WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2025, 10

Page 112, on May 6, 2025, that the abundance of overgrown grass and weeds at 1456 South 12
13
Memorial Drive, Lot A, 434 Water Street, and 1667 Buena Vista Boulevard constituted a public 14
15
nuisance and set a Public Hearing on said nuisance; and 16
17
WHEREAS, the Autauga County tax records list the property owner(s) as follows: 18
19
•1456 South Memorial Drive, Lot A - Candlestick MHC LLC C/O Cameron Bailey with20
an address of 108 Kacey Marie, Winchester, TN 37398, to Parcel Number 19 06 23 421
000 020.00022
•434 Water Street – Brown Edwina M and Rezentes Julia Jahn with an address of P.O.23

WHEREAS, notice was provided to correct, remedy, or remove overgrown grass and 28

weeds; and 30

WHEREAS, the owner(s) of said properties have failed and/or refused to correct, 32

Remedy, or remove said nuisances by the expiration of said notices; and 34
35
WHEREAS, the owner(s) of said properties did not file written objections with the City 36
37
Clerk’s Office within the time prescribed by City of Prattville Code of Ordinances, Section 46- 38
39
114 (c); and 40

WHEREAS, the City Council held the required Public Hearing at 6:00 p.m. on June 3, 42
43
2025, permitting the owner of said property to present evidence, objections , and protest 44
45
regarding said nuisance; and 46
47
WHEREAS, Chapter 46 et seq., City of Prattville Code of Ordinances, authorizes the 48
49
City to do such work or make such improvements that are necessary to correct, remedy, or 50
51
remove such conditions, pay therefore, and charge the expenses incurred to the owner of such 52
53
property. 54

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 56
57
declares that the overgrown grass and weeds at 1456 South Memorial Drive, Lot A, 434 Water 58
59
Street, and 1667 Buena Vista Boulevard continued to be a public nuisance at the expiration of 60
61
the notice of violation. 62

BE IT FURTHER RESOLVED that the Mayor shall have the overgrown grass and weeds 64

at said property removed using City forces or private contractors. The property owner shall 1

have the right to remove said nuisance at their expense , provided that the removal is done prior 3
4
to the commencement of work by employees or agents of the City of Prattville; however, this 5
6
does not abolish incurred fines and expenses. 7

BE IT FURTHER RESOLVED that the Mayor shall keep an accounting of all costs 9
10
related to this request and report such costs to the City Council following its abatement. 11

City Council of the City of Prattville to declare a public nuisance and have the violation resolved; 10

WHEREAS, in Resolution Book 2024-B, Page 308, on December 17, 2024, the City 14
15
Council of the City of Prattville declared the garbage and rubbish at 342 6th Street continued to 16
17
be a public nuisance; and 18
19
WHEREAS, the Autauga County tax records list the property owner as Prattville 20
21
Properties LLC, with an address of 216 Evergreen Street, Prattville, AL 36067, to Parcel 22
23
Number 19 03 08 3 001 005.001; and 24

WHEREAS, in compliance with Section 46-31, City of Prattville Code of Ordinances, the 26
27
Code Enforcement Officer gave written notice to the owner of said property on November 4, 28
29
2024, to correct, remedy, or remove the conditions of garbage and rubbish within ten (10) days; 30

WHEREAS, the owner/operator of said property failed and/or refused to correct, 34

remedy, or remove said nuisance conditions by the expiration of said notice; and 36

WHEREAS, Section 46-32 of the City of Prattville Code of Ordinances authorizes the 38

WHEREAS, the City of Prattville, Alabama, has certain items of personal property 8

which are no longer needed for public or municipal purposes; and 10

WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the 12

municipal governing body to dispose of unneeded personal property; and 14

WHEREAS, Sunbelt Fire Inc., a distributor of SCBAs, has a program to provide 16
17
refurbished SCBAs to volunteer fire departments who are unable to provide said equipment 18
19
due to funding issues; and 20

WHEREAS, it is the desire of the City Council of the City of Prattville to donate said 22
23
equipment to Sunbelt Fire Inc. for refurbishing and dissemination to volunteer fire departments. 24

a breeding ground and shelter for rats, mice, snakes and mosquitoes , and other vermin;13

3.may hide debris, such as glass or metal, that could inflict injury on a person going to such15

4.may also pose a fire hazard and respiratory hazard; and17

the properties and determined the existence of an abundance of overgrown grass and weeds 21

City Council at a Public Hearing at 6:00 p.m. on July 1, 2025, on the 2 nd floor of 124 W.7
Main Street, Prattville, Alabama; and8
3.any objections may be filed, in writing, to the City Clerk at least five (5) days prior to the9
Public Hearing; and10
4.the fine of $100.00 shall be assessed to the owner(s) of said properties in addition to any11

WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 16

WHEREAS, the Autauga County tax records list the property owner as Cooley Julie, 22

BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 54

said property removed using City forces or private contractors. The property owner shall have 56

WHEREAS, a need has been identified for parking lot improvements at Pratt Pool; and 8

WHEREAS, Alexander Sealcoating and Striping, Inc. has the expertise to complete said 10
11
project at a cost not to exceed $90,535.00 ; and 12
13
WHEREAS, pursuant to §39-2-1, Code of Alabama, 1975, as amended, said project is 14
15
a public works project; and 16
17
WHEREAS, §39-2-2, Code of Alabama, 1975, as amended, allows contracts for public 18
19
works projects under $100,000.00 to be let without bidding; and 20
21
WHEREAS, this is a budgeted expense in the Gas Tax Fund. 22
23
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 24
25
funds in an amount not to exceed $90,535.00, are hereby authorized and approved to be paid 26
27
to Alexander Sealcoating and Striping, Inc. for said project, and said funds are approved and 28
29
appropriated from FY2025 Budget Line Item Gas Tax Fund/ Pool and Library Paving. 30

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 32
33
all documents necessary to carry out the intent of this Resolution. 34

Stivers Ford Lincoln, Inc. at a cost not to exceed $27,965.00; and 15

WHEREAS, this is a budgeted expense in Cultural Arts. 17

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 19

funds in an amount not to exceed $27,965.00 for the purchase of said truck are hereby 21
