WHEREAS, keeping garbage and rubbish: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 124 Warwick Drive; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Harlin, William 20
21
D, Patricia H Davis & ETAL with an address of 124 Warwick Drive, Prattville, AL 36066, to 22
23
Parcel Number 19 02 10 1 008 022.000; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on November 18, 28
29
2024, to correct, remedy or remove the condition of garbage and rubbish within ten (10) days; 30
31
and 32
33
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 34
35
remove said condition by the expiration of said notice; and 36
37
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 38
39
Council to declare the keeping of garbage and rubbish to be a public nuisance and authorizes 40
41
the City to do such work or make such improvements that are necessary to correct, remedy or 42
43
remove such condition, pay therefore and charge the expenses incurred for the abatement 44
45
process to the owner of such property. 46

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 48
49
declares that the garbage and rubbish at 124 Warwick Drive continued to be a public nuisance 50
51
at the expiration of the notice of violation. 52
53
BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 54
55
said property removed using City forces or private contractors. The property owner shall have 56
57
the right to remove said nuisance at their expense provided that the removal is done prior to 58
59
the commencement of work by employees or agents o f the City of Prattville; however, this does 60
61
not abolish incurred expenses. 62

BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 64
to this request and report such costs to the City Council following its abatement. 1

WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the municipal 11

governing body to dispose of unneeded personal property. 13

Road to US-31 (South Memorial Drive); and 16

WHEREAS, the Engineering Department reviewed an in-depth cost estimate for said 18
19
project and concluded that it would benefit the City to adjust the percentage of match committed 20
21
to said project; and 22

WHEREAS, a new resolution will be brought before the City Council for approval. 24

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 26

WHEREAS, on June 18, 2024, the City Council of the City of Prattville adopted 12

Resolution Book 2024-A, Page 154, authorizing Krebs Engineering, Inc. to submit an 14
15
application to Montgomery Metropolitan Planning Organization (MPO) for the FY2025 16
17
Transportation Alternative Program (TAP) for Selma Highway Pedestrian Access 18
19
Improvements; and 20
21
WHEREAS, the State and the City desire to enter into a Construction Agreement for a 22
23
TAP Project for said Sidewalk Extension improvements for Project No. TAPMN-TA25(933), 24
25
CPMS Ref # 100079724 at a total cost not to exceed $607,919.00 (net cost to City not to 26
27
exceed $121,583.80); and 28
29
WHEREAS, this is a partially budgeted expense in the Capital Projects Fund. 30
31
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 32
33
the FY2025 Budget is hereby amended as follows: 34
35
Increase Capital Projects Fund/ Selma Highway Sidewalks $117,919.00 36
Increase Capital Projects Fund/ Grant Income $ 94,335.00 37
Decrease Development Reserves $ 23,584.00 38

BE IT FURTHER RESOLVED that the City Council hereby authorizes the Mayor to enter 40
41
into a construction agreement with the State of Alabama, acting by and through ALDOT, 42
43
relating to said TAP project. 44

BE IT FURTHER RESOLVED that said agreement be executed in the name of the City, 46
47
by the Mayor, for and on its behalf and that it be attested by the City Clerk and the official seal 48
49
of the City, be affixed thereto. 50

BE IT FURTHER RESOLVED that funds in the amount not to exceed $607,919.00 (net 52
53
cost to City not to exceed $121,583.80) are hereby authorized and approved to be paid for said 54
55
project, and said funds are hereby approved and appropriated from the FY2025 Budget Line 56

Item Capital Projects Fund/ Selma Highway Sidewalks. 58

BE IT FURTHER RESOLVED that upon completion of the execution of said agreement 60

WHEREAS, specifications were drafted for said laser devices; and 12

WHEREAS, one (1) sealed bid was received, opened and read in public on January 6, 14

2025, at 2:00 p.m. in the Council Chambers at City Hall, and See the Night, LLC was the lowest 16
17
responsible bidder at a cost not to exceed $48,300.00 for said laser devices; and 18
19
WHEREAS, State Drug Proceeds will be utilized for the purchase. 20

the Elmore County Commission, the Elmore County Board of Registrars, and the Elmore 4
County Probate Judge at a Cost Not to Exceed $4,000.00 Per Election .] 5

WHEREAS, Alabama Ethics Commission Advisory Opinion No. 2018-3 provides that 9
10
counties and municipalities may enter into a contract through which the municipality 11
12
reimburses the county for the use of the county’s election equipment and county employees 13
14
who possess the requisite skill and knowledge to operate the equipment; and 15
16
WHEREAS, the City of Prattville, the Elmore County Commission, the Elmore County 17
18
Board of Registrars and the Elmore County Probate Judge desire to enter into an Election 19
20
Agreement based on the requirements of said Ethics opinion; and 21
22
WHEREAS, Section 11-46-4, Code of Alabama, 1975, as amended, requires that said 23
24
agreement be completed at least 180 days prior to any municipal election; and 25
26
WHEREAS, the cost to reimburse the County for said services is not expected to exceed 27
28
$4,000.00 per election; and 29
30
WHEREAS, said expenses are a budgeted expense of the City Clerk’s Department. 31
32
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 33
34
hereby authorizes the Mayor to enter into said Election Agreement between the City of 35
36
Prattville, the Elmore County Commission, the Elmore County Board of Registrars, and the 37
38
Elmore County Probate Judge. 39

BE IT FURTHER RESOLVED that funds in an amount not to exceed $4,000.00 per 41

election are hereby authorized and approved to be paid to the Elmore County Commission 43

to reimburse the County for said services and said funds are approved and appropriated from 45

Transportation (USDOT) for the Better Utilizing Investments to Leverage Development 4
(BUILD) Grant Funding for the Widening of McQueen Smith Road from Cobbs Ford Road to 5
US-31 (South Memorial Drive).] 6

WHEREAS, the City of Prattville has identified a need for improvements to McQueen 10
11
Smith Road from Cobbs Ford to US-31 (South Memorial Drive); and 12
13
WHEREAS, the City is eligible to apply for funding assistance made available under the 14
15
BUILD Grant Program, through the USDOT, with a maximum award of $25,000,000.00; and 16
17
WHEREAS, the BUILD Grant Program can provide grant funding of up to eighty percent 18
19
(80%) of eligible project costs from the USDOT with the remaining balance of not less than 20
21
twenty percent (20%) of eligible project costs required to be paid by the City of Prattville. 22
23
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 24
25
City staff is hereby authorized to submit the FY2025 BUILD Grant application to the USDOT 26
27
for funding assistance to increase safety, provide accommodations for safe pedestrian and 28
29
non-motorized access, improve quality of life, relieve traffic congestion, and reduce travel time 30
31
on McQueen Smith Road. 32
33
BE IT FURTHER RESOLVED that the City of Prattville commits to matching funds for 34
35
said project should the grant be awarded by the USDOT and implemented. 36

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 38
39
all documents necessary to carry out the intent of this Resolution. 40
