WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2024- 9
10
B, Page 279, on November 19, 2024, that the abundance of overgrown grass and weeds at 11
12
708 Waverly Lane and 217 Clubview Drive constituted a public nuisance and set a Public 13
14
Hearing on said nuisance; and 15
16
WHEREAS, the Autauga County tax records list the property owner(s) as follows: 17
18
• 708 Waverly Lane – Morland Bruce T Jr & Ann C, with an address of 708 Waverly Lane, 19
Prattville, AL, 36067, to Parcel Number 19 03 05 2 004 001.000 20
• 217 Clubview Drive – Omega Rez 6D LLC, with an address of 4518 Valleydale Road, 21
Hoover, AL, 35242, to Parcel Number 19 04 20 1 004 032.000;and 22
23
WHEREAS, notice was provided to correct, remedy or remove overgrown grass and 24
25
weeds; and 26
27
WHEREAS, the owner(s) of said properties have failed and/or refused to correct, 28
29
remedy or remove said nuisances by the expiration of said notices; and 30
31
WHEREAS, the owner(s) of other said properties did not file written objections with the 32
33
City Clerk’s Office within the time prescribed by City of Prattville Code of Ordinances, Section 34
35
46-114 (c); and 36
37
WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on December 38
39
17, 2024, permitting the owner of said property to present evidence, objections and protest 40
41
regarding said nuisance; and 42
43
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, authorizes the 44
45
City to do such work or make such improvements that are necessary to correct, remedy or 46
47
remove such conditions, pay therefore and charge the expenses incurred to the owner of such 48
49
property. 50
51
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 52
53
declares that the overgrown grass and weeds at 708 Waverly Lane and 217 Clubview Drive 54
55
continued to be a public nuisance at the expiration of the notice of violation. 56
57
BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds 58
59
at said property removed using City forces or private contractors. The property owner shall 60
61
have the right to remove said nuisance at their expense provided that the removal is done prior 62
63
to the commencement of work by employees or agents of the City of Prattville; however, this 64
does not abolish incurred fines and expen ses. 1

BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 3
4
to this request and report such costs to the City Council following its abatement. 5

WHEREAS, § 6-5-122 et Seq., of the Code of Alabama, 1975, as amended, permits the 8

City Council of the City of Prattville to declare a public nuisance and have the violation resolved; 10

and 12

WHEREAS, in Resolution Book 2024-A, Page 221, on September 3, 2024, the City 14
15
Council of the City of Prattville declared garbage and rubbish at 231 Caroline Drive continued 16
17
to be a public nuisance; and 18
19
WHEREAS, the Elmore County tax records list the property owner as Reuter Clint, with 20
21
an address of 4426 Fig Avenue, Lanchester, CA 93534, to Parcel Number 26 09 30 0 003 22
23
044.000; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on August 6, 2024, 28
29
to correct, remedy or remove the conditions of garbage and rubbish within ten (10) days; and 30
31
WHEREAS, the owner/operator of said property failed and/or refused to correct, remedy 32
33
or remove said nuisance conditions by the expiration of said notice; and 34
35
WHEREAS, Section 46-32 of the City of Prattville Code of Ordinances authorizes the 36
37
City to do such work or make such improvements that are necessary to correct, remedy or 38
39
remove such condition, pay therefore and charge the expenses incurred to the owner/operator 40
41
of such property to the fullest extent authorized by law. 42

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 44

the total amount of $571.69 (including legal expenses) for the removal of garbage and rubbish 46

at 231 Caroline Drive is accurate and shall be established as a lien against the property. 48

BE IT FURTHER RESOLVED that the City Attorney is authorized to file any actions 50

breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 342 6th Street; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Prattville 20
21
Properties LLC, with an address of 216 Evergreen Street, Prattville, AL 36067, to Parcel 22
23
Number 19 03 08 3 001 005.001; and 24

WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on November 4, 28
29

WHEREAS, in Resolution Book 1996, Page 40, on March 19, 1996, the City Council 7
8
established a policy for the purchase and display of Mayoral portraits; and 9
10
WHEREAS, with the renovations of the Council Chambers, this policy will need to be 11
12
updated. 13
14
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 15
16
hereby amends the policy for the purchase and display of Mayoral portraits as follows: 17
18
1. Commencing with the Election of Mayor in 2025 and upon taking office as Mayor of the 19
City of Prattville, a portrait will be commissioned of the new Mayor at a cost not to exceed 20
industry standards, and upon its completion, this portrait will hang in the Mayor’s Office 21
or Council Chambers. 22
2. When the Mayor leaves office, their portrait will be moved alongside the portraits of other 23
former Mayors in the Council Chambers. 24

WHEREAS, keeping garbage and rubbish: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 611 Hatty Lane; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Soto Sergio, with 20
21
an address of 614 Hatty Lane, Prattville, AL 36067, to Parcel Number 19 05 16 3 001 001.119; 22
23
and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on November 22, 28
29
2024, to correct, remedy or remove the condition of garbage and rubbish within ten (10) days; 30
31
and 32
33
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 34
35
remove said condition by the expiration of said notice; and 36
37
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 38
39
Council to declare the keeping of garbage and rubbish to be a public nuisance and authorizes 40
41
the City to do such work or make such improvements that are necessary to correct, remedy or 42
43
remove such condition, pay therefore and charge the expenses incurred for the abatement 44
45
process to the owner of such property. 46
47
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 48
49
declares that the garbage and rubbish at 611 Hatty Lane continued to be a public nuisance at 50
51
the expiration of the notice of violation. 52
53
BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 54
55
said property removed using City forces or private contractors. The property owner shall have 56
57
the right to remove said nuisance at their expense provided that the removal is done prior to 58
59
the commencement of work by employees or agents of the City of Prattville; however, this does 60
61
not abolish incurred expenses. 62

BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 64
to this request and report such costs to the City Council following its abatement. 1

WHEREAS, said lease agreement will expire on December 31, 2024; and 16

WHEREAS, Fountain City BMX, Inc., a non-profit organization, has expressed a desire 18
19
to continue to operate said BMX Park and possesses the degree of expertise necessary to 20
21
operate said park. 22

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 24
25
hereby authorizes the Mayor to enter into a lease agreement between the City of Prattville 26
27
and Fountain City BMX, Inc. for the continued use of said City property to operate a BMX Park 28
29
for a one-year period from January 1, 2025, through December 31, 2025. 30

WHEREAS, §11-43-2(d) Code of Alabama, 1975, as amended provides that the 7

salaries of elected officials shall be fixed by the Council at least six months prior to a general 9
10
municipal election; and 11
12
WHEREAS, pursuant to Resolution Book 2007-A, Page 070, adopted on November 20, 13
14
2007, and Ordinance Book 2007, Page 034, adopted on December 18, 2007, the Mayor has 15
16
been at the same annual salary since 2008; and 17
18
WHEREAS, pursuant to Resolution Book 2004, Page 010, adopted on November 17, 19
20
2004, the City Council has been at the same annual salary since 2004; and 21
22
WHEREAS, §11-43-9 Code of Alabama, 1975, as amended provides that salaries of 23
24
elected officials, shall not be increased nor diminished during the term for which they have 25
26
been elected, except as described by ordinance; and 27
28
WHEREAS, a comparison was conducted with local area city/county entities; and 29
30
WHEREAS, it is the desire of the City Council to include an increase in salary for the 31
32
next Mayor and Councilors during the 2025-2029 Quadrennium. 33
34
NOW, THEREFORE, BE IT ORDAINED that the City Council of the City of Prattville 35
36
hereby sets the Mayor’s annual salary at $110,000.00 for the first two years of the 2025-2029 37
38
Quadrennium to be compensated in equal monthly payments beginning in November 2025. 39
40
BE IT FURTHER ORDAINED that the City Council hereby sets the Mayor’s annual 41
42
salary at $120,000.00 for the last two years of the 2025-2029 Quadrennium to be compensated 43
44
in equal monthly payments effective in October 2027. The Mayor shall also receive a car 45
46
allowance of $1,000.00 a month during the entire 2025 -2029 Quadrennium beginning in 47
48
November 2025. 49

BE IT FURTHER ORDAINED that the City Council of the City of Prattville shall be 51
52
compensated with an annual salary of $30,000.00, except the President of the City Council 53
54
shall be compensated with an annual salary of $35,000.00, during the 2025-2029 55
56
Quadrennium, to be compensated in equal monthly payments beginning in November 2025. 57
58
BE IT FURTHER ORDAINED the Mayor and City Council are hereby eligible to continue 59
60
participating in the City group health, dental, vision, life, and flexible spending benefits. 61
62
THIS Ordinance shall become effective on the first meeting in November 2025 and shall 63
64
continue in force and effect until repealed by action of the Council. 1

THE provisions of this Ordinance are severable. If any portion of this Ordinance is 3
4
declared invalid or unconstitutional, such declaration shall not affect the parts which remain. 5

WHEREAS, Alabama Ethics Commission Advisory Opinion No. 2018-3 provides that 11

counties and municipalities may enter into a contract through which the municipality 13

reimburses the county for the use of the county’s election equipment and county employees 15

who possess the requisite skill and knowledge to operate the equipment; and 17
18
WHEREAS, the City of Prattville, the Autauga County Commission, the Autauga 19
20
County Board of Registrars and the Autauga County Probate Judge desire to enter into an 21
22
Election Agreement based on the requirements of said Ethics opinion; and 23
24
WHEREAS, Section 11-46-4, Code of Alabama, 1975, as amended, requires that said 25
26
agreement be completed at least 180 days prior to any municipal election; and 27
28
WHEREAS, the Autauga County Commission agrees to allow the use of the DS200 29
30
Electronic Vote Tabulators and the ExpressVote ADA-Compliant Ballot Marking Devices 31
32
to the City of Prattville for the municipal general and run-off elections; and 33
34
WHEREAS, the cost to reimburse the County for said equipment and services is not 35
36
expected to exceed $20,000.00 per election; and 37

WHEREAS, said expenses are a budgeted expense in the City Clerk’s Department. 39

WHEREAS, the Fire Department has since upgraded to the power Ferno cots to assist 15

with avoiding unnecessary injuries to employees while lifting patients; and 17
18
WHEREAS, the power Ferno cot is available for a total cost of $23,830.60; and 19
20
WHEREAS, $6,405.21 was allocated for the manual Stryker cot as part of the original 21
22
purchase cost of the ambulance. 23

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 25
26
the FY2025 Budget is hereby amended as follows: 27
28
Decrease Fire/ Equipment Maintenance $17,425.39 29
Increase Fire/ Capital Outlay $17,425.39 30

BE IT FURTHER RESOLVED that Resolution Book 2021, Page 066 is hereby amended 32
33
to include the full cost of the power Ferno cot, and funds in an amount not to exceed $17,425.39 34
35
are approved and appropriated from the FY 2025 Budget Line Item Fire/ Capital Outlay. 36

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 38
39
all documents necessary to carry out the intent of this Resolution. 40

WHEREAS, in Resolution Book 2022-B, Page 250, on December 20, 2022, Louis C. 7

Colley was re-appointed as Municipal Court Judge / Municipal Court Department Head; and 9

WHEREAS, §12-14-30 of the Code of Alabama, 1975, as amended, provides that the 11
12
term of office for Municipal Court Judge shall be two (2) years and shall continue until a 13
14
successor has been appointed and qualified. 15
16
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 17
18
Louis C. Colley is hereby re-appointed as Municipal Court Judge / Municipal Court Department 19
20
Head of the City of Prattville and shall carry out the duties and responsibilities of said office at 21
22
an annual salary of $30,000.00. Said appointment shall be for a period of two (2) years, from 23
24
January 6, 2025, through January 5, 2027, or shall continue until a successor is duly appointed 25
26
and qualified. 27

BE IT FURTHER RESOLVED that the Municipal Court Judge is hereby eligible to 29
30
continue participating in the City group health, dental, vision, life, and flexible spending benefits. 31

WHEREAS, Alabama Bass Trail desires to conduct and promote an Alabama Bass Trail 9

Tournament Series Divisional with a tournament date of April 26, 2025; and 11

WHEREAS, the City of Prattville shall serve as a host for said event; and 13

WHEREAS, the host fee for said event shall be $8,500.00; and 15
16
WHEREAS, this is a budgeted expense in the Parks and Recreation Department. 17

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 19
20
the Mayor is hereby authorized to enter into an agreement with Alabama Bass Trail to host 21
22
said tournament on April 26, 2025. 23

BE IT FURTHER RESOLVED that funds in an amount not to exceed $8,500.00 are 25
26
hereby authorized and approved to be paid to Alabama Bass Trail for said tournament, and 27

said funds are approved and appropriated from FY2025 Budget Line Item Parks and 29

WHEREAS, in Resolution Book 2022-B, Page 251, on December 20, 2022, Bradley E. 7

Ekdahl was re-appointed as City Prosecutor of the City of Prattville for a period of two (2) years 9

or until a successor was duly appointed and qualified; and 11

WHEREAS, said appointment will end on January 5, 2025. 13

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 15
16
Bradley E. Ekdahl is hereby re-appointed as City Prosecutor of the City of Prattville to carry out 17
18
the duties and responsibilities of said office as authorized by the Code of Alabama, 1975, as 19
20
amended, for a period of two (2) years, from January 6, 2025, through January 5, 2027, or shall 21
22
continue until a successor is duly appointed and qualified. 23
24
BE IT FURTHER RESOLVED that the City Prosecutor shall prosecute cases brought 25
26
before the Municipal Court of the City of Prattville, assist in the preparation of warrants, confer 27
28
with Police Officers as to type and character of evidence required, advise the Police Officers 29
30
on sufficiency and advisability of evidence, recommend dismissal of cases in the Circuit Court 31
32
and perform related work as required. Compensation shall be an annual base salary of 33
34
$16,000.00, plus $175.00 per hour for Appellate Court work . 35

BE IT FURTHER RESOLVED that the City Prosecutor is hereby eligible to continue 37
38
participating in the City group health, dental, vision, life, and flexible spending benefits. 39
