WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2024- 9
10
B, Page 271, on November 6, 2024, that the abundance of overgrown grass and weeds at 11
12
739 Silver Hills Drive and 1389 Padres Place constituted a public nuisance and set a Public 13
14
Hearing on said nuisance; and 15
16
WHEREAS, the Autauga County tax records list the property owner(s) as follows: 17
18
• 739 Silver Hills Drive – Mattingly Michael & Mattingly Ranae, with an address of 739 19
Silver Hills, Prattville, AL, 36067, to Parcel Number 19 06 14 2 000 001.134 20
• 1389 Padres Place – Candlestick MHC LLC c/o Cameron Bailey, with an address of 21
108 Kacey Marie, Winchester, TX, 37398, to Parcel Number 19 07 25 2 000 002.000; 22
and 23

WHEREAS, notice was provided to correct, remedy or remove overgrown grass and 25
26
weeds; and 27
28
WHEREAS, the owner(s) of said properties have failed and/or refused to correct, 29
30
remedy or remove said nuisances by the expiration of said notices; and 31
32
WHEREAS, the owner(s) of other said properties did not file written objections with the 33
34
City Clerk’s Office within the time prescribed by City of Prattville Code of Ordinances, Section 35
36
46-114 (c); and 37
38
WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on December 39
40
3, 2024, permitting the owner of said property to present evidence, objections and protest 41
42
regarding said nuisance; and 43
44
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, authorizes the 45
46
City to do such work or make such improvements that are necessary to correct, remedy or 47
48
remove such conditions, pay therefore and charge the expenses incurred to the owner of such 49
50
property. 51

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 53
54
declares that the overgrown grass and weeds at 739 Silver Hills Drive and 1389 Padres Place 55
56
continued to be a public nuisance at the expiration of the notice of violation. 57
58
BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds 59
60
at said property removed using City forces or private contractors. The property owner shall 61
62
have the right to remove said nuisance at their expense provided that the removal is done prior 63
64
to the commencement of work by employees or agents of the City of Prattville; however, this 1
2
does not abolish incurred fines and expenses. 3
4
BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 5
6
to this request and report such costs to the City Council following its abatement. 7

WHEREAS, keeping garbage and rubbish: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 1946 Chancellor Ridge 18
19
Road; and 20
21
WHEREAS, the Autauga County tax records list the property owner as White Ervin D, 22
23
with an address of 3606 McGehee Place Drive N, Montgomery, AL 36111, to Parcel Number 24
25
19 01 12 1 001 258.000; and 26
27
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 28
29
Code Enforcement Officer gave written notice to the owner of said property on November 13, 30
31
2024, to correct, remedy or remove the condition of garbage and rubbish within ten (10) days; 32
33
and 34
35
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 36
37
remove said condition by the expiration of said notice; and 38
39
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 40
41
Council to declare the keeping of garbage and rubbish to be a public nuisance and authorizes 42

WHEREAS, it is the desire of the City Council of the City of Prattville to ensure the 11

continuity of the Board’s operation. 13

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 15

Douglas Darr is hereby re-appointed to a one-year term on the Autauga-Prattville Public Library 17
18
Board of Trustees with said term expiring on November 30, 2025, or until a successor is duly 19

qualified and appointed. 21

WHEREAS, the City of Prattville, Alabama, has identified a need for improvements to 10
11
McQueen Smith Road from Cobbs Ford to US-31 (South Memorial Drive); and 12
13
WHEREAS, the City is eligible to apply for funding assistance made available under 14
15
the RAISE Grant Program, through the USDOT; and 16
17
WHEREAS, the RAISE Grant Program can provide grant funding of up to seventy 18
19
(70) percent (%) of eligible project costs from the USDOT, with the remaining balance of not 20
21
less than thirty (30) percent (%) of eligible project costs required to be paid by the City of 22
23
Prattville. 24
25
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 26
27
that the Mayor is hereby authorized to submit the FY 2025 RAISE Grant application to the 28
29
USDOT for funding assistance to increase safety, provide accommodations for safe 30
31
pedestrian and non-motorized access, improve quality of life, relieve traffic congestion, and 32
33
reduce travel time on McQueen Smith Road. 34
35
BE IT FURTHER RESOLVED that the City of Prattville commits matching funds for 36
37
said project should the grant be awarded by the USDOT and implemented. 38
39
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 40
41
all documents necessary to carry out the intent of this Resolution. 42

WHEREAS, Long-Lewis of the River Region, Inc. has requested an extension of 19

incentives for a period of five (5) years; and 21

WHEREAS, the City and County concur the additional time frame will be mutually 23
24
beneficial to all parties. 25

WHEREAS, Jim Matthews is the petitioner of the property described in Attachment “A” 9

and Attachment “B”; and 11

WHEREAS, said property to be rezoned is located inside the Corporate Limits West of 13
14
Rocky Mount Road and East of Magnolia Ridge; and 15
16
WHEREAS, the petitioner wishes to rezone the approximately 26.5 +/- acre property 17
18
from FAR to R-3 and B-2; and 19
20
WHEREAS, a Public Hearing on the proposed rezoning was held by the City of Prattville 21
22
Planning Commission on November 21, 2024; and 23
24
WHEREAS, the Planning Commission did recommend the zoning of said property, as 25
26
described in Attachment “A” be amended from FAR to R-3 and Attachment “B”, be amended 27
28
from FAR to B-2. 29

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 31

a Public Hearing is set for January 7, 2025, at 6:00 p.m. at Prattville City Hall. 33

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows: 3

THAT the zoning ordinance of the City of Prattville, Alabama, and the zoning map are 5
6
hereby amended to reclassify the property described in Attachment “A” be amended from FAR 7
8
to R-3 and Attachment “B”, be amended from FAR to B-2; and 9
10
THAT this proposed Ordinance and a synopsis were advertised for two (2) weeks in the 11
12
Montgomery Advertiser, a newspaper of general circulation within the Corporate Limits of the 13
14
City of Prattville, and that the City Council at its Public Hearing on January 7, 2025, at 6:00 15
16
p.m., considered said proposed Ordinance and that at such time and place all persons who 17
18
desired had an opportunity to be heard in favor of or in opposition to such Ordinance. 19
20
ALL other items and provisions of the zoning ordinance not herein specifically amended 21
22
shall remain in full force and effect. 23

THE amendments herein contained were considered and recommended by the City of 25
26
Prattville Planning Commission on November 21, 2024. 27

THIS Ordinance shall become effective upon its passage and execution as provided by 29
30

Between Autauga County, the Water Works Board of the City of Prattville and James 4
Hardie Building Products Inc. in Support of Project Mayfield to Extend Economic 5
Development Incentives for Two (2) Years.] 6

WHEREAS, in Resolution Book 2022-A, Page 101, on June 7th, 2022, the City Council 10
11
of the City of Prattville authorized the Mayor to enter into an economic development agreement 12
13
for an incentive package with Autauga County, the Water Works Board of the City of Prattville 14
15
and James Hardie Building Products, Inc. in support of Project Mayfield; and 16
17
WHEREAS, James Hardie Building Products, Inc. has requested an extension of 18
19
incentives for a period of two (2) years; and 20
21
WHEREAS, the City, County, and Water Works Board concur the additional time frame 22
23
will be mutually beneficial to all parties. 24
25
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 26
27
the Mayor is hereby authorized to enter into an amended economic development agreement 28
29
in support of Project Mayfield to extend the economic development incentives for two (2) years. 30
31
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 32
33
all documents necessary to effectuate the provisions of said incentives to the extent and as 34
35
permitted by applicable law, and to take all such further action as shall be necessary to carry 36
37
out the purposes and intent of this Resolution for and on behalf of the City of Prattville. 38
