WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2024- 9
10
A, Page 115, that the abundance of overgrown grass and weeds at 2305 Cobbs Ford Road 11
12
and 119 Overlook Drive constituted a public nuisance and set a Public Hearing on said 13
14
nuisance; and 15
16
WHEREAS, the Elmore and Autauga County tax records list the property owners as 17
18
follows: 19
20
• 2305 Cobbs Ford Road – Store Master Funding VIII LLC, with an address of 828 21
Columbiana Road, Homewood, AL 35209, to Parcel Number 26 03 07 0 001 020.002 22
• 119 Overlook Drive – Cooper Harris E. & Christine with an address of 3523 Little John 23
Drive, Montgomery, AL 36109, to Parcel Number 19 05 15 4 001 013.000; and 24
25
WHEREAS, notice was provided to correct, remedy or remove the overgrown grass and 26
27
weeds; and 28
29
WHEREAS, the owners of said properties have failed and/or refused to correct, remedy 30
31
or remove said nuisance by the expiration of said notice; and 32
33
WHEREAS, the owners of said properties did not file written objections with the City 34
35
Clerk’s Office within the time prescribed by City of Prattville Code of Ordinances, Section 46- 36
37
114 (c); and 38
39
WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on June 18, 40
41
2024, permitting the owners of said properties to present evidence, objections and protest 42
43
regarding said nuisance; and 44
45
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, authorizes the 46
47
City to do such work or make such improvements that are necessary to correct, remedy or 48
49
remove such condition, pay therefore and charge any expenses incurred for the abatement 50
51
process to the owners of such properties. 52
53
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 54
55
declares that the overgrown grass and weeds at said properties continued to be a public 56
57
nuisance at the expiration of the notice of violation. 58
59
BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds 60
61
at said properties removed using City forces or private contractors. The property owners shall 62
63
have the right to remove said nuisance at their expense provided that the removal is done 64
prior to the commencement of work by employees or agents of the City of Prattville; however, 1

this does not abolish incurred fines and expenses. 3
4
BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 5
6
to this request and report such costs to the City Council following its abatement. 7

WHEREAS, keeping garbage and rubbish: 9
10
1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 279 Gardner Road; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Colindres Yesser 20
21
Jonathan Rosales & Mendoza Rosalia Marisela Henriquez, with an address of 8 Mossey Lane, 22
23
Millbrook, AL 36054, to Parcel Number 19 03 05 1 000 004.000; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on May 16, 2024, 28
29
to correct, remedy or remove the condition of garbage and rubbish within ten (10) days; and 30
31
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 32
33
remove said condition by the expiration of said notice; and 34
35
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 36
37
Council to declare the keeping of garbage and rubbish to be a public nuisance and authorizes 38
39
the City to do such work or make such improvements that are necessary to correct, remedy or 40
41
remove such condition, pay therefore and charge the expenses incurred for the abatement 42
43
process to the owner of such property. 44

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 46
47
declares that the garbage and rubbish at 279 Gardner Road continued to be a public nuisance 48
49
at the expiration of the notice of violation. 50

BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 52
53

WHEREAS, under the authority of Title 11, Chapter 53B, Code of Alabama, 1975, as 7
8
amended, on April 17, 2024, the City of Prattville Chief Building Official declared the dilapidated 9
10
structure at 116 7th Street, Parcel No. 19 03 08 1 009 024.000, to be an unsafe structure; and 11
12
WHEREAS, on April 18, 2024, the City of Prattville Code Enforcement Officer sent 13
14
notice ordering the repair or demolition of the dilapidated structure at 116 7th Street within 45 15
16
days of said notice; and 17
18
WHEREAS, said notice was delivered by certified mail in accordance with §11-53B-3, 19
20
Code of Alabama, 1975, as amended; and 21
22
WHEREAS, Title 11, Chapter 53B allows the property owner or other interested parties 23
24
to file a written appeal within thirty (30) days of the date of notice with the City Clerk requesting 25
26
a hearing before the City Council of the City of Prattville; and 27
28
WHEREAS, no written request for a hearing was received within thirty (30) days of the 29
30
date of the notice; and 31
32
WHEREAS, §11-53B-4, Code of Alabama, 1975, as amended, authorizes the City 33
34
Council to determine whether or not the building or structure is unsafe to the extent that it is a 35
36
public nuisance; and 37
38
WHEREAS, no repairs have been made to the dilapidated structure located at 116 7th 39
40
Street, and the structure remains unsafe and a public nuisance. 41
42
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 43
44
the dilapidated structure located at 116 7th Street continues to be unsafe and a public nuisance 45
46
that must be repaired or demolished. 47
48
BE IT FURTHER RESOLVED that the City Council instructs the Code Enforcement 49
50
Officer to provide a report of the cost to repair or demolish the dilapidated structure located at 51
52
116 7th Street to the City Council. 53

WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 53

Council to declare the abundance of overgrown grass and weeds to be a public nuisance and 55

abate the same; and 57

WHEREAS, pursuant to Section 46-114 (e), City of Prattville Code of Ordinances, 59
60
declaring the abundance of overgrown grass and weeds to be a public nuisance and ordering 61
62
their abatement by the City Council initiates a fine for the first violation and designation on the 63
64
repeat offender registry. 1

NOW, THEREFORE, BE IT RESOLVED THAT: 3
4
1. the City Council of the City of Prattville declares the abundance of overgrown grass and 5
weeds at said properties to be a public nuisance and has therefore initiated the abatement 6
process; and 7
2. the owner(s) of said properties are ordered to abate said nuisance and appear before the 8
City Council at a Public Hearing at 6:00 p.m. on July 16, 2024, at Prattville City Hall; and 9
3. any objections may be filed, in writing, to the City Clerk at least five (5) days prior to the 10
Public Hearing; and 11
4. the fine of $100.00 shall be assessed to the owner(s) of said properties in addition to any 12
costs incurred for the abatement process; and 13
5. said properties shall be placed on the repeat offender registry for a period of three (3) years; 14
and 15
6. the notice of Public Hearing on the matter, as required by law, will be provided in a 16
publication of general circulation, by certified mail, and by signage on the subject properties. 17

City Council of the City of Prattville to declare a public nuisance and have the violation resolved; 10

WHEREAS, in Resolution Book 2024, Page 043, on March 5, 2024, the City Council of 14
15
the City of Prattville declared garbage and rubbish and the abundance of overgrown grass and 16
17
weeds at 105 Colonial Court continued to be a public nuisance; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Edwards Mary 20
21
A & Edwards James S, with an address of 105 Colonial Court, Prattville, AL 36066, to Parcel 22
23
Number 19 02 10 2 010 014.000; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on February 6, 28
29
2024, to correct, remedy or remove the conditions of garbage and rubbish within ten (10) days; 30
31
and 32
33
WHEREAS, the owner/operator of said property failed and/or refused to correct, remedy 34
35
or remove said nuisance conditions by the expiration of said notice; and 36
37
WHEREAS, Section 46-32 of the City of Prattville Code of Ordinances authorizes the 38
39
City to do such work or make such improvements that are necessary to correct, remedy or 40
41
remove such condition, pay therefore and charge the expenses incurred to the owner/operator 42
43
of such property to the fullest extent authorized by law. 44

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 46

the cost totaling $3,805.64 for the removal of garbage and rubbish at 105 Colonial Court is 48

accurate and shall be established as a lien against the property. 50

WHEREAS, § 6-5-122 et Seq., of the Code of Alabama, 1975, as amended, permits the 8

City Council of the City of Prattville to declare a public nuisance and have the violation resolved; 10
11
and 12

WHEREAS, in Resolution Book 2024, Page 028, on February 20, 2024, the City 14
15
Council of the City of Prattville declared garbage and rubbish and the abundance of overgrown 16
17
grass and weeds at 839 Heather Drive continued to be a public nuisance; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Martin David Lee 20
21
& Sarah L, with an address of 839 Heather Drive, Prattville, AL 36066, to Parcel Number 19 06 22
23
13 1 000 001.087; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on January 25, 28
29
2024, to correct, remedy or remove the conditions of garbage and rubbish within ten (10) days; 30
31
and 32
33
WHEREAS, the owner/operator of said property failed and/or refused to correct, remedy 34
35
or remove said nuisance conditions by the expiration of said notice; and 36
37
WHEREAS, Section 46-32 of the City of Prattville Code of Ordinances authorizes the 38
39
City to do such work or make such improvements that are necessary to correct, remedy or 40
41
remove such condition, pay therefore and charge the expenses incurred to the owner/operator 42
43
of such property to the fullest extent authorized by law. 44
45
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 46
47
the cost totaling $272.14 for the removal of garbage and rubbish at 839 Heather Drive is 48
49
accurate and shall be established as a lien against the property. 50
51
BE IT FURTHER RESOLVED that the City Attorney is authorized to file any actions 52
53
necessary to recover costs of said removal. 54
