After the Pledge of Allegiance, 8 invocation and reading the Character Trait, the meeting commenced. 9 10 ROLL CALL: 11 Members present were Chairman Charles Knapp, Mr. Jerry Crosby, Mr. Neal Parker, Mr. Greg Duke, and 12 Mr. Billy Barrett. Ms. Sarah Johnson was absent. 13 14 Quorum Present 15 16 Staff present were Mr. Scott Stephens, City Planner; Mr. Joshua McKinney, Planner; and Ms. Bria 17 Hudson, Planner. 18 19 CHARACTER TRAIT OF THE MONTH: 20 The Character Trait of the Month is Patience… Taking the time necessary to work through a difficult 21 situation. 22 23 COMMITTEE REPORTS: 24 25 OLD BUSINESS: 26 There was no old business to discuss. 27 28 NEW BUSINESS: 29 SPECIAL EXCEPTION: 30 Outdoor Storage/Unenclosed Retail 31 2231 Cobbs Ford Road 32 Jorge Sanchez, Petitioner 33 34 Mr. McKinney introduced the special exception request to allow outdoor storage/unenclosed retail. He 35 stated that the petitioner is proposing sales of granite and other stone countertops. The proposed outdoor 36 storage/unenclosed requires a Special Exception in B-2 zoning. 37 38 Jorge Sanchez, petitioner, appeared for the request and answered questions from the Board. Mr. Knapp 39 asked if fabrication was done on site and Mr. Sanchez said that was performed off-site. The Board asked 40 questions to ensure the safety and security of the large countertop slabs. 41 42 Chairman Knapp opened the floor for public comments. After seeing none, the public hearing was closed. 43 44 Chairman Knapp opened the discussion for the Board. Mr. Parker moved to establish the findings of fact 45 stating that 1) the proposal is in the public interest and meets the spirit of the Zoning Ordinance; 2) the 46 proposal is an allowable special exception, and is not a prohibited use in the underlying zoning district; 47 and 3) the proposed use will not cause substantial adverse impact to adjacent or nearby properties. The 48 motion was seconded by Mr. Duke. The findings of fact were approved unanimously. 49 50 Mr. Parker moved to approve the Special Exception based on the findings of fact. Special Exception to allow metal siding on side facades of the structure. ZONING ORDINANCE REFERENCED: The provisions of the Zoning Ordinance in which item 1 is requested is referenced in section described below: §5.01.03 Additional Regulations 1. Accessory structures are subject to §3.04.06 Accessory Structures, Site Appurtenances and the following: a. No accessory structures may be located in required landscape buffers. b. Accessory structures are subject to the same setbacks as the principal structure. 2. Temporary Structures. The Board may permit the use of a temporary structure for up to 18 months prior to construction of a permanent structure, which will replace the temporary structure. The owner must give evidence, satisfactory to the Board, of the owner's good faith and intent to have constructed a permanent structure. Under no circumstances may such structures be authorized as for habitation. 3. Fences and walls may not exceed ten feet in height. 4. Appearance Standards. The following standards apply except the M-1 and M-2 Districts: DR A F T Page 2 of 2 a. The use of metal siding on any street-facing and side facades is subject to approval by the Board of Adjustment in accordance with §12.03 Special Exceptions. b. Street-facing facades of principal buildings may not be longer than 40 ft horizontally without one of the following forms of articulation: projecting or recessed entry, column, pillar or other change in the wall plane, window, door or similar design feature. A change in material or color must be accompanied by a change in the wall plane of at least six inches to satisfy this requirement. c. Storage or display of tires between the principal building and the front property line is prohibited. d. Mechanical units (e.g. air conditioners) must be shielded from view from the public right-of-way Section 12.03 Special Exceptions §12.03 Special Exceptions §12.03.01 The Board hears and decides requests for approval of Special Exceptions as set out in this Ordinance. §12.03.02 Special Exceptions require application to the Board on forms provided by the Director. §12.03.03 Notice of the scheduled hearing is given to the applicant and other interested parties in accordance with board rules. §12.03.04 The Board reviews the request for compliance with this Ordinance and all other applicable codes and ordinances of the City. Before granting any Special Exception, the Board must make written finding determining that the proposed Special Exception will not: 1. Be contrary to the public interest and will ensure that the spirit of this Ordinance is observed; 2. Permit the establishment of a use prohibited in the zoning district; and 3. Cause a substantial adverse impact on property or improvements in the vicinity or in the applicable district. §12.03.05 The Board may impose such conditions for approval that it deems necessary in the particular case to protect the public interest and the intent of the Comprehensive Plan and this Ordinance. Such conditions apply to the land, structure, and use for which the Special Exception is granted and not to a particular person. Violations of conditions lawfully attached to any Special Exception constitute violations of this Ordinance. §12.03.06 Board approval of a Special Exception pertains solely to that specific use at the location specified in the application. Such approval is not transferable to another use at that location or the same use at another location. §12.03.07 Special Exception approval lapses and will be of no effect if, after one year from the date of Board approval, no construction or change in use pursuant to the approval has taken place. The Board may, for good cause shown, specify a longer period of time in conjunction with its approval. ANALYSIS: The petitioner is proposing a 4,500 square foot structure with metal siding on the side façades. This structure will feature stone and hardie siding on the street facing façade, with approximately 20ft wrapped around on the side facades. The rest of the side facades are requested to be metal siding, which requires the Special Exception. Additionally, the petitioner plans to use metal siding on the back, where automobiles will be stored. The proposed site is currently undeveloped.
