WHEREAS, §11-53B-1 through §11-53B-16, Code of Alabama, 1975, as amended, 8
9
details the process for the City of Prattville to declare certain unsafe structures a public 10
11
nuisance and order repair or demolition; and 12
13
WHEREAS, §11-53B-3, Code of Alabama, 1975 as amended, requires the City’s order 14
15
to repair or demolish an unsafe structure be sent to the owner of the property and those having 16
17
legal interest in the property; and 18
19
WHEREAS, §11-53B-3 and §11-53B-4, Code of Alabama, 1975, as amended, requires 20
21
the owners to repair or demolish the unsafe structure within forty-five (45) days of being issued 22
23
an order from the City or to request a hearing before the City Council of the City of Prattville 24
25
within thirty (30) days of the order; and 26
27
WHEREAS, §11-53B-3, Code of Alabama, 1975, as amended, permits the City to repair 28
29
or demolish an unsafe structure if the owner fails to comply with the City order; and 30
31
WHEREAS, §11-53B-5, Code of Alabama, 1975, as amended, permits the City Council 32
33
to adopt a resolution affixing the cost of demolition and establishing a lien against the property; 34
35
and 36
37
WHEREAS, the City Council finds that: 38
39
1. The City’s Chief Building Official declared the residential structure at 156 Durden 40
Road to be an unsafe structure on December 18, 2023; and 41
2. The City’s Code Enforcement Officer issued an order to Roy Earnest H Jr c/o Flora -42
Bama Home Solutions Inc., on January 31, 2024, to have the property repaired or 43
demolished within forty-five (45) days of the notice; and 44
3. Roy Earnest H Jr c/o Flora-Bama Home Solutions Inc. did not request a hearing 45
before the City Council within thirty (30) days of the notice nor repair or demolish the 46
structure within forty-five (45) days of the notice; and 47
4. The City Council declared the structure located at 156 Durden Road to be unsafe 48
and a public nuisance in Resolution Book 2024, Page 071, on April 2, 2024; and 49
5. The City Council authorized the demolition of the structure and awarded the contract 50
for complete demolition in Resolution Book 2024-A, Page 124, on May 21, 2024; and 51
6. The total cost of demolition was determined to be $9,677.93. 52

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 54
55
the total amount of $9,877.93 (including legal expenses) for the demolition of the dilapidated 56
57
and unsafe structure located at 156 Durden Road is accurate and shall be established as a lien 58
59
against the property. 60

BE IT FURTHER RESOLVED that the City Attorney is authorized to file any actions 62
63
necessary to recover costs to demolish the structure pursuant to §11-53B et seq., Code of 64
Alabama, 1975, as amended. 1

WHEREAS, § 6-5-122 et Seq., of the Code of Alabama, 1975, as amended, permits the 8

City Council of the City of Prattville to declare a public nuisance and have the violation resolved; 10
11
and 12

WHEREAS, in Resolution Book 2024-A, Page 158, on July 2, 2024, the City Council 14
15
of the City of Prattville declared garbage and rubbish at 1274 County Road 85 continued to be 16
17
a public nuisance; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Gardner Archie 20
21
& Julia Mae c/o Gardner Tony, with an address of 1274 County Road 85, Prattville, AL 36067, 22
23
to Parcel Number 10 09 31 0 000 008.001; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on June 7, 2024, 28
29
to correct, remedy or remove the conditions of garbage and rubbish within ten (10) days; and 30
31
WHEREAS, the owner/operator of said property failed and/or refused to correct, remedy 32
33
or remove said nuisance conditions by the expiration of said notice; and 34
35
WHEREAS, Section 46-32 of the City of Prattville Code of Ordinances authorizes the 36
37
City to do such work or make such improvements that are necessary to correct, remedy or 38
39
remove such condition, pay therefore and charge the expenses incurred to the owner/operator 40
41
of such property to the fullest extent authorized by law. 42

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 44
45
the total amount of $1,044.14 (including legal expenses) for the removal of garbage and rubbish 46

public nuisance in Resolution Book 2024-A, Page 114, on May 21, 2024; and 49
5. The City Council authorized the demolition of the structure and awarded the contract 50
for complete demolition in Resolution Book 2024 -A, Page 195, on August 6, 2024; 51
and 52
6. The total cost of demolition was determined to be $7,564.69. 53

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 55
56
the total amount of $7,764.69 (including legal expenses) for the demolition of the dilapidated 57
58
and unsafe structure located at 114 8th Street is accurate and shall be established as a lien 59
60
against the property. 61

BE IT FURTHER RESOLVED that the City Attorney is authorized to file any actions 63

necessary to recover costs to demolish the structure pursuant to §11-53B et seq., Code of 1

WHEREAS, the Sanitation Department has personal property which is no longer needed 7

for public or municipal purposes; and 9

WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the municipal 11

governing body to dispose of unneeded personal property. 13

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 15
16
the following personal property owned by the City of Prattville is no longer needed for public or 17
18
municipal purposes, and said property shall be removed from the inventory of the Sanitation 19

WHEREAS, keeping garbage and rubbish: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 711 Doster Road; 18
19
and 20
21
WHEREAS, the Autauga County tax records list the property owner as Mendez Sasha, 22
23
with an address of 335 Summerhill Road, Prattville, AL 36067, to Parcel Number 19 05 16 3 24
25
001 001.001; and 26
27
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 28
29
Code Enforcement Officer gave written notice to the owner of said property on October 17, 30
31
2024, to correct, remedy or remove the condition of garbage and rubbish within ten (10) days; 32
33
and 34
35
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 36
37
remove said condition by the expiration of said notice; and 38
39
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 40
41
Council to declare the keeping of garbage and rubbish to be a public nuisance and authorizes 42
43
the City to do such work or make such improvements that are necessary to correct, remedy or 44
45
remove such condition, pay therefore and charge the expenses incurred for the abatement 46
47
process to the owner of such property. 48

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 50
51
declares that the garbage and rubbish at 711 Doster Road continued to be a public nuisance 52
53
at the expiration of the notice of violation. 54

BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 56
57
said property removed using City forces or private contractors. The property owner shall have 58
59
the right to remove said nuisance at their expense provided that the removal is done prior to 60
61
the commencement of work by employees or agents of the City of Prattville; however, this does 62
63
not abolish incurred expenses. 64
BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 1

to this request and report such costs to the City Council following its abatement. 3

weeds at said properties to be a public nuisance and has therefore initiated the abatement 61

2. the owner(s) of said properties are ordered to abate said nuisance and appear before the 1
City Council at a Public Hearing at 6:00 p.m. on December 3, 2024, at Prattville City Hall; 2

3. any objections may be filed, in writing, to the City Clerk at least five (5) days prior to the 4
Public Hearing; and 5
4. the fine of $100.00 shall be assessed to the owner(s) of said properties in addition to any 6

September 17, 2024, authorized debt proceeds for various City Projects, to include projects 19
20
previously approved, but not yet completed; and 21

WHEREAS, additional funds in the amount of $8,835,000.00 are needed in the form of 23
24
financing to cover debt for the City Hall Annex Renovations, Vista Pointe Park Improvements, 25
26
Public Safety Training Facility, Parks Tier 1 Projects, Newton Park-Phase II, Spillway Park 27
28
Improvements, Lane Drive Extension projects, and debt issuance costs; and 29

WHEREAS, it is in the best interest of the City to combine debt financing for all said 31
