Chairman Gardner opened the public hearing. 37 38 Rosanna Duke, 1312 Cherry Tree Lane, and Bryan Morgan, 1020 Saddle Ridge, expressed their concerns and 39
spoke in opposition to The Cottages. 40 41 Seeing no further requests to speak, Chairman Gardner closed the public hearing. 42
43 Mr Mullins introduced a resolution to approve the preliminary plat for The Cottages at Prattville as submitted. 44 It was seconded by Mr Hayden. 58 59 Chloe Kelly, of 68 Ventures, and Kenneth White, Flowers & White, appeared for the request. Mayor Gillespie 60
and Councilor Chambers asked about some of the traffic calming measures being planned. Ms Kelly mentioned 61 that there are a few, including a raised crosswalk on Stapleford Trail/Wee Lovett Drive between Highland Ridge 62 and the proposed subdivision. 63 64 Mr Mullins asked Mr Stephens about parcels located along the Autauga County and Elmore County line. Mr 65 Stephens said that the updated subdivision regulations required that residential lots near the boundary allowed 66 enough buildable area on either side of the line so there would be no split residences. 67 68 Mr Hayden introduced a resolution to approve the preliminary plat as submitted. It was seconded by Mr Mullins. 69 Chairman Gardner called for the vote and the resolution passed unanimously. 70 71 3. Mr McKinney introduced the request. 97 98 Chairman Gardner opened the public hearing. 99 100 Tony Byrd, 828 Dunvegan Drive, spoke to ask about infrastructure in the area, previous plans, and express 101 concerns about traffic. 102
103 Haley Staken, Dunvegan Drive, expressed concerns about traffic. 104 105 Serita Harmon, Austin Valley, asked about greenspace, amenities, and noise during construction. 106 107 Brenda Tuck and another neighbor residing on Austin Valley, asked about amenities and whether a fence would 108 be installed between the proposed PUD and the Austin Valley neighborhood. She also mentioned concerns 109 about construction noise and times for construction. 110

Jon Lee Finnegan, 211 Deer Trace, asked about the potential for the development being ‘build-to-rent.’ 111 112
Crystal Ziegler, Howard Street, asked about potential impacts in the adjacent College Heights neighborhood. 113 114 Jeff Brown, Dunvegan Drive, expressed concerns about traffic and crime. 115
116 Jack Estes, Rausch Coleman Homes, appeared for the request. He stated that Rausch Coleman Homes had not 117 built any build-to-rent neighborhoods in Alabama, and had no plans to do that. He said they would be open to 118 considering a fence or other buffer along the north side between them and Austin Valley and discussed the 119 proposed greenspaces. 120 121 Mr Stephens further explained the various housing areas being proposed. He mentioned that the standard zoning 122 for some of these areas would require side setbacks of 7ft, but they are proposing 5ft in this development. 123 124 Mr Daniel asked about the proposed density and compliance with the comprehensive plan. Mr Stephens said 125 the comp plan defines medium density, which this area is indicated for in the Future Land Use Map, as “single-126 family detached homes with moderate lot sizes, generally 4-5 units per acre.” The proposed development would 127 fall within that range, but it does include attached housing. A PUD can offer some flexibility if desired. 128 129
Mayor Gillespie expressed concerns about the number of units and density and that if a similar number of homes 130 are considered, then the greenspace and recreation areas need to be improved. He also asked about the 131 connection along Carver Street and wanted to see traffic calming measures installed. Councilor Chambers 132
agreed about the greenspace and a fence along the north side. 133 134 Ms Brenda Tuck requested that the fence would “wrap around” the corners and asked if there would be an HOA. 135
136 Mr Estes said they would consider the fence connecting around to the entrance on Carver Street and that there 137 would be an HOA. 138 139 Chairman Gardner closed the public hearing. 140 141 Mr Daniel introduced a resolution to approve the preliminary PUD master plan and that proposal substantially 142 conforms to or meets: 143 144 1. The comprehensive plan. 145 2. The intent, objectives and general requirements of the Planned Unit Development District. 146
3. The proposal is conceptually sound in that it meets a community need and conforms to accepted 147 design principles in the proposed street system, land use configuration, open space system, and drainage 148 and utility systems. 149
4. There are adequate services and utilities available in the construction of the development. 150 151 Mr Mullins seconded. 152
153 Mayor Gillespie stated he has some reservations about the plan as presented and suggested that perhaps it be 154 postponed for further work and discussion. Mr Daniel stated he shared the Mayor’s reservations and that it was 155 too dense and inadequate greenspace. Councilor Chambers said he had similar concerns as well as about traffic 156 impacts. 157 158 Chairman Gardner asked the applicant if he would desire to postpone. Mr Estes stated he would be ok with 159 postponing to the October meeting. 160 161 Mr Mullins moved to postpone this item and #5 (the rezoning) to the October meeting. Mayor Gillespie 162 seconded. She mentioned the intended use would be for RV and boat storage. 179 180 Chairman Gardner opened the public hearing. There was no one present desiring to speak, so he closed the 181 public hearing. 182 183 Mr Daniel asked about the submitted site plan and its relevance on the rezoning. Mr Stephens stated that the 184 Planning Commission should consider all available uses in a requested zoning, but applicants often provide 185
information on their intended plans. 186 187 Mayor Gillespie introduced a resolution recommending the rezoning. Mr Mullins seconded. 188
189 Blake Rice, Barrett-Simpson, appeared for the request. He explained that for the desired use, B-2 zoning is what 190 would be needed. He mentioned that not all allowable uses would be practical in that location. 191

Members present were Chairman Reuben Gardner, Vice-Chairman Ken Daniel, Mayor Bill Gillespie, Fire Marshal Craig Allen, Mugs Mullins, Seth Hayden, and Councilor John Chambers. 2. Additional street or infrastructure improvements, including sidewalks and right-of-way width (§ 4.3) 3. Dead-end greater than 1,000ft (§ 4.3 (6))
Subdivision Regulations § 1.8: Where the Planning Commission finds that hardships or practical difficulties may result from strict compliance with these regulations and/or the purposes of these regulations may be served to a greater extent by an alternative proposal, it may waive or vary these subdivision regulations so that substantial justice may be done and the public interest secured, provided that such waiver shall not have the effect of nullifying the intent
and purpose of these regulations. Further provided, the Planning Commission shall not approve waivers unless it is determined that:
a. The granting of the waiver will not be detrimental to the public safety, health, or welfare or injurious to other property;
b. The relief sought will not vary the provisions of the Zoning Ordinance.
Staff Comments:
The purpose of this plat is to establish a public right-of-way over the existing Vista Point Boulevard. Because it is existing and the nature of the existing infrastructure, staff has no objections to the waiver requests. Reviewed by: Scott Stephens, City Planner
