CITY OF PRATTVILLE PLANNING COMMISSION MINUTES April 17, 2025 Call to order: Chairman Reuben Gardner called the regular meeting to order at 3:01 p.m. Roll Call: The roll was called. Members present were Mayor Bill Gillespie, Chairman Reuben Gardner, Vice-Chairman Ken Daniel, Mrs. Paula Carpenter, Mr. Cody Daughtry, Mr. Seth Hayden, and Mr. Mugs Mullins. Absent were Councilor John Chambers and Fire Marshal Craig Allen.

The minutes of the March 20, 2025 meeting were approved unanimously. Committee Reports: None OLD Business: 1. Preliminary Plat: Lower Kingston Plat 1 Location: Lower Kingston Road Owner: Linda Gail Randolph Representative: Alabama Land Surveyors, Inc. This item was previously postponed. Ms. Hudson provided a brief review of the proposed preliminary plat. James Monk of Alabama Land Surveyors, Inc., petitioner’s representative, stated that there were no significant
changes to the preliminary plat as it was previously presented. He stated that the question of concern was regarding elevation and the plat shows the Lot 2 proposed structure will be outside of FEMA’s base flood elevation.
Mrs. Carpenter commented that flag lots are not favorable in a subdivision asking why are they being allowed for this subdivision. Ms. Hudson stated that the subdivision does meet the regulations. Dustin Woodley of Alabama Signature Homes provided more details to the proposed preliminary plat. He stated that a small ravine was provided to the right to slow water runoff to the street. Mr. Daniel introduced a resolution recommending approval of the preliminary plat of Lower Kingston Plat 1 and moved for its approval. Mr. Hayden seconded the motion. Mrs. Carpenter asked why is this plat an exception to flag lots. Chairman Gardner stated that the subdivision meets the subdivision regulations and was previously postponed to ensure flood requirements are being met. After their discussion, the vote was called. The motion to approved passed by 6/1 vote as recorded. Favor:
Chairman Gardner, Vice-Chairman Daniel, Mrs. Carpenter, Mr. Daughtry, Mr. Hayden, and Mr. Mullins. Opposed: Mayor Gillespie.

New Business: 2. Zoning Amendment: B-2 to R-3 Location: County Road 4 E and Washington Ferry Road Petitioner: City of Prattville Mr. McKinney introduced proposed zoning amendment for 16 lots located on County Road 4 East and Washington Ferry Road. The existing lots are in a Business zoned district and are currently being used as single-family resident except one lot which is currently undeveloped. He stated that the Future Land Use Map (FLUM) designates the area as mixed use residential. Chairman Gardner opened the public hearing. Dennis Mullins stated that he owns property in the Industrial Park area and wanted to know the reason that the
city is proposing the rezoning. Mr. Mullins stated that the city has found properties throughout that have been zoned differently than the use and this is a way to correct those that are improperly zoned.
After no further comments, the public hearing was closed. Mrs. Carpenter introduced a resolution recommending approval of the zoning amendment from B-2 to R-3 and moved for its approval. Mr. Daniel seconded the motion.
In their discussion, Mayor Gillespie encouraged the rezoning stating that it offers protection to the existing homes that could be impacted by future business development. Chairman Gardner allowed Dorothy Smith to ask a question for clarity of location of lots. After no further comments, the vote was called and the motion passed unanimously. 3. Preliminary Plat: Moses H Thomas Estate Plat 1 Location: South end of McGriff Street; Johnson Street at Hwy 82 Bypass Owner: Latricia Gardner Representative: Larry E Speaks & Associates, Inc.
Ms. Hudson introduced the preliminary plat of Moses H Thomas Estate Plat 1 which is proposed for 2-lots. She stated that the sketch plan (7 lots) of the proposed development was approved in November 2024 to allow development of Lot 1. She stated that the curb and gutter waiver request is no longer being requested. Chairman Gardner opened the public hearing.
Greg Gillian of Larry E Speaks & Associates, Inc., petitioner’s representative, presented the preliminary plat of Moses H Thomas Estate Plat 1. He stated that the 2-Lot subdivision will allow for immediate development of Lot 1 and Lot 2 remains for future development. He stated that a reserved area for a future cul-de-sac is provided as requested by the Engineer and a 10’ water main easement is provided as requested by the Water Works Board. Will Boartfield, adjacent property owner, asked about the access point for the proposed subdivision and discussion about a barricade. Mr. Gillian stated that the access point will be from McGriff Street for Lot 1. He stated that the barricade belongs to the city. Mr. Reiss stated that and will be discussed once the proposed plan of development are presented to the city.
Danna Patterson, adjacent property owner and The Cove’s Home Owner’s Association (HOA) representative, stated that the HOA has been maintaining the barricade and presumed that it belonged to them. She also expressed concerns about the access from McGriff Street. Terry Stanfield, adjacent property owner and Dennis Mullins wanted clarity on the proposed development and cul-de-sac.
Latricia Gardner, petitioner, expressed her desire to build a home on Lot 1 and Lot 2 is reserved for her family for future development how they choose.

Ms. Patterson asked out of curiosity why Johnson Street wasn’t proposed as the access. Mr. Hayden stated that
the plat shows that Lot 2 has access to Johnson Street and Lot 1 will access McGriff Street. After no further comments, the public hearing was closed. Mr. Hayden introduced a resolution to approve the preliminary plat of Moses H. Thomas Estate Plat 1 and moved for its approval. Mr. Mullins seconded the motion. After no further discussion, the vote called and the motion to approve passed unanimously. 4. Preliminary Plat: Durden-Gaddis Pit Plat 1 Location: Gaddis-Pitt Road and Durden Road Owner: William Turner Representative: Alabama Land Surveyors, Inc.
Ms. Hudson introduced the preliminary plat of Durden-Gaddis Pit Plat 1 subdividing 1.86 acres into two lots. She stated that this is a revised plat of the previously approved plat submitted December 2024. There were
changes in the lot sizes. Waivers to the Subdivision Regulations are being requested for the curb & gutter and sidewalks.
Chairman Gardner opened the public hearing. James Monk of Alabama Land Surveyors, Inc., petitioner’s representative, presented the preliminary plat of Durden-Gaddis Pit Plat 1. He stated that this plat provides access to Durden Road, eliminating the need for a turnaround access. Chairman Gardner was briefly excused. Vice-Chairman Daniel continued the meeting. Mr. Mullins introduced a resolution approving the requested waivers and moved for its approval. Mr. Hayden seconded the motion. The motion to approve passed unanimously. Chairman Gardner resumed his seat. Mr. Mullins introduced a resolution to approve the preliminary plat of
Durden-Gaddis Pit Plat 1 with requested waivers and moved for its approval. Mr. Daughtry seconded the motion. Mayor Gillespie mentioned that the proposed plat shows Gaddis Pit Road as a “prescriptive paved right-of-way” and it is not maintained by the city and will not be maintained until it goes through the proper process for acceptance.
After no further discussion, the vote was called and the motion to approve passed unanimously. 5. Preliminary Plat: Yarbrough Subdivision Plat 1C Location: 530, 536, and 546 W 4th Street Owner: Loyd & Juanita Bittle Representative: Alabama Land Surveyors, Inc. Mr. McKinney introduced the preliminary plat of the Yarbrough Subdivision Plat 1C re-plating three lots into two lots. He stated that the petitioner is requesting waivers to the Subdivision for sanitary sewer, curb & gutter, and sidewalks. Chairman Gardner opened the public hearing. There were none to speak, the public hearing was closed. Mayor Gillespie introduced a resolution to approve the requested waivers and moved for its approval. Mrs.
Carpenter seconded the motion. The motion to approve passed unanimously. Mayor Gillespie introduced a resolution to approve the preliminary plat of Yarbrough Subdivision Plat 1C with

6. Preliminary Plat: Old Farm Lane Plat 1 Location: Old Farm Lane South Owner: Phota II-PG OZ Prattville LLC Representative: Alabama Land Surveyors, Inc. Ms. Hudson introduced the preliminary plat of Old Farm Lane Plat 1 for two commercial lots. The existing structure are proposed to be demolished. Chairman Gardner opened the public hearing. Jon Lee Finnegan asked if the proposed use for a hotel is being considered, design and layout, and traffic increase with the development. James Monk of Alabama Land Surveyors, Inc., petitioner’s representative, presented the preliminary plat of Old
Farm Lane Plat 1. He stated that the petitioner is a hotel group but he could not speak in detail on the proposed plan designs.
Linda Gilmore, representative of the owners of 500 Old Farm Lane S, inquired about the affect the development will have on the residents of the apartment complex (Willow Ridge).
Ms. Hudson stated that the development plans will be reviewed by the city departments once submitted for permitting. Mr. Paxon stated that construction plans for two hotels had been received into Engineering Department and have gone through its initial review and are now waiting on resubmittal of those plans. Mr. Daughtry introduced a resolution to approve the preliminary plat of Old Farm Lane Plat 1 and moved for its approval. Mr. Hayden seconded the motion. The motion to approve passed unanimously. 7. Zoning Amendment: R-3 Location: Saratoga Lane and Sydney Drive S Extension Owner: David L. Avant / Diane R. Avant Petitioner: BSI, Inc. Mr. McKinney introduced the zoning request of Glennbrook 10. Chairman Gardner opened the public hearing. There were none to speak, the public hearing was closed. Mrs. Carpenter introduced a resolution recommending the approval of the zoning amendment to R-3 and
moved for its approval. Mr. Daniel seconded the motion. Mrs. Carpenter had questions about the property being zoned as R-2. Mr. Rice explained that the southern portion only is zoned R-2. After no further discussion, the vote was called. The motion to approve passed unanimously. 8. Preliminary Plat: Providence Subdivision Location: Fairview Ave, south of Sycamore Drive; west of Bedford Terrace Owner: Riverside Church of Prattville Representative: Barrett-Simpson, Inc. Mr. McKinney introduced the preliminary plat of Providence Subdivision with 35 lots with street connecting to Fairview Ave and Bedford Terrace. Chairman Gardner opened the public hearing. Wade Newman, commented about mixed use development. Dennis Mullins concerned about traffic.
Mr. Reiss stated that a right-hand turn lane is required for entrance into the proposed development as discussed with the developer.

Staff Comments:
The applicant is requesting to subdivide the proposed preliminary plat into four lots for residential use, totaling
1.36 acres. Lots 1 and 2 will have frontage on Lower Kingston Road and are not considered flag lots. However,
rear lots 3 and 4 are considered flag lots due to the proposed lots being set back from the street they front. The
access strip (the stem) will serve as a shared drive connecting the lots to the street with the required 20 feet of
frontage (Subdivision Regulations 4.6 (3 & 4)).
Lots 1 and 2 are in flood zone AH and must comply with FEMA requirements and obtain the necessary permits.
Please note that an existing structure is located on the parcel where proposed Lot 1 is situated. The applicant can
provide further details regarding whether the existing structure will be demolished or brought up to code.
However, if any improvements exceed 50% of the $54,000 market value, flood-proofing modifications under the
Flood Damage Prevention Ordinance would be required (Unit 8: Substantial Improvement & Substantial
Damage).
The Prattville Planning & Development Department recommends approval of the proposed preliminary plat under
the condition that the identified parties establish an easement access agreement. Additionally, if the applicant
chooses not to demolish the existing structure, they must submit documentation of the estimated renovation cost
and apply for the necessary permits.

COMPREHENSIVE PLAN / FUTURE LAND USE MAP:
On April 15, 2021, the Planning Commission adopted an updated Prattville Comprehensive Plan. The Future Land
Use Plan and Map in Land Use + Transportation section (pg. 40) of the document shows the subject parcel in a
Mixed-Use Residential area.
The boundaries of land use categories shown on the Future Land Use map should not be interpreted rigidly, but the
general pattern should be observed to support comfortable transitions between uses.
PLANNING STAFF COMMENTS:
These parcels are developed as and used as single-family residences. Most of the lots comply with R-3 zoning.
It is unknown why the lots are currently zoned B-2. Only one of the addresses, in the subject area, is owned by a
local business and is undeveloped. Any existing use that may be nonconforming to R-3 will be “grandfathered”
and permitted to continue, but may not expand, and if discontinued, may lose the grandfathered status.
The Planning Commission should consider the full range of permitted uses for rezoning requests, not just the
proposed use.

Staff Comments:
The applicant is requesting to subdivide the proposed preliminary plat into two lots for residential use, totaling
approximately 3.53 acres. Lot 1 will consist of 0.5 acres with frontage on McGriff Street, while Lot 2 will consist
of 3.03 acres with frontage on Johnson Street.
According to the applicant, development is only proposed for Lot 1 at this time. Lot 2 will remain in its current
undeveloped condition until a future phase. The applicant may provide additional information regarding the
anticipated development timeline, frontage, easement access, and site accessibility.
Per the Subdivision Regulations, when a subdivision occurs along a right-of-way that does not meet current
standards, the subdivider is required to dedicate additional right-of-way and complete half-street improvements.
In this case, Johnson Street has a right-of-way width of 25 feet. Therefore, the subdivider would be required to
dedicate 12.5 feet of additional right-of-way. As Johnson Street is currently a dirt and gravel road, completing the
required half-street improvements may present feasibility challenges.
This proposed plat was previously presented to the Planning Commission as a sketch plan and was approved with
conditions, allowing only Lot 1 to move forward while excluding Lots 2 through 7 from further consideration at
that time..

provided that such waiver shall not have the effect of nullifying the intent and purpose of these regulations. Further
provided, the Planning Commission shall not approve waivers unless it is determined that:
a. The granting of the waiver will not be detrimental to the public safety, health, or welfare or injurious to other
property;
b. The relief sought will not vary the provisions of the Zoning Ordinance.
2. Conditions. In approving waivers, the Planning Commission may require such conditions as will, in its judgement, secure
substantially the purposes and policy of these regulations.
3. Procedures. A request for a waiver shall be submitted in writing with the preliminary plat for the consideration of the
Planning Commission. The request shall state fully the grounds for the request and all of the facts relied upon by the
petitioner.
4.3 Streets
8. Curb and Gutter. Curbs and gutters shall be required for all streets.
9. Sidewalks. Sidewalks are required on both sides of arterial and collector streets.
Sidewalks are required on one side of all other streets except alleys. Sidewalks shall not be less than sixty inches in width.
Under special conditions of terrain or other factors, the
Planning Commission may approve alternate designs. The Planning Commission may require sidewalks or other paths that
create connectivity in areas of long blocks or long dead-end streets, between other paths or sidewalks.

Staff Comments:
The proposed preliminary plat seeks to subdivide a 1.86-acre parcel into two residential lots. Proposed Lot 1 will have
frontage exclusively on Gaddis Pitt Road, while Lot 2 will be a corner lot with frontage on both Durden Road and Gaddis
Pitt Road. Both lots are zoned R-3. Please note that Lot 2 contains an existing residential structure.
A preliminary plat for this parcel was previously presented to the Planning Commission on December 19, 2024, and was
approved. The applicant is now submitting a revised preliminary plat due to changes in the proposed lot sizes. The original
submittal included Lot 1 at 0.61 acres and Lot 2 at 1.25 acres. The revised plat being submitted for consideration at the April
Planning Commission meeting proposes Lot 1 at 0.79 acres and Lot 2 at 1.07 acres.
The proposed preliminary plat is compliant with the Subdivision Regulations.

COMPREHENSIVE PLAN / FUTURE LAND USE MAP:
On April 15, 2021, the Planning Commission adopted an updated Prattville Comprehensive Plan. The Future Land
Use Plan and Map in Land Use + Transportation section (pg. 40) of the document shows the subject parcel in a
Conservation/Greenspace area.
The boundaries of land use categories shown on the Future Land Use map should not be interpreted rigidly, but the
general pattern should be observed to support comfortable transitions between uses.
PLANNING STAFF COMMENTS:
The applicant requests to rezone 103.96 acres from R-2 to R-3. Proposed land use will be a continuation of the
master/sketch planned phase 10 of the Glennbrooke subdivision. Approved plan proposes 114 single family
residential lots. The development would have street connectivity at Saratoga Lane and Sydney Dr.
The Planning Commission should consider the full range of permitted uses for rezoning requests, not just the
proposed use.
