WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2024- 10
11
B, Page 230, on September 17, 2024, that the abundance of overgrown grass and weeds at 12
13
1676 S. Memorial Drive, 449 Dawson Street, 1780 E. Main Street, and 711 Doster Road 14
15
constituted a public nuisance and set a Public Hearing on said nuisance; a nd 16
17
WHEREAS, the Autauga County tax records list the property owner(s) as follows: 18
19
•1676 S. Memorial Drive – West Robin & Compton Sara, with an address of 59320
Partridge Lane, Prattville, AL, 36067, to Parcel Number 19 07 25 2 000 002.00121
•449 Dawson Street – Patrick Morace c/o Steve Patrick or Ashley Odom, with an22
address of 1686 Tom Turner Road, Billingsley, AL, 36006, to Parcel Number 19 03 0723

WHEREAS, notice was provided to correct, remedy or remove overgrown grass and 30
31
weeds; and 32

WHEREAS, the owner(s) of said properties have failed and/or refused to correct, 34
35
remedy or remove said nuisances by the expiration of said notices; and 36
37
WHEREAS, the owner of the property located 1780 E. Main Street did file a written 38
39
objections with the City Clerk’s Office within five days of the Public Hearing; and 40
41
WHEREAS, the owner(s) of other said properties did not file written objections with the 42
43
City Clerk’s Office within the time prescribed by City of Prattville Code of Ordinances, Section 44
45
46-114 (c); and46
47
WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on October 48
49
15, 2024, permitting the owner of said property to present evidence, objections and protest 50
51
regarding said nuisance; and 52
53
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, authorizes the 54
55
City to do such work or make such improvements that are necessary to correct, remedy or 56
57
remove such conditions, pay therefore and charge the expenses incurred to the owner of such 58
59
property. 60
61
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 62
63
declares that the overgrown grass and weeds at 1676 S. Memorial Drive , 449 Dawson Street, 64
1780 E. Main Street, and 711 Doster Road continued to be a public nuisance at the expiration 1
2
of the notice of violation. 3

BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds 5
6
at said property removed using City forces or private contractors. The property owner shall 7
8
have the right to remove said nuisance at their expense provided that the removal is done prior 9
10
to the commencement of work by employees or agents of the City of Prattville; however, this 11
12
does not abolish incurred fines and expenses. 13
14
BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 15
16
to this request and report such costs to the City Council following its abatement. 17

WHEREAS, an abundance of overgrown grass and weeds: 9

1.is injurious to the public health, safety and general welfare of the community by providing a11
breeding ground and shelter for rats, mice, snakes and mosquitoes and other vermin;12
2.may cause the further spread of weeds;13
3.may hide debris, such as glass or metal, that could inflict injur y on a person going to such14
property;15
4.may also pose a fire hazard and respiratory hazard; and16
17
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 18
19
the properties and determined the existence of an abundance of overgrown gras s and weeds 20
21
at 116 7th Street; and 22
23
WHEREAS, the Autauga County tax records list the property owner(s) as follows: 24
25
•116 7th Street – Golson Lillian c/o Carolyn Norman, with an address of 131 Mt Vernon26
Drive, Montgomery, AL, 36105, to Parcel Number 19 03 08 1 009 024.000 ; and27
28
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 29
30
Code Enforcement Officer gave written notice to the owner(s) of said properties on September 31
32
10, 2024, to correct, remedy or remove the abundance of overgrown grass and weeds 33
34
within ten (10) days; and 35
36
WHEREAS, the owner(s) of said properties have failed and/or refused to correct, 37
38
remedy or remove said condition by the expiration of said notice; and 39
40
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 41
42
Council to declare the abundance of overgrown grass and weeds to be a public nuisance and 43
44
abate the same; and 45
46
WHEREAS, pursuant to Section 46-114 (e), City of Prattville Code of Ordinances, 47
48
declaring the abundance of overgrown grass and weeds to be a public nuisance and ordering 49
50
their abatement by the City Council initiates a fine for the first violation and designatio n on the 51
52
repeat offender registry. 53
54
NOW, THEREFORE, BE IT RESOLVED THAT: 55
56
1.the City Council of the City of Prattville declares the abundance of overgrown grass and57
weeds at said properties to be a public nuisance and has therefore initiated the abatement58
process; and59
2.the owner(s) of said properties are ordered to abate said nuisance and appear before the60
City Council at a Public Hearing at 6:00 p.m. on November 19, 2024, at Prattville City Hall;61
and62
3.any objections may be filed, in writing, to the City Cle rk at least five (5) days prior to the63
Public Hearing; and64
4. the fine of $100.00 shall be assessed to the owner(s) of said properties in addition to any 1
costs incurred for the abatement process; and 2
5. said properties shall be placed on the repeat offender registry for a period of three (3) years; 3
and 4
6. the notice of Public Hearing on the matter, as required by law, will be provided in a 5
publication of general circulation, by certified mail, and by signage on the subject properties. 6

WHEREAS, §11-53B-1 through §11-53B-16, Code of Alabama, 1975, as amended, 8
9
details the process for the City of Prattville to declare certain unsafe structures a public 10
11
nuisance and order repair or demolition; and 12
13
WHEREAS, §11-53B-3, Code of Alabama, 1975 as amended, requires the City’s order 14
15
to repair or demolish an unsafe structure be sent to the owner of the property and those having 16
17
legal interest in the property; and 18
19
WHEREAS, §11-53B-3 and §11-53B-4, Code of Alabama, 1975, as amended, requires 20
21
the owners to repair or demolish the unsafe structure within forty-five (45) days of being issued 22
23
an order from the City or to request a hearing before the City Council of the City of Prattville 24
25
within thirty (30) days of the order; and 26
27
WHEREAS, §11-53B-3, Code of Alabama, 1975, as amended, permits the City to repair 28
29
or demolish an unsafe structure if the owner fails to comply with the City order; and 30
31
WHEREAS, §11-53B-5, Code of Alabama, 1975, as amended, permits the City Council 32
33
to adopt a resolution affixing the cost of demolition and establishing a lien against the property; 34
35
and 36
37
WHEREAS, the City Council finds that: 38
39
1. The City’s Chief Building Official declared the residential structure at 116 7th Street 40
to be an unsafe structure on April 17, 2024; and 41
2. The City’s Code Enforcement Officer issued an order to Golson Lillian c/o Carolyn 42
Norman, on April 18, 2024, to have the property repaired or demolished within forty -43
five (45) days of the notice; and 44
3. Golson Lillian c/o Carolyn Norman did not request a hearing before the City Council 45
within thirty (30) days of the notice nor repair or demolish the structure within forty -46
five (45) days of the notice; and 47
4. The City Council declared the structure located at 116 7th Street to be unsafe and a 48
public nuisance in Resolution Book 2024-A, Page 138, on June 18, 2024; and 49
5. The City Council authorized the demolition of the structure and awarded the contract 50
for complete demolition in Resolution Book 2024-A, Page 173, on July 16, 2024; and 51
6. The total cost of demolition was determined to be $7,964.69. 52
53
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 54
55
the total amount of $8,164.69 (including legal expenses) for the demolition of the d ilapidated 56
57
and unsafe structure located at 116 7th Street is accurate and shall be established as a lien 58
59
against the property. 60
61
BE IT FURTHER RESOLVED that the City Attorney is authorized to file any actions 62
63
necessary to recover costs to demolish the structure pursuant to §11-53B et seq., Code of 64
Alabama, 1975, as amended. 1

WHEREAS, in Resolution Book 2014, Page 016, on February 4, 2014, the City of 7

Prattville established a Neighborhood Traffic Calming Policy; and 9
10
WHEREAS, in Resolution Book 2024, Page 066, on March 19, 2024, the City Council 11
12
authorized a review and evaluation of said policy; and 13
14
WHEREAS, based on the review and evaluation, Sain Associates Inc. recommends 15
16
changes to the current policy as described in Attachment “A”. 17
18
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 19
20
the Neighborhood Traffic Calming Policy is hereby amended as described. 21
22
BE IT FURTHER RESOLVED that the amended policy will go into effect November 1, 23
24
2024. 25

the 2024 Redistricting Process in accordance with the 2020 Federal Census. 14

BE IT ORDAINED by the City Council of Prattville, Alabama, as follows: 9

Section 1. 11
In conformity with the provisions Act 2012-256 enacted by the Alabama Legislature during the 12
2012 Regular Session, providing for a State Severe Weather Preparedness Sales Tax Holiday, 13
the City of Prattville, Alabama, exempts “covered items” from municipal sales and use tax 14
during the same period, beginning at 12:01 a.m. on Friday, February 21, 2025, and ending at 15
twelve midnight on the following Sunday, February 23, 2025. 16

Section 2. 18
This Ordinance shall be subject to all terms, conditions, definitions, time periods, and rules as 19
provided by Act 2012-256, except that the time period shall only be as specified in Section 1 20
above and not for all years thereafter. 21

Section 3. 23
The City Clerk is hereby authorized and directed to certify a copy of this Ordinance under the 24
seal of the City of Prattville, Alabama, and to forward said certified copy to the Alabama 25
Department of Revenue to be recorded and posted on the Department website. 26

THIS Ordinance shall become effective upon its passage and publication as required by 28

law. 30

[To Support the Autauga County Board of Education in Their Proposed Local Legislation 3
Regarding the Ad Valorem Tax Referendum.] 4

WHEREAS, Autauga County property owners currently pay the required State of 8
9
Alabama minimum of 10 mills of ad valorem school taxes; and 10
11
WHEREAS, all 10 mills of ad valorem school taxes are credited to the system’s local 12
13
funding; and 14
15
WHEREAS, any local dollars, above the state-required 10 mills collection, are how 16
17
projects are funded, local teacher units are provided, and bond debt is paid; and 18
19
WHEREAS, Local Amendment 1 will be included on the general election ballot on 20
21
November 5, 2024; and 22
23
WHEREAS, the proposed amendment is to provide for the levy and collection of an 24
25
additional ad valorem tax in the amount of seventy cents ($.70) on each one hundred dollars 26
27
($100) equaling 7 mills of taxable property in the county and to provide for the use of the 28
29
proceeds for public school purposes; and 30
31
WHEREAS, a successful referendum would allow for the school system to have access 32
33
to additional funding that is not earmarked, allowing the Autauga County Board of Education 34
35
and district administrators the ability to meet immediate needs designed to stabilize the system; 36
37
and 38
39
WHEREAS, the City Council concurs that additional funding will be in the best interest 40
41
of the students of Autauga County. 42
43
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 44
45
hereby supports the local legislation regarding the Autauga County Ad Valorem Tax 46
47
Referendum. 48
