He explained that the property owner 37 desired to keep the existing house lot as R-2, but the rest to rezone in INST for the church’s use. 38 39 Chairman Gardner opened the public hearing. 40 41 Ricky Glenn and Shawn Meeks both appeared on behalf of the request and in support of it. 42 43 Matt Powell, 123 Lee Circle, appeared seeking information on what was being requested. 44 45 Ms Carpenter introduced a resolution to recommend the rezoning from B-2 & R-2 to INST. It was seconded by 46 Mayor Gillespie. Chairman Gardner called for the vote. The motion was approved unanimously. 47 48 2. Zoning Amendment: FAR to R-3 & B-2 60 Location: Rocky Mount Road, east of Magnolia Ridge 1 61 Owner: Steve W. Corbett 62 Petitioner: Jim Mathews 63 Mr Stephens introduced the request. He explained that it was currently one large parcel and the request to zone 64 the northern portion to B-2 and the southern portion to R-3. He also introduced the sketch plan to be heard for 65 the next item on the same location. 66 67 Chairman Gardner opened the public hearing. 68 69 Greg Gillian, Larry Speaks and Associates, appeared for the request. 70 71 Ms Mullins introduced a resolution to recommend the rezoning from FAR to B-2 & R-3. It was seconded by 72 Councilor Chambers. 73 74 Mayor Gillespie expressed concerns about the B-2 portion of the request and whether it was in harmony with 75 the Future Land Use Map and was appropriate in this location. Ms Carpenter expressed similar concerns and 76 asked what other zoning categories would allow mini-storage. She emphasized that everything in B-2 should be 77 considered. 78 79 Jim Mathews, the potential developer, appeared and said his only plan was to building mini-storage at the 80 location. 81 82 Chairman Gardner called for the vote. The motion was approved with the following vote: Yes-Chambers, 83 Gardner, Allen, Mullins; No-Gillespie, Carpenter. 84 85 4. Subdivision Sketch Plan: Magnolia Ridge Phase 2 86 Location: Rocky Mount Road, east of Magnolia Ridge 1 87 Petitioner: Jim Mathews 88 Representative: Larry E Speaks & Associates, Inc. 89 90 Mr Stephens introduced this request and explained that sketch plan is for initial feedback and is non-binding. 91 92 Mayor Gillespie introduced a resolution to approve the sketch plan. It was seconded by Councilor Chambers. 93 94 Chairman Gardner called for the vote. The motion was approved unanimously. 95 96 5. Zoning Amendment: R-2 to R-3 and INST 97 Providence Subdivision 98 Location: Fairview Ave, south of Sycamore Drive; west of Bedford Terrace 99 Owner: Riverside Church of Prattville 100 Representative: Barrett-Simpson, Inc. 101 102 Mr McKinney introduced the request. He stated that this site had this rezoning request, followed by a master 103 plan, and then followed by a preliminary plat request. He introduced all three requests. 104 105 He explained that the proposal was to create a lot for a proposed church site and the rest would be for a single-106 family residential subdivision. 107 108 Councilor Chambers said he had heard concerns about traffic impact and whether a traffic study had been 109 performed. 110 111 DR A F T DRAFT 12/13/2024DRAFT 12/16/2024 DRAFT Prattville Planning Commission November 21, 2024 Minutes Page 3 of 5 Blake Rice, Barrett-Simpson, appeared for the request. He stated he felt the additional access points would be 112 beneficial to traffic. 113 114 Paxton Reiss, City Engineer, suggested that during the design process that a traffic study may need to be 115 performed to determine if a signal would be required. 116 117 Mayor Gillespie asked how long a traffic study would take to perform and the cost of a traffic signal. 118 119 Mr Rice stated he felt there was almost zero chance that the proposed development would create a need for a 120 traffic light. He said he estimated the cost to be approximately $650,000. 121 122 Mayor Gillespie asked if a traffic light at the entrance into the proposed subdivision across from Sycamore might 123 promote people using that intersection. He asked on the cost of a traffic study or signal warrant analysis. Mr 124 Rice said it depended on the scope, but that a signal warrant analysis study would probably be $8,000 to $10,000. 125 126 Chairman Gardner opened the public hearing. 127 128 Warren Scott, 332 Beford Terrace, expressed concerns about children from the neighborhood and their safe 129 access to Newton Park. Mr Stephens stated that the proposed plat included a sidewalk through the proposed 130 subdivision and into the park. Mr Scott said he was concerned about the stormwater and traffic. Mayor Gillespie 131 asked his opinion if a speed bump was installed in the proposed neighborhood how he would feel about it. Mr 132 Scott said he would like that. 133 134 Jim Skelton, 122 Sycamore, said he would like a signal at Fairview and Sycamore. 135 136 Tracy Rawls, 116 Sycamore, said that turning from Sycamore onto Fairview often takes a very long time due to 137 traffic. 138 139 Councilor Chambers asked Mr Rice if there would be any consideration of postponing request in order to perform 140 a traffic study. Mr Rice requested that that requirement be put on the construction plans after a rezoning and 141 preliminary plat. Mr Reiss supported the idea of performing the study as part of the construction plans. He said 142 if the traffic study came back stating a signal is required, then that would be required prior to issuing permits for 143 the construction of the subdivision. Council Chambers said he would recommend that condition. 144 145 Mr Reiss stated that turn lanes on Fairview were part of the City’s comments for this development. 146 147 Mr Rice stated he felt that if a traffic analysis determined that a signal was warranted, it would not be because 148 of the proposed development, but because of the current traffic levels. 149 150 Mayor Gillespie asked about required some type of traffic calming as part of this approval. Mr Stephens 151 suggested leaving the specifics of the traffic calming method to city staff so it could be coordinated with the City 152 Engineer’s office and Fire Marshal’s office to ensure what is installed is compatible. 153 154 Councilor Chambers introduced a resolution to recommend the rezoning. It was seconded by Mr Allen. 155 Chairman Gardner called for the vote. The motion was approved unanimously. 156 157 6. There was no one present desiring to speak, so he closed the 171 public hearing. 172 173 Ms Carpenter introduced a resolution to approve the preliminary plat with the following conditions: 174 1. The proposed rezoning be approved by the City Council 175 2. Traffic Study being conducted to include a traffic signal warrant being performed at the Sycamore 176 intersection 177 3. Traffic calming measures being installed as approved by city staff 178 It was seconded by Mr Mullins. The motion was approved unanimously. 179 180 8. Preliminary Plat: Hale Property Plat 1 181 Location: 170 N Memorial Drive 182 Owner: Logan Hale 183 Representative: Larry E Speaks & Associates, Inc. 184 185 Ms Hudson introduced this request. She stated she would introduce this item for the plat and the rezoning request 186 for the same location, next on the agenda. 187 188 Chairman Gardner opened the public hearing. 189 190 Robert Walker, 323 Walker Street, spoke in opposition of the rezoning request from O-2 to B-2. He spoke of 191 concerns of noise and light and the variety of businesses that could be permitted in B-2. 192 193 Zyna Captain, 313 Walker Street, expressed concerns about the proposal and asked if a wall could be built to 194 mitigate noise. 195 196 Chairman Gardner closed the public hearing. 197 198 Mr Mullins introduced a resolution to approve the plat. It was seconded by Ms Carpenter. 199 200 Councilor Chambers asked for some feedback from the application. Logan Hale appeared for the request and 201 said he would be willing to work with the neighbors to make any new development would not create a nuisance. 202 203 Mayor Gillespie about approvals from ALDOT. Greg Gillian stated that they had presented plans to ALDOT 204 and begun those discussions. Mayor Gillespie expressed his concerns about traffic in the area. 205 206 Ms Carpenter expressed concerns about the zoning request and how it wasn’t in compliance with the FLUM and 207 its proximity to existing residential. 208 209 Mr Stephens stated that the plat as proposed would be compliant with the Subdivision Regulations with the 210 current zoning as well as the proposed rezoning. 211 212 Chairman Gardner called for the vote. He pointed out how the request was inconsistent with the FLUM 222 and potential uses would be incompatible with the adjoining area. 223 224 Mr Allen introduced a resolution to recommend the rezoning. It was seconded by Mr Mullins. The motion 225 failed with the following vote: Yes-Mullins, Chambers; No-Gillespie, Allen, Carpenter, Gardner. 226 227 10. Subdivision Sketch Plan: Moses H Thomas Estate 228 Location: South end of McGriff Street; Johnson Street @ Hwy 82 Bypass 229 Owner: Latricia Gardner 230 Representative: Larry E Speaks & Associates, Inc. 231 232 Mr Stephens introduced the request. He explained how the adjacent Johnson Street was a 25ft right-of-way and 233 the road or drive there was not built to city standards. On the north side, McGriff Street is built to city standards 234 and stubs into the property. 235 236 Mayor Gillespie asked if Johnson Street was an accepted street by the City. Mr Stephens was uncertain if it had 237 be accepted. The Mayor asked Mr Stephens to investigate if it had been accepted by the council. 238 239 Greg Gillian, Larry Speaks & Associates, appeared and stated that it was heir property and the sketch plan was 240 an attempt to divide the property among all the heirs. He stated the initial plan was to subdivide out one parcel 241 for Ms Gardner and not further divide the remaining parcel. 242 243 Latricia Gardner, property owner, appeared for the request. 244 245 Ella Savage, 219 Marion Drive and a member of the family, appeared in support of the request. 246 247 There was discussion that the proposed Lot 1 would be potentially acceptable, but the others as proposed may 248 not. 249 250 Ms Carpenter introduced a resolution to approve the sketch plan. It was seconded by Councilor Chambers. 251 252 Mr Mullins moved to amend to exclude Lots 2-7 and only approve the layout for Lot 1. It was seconded by 253 Councilor Chambers. Sidewalks. Sidewalks are required on both sides of arterial and collector streets. Sidewalks are required on one side of all other streets except alleys. Sidewalks shall not be less than sixty inches in width. Under special conditions of terrain or other factors, the Planning Commission may approve alternate designs. The Planning Commission may require sidewalks or other paths that create connectivity in areas of long blocks or long dead-end streets, between other paths or sidewalks.
