NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 18

take place on Tuesday, August 26, 2025, and the Run-Off Election, if necessary, shall be 9

held on Tuesday, September 23, 2025, pursuant to §11-46-22 Code of Alabama, 1975, as 11

amended; and 13

WHEREAS, the incumbent Mayor anticipates being a candidate in said Prattville 15
16
Municipal Elections and as such cannot serve as the Municipal Election Official for said 17
18

WHEREAS, under the authority of Title 11, Chapter 53B, Code of Alabama, 1975, as 8
9
amended, on September 19, 2024, the City of Prattville Chief Building Official declared the 10
11
dilapidated structure at 819 Wilberforce Avenue, Parcel No. 19 03 05 4 009 011.000, to be an 12
13
unsafe structure; and 14
15
WHEREAS, on January 24, 2025, the City of Prattville Code Enforcement Officer sent 16
17
notice ordering the repair or demolition of the dilapidated structure at 819 Wilberforce Avenue 18
19
within 45 days of said notice; and 20
21
WHEREAS, said notice was delivered by certified mail to the property owners on file 22
23
with the Autauga County Revenue Commission, in accordance with §11 -53B-3, Code of 24
25
Alabama, 1975, as amended; and 26
27
WHEREAS, said notice of violation was also published in the Montgomery Advertiser, a 28
29
publication of general circulation, on January 6, 2025, February 2, 2025, February 9, 2025, and 30
31
February 16, 2025, to notify any property heirs; and 32
33
WHEREAS, Title 11, Chapter 53B allows the property owner or other interested parties 34
35
to file a written appeal within thirty (30) days of the date of notice with the City Clerk requesting 36
37
a hearing before the City Council of the City of Prattville; and 38
39
WHEREAS, no written request for a hearing was received within the thirty (30) days of 40
41
the date of notice; and 42
43
WHEREAS, §11-53B-4, Code of Alabama, 1975, as amended, authorizes the City 44
45
Council to determine whether or not the building or structure is unsafe to the extent that it is a 46
47
public nuisance; and 48
49
WHEREAS, no repairs have been made or permits obtained for the dilapidated structure 50
51
located at 819 Wilberforce Avenue by the expiration of the notice, and the structure remains 52
53
unsafe and a public nuisance. 54
55
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 56
57
the dilapidated structure located at 819 Wilberforce Avenue continues to be unsafe and a public 58
59
nuisance that must be repaired or demolished. 60
61
BE IT FURTHER RESOLVED that the City Council instructs the Code Enforcement 62
63
Officer to provide a report of the cost to repair or demolish the dilapidated structure located at 64
819 Wilberforce Avenue to the City Council. 1

WHEREAS, keeping garbage and rubbish: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 118 Overlook Drive; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Pond Nola B 20
21
(LE) and Pond James Rolland with an address of P.O. Box 681933 Prattville, AL 36068, to 22
23
Parcel Number 19 05 15 4 004 003.000; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on March 28, 2025, 28
29
to correct, remedy or remove the condition of garbage and rubbish within ten (10) days; and 30
31
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 32
33
remove said condition by the expiration of said notice; and 34
35
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 36
37
Council to declare the keeping of garbage and rubbish to be a public nuisance and authorizes 38
39
the City to do such work or make such improvements that are necessary to correct, remedy or 40
41
remove such condition, pay therefore, and charge the expenses incurred for the abatement 42
43
process to the owner of such property. 44
45
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 46
47
declares that the garbage and rubbish at 118 Overlook Drive continued to be a public nuisance 48
49
at the expiration of the notice of violation. 50
51
BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 52
53
said property removed using City forces or private contractors. The property owner shall have 54
55
the right to remove said nuisance at their expense provided that the removal is done prior to 56
57
the commencement of work by employees or agents of the City of P rattville; however, this does 58
59
not abolish incurred expenses. 60
61
BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 62
63
to this request and report such costs to the City Council following its abatement. 64

WHEREAS, the 2025 Annual Business Meeting of the Alabama League of Municipalities 8

(ALM), as part of the ALM Annual Convention, will be held at 4:00 p.m. on Thursday, May 15, 10

2025, in Huntsville, Alabama; and 12

WHEREAS, each member municipality is entitled to designate one voting delegate, and 14
15
first and second alternate voting delegates to represent their municipality; and 16
17
WHEREAS, it is the desire of the City of Prattville to name its delegate(s) to ensure its 18
19
voting participation at the Annual Business Meeting. 20

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 22

WHEREAS, the City of Prattville, Alabama, has certain items of personal property which 7

are no longer needed for public or municipal purposes; and 9

WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the municipal 11
12
governing body to dispose of unneeded personal property. 13

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 15
16
the following personal property items owned by the City are no longer needed for public or 17
18
municipal purposes, and said property shall be removed from the inventory of Park and 19
20
Recreation. 21

WHEREAS, certain federal and state grant funding opportunities require municipalities 7
8
to have a written Conflict of Interest policy; and 9
10
WHEREAS, the City of Prattville’s Conflict of Interest statement in the Human 11
12
Resources Policies and Procedures Manual does not meet the criteria for those federal and 13
14
state grant funding opportunities; and 15
16
WHEREAS, the City of Prattville desires to implement a Conflict of Interest Policy for 17
18
Economic Development purposes. 19
20
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville, that 21
22
a Conflict of Interest Policy is now approved as follows: 23
24
ARTICLE I. 25
Purpose 26
The purpose of this Conflict of Interest Policy (“Policy”) is to protect the interest of the City when 27
it is contemplating entering into a transaction or arrangement that might benefit the private 28
interest of an officer or director of the City or might result in a possible excess benefit 29
transaction. This policy is intended to supplement but not replace or supersede any applicable 30
state and federal laws governing conflicts of interest applicable to the City. 31

ARTICLE II. 33
Definitions 34
1. Interested Person. Any director, department head, principal officer, or member of a 35
committee with governing board delegated powers, who has a direct or indirect financial 36
interest, as defined below, is an interested person. 37
2. Financial Interest. A person has a financial interest if the person has, directly or 38
indirectly, through business, investment or family: 39
a. An ownership or investment interest in any entity with which the City has a transaction 40
or arrangement; 41
b. A compensation arrangement with the City or with any entity or i ndividual with which 42
the City has a transaction or arrangement; or 43
c. A potential ownership or investment interest in, or compensation arrangement with, 44
any entity or individual with which the City is negotiating a transaction or arrangement. 45
Compensation includes direct and indirect renumeration as well as gifts or favors that are not 46
insubstantial. A financial interest is not necessarily a conflict of interest. Under Article III, 47
Section 2, a person who has a financial interest may have a conflict of interes t only if the 48
appropriate governing board or committee decides that a conflict of interest exists. 49

ARTICLE III. 51
Procedures 52
1. Duty to Disclose. In connection with any actual or possible conflict of interest, an 53
interested party must disclose the existence of the financial interest and be given the 54
opportunity to disclose all material facts to the directors and members of committees with 55
governing board delegated powers considering the proposed transaction or 56
arrangement. 57
2. Determining Whether a Conflict of Interest Exists. After disclosure of the financial 58
interest and all material facts, and after any discussion with the interested person, he/she 59
shall leave the governing board or committee meeting while the determination of a 60
conflict of interest is discussed and voted upon. The remaining board or committee 61
members shall decide if a conflict of interest exists. 62

3. Procedures of Addressing a Conflict of Interest. 1
a. An interested person may make a presentation at the governing board or committee 2
meeting, but after the presentation, he/she shall leave the meeting during the 3
discussion of, and the vote on, the transaction or arrangement involving the possible 4
conflict of interest. 5
b. The chairperson of the governing board or committee shall, if appropriate, appoint a 6
disinterest person or committee to investigate alternatives to the proposed transaction 7
or arrangement. 8
c. After exercising due diligence, the governing board or committee shall determine 9
whether the City can obtain with reasonable efforts a more advantage ous transaction 10
or arrangement from a person or entity that would not give rise to a conflict of interest. 11
12
d. If a more advantageous transaction or arrangement is not reasonably possible under 13
the circumstances not producing a conflict of interest, the governing board or 14
committee shall determine by a majority vote of the disinterested directors whether the 15
transaction or arrangement is in the City’s best interest, for its own benefit, and 16
whether it is fair and reasonable. In conformity with the above determ ination, it shall 17
make its decision as to whether to enter into the transaction or arrangement. 18
4. Violations of the Conflict of Interest Policy. 19
a. If the governing board or committee has reasonable cause to believe a member has 20
failed to disclose actual or possible conflicts of interest, it shall inform the member of 21
the basis of such belief and afford the member an opportunity to explain the alleged 22
failure to disclose. 23
b. If, after hearing the member’s response and after making further investigation as 24
warranted by the circumstances, the governing board or committee determines the 25
member has failed to disclose an actual or possible conflict of interest, it shall take 26
appropriate disciplinary and corrective action. 27

ARTICLE IV. 29
Records of Proceedings. 30
The minutes of the governing board and all committees with board delegated powers shall 31
contain, at a minimum: 32
a. The names of the persons who disclosed or otherwise were found to have a financial 33
interest in connection with an actual or possible conflict of interest, any action taken to 34
determine whether a conflict of interest was present, and the governing board’s or 35
committee’s decision as to whether a conflict of interest in fact existed. 36
b. The names of the persons who were present for discussions and votes relating to the 37
transaction or arrangement, the content of the discussion, including any alternatives 38
to the proposed transaction or arrangement, and a record of any votes tak en in 39
connection with the proceedings. 40

ARTICLE V. 42
Compensation. 43
a. A voting member of the governing board who receives compensation, directly or 44
indirectly, from any contract for services is precluded from voting on matters pertaining 45
to that member’s compensation. 46
b. A voting member of any committee whose jurisdiction includes compensation for 47
matters and who receives compensation, directly or indirectly, from the contract for 48
services is precluded from voting on matters pertaining to that member’s 49
compensation. 50
c. No voting member of the governing board or any committee whose jurisdiction 51
includes compensation matters and who receives compensation, directly or indirectly, 52
from the contract either individually or collectively, is prohibited from providing 53
information to any committee regarding compensation. 54

ARTICLE VI. 56
Annual Statements. 57
Each director, principal officer, and member of a committee with governing board delegated 58
powers shall annually sign a statement which affirms such person: 59
a. Has received a copy of the conflict of interest policy; 60
b. Has read and understands the policy; 61
c. Has agreed to comply with the policy; and 62

d. Understands the City is subject to Alabama law concerning industrial development 1
authorities and that it must engage primarily in activities which accomplish one or more 2
of its lawful purposes. 3

ARTICLE VII. 5
Periodic Reviews. 6
To ensure the City operates in a manner consistent with Alabama law, periodic reviews shall 7
be conducted. The periodic reviews shall, at a minimum, include the following subjects: 8
a. Whether compensation arrangements and benefits are reasonable based on 9
competent survey information, and the result of arm’s length bargaining. 10
b. Whether partnerships, joint ventures, and arrangements with management 11
organizations conform to the City’s written policies, are properly recorded, reflect 12
reasonable investment or payments for goods and services, and further industrial 13
development purposes. 14

ARTICLE VIII. 16
Use of Outside Experts. 17
When conducting the periodic reviews as provided in Article VII, the City may but need not, use 18
outside advisors. If outside experts are used, their use shall not relieve the governing board of 19
its responsibility for ensuring periodic reviews are conducted. 20

Section 1. In conformity with the provisions of §40-23-210 through §40-23-213, Code of 12
Alabama, 1975, as amended, providing for a State Sales Tax Holiday, the City of Prattville, 13
Alabama, exempts “covered items” from municipal sales and use tax during the same perio d, 14
beginning at 12:01 a.m. on the third Friday in July (July 18, 2025) and ending at twelve midnight 15
the following Sunday (July 20, 2025). 16

Section 2. This Ordinance shall be subject to all terms, conditions, definitions, time periods, 18
and rules as provided by §40-23-210 through §40-23-213, Code of Alabama, 1975, as 19
amended, except that the time period shall only be as specified in Section 1 above and not for 20
all years thereafter. 21

Section 3. The City Clerk is hereby authorized and directed to certify a cop y of this Ordinance 23
under the seal of the City of Prattville, Alabama, and to forward said certified copy to the 24
Alabama Department of Revenue to be recorded and posted on the department website. 25

Section 4. This Ordinance shall become effective upon its passage and publication as required 27

secure services with engineers possessing a high degree of professional skill to be let without 26
27
bidding; and 28

WHEREAS, said expenses will be expended in FY2026. 30

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 32

the Mayor is hereby authorized to enter into an agreement with Sain Associates, Inc. for said 34
35
engineering services, and funds in the amount not to exceed $218,500.00 will be appropriated 36

from the FY2026 Budget Line Item Capital Projects Fund/ ATRIP II Hwy 82. 38
