WHEREAS, the Alabama Municipal Insurance Cooperation has identified a need for a 8
9
Special Called Meeting for the Election of Board Members on July 10, 2024, at 2:00 p.m. in 10
11
Montgomery, Alabama; and 12
13
WHEREAS, each member municipality is entitled to designate one voting delegate, and 14
15
first and second alternate voting delegates, to represent their municipality; and 16
17
WHEREAS, it is the desire of the City of Prattville to name a delegate to ensure its voting 18
19
participation at the Special Meeting. 20
21
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 22
23
Councilor Michael Whaley is hereby designated as the voting delegate for the City of Prattville. 24
25
BE IT FURTHER RESOLVED that Councilor Marcus Jackson be hereby designated as 26
27
the alternate voting delegate for the City of Prattville. 28

WHEREAS, an abundance of overgrown grass and weeds: 9
10
1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, mosquitoes, and other vermin; 12
2. may cause the further spread of weeds; 13
3. may hide debris, such as glass or metal, that could inflict injury on a person going to such 14
property; 15
4. may also pose a fire hazard and respiratory hazard; and 16
17
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 18
19
the property and determined the existence of an abundance of overgrown grass and weeds 20
21
at 1722 E. Main Street; and 22
23
WHEREAS, the Autauga County tax records list the property owner as HACM INC with 24
25
an address of 103 Par Circle, Fairhope, AL 36532, to Parcel number 19 06 14 1 002 002.000; 26
27
and 28
29
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 30
31
Code Enforcement Officer gave written notice to the owner(s) of said property on February 29, 32
33
2024, to correct, remedy or remove the abundance of overgrown grass and weeds within ten 34
35
(10) days; and 36
37
WHEREAS, the owner(s) of said property have failed and/or refused to correct, remedy 38
39
or remove said condition by the expiration of said notice; and 40
41
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 42
43
Council to declare the abundance of overgrown grass and weeds to be a public nuisance and 44
45
abate the same; and 46
47
WHEREAS, pursuant to Section 46-114 (e), City of Prattville Code of Ordinances, 48
49
declaring the abundance of overgrown grass and weeds to be a public nuisance and ordering 50
51
its abatement by the City Council initiates a fine for the first violation and designation on the 52
53
repeat offender registry. 54
55
NOW, THEREFORE, BE IT RESOLVED THAT: 56
57
1. the City Council of the City of Prattville declares the abundance of overgrown grass and 58
weeds at said property to be a public nuisance and has therefore initiated the abatement 59
process; and 60
2. the owner(s) of said property is ordered to abate said nuisance and appear before the City 61
Council at a Public Hearing at 6:00 p.m. on July 2, 2024, at Prattville City Hall; and 62
3. any objections may be filed, in writing, to the City Clerk at least five (5) days prior to the 63
Public Hearing; and 64

4. the fine of $100.00 shall be assessed to the owner(s) of said property in addition to any 1
costs incurred for the abatement process; and 2
5. said property shall be placed on the repeat offender registry for a period of three (3) years; 3
and 4
6. the notice of Public Hearing on the matter, as required by law, will be provided in a 5
publication of general circulation, by certified mail, and by signage on the subject property. 6

WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2024, 9
10
Page 088, that the abundance of overgrown grass and weeds at 116 Newby Street constituted 11
12
a public nuisance and set a Public Hearing on said nuisance; and 13
14
WHEREAS, the Autauga County tax records lists the property owners as Ezelle Willie 15
16
Jr & Deramus Deanton with an address of 116 Newby Street, Prattville, AL 36067, to Parcel 17
18
number 19 03 08 1 006 016.000; and 19
20
WHEREAS, notice was provided to correct, remedy or remove overgrown grass and 21
22
weeds; and 23
24
WHEREAS, the owner of 116 Newby Street has failed and/or refused to correct, 25
26
remedy or remove said nuisance by the expiration of said notice; and 27
28
WHEREAS, the owner of said property did not file written objections with the City Clerk’s 29
30
Office within the time prescribed by City of Prattville Code of Ordinances, Section 46-114 (c); 31
32
and 33
34
WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on June 4, 35
36
2024, permitting the owner of said property to present evidence, objections and protest 37
38
regarding said nuisance; and 39
40
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, authorizes the 41
42
City to do such work or make such improvements that are necessary to correct, remedy or 43
44
remove such conditions, pay therefore and charge the expenses incurred to the owner of such 45
46
property. 47

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 49
50
declares that the overgrown grass and weeds at 116 Newby Street continues to be a 51
52
public nuisance at the expiration of the notice of violation. 53
54
BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds 55
56
at said property removed using City forces or private contractors. The property owner shall 57
58
have the right to remove said nuisance at their expense provided that the removal is done 59
60
prior to the commencement of work by employees or agents of the City of Prattville; however, 61
62
this does not abolish incurred fines and expenses. 63

WHEREAS, a need has been identified for an outdoor venue around 124 W. Main Street 9

to promote economic development and provide a public facility for entertainment; and 11

WHEREAS, specifications were drafted for said improvements; and 13
14
WHEREAS, four (4) sealed bids were received, opened and read in public on May 23, 15
16
2024, at 2:00 p.m. in the Council Chambers at City Hall, and Construction One, Inc. was the 17
18
lowest responsible bidder at a cost not to exceed $3,742,645.00 for said project; and 19
20
WHEREAS, this is a budgeted expense in the Capital Projects Fund. 21
22
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 23
24
the FY2024 Budget is hereby amended as follows: 25

Decrease General Fund/ Departmental Reserves $250,000.00 27
Decrease General Fund/ Bank Building Reserves $584,604.00 28
Decrease Facilities Maintenance/ Capital Outlay $314,000.00 29

WHEREAS, E & L Masonry, Inc. has the expertise to refurbish said wall at a cost not to 12

exceed $85,000.00; and 14

WHEREAS, pursuant to §39-2-1, Code of Alabama, 1975, as amended, said project is 16
17
a public works project; and 18
19
WHEREAS, §39-2-2, Code of Alabama, 1975, as amended, allows contracts for public 20
21
works projects under $100,000.00 to be let without bidding; and 22
23
WHEREAS, this is a budgeted expense in Parks and Recreation. 24

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 26
27
funds in an amount not to exceed $85,000.00 for said project are hereby authorized and 28
29
approved to be paid to E & L Masonry, Inc., and said funds are approved and appropriated 30

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows: 3

THAT the zoning ordinance of the City of Prattville, Alabama, and the zoning map are 5

hereby amended to reclassify the property described in Attachment “A” from R-2 to O-1; and 7
8
THAT this proposed Ordinance and a synopsis were advertised for two (2) weeks in the 9
10
Montgomery Advertiser, a newspaper of general circulation within the Corporate Limits of the 11
12
City of Prattville, and that the City Council at its Public Hearing on July 2, 2024, at 6:00 p.m., 13
14
considered said proposed Ordinance and that at such time and place all persons who desired 15
16
had an opportunity to be heard in favor of or in opposition to such Ordinance. 17
18
ALL other items and provisions of the zoning ordinance not herein specifically amended 19
20
shall remain in full force and effect. 21
22
THE amendments herein contained were considered and recommended by the City of 23
24
Prattville Planning Commission on May 16, 2024. 25
26
THIS Ordinance shall become effective upon its passage and execution as provided by 27
28
law. 29

WHEREAS, the Fire Department is hosting a regional fire recruit school; and 8

WHEREAS, the Fire Department has identified the need to maximize departmental 10
11
certification training for additional personnel; and 12
13
WHEREAS, the hiring of additional personnel would allow recruits to attend training 14
15
locally and save on added travel, meals and lodging expenses; and 16
17
WHEREAS, said personnel includes three (3) Firefighters; and 18
19
WHEREAS, the Fire Department is under budget in salaries and wages and 20
21
associated accounts due to retirements and attrition; and 22
23
WHEREAS, funding for additional positions is available in the appropriate accounts in 24
25
the FY2024 budget. 26
27
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 28
29
hereby authorizes the hiring of said additional personnel and funds are to be paid from the 30
31
appropriated FY2024 Budget Line Items Salaries & Wages, FICA, Retirement, Group Health, 32
33
and Group Life for the Fire Department. 34

BE IT FURTHER RESOLVED that the Human Resources Department is authorized to 36
37
implement the hiring process. 38

WHEREAS, the Governmental Accounting Standards Board (“GASB”) sets accounting 9
10
standards for state and local governments and issues statements setting forth such standards; 11
12
and 13

WHEREAS, GASB Statement 75 requires state and local governments providing other 15
16
post-employment benefits (“OPEB”) to account for and report such benefits in accordance with 17
18
GASB guidelines; and 19
20
WHEREAS, an actuarial valuation is required to comply with GASB Statement 75; and 21
22
WHEREAS, the City of Prattville provides OPEB in the form of retiree participation in 23
24
the City’s health insurance plan; and 25
26
WHEREAS, the City is thereby required to have an actuarial valuation of its OPEB 27
28
liability in order to comply with the requirements of GASB Statement 75; and 29
30
WHEREAS, Fontenot Benefits & Actuarial Consulting (FBAC) has the expertise to 31
32
perform said services at a cost not to exceed $6,000.00 to be billed over a two-year period; 33
34
and 35
36
WHEREAS, this is a budgeted expense for the Finance Department. 37
38
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 39
40
funds in an amount not to exceed $6,000.00 are hereby authorized and approved to be paid to 41
42
FBAC over the two-year service period, and said funds are approved and appropriated from 43
44
the FY2025 and FY2026 Budget Line Item Finance Department/ Accounting. 45

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 47

all documents necessary to carry out the intent of this Resolution. 49

WHEREAS, the City of Prattville has a need for employee rental uniforms, shop 9

towels, mats and mop handles/heads for certain departments; and 11

WHEREAS, the current agreement with UniFirst Corporation entered into on 13

November 15, 2022, authorized in Resolution Book 2022-B Page 233, has expired; and 15
16
WHEREAS, UniFirst Corporation has the ability to provide said rental uniforms and 17
18
supplies through Sourcewell Purchasing Cooperative Contract No. 040920-UFC at an 19
20
approximate cost of $1,200.00 per week; and 21
22
WHEREAS, rental uniforms and supplies are budgeted departmental expenses. 23
24
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 25
26
hereby authorizes the Mayor to enter into an Agreement with UniFirst Corporation until May 27
28
22, 2025, for employee uniforms, rental mats and supplies for various City departments. 29
30
BE IT FURTHER RESOLVED that the City Council hereby approves and appropriates 31
32
funding from FY2024 Budget Line Item Uniforms for the various departments. 33
34
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 35
36
all documents necessary to carry out the intent of this Resolution. 37
