WHEREAS, §6-5-122 et Seq., of the Code of Alabama, 1975, as amended, permits the 8
9
City Council of the City of Prattville to declare a public nuisance and have the violation resolved; 10
11
and 12
13
WHEREAS, in Resolution Book 2024-B, Page 255, on October 15, 2024, the City 14
15
Council of the City of Prattville declared garbage and rubbish at 326 Marlette Drive continued 16
17
to be a public nuisance; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Mims Michael A, 20
21
with an address of 1453 County Road 52, Billingsley, AL 36006, to Parcel Number 19 05 16 4 22
23
010 001.031; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on July 25, 2024, 28
29
to correct, remedy or remove the conditions of garbage and rubbish within ten (10) days; and 30
31
WHEREAS, the owner/operator of said property failed and/or refused to correct, remedy 32
33
or remove said nuisance conditions by the expiration of said notice; and 34
35
WHEREAS, Section 46-32 of the City of Prattville Code of Ordinances authorizes the 36
37
City to do such work or make such improvements that are necessary to correct, remedy or 38
39
remove such condition, pay therefore and charge the expenses incurred to the owne r/operator 40
41
of such property to the fullest extent authorized by law. 42
43
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 44
45
the total amount of $366.69 (including legal expenses) for the removal of garbage and rubbish 46
47
at 326 Marlette Drive is accurate and shall be established as a lien against the property. 48
49
BE IT FURTHER RESOLVED that the City Attorney is authorized to file any actions 50
51
necessary to recover costs of said removal. 52

WHEREAS, keeping garbage and rubbish: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 145 Chester Street; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Evans Bryant D, 20
21
with an address of 145 Chester Street, Prattville, AL 36066, to Parcel Number 19 02 10 3 006 22
23
003.000; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on November 21, 28
29
2024, to correct, remedy or remove the condition of garbage and rubbish within ten (10) days; 30
31
and 32

WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 34
35
remove said condition by the expiration of said notice; and 36

WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 38

Council to declare the keeping of garbage and rubbish to be a public nuisance and authorizes 40

the City to do such work or make such improvements that are necessary to correct, remedy or 42

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 48

declares that the garbage and rubbish at 145 Chester Street continued to be a public nuisance 50

at the expiration of the notice of violation. 52

BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 54
55
said property removed using City forces or private contractors. The property owner shall have 56
57
the right to remove said nuisance at their expense provided that the removal is done prior to 58
59
the commencement of work by employees or agents of the City of Prattville; however, this does 60
61
not abolish incurred expenses. 62

BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 64
to this request and report such costs to the City Council following its abatement. 1

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows: 8

THAT the zoning ordinance and map are hereby amended to pre-zone the property 10
11
described in Attachment “A” to INST; and 12
13
THAT this proposed Ordinance and a synopsis were advertised for two (2) weeks in the 14
15
Montgomery Advertiser, a newspaper of general circulation within the Corporate Limits of the 16
17
City of Prattville, and that the City Council of the City of Prattville, at its Public Hearing on 18
19
February 4, 2025, at 6:00 p.m., considered said proposed Ordinance and that, at such time 20
21
and place, all persons who desired had an opportunity to be heard in favor of or in opposition 22
23
to such Ordinance. 24

THAT this Ordinance is adopted under the authority of §11-52-85 of the Code of 26
27
Alabama, 1975, as amended, and is contingent on the petitioner completing the process to 28
29
annex property described in Attachment “A” into the City of Prattville no later than 180 days 30
31
following adoption of the Ordinance. 32
33
ALL other items and provisions of the zoning ordinance of the City of Prattville not herein 34
35
specifically amended shall remain in full force and effect. 36

THE amendments herein contained were considered and recommended by the City of 38
39
Prattville Planning Commission on December 19, 2024. 40

THIS Ordinance shall become effective upon its passage and execution as provided by 42

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, that the City of 8

Prattville is a City with a population of over 6,000 inhabitants located in the State of Alabama; 10
11
and 12

THAT a petition has been presented by all owners of the property located and 14
15
contained which are contiguous to the Corporate Limits of the City of Prattville as they are 16
17
now situated; and 18
19
THAT the property described in the petition sought to be annexed is as described in 20
21
Attachment “A”; and 22
23
THAT said property does not lie within the Corporate Limits of any other municipality; 24
25
and 26
27
THAT all owners as defined by §11-42-20, Code of Alabama, 1975, as amended, have 28
29
executed said petition requesting the property be annexed into the City of Prattville; and 30
31
THAT the City of Prattville finds that it is in the best interest of the City of Prattville and 32
33
its inhabitants to annex said property; and 34

THAT the City Council of the City of Prattville finds that the petition has met all 36

BE IT FURTHER ORDAINED by the City Council that the Corporate Limits of the City 40

WHEREAS, this is a budgeted expense in Performing and Creative Arts. 16

WHEREAS, the City of Prattville has identified a need for roadway improvements along 9

Northington Road; and 11

WHEREAS, the City desires to make application for funding assistance for said 13

improvements under the RAA annual grant fund. 15

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 17
18
City staff is hereby authorized to submit the FY2025 RAA annual grant application to ALDOT 19
20
for roadway improvements along Northington Road. 21
22
BE IT FURTHER RESOLVED that the City of Prattville commits to matching funds for 23
24
said project should the grant be awarded by ALDOT and implemented. 25
26
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 27
28
all documents necessary to carry out the intent of this Resolution. 29

WHEREAS, this is a budgeted expense in Performing and Creative Arts. 17

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 19

funds in an amount not to exceed $17,582.25 are hereby authorized and approved to be paid 21
22
to Prattville Carpet, Inc. for said flooring and installation, and said funds are hereby approved 23

[To Authorize Certain Actions with Respect to General Obligation Warrants, Series 2025, of 3
the City of Prattville.] 4

BE IT RESOLVED, by the City Council (the “Council”) of the City of Prattville (the 8
9
“City”) as follows: 10
11
Section 1. The Council has found and determined, and does hereby find, determine 12
and declare, as follows: 13
(a) It is in the best interests of the City to acquire, construct and install various 14
capital improvements within the corporate limits of the City, including, without limitation, 15
the following (collectively the “Series 2025 Improvements”): 16
(i) capital improvements and renovations to Vista Point Park; 17
(ii) capital improvements and renovations to Spillway Park; 18
(iii) construction of a public safety training facility; 19
(iv) extension of Laney Drive; 20
(v) capital improvements and renovations to City Hall Annex; 21
(vi) capital improvements and renovations to Stanley Jensen Stadium; and 22
(vii) capital improvements and renovations to Newton Park. 23
(b) It is necessary and desirable for the City to authorize the structure and offering 24
to the public market of its General Obligation Warrants, Series 2025 (the "Series 2025 25
Warrants"), to finance (i) the costs of the Series 2025 Improvements and (ii) the costs 26
of issuance of the Series 2025 Warrants. 27
(c) The Series 2025 Warrants shall be issued in a maximum principal amount of 28
$15,250,000; provided, however, the expected principal amount of the Series 2025 29
Warrants is approximately $14,750,000. 30

Section 2. Subject to Section 4 hereof, the Council does hereby approve, adopt, 32
authorize, direct, ratify and confirm: 33
(a) the engagement of Stifel, Nicolaus & Company, Incorporated, as underwriter 34
(the “Underwriter”), to provide all investment banking and underwriting services with 35
respect to the offering, sale and issuance of the Series 2025 Warrants; 36
(b) the engagement of Rice Advisory, LLC, as financial advisor, to provide all 37
financial advisory services to the City with respect to the offering, sale and issuance of 38
the Series 2025 Warrants; 39
(c) the engagement of Maynard Nexsen PC as bond counsel, and the preparation 40
of the financing and disclosure documents for the Series 2025 Warrants by such bond 41
counsel; 42
(d) the terms, and distribution by the Underwriter, of a preliminary official 43
statement with respect to the Series 2025 Warrants, on behalf of the City, and upon 44
completion by the City and as approved by the Mayor, Council President, or Finance 45
Director of the City; and 46
(e) the terms and provisions of a warrant purchase agreement (the “Warrant 47
Purchase Agreement”) with respect to the Series 2025 Warrants, by the City and the 48
Underwriter. 49

Section 3. Subject to Section 4 hereof, the Mayor, Council President, and the Finance 51
Director of the City are each hereby authorized and directed to exec ute and deliver the Warrant 52
Purchase Agreement as well as documents related to the aforementioned engagements listed 53
in Section 2 with respect to the Series 2025 Warrants. 54

Section 4. The issuance and sale of the Series 2025 Warrants by the City shall be 56
subject to: 57
(a) the final approval and authorization thereof by the Council, including without 58
limitation the purposes, use of proceeds, principal amounts, terms of maturity and 59
payment dates, interest rates, offering prices and redemption prices and terms, and 60
costs of issuance and credit enhancement; and 61
(b) the approving legal opinion of Maynard Nexsen PC as bond counsel. 62

Section 5. If it becomes necessary for the City to expend any funds for the Series 2025 1
Improvements prior to the issuance of the Series 2025 Warrants, the City hereby declares its 2
official intent that (i) proceeds of the Series 2025 Warrants be used to reimburse the City for 3
capital expenditures made by the City from the funds thereof in the General Fund of the City in 4
amounts not exceeding the lesser of the amounts spent therefor which are eligible for 5
reimbursement under Treas. Reg. 1.150-2 or the total cost of such capital improvements, and 6
(ii) any such reimbursement be made in accordance with Treas. Reg. 1.150 -2. 7

Section 6. All actions heretofore taken, and all agreements, documents, instruments 9
and notices heretofore executed, delivered or made, by any of the officers of the City with 10
respect to any matters referenced herein are hereby ratified and confirmed. 11

Section 7. All resolutions, or parts thereof, of the Council in conflict or inconsistent with 13
any provision of this resolution hereby are, to the extent of such conflict or inconsistency, 14
repealed. 15

Section 8. This Resolution shall take effect immediately. 17

WHEREAS, Kinder Morgan Operating LLC “D” and Products (SE) Pipe Line Corporation 13

has the expertise to provide said services at a cost not to exceed $250,000.00; and 15

WHEREAS, §39-2-2(d)(1), Code of Alabama, 1975, as amended, allows contracts to 17
18
secure services with project management services possessing a high degree of professional 19
20
skill to be let without bidding; and 21

WHEREAS, this is a budgeted expense under Community Initiatives. 23
