WHEREAS, a public hearing was set by Resolution Book 2024-B, Page 287, on 14

December 3, 2024, and held January 7, 2025, at 6:00 p.m., and that at such time and place 16

all persons who desired had an opportunity to be heard in favor of or in opposition to such 18
19
resolution. 20

WHEREAS, keeping garbage and rubbish: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 106 Buckner Street; 18
19
and 20
21
WHEREAS, the Autauga County tax records list the property owner as Fountain Valley 22
23
Properties, with an address of 780 County Road 58, Prattville, AL 36067, to Parcel Number 19 24
25
02 10 3 002 008.000; and 26
27
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 28
29
Code Enforcement Officer gave written notice to the owner of said property on November 21, 30
31
2024, to correct, remedy or remove the condition of garbage and rubbish within ten (10) days; 32
33
and 34
35
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 36
37
remove said condition by the expiration of said notice; and 38
39
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 40
41
Council to declare the keeping of garbage and rubbish to be a public nuisance and authorizes 42
43
the City to do such work or make such improvements that are necessary to correct, remedy or 44
45
remove such condition, pay therefore and charge the expenses incurred for the abatement 46
47
process to the owner of such property. 48

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 50
51
declares that the garbage and rubbish at 106 Buckner Street continued to be a public 52
53
nuisance at the expiration of the notice of violation. 54

BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 56
57
said property removed using City forces or private contractors. The property owner shall have 58
59
the right to remove said nuisance at their expense provided that the removal is done prior to 60
61
the commencement of work by employees or agents of the City of Prattville; however, this does 62
63
not abolish incurred expenses. 64
BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 1

WHEREAS, the Information Technology Department identified the need to replace the 9

air conditioning and ventilation equipment in the new server room located at 124 W. Main 11

Street; and 13

WHEREAS, two (2) Liebert DS Air Conditioning Cabinets are available from Joe Powell 15
16
and Associates, Inc. at a cost not to exceed $130,707.92; and 17
18
WHEREAS, §41-16-51(a)(15), authorizes the purchase of products related to or having 19
20
an impact upon, security plans, procedures, assessments, measures, or systems, or the 21
22
security or safety of individuals, structures, facilities, or infrastructures to be let without 23
24
competitive bidding; and 25
26
WHEREAS, it was necessary to proceed with the ordering of said cabinets as there is a 27
28
four (4) month lead time on said cabinets. 29

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 31

the FY2025 Budget is hereby amended as follows: 33

WHEREAS, the City Council of the City of Prattville adopted Ordinance Book 2019, 8
9
Page 004, on March 19, 2019, which amended the City of Prattville Code of Ordinances 10
11
Chapter 14 - Cemeteries; and 12
13
WHEREAS, the City has identified a need to restructure said chapter to promote public 14
15
welfare and safety, preserve historical elements, and prevent the City’s cemeteries from falling 16
17
into disrepair and dilapidation. 18
19
NOW THEREFORE BE IT ORDAINED by the City Council of the City of Prattville, that 20
21
Chapter 14, City of Prattville Code of Ordinances is hereby repealed and replaced as follows: 22
23
Chapter 14 – CITY CEMETERIES 24
25
Sec. 14-1. - Purpose. 26
The City of Prattville (City) maintains two public cemeteries that provide space for depositing 27
the remains of eligible deceased persons. In doing so, the City promotes public welfare, 28
preserves a snapshot of our community’s historical timeline, and prevents the cemeteries from 29
falling into disrepair and dilapidation. 30
Sec. 14-2. - Definitions. 31
Assigned Representative – an individual who has invested and verifiable rights to a burial plot 32
or columbarium niche. 33
At-need - services that are organized at the time of death, while death is imminent, or after the 34
death of an individual, and are required immediately. 35
Burial - the placement of human remains in a grave or plot, also called interment. 36
Burial Site - the specific place and location for burying human remains. 37
Cemetery - a place established, maintained, managed, operated, or improved which is 38
dedicated to and used or intended to be used for the permanent interment of human remains 39
and their memorialization and could include land, a columbarium, a mausoleum, a vault, or any 40
combination of one or more. 41
Cemetery Designee - the person designated by the mayor who is responsible for cemetery 42
affairs. 43
City Cemetery - a cemetery owned, controlled, and maintained by a municipality. 44
Columbarium - a structure or building designed to be used for the inurnment of cremains. 45
Coping - using brick, marble, cement, or other materials to outline a single plot or lot. 46
Cremains - the ashes of a cremated human body. 47
Deceased – a human who is no longer living. 48
Double-Depth Burial - an in-ground interment of two casketed human remains. 49
Engraving - the act of writing on a memorial or grave marker. 50
Exhumation - the removal of the deceased from a burial plot. 51
Footstone - a flat memorial marker placed at the foot of a burial plot. 52
Funeral Arrangements - the completion of funeral service arrangements, cremation 53
arrangements, and the financial details of a funeral at the time of death, including the collection 54
of vital statistic information, death certificate information, obituary notice completion, 55
completion of a statement of funeral goods and services selected, and the organizing of funeral 56
and memorial services for families. 57
Grave - a specific and identifiable space of ground in a cemetery that is used or intended to be 58
used for inground burial, also known as a plot. 59
Grave Fence - a fence surrounding a grave site, usually no more than 12 inches tall and 60
constructed of wood, metal, or stone. 61
Grave Marker - a monument typically constructed of bronze or granite that marks the location 62
and deceased occupant of a burial plot. 63
Grave Offering - an item left at a burial plot with the intent of remembrance or honor. 64
Headstone - a flat memorial marker placed at the head of a burial plot. 1
Interment - the burial of the deceased in the ground. 2
Inurnment - the burial of cremated remains in a receptacle and depositing it in a niche. 3
Lot - a group of plots that are part of a specific layout and location in a cemetery that is usually 4
shared between family members. 5
Mausoleum - an external free-standing building constructed as a monument enclosing the 6
burial chamber of a deceased person or people. 7
Monument - a headstone, footstone, or grave marker placed over or near a burial plot in 8
memory of the decedent. 9
Niche - an above-ground, enclosed space that serves a s the resting place for cremains, 10
typically a square or rectangular compartment within a columbarium. 11
Opening and Closing - labor services performed to prepare a site, perform the interment or 12
inurnment service, and restore the area ex-post. 13
Plot - a specific and identifiable space of ground in a cemetery that is used or intended to be 14
used for inground burial, also known as a grave. 15
Pre-need - services that are arranged in advance of a death and contracted with prepayment. 16
Scattering - the lawful dispersion of cremains. 17
Urn - a container that holds cremains and is suitable for burial in a plot or placement in a niche. 18
Sec. 14-3. - Location and burial types. 19
Oak Hill Cemetery is located at 310 Wetumpka Street, Prattville, Alabama 36067. 20
Chapman Cemetery is located at 450 Water Street, Prattville, Alabama 36067. 21

The City shall maintain records of burial plots, lot locations, columbarium niches, and names 23
of the deceased and their dates of birth and death if known. The City shall also maintain records 24
of plot spaces sold, niches sold, and spaces available. 25
26
The City cemeteries allow: 27
1) Burial sites for interment. Unless otherwise noted, burial sites are 5 -foot x 10-foot plots with 28
burial depths set by industry standards. 29
a) Double-depth burial is allowed in most areas with vault installation required. The City 30
makes no warranties or representations that a selected plot can be used for double -31
depth burial. The assigned representative agrees to hold the City harmless and the City 32
be discharged from any liability concerning the occupying space of a plot. 33
b) Due to high groundwater in some areas, a vault is recommended but not required for 34
single burials. However, a vault is required for double-depth burials. The City makes no 35
warranties or representations that groundwater or the weight of settled soil will not 36
impact the design of a casket or urn. The assigned representative agrees to hold the 37
City harmless and the City be discharged from any liability concerning the viability of a 38
casket or urn within a burial plot. 39
c) The placement of mausoleums, vaults, slabs, headstones, footstones, grave markers, 40
coping, benches, grave fences, flag poles, etc., shall be pre-approved by the cemetery 41
designee, documented, and fit within the deeded burial plot. 42
d) Cremains are allowed. No more than two sets of cremains will be permitted in one burial 43
plot or a combination of one traditional burial and one set of cremains. The City makes 44
no warranties or representations that a selected plot can be used for a combination 45
burial. The assigned representative agrees to hold the City harmless and the City be 46
discharged from any liability concerning the occupying space of a plot. 47
e) Pet remains and cremains shall not be buried in a City cemetery. 48
f) Scattering of cremains shall not be allowed in a City cemetery. 49
2) Columbarium for inurnment. Niches are the standard size of 12 -inch x 12-inch x 12-inch. 50
a) Up to two sets of cremains will be allowed in a single niche, depending on the size of 51
the container or urn. The City makes no warranties or representations that a second set 52
of cremains will fit in a niche. The assigned representative agrees to hold the City 53
harmless and the City be discharged from any liability concerning the occupying space 54
of a niche. 55
b) Pet cremains shall not be placed in any columbariu m niche at a City cemetery. 56
Sec. 14-4. - Eligibility. 57
It shall be unlawful for any person to deposit or bury the deceased in City cemeteries without 58
notice to and consent of the person designated by the mayor as the cemetery designee and 59
without having selected and paid for a plot or niche. The City reserves the right to take 60
appropriate legal action when an unapproved interment or inurnment is discovered and 61
substantiated, resulting in the forfeiture of a selected burial plot or columbarium niche and 62
reimbursement of any incurred cost to remove the remains and restore the area to its state 63
before interment or inurnment. 64
Funeral arrangements and services shall be completed by a provider licensed through the 1
Alabama Board of Funeral Services. Interments and inurnments or the opening and closing of 2
a burial plot or columbarium niche shall only be conducted after notifying the mayor’s office 3
AND receiving written approval from the cemetery designee. Funeral directors, families, or 4
assigned representatives shall contact the cemetery designee to verify burial rights, deeds, 5
certificates, and locations. The cemetery designee shall verify and mark all locations, and 6
confirmation will be returned to the requesting entity to proceed. 7

Placement of mausoleums, vaults, slabs, headstones, footstones, grave markers, coping, 9
benches, grave fences, flag poles, etc., shall only be conducted after notifying the mayor’s 10
office AND receiving written approval from the cemetery designee. Funeral directors, 11
monument companies, families, or assigned representatives shall contact the cemetery 12
designee to approve aspects of memorials and settings and their locations. The cemetery 13
designee shall verify and mark all locations, and confirmation will be returned to the requesting 14
entity to proceed. The assigned representative should consult the lawful deed for any pre -15
determined exclusions. 16

Marking forms are available on the City’s website or by contacting the mayor’s office. Markings 18
will not be scheduled during City-designated holidays. 19
20
Any cemetery research will be billed at the rate of $30.00 per hour after the first 30 minutes. 21
Research fees must be paid in full before the release of research information. 22
Sec. 14-5. - Funeral escorts. 23
Pursuant to §11-47-64, Code of Alabama, 1975, as amended, no person shall stop, stand, or 24
park a vehicle within an intersection except when necessary to avoid conflict with other traffic 25
or in compliance with law or the directions of a police officer or official traffic control d evice. 26
Funeral Home vehicles DO NOT have the authority to stop normal traffic flow, block 27
intersections, or disobey traffic signals while overseeing funeral processionals. 28

In the City’s commitment to honor hometown traditions and to ensure a safe and orga nized 30
journey for the deceased and their families and friends, the City of Prattville Police Department 31
provides funeral escorts within the Corporate Limits to cemeteries located in Prattville at no 32
cost. Funeral Homes should contact the police department on weekdays, 48 hours before a 33
funeral, to schedule a police escort. 34
Sec. 14-6. - Interment regulations. 35
1) Plots will be sold on a pre-need or at-need basis. 36
2) The rate charged for a burial plot shall be $1,000.00 per plot for any sold from the effective 37
date of this policy, giving the owner a deed for the selected plot. 38
3) The rate charged for a Transfer of Deed shall be $25.00 per burial plot for any transfer from 39
the effective date of this policy, giving the qualified and eligible assignee a deed for the 40
selected plot. 41
a) For this section, a qualified and eligible assignee is defined as a living person, eighteen 42
years of age or older, who is the deed holder's direct relative or spouse. 43
b) In the event of a deed holder’s death, all remaining vacant plots shall revert t o the 44
beneficiary named in a probated will. If the deed holder did not execute a will, all 45
remaining deeded plots shall revert to the rightful surviving heir in descending order 46
under the Alabama laws of intestate succession and distribution to inherit the estate of 47
the decedent (1. spouse, 2. child, 3. grandchild, 4. parent, 5. sibling, 6. grandparent, 7. 48
appointed guardian). 49
c) The City is not responsible for contacting or independently investigating the existence 50
of an heirship or a decedent's relatives and relies upon the information and affidavit 51
submitted with any request for a deed transfer. Thus, the City makes no warranties or 52
representations that the information received is accurate, and the City shall be held 53
harmless of any claims otherwise. 54
d) The deed holder is responsible for any fees necessary to remove the remains of the 55
deceased for disinterment at any time. 56
4) A deed holder shall not sell any burial plot without first offering it to the City at the original 57
purchase price, as the City retains the option to buy back the plot before the deed holder 58
sells it to any other individual who is not categorized as a qualified and eligible assignee. 59
5) The fee for marking burial plots shall be $100.00 per plot from the effective date of this 60
policy. 61
6) The fee for marking the placement of any mausoleums, vaults, slabs, headstones, 62
footstones, grave markers, coping, benches, grave fences, flag poles, etc., shall be $100.00 63
per plot or lot from the effective date of this policy. 64
7) Military headstones, markers, and plaques shall be allowed when approved and received 1
through the United States Office of Veterans Affairs VA Form 40 -1330 and coordinated by 2
the cemetery designee. 3
8) The City shall not be liable for ensuring the identity of the person whose remains are sought 4
to be interred. 5
9) In the event of total capacity, the City shall maintain a waiting list for burial plots. 6
Sec. 14-7. - Inurnment regulations. 7
1) Niches will be sold on an at-need basis. 8
2) The rate charged for a columbarium niche shall be $1,500.00 per niche for any sold from 9
the effective date of this policy, giving the owner a certificate of rights to conduct no more 10
than two inurnments for one niche. 11
a) Cremains must be encased in a plastic container or an urn that fits in a 12-inch x 12-12
inch x 12-inch niche, sealed to prevent discharge in the event of an accidental tip -over, 13
and engraved or otherwise printed with the deceased's name. 14
2) The rate charged for a niche shall include verifying and marking the niche location, 15
engraving the niche cover, and placing a temporary niche cover during engraving if needed. 16
3) To ensure uniformity, the cemetery designee shall coordinate the engraving of the niche 17
cover exclusively with the City’s chosen vendor. 18
a) A niche cover shall only include the name of the deceased, birth year, and death year. 19
4) A veteran medallion may be affixed to any eligible niche cover when approved and received 20
through the United States Department of Veterans Affairs Form 40-1330M and coordinated 21
by the cemetery designee. The medallion size shall not be larger than 2 inches wide x 1½ 22
inches high x 1/3 inches deep (categorized as a “small” medallion on VA Form 40-1330M). 23
5) The City shall not be liable for ensuring the identity of the person wh ose cremains are 24
sought to be inurned. 25
6) The fee for replacing a niche cover if cremains are removed during an approved relocation 26
process is $500.00 from the effective date of this policy. 27
Sec. 14.8. - Exhumation or relocation of remains. 28
Pursuant to §11-47-64 and §11-47-65, Code of Alabama, 1975, as amended, it shall be 29
unlawful to exhume, relocate, and remove remains or cremains initially located at City 30
cemeteries without following established guidelines adopted by the State Board of Health. 31
Voluntary removal of remains by a relative of the decedent or by deed owner of the burial plot 32
shall be accomplished through the affidavit process prescribed in the code stated above. 33
Sec. 14.9. - Grounds maintenance. 34
The City enlists the Urban Management Division of the Public Works Department (maintenance 35
crews) to protect, maintain, and adequately care for City cemeteries, thereby preserving the 36
character and heritage of these areas with the utmost dignity and respect. Citizens should 37
contact the cemetery designee to report issues or areas of concern at City cemeteries or place 38
a work order with the Public Works Department. 39

1) Unauthorized groundwork, grading, leveling, or excavating upon a burial plot or 41
columbarium site in City cemeteries shall not be allowed without the permission of the 42
cemetery designee. 43
2) No planting of trees, shrubs, sod, or invasive flowers shall be allowed in City cemeteries. 44
3) The City reserves the right to direct the removal or trimming of any tree, plant, shrub, or 45
other plantings located at City cemeteries to maintain proper appearance, safety, and use 46
of the cemeteries. The City will make diligent efforts to advertise removal assignments in 47
advance. 48
4) The City has the discretionary authority to trim and remove all existing trees, shrubs, and 49
plantings that have become unsightly, overgrown, cause a health or safety hazard, or 50
encroach on an adjacent burial plot or columbarium. Hence, no unauthorized trimming, 51
pruning, or removing of a branch from any tree or shrub or cutting grass at City cemeteries 52
is permitted except under the supervision of the cemetery designee. 53
5) The City’s maintenance crews may, at any time, enter a burial plot or lot and columbarium 54
sites to keep them neat and clear of grass, weeds, wilted flowers, insects, and debris. The 55
City’s maintenance crews reserve the right to remove any artifacts, decorations, and grave 56
offerings from burial plots (i.e., artificial flowers, stuffed animals, ribbons, dead plantings, 57
benches, knick-knacks or statues) that are determined to be unsightly or faded and present 58
a safety hazard or detriment to the natural beauty of City cemeteries. Furthermore, the City’s 59
maintenance crews reserve the right to use their discretion to determine ease of 60
maintenance. Semi-annual cleanup days will be scheduled and advertised on the City’s 61
website. 62
6) The City’s maintenance crews are responsible for repairs to the columbarium at City 63
cemeteries while taking reasonable care to ensure the safety of its contents. However, the 64
City will not be held accountable for the loss or destruction of inurned cremains due to 1
vandalism, acts of nature, or unforeseen circumstances. Furthermore, the City shall not 2
willfully take any action or fail to do any act resulting in the loss, destruction, or desecration 3
of any cremains in niches. 4
7) Grave offerings shall not be allowed at columbarium sites at City cemeteries but may be 5
left inside niches during the inurnment ceremony as space permits. 6
8) Grave offerings left at a burial plot or lot must be permanently attached to the headstone. 7
All flowers, planted or artificial, mementos, benches, statues, lights, shepherd hooks, etc., 8
must be placed directly to either side and in line with the headstone to not interfere with the 9
direct line of maintenance equipment. 10
9) The City’s maintenance crews will not be responsible for lost, misplaced, or damaged items. 11
Sec. 14.10. - Personal conduct and security. 12
All persons entering City cemeteries are expected to conduct themselves according to 13
customary good decorum and follow established rules. Per state and lo cal laws, the City shall 14
have the right to prosecute any unlawful acts or ordinance violations. 15

1) It shall be unlawful for any person without proper authority to enter, remain, or be present 17
in a City cemetery between one hour after sunset and one hour befo re sunrise. A violation 18
could constitute criminal trespass in the second degree, a Class C misdemeanor. 19
2) It shall be unlawful for any person to willfully or maliciously damage, deface, remove, or 20
destroy any burial plot, monument, gravestone, container of human remains, memorial to 21
the deceased, or any grave fence or enclosure, or willfully destroy, remove, cut, break or 22
injure any tree, shrub or plant within the enclosure of a City cemetery. A violation could 23
constitute desecration of venerated objects, a Class A misdemeanor. 24
3) It shall be unlawful for any person to willfully or maliciously injure, mutilate, or destroy a 25
human corpse or any remains of the deceased within the enclosure of a City cemetery. A 26
violation could constitute invasion or mutilation of a corpse, a Class C felony. 27
Sec. 14-11. - Protection against loss. 28
The City may carry such insurance for its benefit upon its cemeteries and their contents as it 29
sees fit. However, the City is not obligated to provide insurance for the benefit of deed or 30
certificate holders. 31

THIS Ordinance shall become effective upon its passage and execution as provided by 33
34
law. All Ordinances, or parts of Ordinances, in any manner conflicting herewith are hereby 35
36
repealed. 37
38
THE provisions of this Ordinance are severable. If any portion of this Ordinance is 39
40
declared invalid or unconstitutional, such declaration shall not affect the parts which remain. 41

February 4, 2025, at 6:00 p.m., considered said proposed Ordinance and that, at such time 15

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, that the City of 8
9
Prattville is a City with a population of over 6,000 inhabitants located in the State of Alabama; 10
11
and 12
13
THAT a petition has been presented by all owners of the property located and 14
15
contained which are contiguous to the Corporate Limits of the City of Pra ttville as they are 16
17
now situated; and 18
19
THAT the property described in the petition sought to be annexed is as described in 20
21
Attachment “A”; and 22
23
THAT said property does not lie within the Corporate Limits of any other municipality; 24
25
and 26
27
THAT all owners as defined by §11-42-20, Code of Alabama, 1975, as amended, have 28
29
executed said petition requesting the property be annexed into the City of Prattvi lle; and 30
31
THAT the City of Prattville finds that it is in the best interest of the City of Prattville and 32
33
its inhabitants to annex said property; and 34
35
THAT the City Council of the City of Prattville finds that the petition has met all 36
37
requirements of §11-42-20 through §11-42-23, Code of Alabama, 1975, as amended. 38
39
BE IT FURTHER ORDAINED by the City Council that the Corporate Limits of the City 40
41
of Prattville be extended and rearranged to embrace and include the following property as 42
43
described in Attachment “A”; and 44
45
THAT such property shall become part of the Corporate Limits of Prattville, Alabama, 46
47
upon passage and publication of this Ordinance as required by law. 48

BE IT FURTHER ORDAINED that a copy of the petition be filed in the office of the 50
51
Judge of Probate of Autauga County, Alabama, and that this Ordinance be published in the 52
53
Montgomery Advertiser, a newspaper of general circulation within the Corporate Limits of the 54
55
City of Prattville. 56

Striping on Gardner Road from Upper Kingston Road from Martin Luther King Jr. Drive at a 6

WHEREAS, in Resolution Book 2024-A, Page 174, on July 16, 2024, the City Council 11
12
of the City of Prattville authorized the Mayor to enter into a Preliminary Engineering and 13
14
Construction Agreement with the State of Alabama, acting by and through ALDOT for Project 15
16
No. STPMN-0124( ); CPMS Ref# 100077721 & 100077 717, for the for the resurfacing and 17
18
traffic striping on Gardner Road from Upper Kingston Road to Martin Luther King Jr. Drive; and 19
20
WHEREAS, the Engineering Department has identified a need for engineering services 21
22
for said projects; and 23
24
WHEREAS, Krebs Engineering, Inc. has the expertise to provide said engineering 25
26
services at a total cost not to exceed $47,266.00 (net cost to City not to exceed $9,453.20); 27
28
and 29

WHEREAS, §39-2-2(d)(1), Code of Alabama, 1975, as amended, allows contracts to 31
32
secure services with engineers possessing a high degree of professional skill to be let without 33
34
bidding. 35
36
WHEREAS, said improvements are budgeted expenses in the Gas Tax Fund. 37
38
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 39
40
the Mayor is hereby authorized to enter into an agreement with Krebs Engineering, Inc. for said 41
42
resurfacing and traffic striping project, and funds in the amount not to exceed $47,266.00 (net 43
44
cost to City not to exceed $9,453.20) are hereby approved and appropriated from the FY2025 45
46
Budget Line Item Gas Tax Fund/ Gardner Road Paving. 47

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 49
50
all documents necessary to carry out the intent of this Resolution. 51
