WHEREAS, a public hearing was set by Resolution Book 2025, Page 096, on April 15, 14

WHEREAS, §6-5-122 et seq., of the Code of Alabama, 1975, as amended, permits the 8

City Council of the City of Prattville to declare a public nuisance and have the violation resolved; 10
11
and 12

WHEREAS, in Resolution Book 2025, Page 009, on January 28, 2025, the City Council 14
15
of the City of Prattville declared the garbage and rubbish at 124 Warwick Drive continued to be 16
17
a public nuisance; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Harlin William D, 20
21
Patricia H Davis & ETAL, with an address of 124 Warwick Drive, Prattville, AL 36066, to Parcel 22
23
Number 19 02 10 1 008 022.000; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on November 18, 28
29
2024, to correct, remedy or remove the conditions of garbage and rubbish within ten (10) days; 30
31
and 32
33
WHEREAS, the owner/operator of said property failed and/or refused to correct, remedy 34
35
or remove said nuisance conditions by the expiration of said notice; and 36
37
WHEREAS, Section 46-32 of the City of Prattville Code of Ordinances authorizes the 38
39
City to do such work or make such improvements that are necessary to correct, remedy or 40
41
remove such condition, pay therefore, and charge the expenses incurred to the owner/operator 42
43
of such property to the fullest extent authorized by law. 44

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 46

WHEREAS, keeping garbage and rubbish: 9

1. is injurious to the public health, safety and general welfare of the community by providing a 11
breeding ground and shelter for rats, mice, snakes, and other vermin; 12
2. may inflict injury on a person going to such property; 13
3. may also pose a fire and environmental hazard; and 14
15
WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16
17
the property and determined the existence of garbage and rubbish at 464 Dawson Street; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Betzhold Wayne 20
21
Carl and Myrtle Wynell with an address of 464 Dawson Street, Prattville, AL 36067, to Parcel 22
23
Number 19 03 07 4 001 030.000; and 24
25
WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on March 27, 2025, 28
29
to correct, remedy or remove the condition of garbage and rubbish within ten (10) days; and 30
31
WHEREAS, the owner of said property has failed and/or refused to correct, remedy or 32
33
remove said condition by the expiration of said notice; and 34
35
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, permits the City 36
37
Council to declare the keeping of garbage and rubbish to be a public nuisance and authori zes 38
39
the City to do such work or make such improvements that are necessary to correct, remedy or 40
41
remove such condition, pay therefore, and charge the expenses incurred for the abatement 42
43
process to the owner of such property. 44

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 46
47
declares that the garbage and rubbish at 464 Dawson Street, continued to be a public nuisance 48
49
at the expiration of the notice of violation. 50
51
BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 52
53
said property removed using City forces or private contractors. The property owner shall have 54
55
the right to remove said nuisance at their expense provided that the removal is done prior to 56
57
the commencement of work by employees or agents of the City of Prattville; however, this does 58
59
not abolish incurred expenses. 60
61
BE IT FURTHER RESOLVED the Mayor shall keep an accounting of all costs related 62
63
to this request and report such costs to the City Coun cil following its abatement. 64

weeds at said properties to be a public nuisance and has therefore initiated the abatement 4

2. the owner(s) of said properties are ordered to abate said nuisance and appear before the 6
City Council at a Public Hearing at 6:00 p.m. on June 17, 2025, on the 2nd floor of 124 W. 7
Main Street, Prattville, Alabama; and 8
3. any objections may be filed, in writing, to the City Clerk at least five (5) days prior to the 9
Public Hearing; and 10
4. the fine of $100.00 shall be assessed to the owner(s) of said properties in addition to any 11
costs incurred for the abatement process; and 12

WHEREAS, the City of Prattville possesses a profound and unique history da ting back 9

to its founding in 1839; and 11

WHEREAS, the Autauga County Heritage Association (ACHA) was founded in 1976 to 13

create historical interest and educate the community about the benefits of preservation and the 15
16
significance of the City’s heritage; and 17
18
WHEREAS, ACHA has embarked on a project to develop and construct the PRATT; 19
20
and 21
22
WHEREAS, the PRATT is envisioned as a museum, archival library, STEM education 23
24
Center, and event venue in downtown Prattville; and 25
26
WHEREAS, the City Council of the City of Prattville finds the PRATT will serve and fulfill 27
28
a valid public purpose through the services and opportunities it will provide to the citizens of 29
30
the City of Prattville; and 31
32
WHEREAS, the State of Alabama has allocated $2,000,000.00 towards this project in 33
34
the 2026 Education Trust Fund budget; and 35
36
WHEREAS, the City of Prattville desires to pledge $2,000,000.00 towards the design 37
38
and construction of the PRATT; and 39
40
WHEREAS, this pledge will consist of up to $400,000.00 per year over five years 41
42
beginning with the fiscal year ending September 30, 20 25; and 43
44
WHEREAS, the funding for said pledge will be paid from the Education Reserves of the 45
46
One-Cent Sales tax imposed via Ordinance Book 2021, Page 021; and 47
48
WHEREAS, the funding of the pledge will be on a reimbursement basis, whereby 49
50
invoices for the design and construction of the PRATT are to be presented to the City’s Finance 51
52
Director for approval and release of funds; and 53
54
WHEREAS, there shall be no obligation for funding in any fiscal year covered under the 55
56
pledge should no eligible work be performed on the PRATT. 57

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Prattville 59

that the FY2025 Budget is hereby amended as follows: 61

• Increase Community Initiatives/ the PRATT $400,000.00 63
• Decrease Education One-Cent Reserves $400,000.00 64
BE IT FURTHER RESOLVED, that the City Council hereby pledges and authorizes up 1

to $400,000.00 annually for five years beginning with the year ending September 30, 2025, for 3
4
eligible design and construction expenses on a reimbursement basis for the PRATT. 5

BE IT FURTHER RESOLVED, that any unspent pledge funds each year may be 7

encumbered and rolled forward to a future year for the project, provided the future year is no 9

later than the fiscal year ending September 30, 2029. 11

has a need for a permanent easement of 1800 SQ FT with respect to NE ¼ OF SEC 15 – T17N 16

– R16E; PIN 19 05 15 1 001 001.005 for said project as indicated in Attachment A; and 18

WHEREAS, the City of Prattville has the authority to grant easements over municipal 20
21
property; and 22

WHEREAS, the City Council of the City of Prattville finds that it is in the public interest 24

to convey said easement. 26

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 28

hereby authorizes the Mayor to enter into an agreement with Kinder Morgan Operating LLC 30
