Members present were Mayor Bill Gillespie, Councilman John Chambers, Chairman Reuben Gardner, Deputy Fire Marshal Craig Allen, Mr. Robert King, and Mr. Mugs Mullins. Vice-Chairman Ken Daniel, Mrs. Paula Carpenter, and Mr. Seth Hayden were absent. (Quorum present) Staff present: Mr. Scott Stephens, City Planner; Mr. Joshua McKinney, Ms. Bria Hudson; Planners, and Ms. Alisa Morgan, Secretary. Minutes: Mr. Mullins moved to approve the minutes of the March 21, 2024 regular meeting. Chief Allen seconded the motion. The motion passed unanimously. Committee Reports: None Old Business: There was no old business to discuss. New Business: 1. Preliminary Plat: Dorsey Plat 1 Location: 621 E Main Street Owner: Richard Taylor Dorsey Representative: Hutton ST 21, LLC Ms. Hudson introduced the preliminary plat of Dorsey Plat 1. She stated that the plat proposes to reconfigure the interior property lines. The petitioner is requesting waivers to the sidewalks and curb and gutter requirements. Chairman Gardner opened the floor for public comments. There were none to speak. The public hearing was closed. Mr. Mullins introduced a resolution approving the requested waivers for the preliminary plat of Dorsey Plat 1 and moved for its approval. Mr. Allen seconded the motion. In their discussion, Mayor Gillespie stated that sidewalks are proposed for this area in the future and he is not in favor of waiving the requirements to install them in this area. Chairman Gardner disagreed stating that the developer should not be required to place sidewalks in the area since there are none existing at this time. Mr. Stephens stated that the petitioner was made aware of the future plans for sidewalks in the area. After their discussion, the vote was called. The motion to approve the waivers failed by 1/5 vote as recorded. Favor: Chairman Gardner. Opposed: Mayor Gillespie, Mr. Mullins, Mr. Allen, Mr. King, and Councilman Chambers. Miriam Smith Robinson of Hutton, petitioner’s representative, asked questions about the vote and the requirements of the sidewalk length. Mayor Gillespie seconded the motion. The motion to approve failed by 5/1 vote as recorded. Favor: Mr. Mullins, Mr. Allen, Mr. King, Councilman Chambers, and Mr. King. Opposed: Chairman Gardner. Chairman Gardner offered to reconsider his vote. The vote was called again and the motion to approve the preliminary plat without waivers passed unanimously. 2. Preliminary Plat: Campbell Champion Plat 1 Location: 203 Ridgewood Road Owner: Gregory Lyn Campbell Representative: Alabama Land Surveyors, Inc. Mr. McKinney introduced the preliminary plat of Campbell Champion Plat 1. He stated that the proposed plat proposes to move interior lot lines. The petitioner is requesting waivers to the sidewalks and curb and gutter requirements. Chairman Gardner opened the floor for public comments. There were none to speak. The public hearing was closed. Mr. Allen introduced a resolution approving the requested waivers for the preliminary plat of Campbell Champion Plat 1 and moved for its approval. Mr. Mullins seconded the motion. The motion to approve passed unanimously. Mr. Allen introduced a resolution approving the preliminary plat of Campbell Champion Plat 1 with requested waivers and moved for its approval. Mr. Mullins seconded the motion. The motion to approve passed unanimously. 3. Preliminary Plat: Camellia Corner Location: 200 Camellia Drive Owner: Whitney Morgan Representative: Elizabeth Jordan Mr. McKinney introduced the preliminary plat of Camellia Corner. He stated that this is a replat for single family designation of a lot that was previously platted in 1961 and designated as Park. The applicant is requesting a waiver from installing sidewalks and curb and gutter. Councilman Chambers introduced a resolution approving the requested waivers for the preliminary plat of Camellia Corner and moved for its approval. Mr. Mullins seconded the motion. Mayor Gillespie moved to amend the motion to approve the waiver for no sidewalks, add curb and gutter on the south side of the lot. The motion failed for a lack of a second. Elizabeth Jordan, 741 Sweet Ridge Rd., petitioner, presented the preliminary plat for Camellia Corner. Dollie Burkhalter, 513 Woodvale Rd, stated that the property should remain a park as intended. The motion to approve the waiver failed by 5/1 vote as recorded. Favor: Mr. Mullins, Mr. Allen, Councilman Chambers, and Mr. King. Opposed: Mayor Gillespie. Mayor Gillespie offered to reconsider his vote. Councilman Chambers moved to reconsider the vote on the waiver request. Mr. Mullins seconded the motion. The motion passed unanimously. The vote was called and the motion to approve the waivers passed unanimously. Mr. Allen seconded the motion. The motion to approve passed unanimously. 4. Preliminary Plat: Randall Bishop Plat 1 This item is postponed as requested by the petitioner. 5. Zoning Amendment: R-3 to Institutional Parcel B-3 Location: McQueen Smith Road Owner: H D & D Land Company, LLC Representative: Goodwyn, Mills, & Cawood, LLC. Mr. Stephens introduced the next two zoning amendments that are requesting to be rezoned to Institutional. He stated that Institutional zoning was adopted with the latest Zoning Ordinance update and this is the first request since that adoption. He explained the purpose and the uses allowed in Institutional Zoning. Mr. McKinney provided the staff report for the proposed zoning amendment for Parcel B-3 located off McQueen Smith Road. He stated that the petitioner is requesting to rezone the property from R-3 Single Family Residential to Institutional zoning. The property is located south of the YMCA and the request is inline with the Future Land Use Map. Chairman Gardner opened the floor for public comments. Judy Jones of Goodwyn, Mills & Cawood, petitioner’s representative presented the rezoning request. She stated that there currently is no planned use. There were no other comments. The public hearing was closed. Correspondence was received from Patrick White. (Attached and made a part of the minutes). Mr. King introduced a resolution recommending approval of the rezoning of Parcel B-3 from R-3 to Institutional and moved for its approval. Mr. Mullins seconded the motion. The motion to approve passed unanimously. 6. Zoning Amendment: R-3 to Institutional Parcel B1-A Location: McQueen Smith Road S, Jay Street Extension Owner: H D & D Land Company, LLC Representative: Goodwyn, Mills, & Cawood, LLC. Mr. McKinney provided the staff report for the proposed zoning amendment for Parcel B1-A located near McQueen Smith Road and the future Jay Street extension. Councilman Chambers introduced a resolution recommending approval of the rezoning of Parcel B1-A from R-3 to Institutional and moved for its approval. Mr. King seconded the motion. The motion to approve passed unanimously. The vote was called. The motion to approve passed unanimously. 7. She stated that the petitioner is requesting to rezone the property from FAR, Forest, Agricultural, Recreation to B-2, General Business. Chairman Gardner opened the floor for public comments. Judy Jones, petitioner’s representative, presented the rezoning request. She stated that there currently is no planned use. Katherine Evan, representative for the residents of the McClain Landing Subdivision spoke in opposition of the rezoning amendment. Mike Hobby, 709 Harbin Drive, spoke in opposition to the rezoning amendment. He stated that a significant buffer needs to be in place between the proposed B-2 property and the existing subdivision. After no further comments, the public hearing was closed. Mr. Allen introduced a resolution recommending approval of the rezoning of Parcel 5-B from FAR to B-2 and moved for its approval. Mr. Mullins seconded the motion. The motion to approve passed unanimously. Main St. Prattville, AL 36067 RE: Planned Urgent Care Medical Office, 621 East Main Street, Prattville, AL (the “Project”) Mr. Stephens I am writing to request that Hutton be granted a waiver from the subdivision requirement for curb, gutter and sidewalk along the right of way of East Main Street for the above- described project. The Project lies mid-block on an expanse of East Main Street in which none of the other properties have curb, gutter, or sidewalks. The right of way of East Main Street is quite a bit wider than the actual road leading to a very wide grassy shoulder between the Project and the paved road. If sidewalk, curb and gutter were to be added at just the Project’s location it could not be used for the foreseeable future, and there is a decent chance that at some future point, when sidewalks, curb and gutter are employed along the full length of East Main Street, they would not be in the locations we would install them resulting in those we installed having to be removed and replaced. All, Unfortunately I will be out of town for this meeting however I wanted to raise my concerns over three of the proposed rezoning efforts, two on McQueen Smith Rd from residential to institutional, and one on South Memorial from FAR too Commercial. All three of the requests state there are no planned uses for the land and consequently I question the need to address the zoning until such time as a use is identified. Regarding the third request, I find it interesting the same company made all three yet failed to cite the 2040 plan as justification for the third. As a member of the team responsible for putting together the 2040 plan, I argue that it represents the vision of the residents of Prattville and should not be altered without significant justification which has not been shown in this case. The plan identified the South Memorial plot as residential and it should remain that way until such time as the applicant can show sufficient reason why they know better than the citizens of this city how the land should be used. I would like to voice my objection to all three of these changes at this time. COMPREHENSIVE PLAN / FUTURE LAND USE MAP: On April 15, 2021, the Planning Commission adopted an updated Prattville Comprehensive Plan. The Future Land Use Plan and Map in Land Use + Transportation section (pg. 40) of the document shows the subject parcel in an Institutional zone. The boundaries of land use categories shown on the Future Land Use map should not be interpreted rigidly, but the general pattern should be observed to support comfortable transitions between uses. PLANNING STAFF COMMENTS The applicant wants to rezone the parcel from R-3 into Institutional. The applicant does not currently propose any additional changes to the property. It is south of new, under constructions elementary school (institutional use) and adjacent to the east of the Smith Center (institutional use). The property has approximately 520ft of frontage on S Memorial Drive (Hwy 31), which is its only street frontage. The adjacent uses to the west are commercial. Note that the Zoning Ordinance requires any proposed commercial uses adjacent to residential uses to install additional landscaping buffers between the uses.
