the Capital Projects Fund. 32

WHEREAS, specifications were drafted for said improvements; and 13

WHEREAS, three (3) sealed bids were received, opened and read in public on May 14, 15
16
2024, at 2:00 p.m. in the Council Chambers at City Hall, and Construction One, Inc. was the 17

lowest responsible bidder at a cost not to exceed $1,574,686.00 for said project; and 19

WHEREAS, this is a budgeted expense in the Capital Projects Fund. 21

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 23

hereby awards Bid No. 024-004 to Construction One, Inc. in an amount not to exceed 25

WHEREAS, Sain Associates, Inc. has the expertise to provide said engineering services 17

WHEREAS, §39-2-2(d)(1), Code of Alabama, 1975, as amended, allows contracts to 21

secure services with engineers possessing a high degree of professional skill to be let without 23
24
bidding; and 25
