1 CITY OF PRATTVILLE PLANNING COMMISSION 2 MINUTES 3 January 16, 2025 4 5 Call to order: 6 Chairman Reuben Gardner called the regular meeting to order at 3:05 p.m. 7 8 Roll Call: 9 Mr. McKinney called the roll. Members present were Mayor Bill Gillespie, Chairman Reuben Gardner, Ms. 10 Paula Carpenter, Fire Marshal Craig Allen, Mr. Mugs Mullins, Vice-Chairman Ken Daniel, and Mr. Seth 11 Hayden. 12 13

The minutes of the December 19, 2025 meeting were approved unanimously. Mayor Gillespie pointed out that 20 the city will not do maintenance on Gaddis-Pitt Rd. 21 22 Committee Reports: 23 None 24 25 Old Business: 26 1. Preliminary Plat: East Memorial Baptist Church Plat 1 27 Location: 1779 Fairview Ave 28 Owner: East Memorial Baptist Church 29 Representative: Jarvis & Associates 30 31 Mr. McKinney introduced this request for the preliminary plat including requested waiver from infrastructure 32 improvements including sidewalks, contours, curb, and gutter. 33
34 Mr. Stephens pointed out the road behind the ABC store is a private drive. Currently, they are separate parcels. 35 The plat will incorporate some of the parcels into the church property. If and when the area becomes developed, 36
it may require sidewalks. 37 38 Mayor Gillespie asked Mr. Stephens to explain the reasons for waivers on setbacks and contours. 39
40 Mr. Stephens explained that contours is standard requirements for preliminary plats. Sometimes they are not 41 required for developments. Staff thought it was a reasonable request. 42 43 Chairman Gardner opened the public hearing. 44 45 Mr. Daniel introduced a resolution to approve the plat with the requested waivers. It was seconded by Mr. 46 Mullins 47 48 Chairman Gardner called for the vote. The motion to approve the plat with waivers was approved unanimously. 49 50 2. Mr. McKinney introduced this request for the preliminary plat including requested waiver from infrastructure 56 improvements including curb and gutter and sidewalks. 57 58 Chairman Gardner opened the public hearing. 59 60 Chris Stamper, nearby property owner, was not for subdividing property because of topography. Also concerned 61 of multifamily residentials. 62 63 Jamye Morris, the developer, explained development purpose and plans. Informed Commission that there are 64 no plans of multifamily residentials. 65 66 Mayor Gillespie explained many years ago it was zoned for multifamily residentials. That is why some people 67 are concerned about development. He stated he is not a fan of flag lots. 68
69 Mr. Morris explained the development will have a street and a cul-de-sac 70 71
Mr. Daniel wondered why the full plans were not included in the preliminary plat. 72 73 Ms. Carpenter introduced a resolution to approve the plat with the requested waivers. It was seconded by Mr. 74
Hayden. 75 76 Mayor Gillespie reiterated that he is not a fan of flag lots. Mayor stated that the lots seem like it will be 77 multifamily residentials. He will not be supporting development. 78 79 Mr. Daniel agrees with the mayor’s concern and wants it postponed. 80 81 Chairman Gardner asked Mr. Stephens to explain development. 82 83 Mr. Stephens explained that the proposed plat is subdividing into two lots, zoned for R-4, and lot is not ideal for 84 multifamily residentials. 85 86 Eric McGreevy, spoke of property loss of property value because of development. 87 88
Mr. Gillespie asked Mr. Stephens to explain if this plat will need six affirmative votes. 89 90 Mr. Stephens explained plat will need six affirmative votes. If the subdivision does not get approved, the reasons 91
of not being approved must be in the minutes. Law requires reasons to be approved, in the minutes, within 30 92 days. 93 94
Mr. Daniel makes a motion to postpone preliminary plat to February 20th meeting. 95 96 Jamye Morris requested to postpone preliminary plat to February 20th meeting. 97 98 Mayor Gillespie requested staff stays in communication as much as legally possible with Planning Commission 99 and with Mr. Morris and remain on the same page. Mayor Gillespie also stated that there will not be additional 100 announcement or signs put out. 101 102 Mr. Stephens explained that a new application would require new advertisement. Since this is a postponement, 103 there won’t be new advertisement. This will not be a new application but a modified plat and a postponement 104 from today. 105 106 New Business: 107 3. Jack Estes was present on behalf of the applicant. 114 115 Chairman Gardner opened the public hearing. 116 117 Ms. Harmen has questions about public safety, wild life, and land usage. 118 119 Mr. Stamper has concerns about public safety and traffic. 120 121 Ms. Deramus wants to know if the development will affect the surrounding area and her property. 122 123 Mr. Taylor has concerns about entrances of the development and wild life. 124
125 Ms. Staken has concerns about traffic and public safety. Asked if a traffic study could be done while peak hours 126 of school. 127
128 Mr. Estes, the representative for proposed development, addressed concerns and questions. 129 130
Ms. Harmen asked Mr. Estes if there would be more recreational spaces added to plans. 131 132 Mr. Estes stated there will be a common space or open area. 133 134 Ms. Rose wants to know how the development impact current residents in the surrounding area. 135 136 Mr. Newman wanted to inform PC of volume and wild life. 137 138 Mr. Allison has concerns about wild life and traffic. 139 140 Chairman Gardner asked Mr. Stephens if there is concerns regarding fire hydrants and water pressure. 141 142 Mr. Stephens stated that the water authority, fire department, and public works provided a letter and expressed 143 no concerns. 144
145 Mr. Davis had concerns about traffic and wanted more traffic calming measures. 146 147
Mr. Estes stated that there is a traffic study underway. 148 149 Mayor Gillespie asked Mr. Estes to explain plans for green space. 150
151 Mr. Estes explained there was no plans for green space or playground. 152 153 Mayor Gillespie asked if Mr. Estes would mind if vote was postponed till after traffic study. 154 155 Mr. Estes stated that they would mind. Mr. Estes stated they would like a vote today and that the traffic study 156 will not have a major effect on the development. 157 158 Ms. Staken questions if the vote will still continue, even though the traffic study is not complete. 159 160 Mr. McGreevy asked if duplexes were allowed. 161
162 Mr. Stephens informed Mr. McGreevy that it would require a special exception. 163 164
Mr. McGreedy has concerns about what type of residential homes being built and possibly bringing down nearby 165 property values. 166 167

Mr. Mullins informed Mr. McGreedy that the type of residential homes will not bring down nearby property 168 values. 169
170 Mr. Taylor believes a vote should not be taken without a traffic study. 171 172 Ms. Rose wants the vote to be postponed until traffic study is complete. 173 174 Mr. Burton disagrees with location of development and concerns of wild life. 175 176 Mr. Estes informs PC that the proposed development is for first time home buyers. 177 178 Ms. Welch has concerns about hazards and nuisances about new residentials and development. Wants sidewalks 179 going to the Junior High School. She also expressed concerns about power lines. 180
181 Mr. Taylor expressed concerns about power lines. 182 183
Mr. Estes addressed concerns over power easements. Stated the development will have a 20 ft of buffer between 184 the easement. Mr. Estes also stated that they are currently doing a study regarding wildlife and natural streams. 185 186
Chairman Gardner asked if Mr. Estes has given wildlife consideration. 187 188 Mr. Estes informed Chairman Gardner there will be a phase 1 ESA study. 189 190 Mr. Howard has concerns about a natural spring, wild life and safety. 191 192 Ms. Harmen reiterated about fencing. She wondered if there will be fencing 193 194 Mr. Estes stated that the development will not have fencing to the north. There will be a natural buffer of roughly 195 100 ft. 196 197 Ms. Coone has concerns about wild life and privacy. 198 199 Mr. Estes states the development will not encroach on neighboring properties. 200
201 Mr. Burton had concerns for wildlife. 202 203
Ms. Welch recalls last meeting there an agreement for fencing. She has concerns about neighbors’ dogs attacking 204 other dogs. She states that her dogs were killed by domestic dogs. She also has concerns about neighbors going 205 into their back yards. She asks why there will not be fencing. 206
207 Mr. Hayden informed Ms. Welch that there was originally more residentials planned and because the amount of 208 residentials has decreased, also the budget. There will not be fencing. 209 210 Chairman Gardner informed the public that there are certain things we can and can’t do. Informed the public that 211 it is a preliminary plat. 212 213 Mr. Stephens informed the public that the last request was a P.U.D. The city could require more conditions and 214 the developer had more flexibility. The commission can’t require provisions for a fence under a single-family 215 subdivision request. Preliminary plat will not come back to Planning Commission. Construction plans will come 216 to staff and the traffic study will be a part of that. Final plat would be administrative review as well. 217
218 Mr. Mullins introduced a resolution to approve the plat with the requested waivers. It was seconded by Mr. 219 Hayden. 220
221 Mayor Gillespie states that the area is a challenging area to develop. The mayor is concerned about school traffic 222 and topography. He also stated he will not support this development 223

224 Ms. Carpenter agrees with the mayor and she does not support the plans. She is disappointed that the traffic study 225
was not complete before planning commission. Ms. Carpenter wished the public was more involved with the 226 comprehensive plan. 227 228 Mr. Estes informed Planning Commission that the traffic study had a 5–6-week completion date. He stated that 229 they will address all the findings of the traffic study during the civil design phase. If it deems traffic calming 230 measures are necessary, it will change the streets to a degree but it will likely be an intersection or round about. 231 It will not change the number of homes. Mr. Estes does not believe it is fair to delay preliminary approval. 232 233 Mr. Daniel asked Mr. Estes if there is a mix or profile on the types of homes that will be developed. 234 235 Mr. Estes said there is no profile made but informed Planning Commission that the homes will be similar to 236
homes in the area. 237 238 Mr. Stephens explained plat will need six affirmative votes. If the subdivision does not get approved, the reasons 239
of not being approved must be in the minutes. Law requires reasons to be approved, in the minutes, within 30 240 days. 241 242
Mr. Reese, City of Prattville Engineer, spoke regarding traffic study and traffic calming measures. Mr. Reese 243 doubts a traffic study will conclude that the development would have a negative effect. Traffic study does take 244 into account peak hours. 245 246 Ms. Carpenter amended motion to include providing adequate traffic calming study and measures as a result and 247 recommendation of the traffic study provided by the developer, as reviewed by the city engineer at the time it is 248 presented. It was seconded by Mr. Mullins. 249 250 Chairman Gardner called for motion vote. The amendment passed unanimously. 251 252 Chairman Gardner called for resolution vote. The motion to approve the plat with waivers and conditions was 253 approved 6-1. Mayor Gillespie voting no. 254 255 Miscellaneous: 256

EVALUATION/COMMENTS:
Street Connectivity: Street frontage on Rocky Mount Rd and an adjoining stub street from the west (Old Willow
Drive)
Water/Sewer: Public water and sewer is in the area.
Staff Comments:
The submitted preliminary plat includes a continuation of the existing Magnolia Ridge subdivision which
currently has entrances on Old Farm Lane. The proposed Phase 2 would have 38 residential lots and connect to
the eastern end of Old Willow Lane in Magnolia Ridge, and continue to Rocky Mount Road.
The preliminary plat also includes a proposed commercial use on the northern portion. The proposed use is a
mini-storage facility. The proposed northern commercial area would be well separated from the southern
residential area by significant topography and a proposed detention area.
The proposed subdivision layout would be compliant with the subdivision regulations and the proposed
underlying zoning.
