Members present were Mayor Bill Gillespie, Chairman Reuben Gardner, Mr. Seth Hayden, Mr. Mugs Mullins, Mrs. Paula Carpenter, Fire Marshal Craig Allen, and Mr. Robert King. Councilman John Chambers and Vice-Chairman Ken Daniel were absent. (Quorum present) Staff present: Mr. Scott Stephens, City Planner; Joshua McKinney, Planner; and Ms. Bria Hudson, Planner. Minutes: Mayor Gillespie moved to approve the minutes of the June 20, 2024 regular meeting. Mr. King seconded the motion. The motion passed unanimously. Committee Reports: None Old Business: There was no old business to discuss. New Business: 1. Preliminary Plat: Highland Farms Plat 1 Location: East of Highland Ridge Subdivision Petitioner: Flowers & White Engineering, LLC Mr Stephens introduced this request. He explained that preliminary plats remail valid for 18 months after Planning Commission approval. All four Highland Farms plats were approved on March 2, 2023. The request for a time extension is occurring within the required timeframe. Chloe Kelly of 68Ventures explained the requests and gave an update on work performed so far and reasons for the time extension. Plats 1 and 2 were under active construction. Plats 3 and 4 are planned for the future. Mr Mullins stated that he was favorable for the time extensions on Plats 1 and 2, but not 3 and 4. Mrs. Carpenter introduced a resolution recommending approval of the time extension of Plat 1 for 180 days. Mr. Allen seconded the motion. Chairman Gardner opened for discussion amongst the commissioners. Mayor Gillespie said he agreed with Mr Mullins’ feelings on extending Plats 1 and 2 but not 3 or 4. He further mentioned concerns about the delays the developer has had in establishing and using the required construction entrance, instead of using other locations. Ms Kelly spoke and said there was some boundary disputes and other issues which set back some of the work. Kenneth White, Jr, of Flowers & White, provided some feedback. Mayor Gillespie asked for clarification for where the current construction was. Ms Kelly confirmed that the contractor was using the Old Farm entrance and had ceased using the other entrances. Mayor Gillespie made a motion to amend the motion to change the time extension to 30 days. The motion was seconded by Mr Allen. Chairman Gardner called for the vote and the motion to approve the amendment passed unanimously. Preliminary Plat: Highland Farms Plat 2 Location: East of Highland Ridge Subdivision Petitioner: Flowers & White Engineering, LLC Mrs. Carpenter introduced a resolution recommending approval of the time extension of Plat 2 for 30 days. Mr. Allen seconded the motion. The motion to adopt the resolution extending preliminary plat approval for Highland Farms Plat 2 by 30 days (ending on September 1, 2024) passed unanimously. 3. Preliminary Plat: Highland Farms Plat 3 Location: East of Highland Ridge Subdivision Petitioner: Flowers & White Engineering, LLC Mrs. Carpenter introduced a resolution recommending approval of the time extension of Plat 3 for 30 days. Mr. Allen seconded the motion. Chairman Gardner opened for discussion amongst the commissioners. Mr Mullins stated that based on market conditions and housing sales, he didn’t believe that Plat 3 construction would begin in the near future, and would rather consider new approval of a plat than extending the time on this one. Chairman Gardner called for the vote. The motion to adopt the resolution failed with the following vote: Yes-Hayden; No-Gillespie, King, Gardner, Carpenter, Allen, Mullins. 4. Preliminary Plat: Highland Farms Plat 4 Location: East of Highland Ridge Subdivision Petitioner: Flowers & White Engineering, LLC Mrs. Carpenter introduced a resolution to approve the time extension of Plat 3 for 30 days. Mr. Allen seconded the motion. Chairman Gardner opened for discussion amongst the commissioners. Chairman Gardner called for the vote. The motion to adopt the resolution failed with the following vote: Yes-Hayden; No-Gillespie, King, Gardner, Carpenter, Allen, Mullins. Mr Stephens stated that Highland Farms does have a current master plan and the developer may submit a new application for the additional phases when they are ready. 5. Preliminary Plat: The Cottages at Prattville Location: Highway 82 E & Constitution Ave. Owner: DHS-1 Holding, Inc., DHS-2 Holding, Inc., DHS-3 Holding, Inc., and Gresham Place Representative: Barrett-Simpson, Inc. Mr Stephens introduced the request. He stated that he would initially discuss the proposed plat and the proposed PUD master plan at the same time, since they are the same location, but they are separate items that will require their own respective votes. Mr Stephens gave a brief history of the location and request and showed the overall plan and requests, including the proposed public street between Constitution Ave and Coffee Exchange. He specifically pointed out the proposed setbacks along Constitution Ave, the proposed landscape plan, and architectural styles proposed to face Constitution Ave. DR A F T DRAFT Prattville Planning Commission July 18, 2024 Minutes Page 3 of 4 John Baumhauer, of Forge Residential Partners, explained the proposal. He stated that their traffic engineer, Skipper Consulting, re-examined potential traffic impacts with the newer proposed design and provided a letter with his findings. He further explained setbacks, proposed public street with parallel parking, tenant screening, and maintenance standards. Chairman Gardner opened the public hearing. Craig Clement, HomePlace resident and HOA president, spoke in opposition to the request. He specifically raised concerns of traffic and safety concerns, and stated that he felt there should be at least a 60’ setback with landscaping along Constitution and Coffee Exchange. Rosanna Duke, of Cherry Lane, spoke in opposition. She stated that she previously sent a letter to the Commission expressing her belief that the proposed development is not compliant with zoning or comprehensive plan. She feels that there are too many existing apartments and their occupancy rates are low and that this development will be a safety hazard. Lane Easterling, of Cherry Tree Lane, spoke in opposition. He stated that he doesn’t believe the traffic studies have considered future development and that there will be traffic safety issues. Chairman Gardner closed the public hearing. Mr Allen introduced a resolution to approve the Preliminary Plat for The Cottages at Prattville. Mr Hayden seconded the motion. Chairman Gardner opened for discussion amongst the commissioners. Mayor Gillespie asked about the aforementioned agreements between the developers and the Homeplace residents on certain items (e.g. irrigation well, landscaping). Mr Stephens stated that he did not have any documentation but believed those would be private arrangements. Mr Baumhauer stated that he didn’t have a physical copy of an agreement, but that he would still maintain the previous agreement with the exception of any required gates. He specifically mentioned landscaping, the relocation of the irrigation well, all construction traffic would come from Legends Drive and not Constitution, they relocated the garbage/trash locations. Mr Baumhauer stated he could provide a copy of the agreements to the City. Mayor Gillespie mentioned the “Blue Lagoon” or “Blue Hole” informal swimming area existing on site. Mike Baker, of Forge Residential, stated they had no particular plans for it and were not going to grant specific access to it. Mayor Gillespie stated that the developers needed a plan to make it secure for safety purposes. Chairman Gardner asked if they had considered a traffic signal. Mr Baumhauer stated that their traffic engineer told them that the proposed development wouldn’t not meet the criteria for a new signal. Mayor Gillespie stated he was against the proposed on-street parallel parking and the proposal to make the street public. He stated he is not in favor of a build to rent complex with a public street and that the parallel parking would not be good for a street he believes would be a heavily trafficked cut-through. Eric Wadsworth, the developer’s landscape architect, asked for clarification on why the proposed street would be a popular cut-through. Mayor Gillespie asked if Forge Residential had selected a property manager. Mr Baumhauer stated they had not made that decision yet. Chairman Gardner asked about how a private versus public road would be different. Kathryn Welch, of Barrett-Simpson, spoke on street widths and design. Mr Baker mentioned that they would be willing to add speed bumps or other traffic calming options. There was discussion on setbacks and distance from the property line nearest Constitution. The motion to adopt the resolution failed with the following vote: Yes-Hayden, Gardner, Carpenter, Allen, Mullins; No-Gillespie, King. Mr Stephens stated that a preliminary plat required six affirmative votes in order to be approved. Mayor Gillespie said that he voted no because of safety of the “blue lagoon” area and too many unknowns. Mr King said he voted no because of the citizens’ concerns, questions about the building architecture, traffic problems, and parallel parking. Mayor Gillespie asked if the petitioners would like to request the Planning Commission to postpone the decision. Mr Baker stated yes. Mr Stephens suggested that the Commission could rescind the previous vote and postpone the decision on the plat to a subsequent meeting. Mr Mullins moved to rescind the previous motion on approval of the preliminary plat for The Cottages at Prattville. Mr Allen seconded. The motion passed unanimously. Mr Mullins asked about postponing the decision on the preliminary plat to the August meeting and asked if that would work for the developer. Mr Baker indicated that it would. Mr Mullins moved to postpone to the August 15, 2024, meeting. Mr Allen seconded. The motion was approved by the following vote: Yes-Hayden, King, Gardner, Carpenter, Allen, Mullins; Abstain-Gillespie. 6. Chairman Gardner suggested scheduling a work session and asked Mr Stephens to email the commissioners on scheduling that. The motion was approved passed unanimously. Scott Stephens, Planning Director DATE: August 15, 2024 RE: Time Extension Requests for Highland Farms Items #3 and #4 of today’s agenda are requests for time extensions for the Highland Farms Preliminary Plats 1 and 2, respectively. The Prattville Subdivision Regulations state: The approval of a Preliminary Plat shall be effective for a period of 18 months from the date that the plat was approved by the Planning Commission, at the end of which time the applicant must have submitted a Final Plat for approval. If the subdivision is under active construction, the Planning Director may authorize a one-time extension of no more than 180 days, otherwise, the applicant may request an extension of no more than 180 days at a time from the Planning Commission. The request must appear before the Planning Commission prior to the end of the approval period. If the approval time is lapsed, then preliminary approval shall be null and void, and the applicant must submit a new Preliminary Plat subject to current ordinances and regulations. It is the responsibility of the subdivider to request any needed extensions (§ 3.4 (7)). Highland Farms Preliminary Plats 1 and 2 were approved at the March 2, 2023, Planning Commission meeting, and the 18-month approval period ran through August 2, 2024. At the July 18, 2024, Planning Commission meeting, the Commission approved a 30-day time extension on these two plats, which will end on September 1, 2024. Currently, Plats 1 and 2 are under construction, and the developer is requesting another time extension. The Planning Commission may authorize a time extension of no more than 180 days. If DR A F T Memo to Planning Commission, Highland Farms Page 2 August 15, 2024 the preliminary plats are allowed to expire, the developer will need to begin the preliminary plat process again, submitting new applications, fees, and plats that are compliant with the current subdivision regulations. If the Planning Commission chooses to extend the approval by the full 180 days (from the September 1, 2024, end date), the new approval end date would be February 28, 2025. The developer must then have submitted a final plat for approval or receive another time extension before the new date, or the preliminary plat approval(s) would lapse. The following table may help for consideration of possible extension time periods: As a reminder, final plats must be in substantial compliance with the approved preliminary plat in order to be approved (Subdivision Regulations § 3.7 (5) (a)).
