Members present were Mayor Bill Gillespie, Councilman Richard Cables, Chairman Tim Smith, Vice-Chairman Reuben Gardner, Mrs. Paula Carpenter, Mr. Mark Hindman and Mr. Mugs Mullins. Absent: Chief Dallis Johnson, and Mr. Roy McAuley. (Quorum present) Staff present: Mr. Scott Stephens, City Planner; Mr. Austin Brass, Senior Planner, and Ms. Alisa Morgan, Secretary. Minutes: Mayor Gillespie moved to approve the minutes of the October 18, 2018 meeting. Councilman Cables seconded the motion. The motion passed unanimously. Mayor Gillespie introduced the new City Planner, Mr. Scott Stephens, and the new appointed Planning Commission member, Mr. Patrick “Mugs” Mullins. He also stated that Mr. McAuley has offered his letter of resignation. Old Business: There was no old business to discuss. New Business: 1. Zoning Amendment: FAR (Forest, Agricultural, Recreation) to B-2 (General Business) Capital View Location: McQueen Smith Road South Petitioner: Bryan Ward Representative: Mike Vaughan Mike Vaughan and Bryan Ward, petitioners, presented the request to zone property from FAR to B-2. Mr. Vaughan stated that the development of the 4.98 acres will be developed similar to types of businesses on McQueen Smith North. Chairman Smith opened the floor for public comments. There were none to speak. The public hearing was closed. Mr. Brass provided the staff comments to the zoning request of the Capital View property from FAR to B-2. He stated that the property to the north of this proposed rezoning was recently rezoned to R-3. He stated that the proposed B-2 is a more intense use than R-3. He stated that the property directly across the street is zoned B-2. He stated that the proposed B-2 request is consistent with the adopted land use plan for this area. Councilman Cables introduced a resolution recommending the approval of the zoning of Capital View from FAR to B-2 and moved for its approval. Mr. Gardner seconded the motion. Zoning Amendment: PUD (Planned Unit Development)/FAR (Forest, Agricultural, Recreation) to B-2 (General Business) Location: Highway 82 at McQueen Smith Road Petitioner: DHS Holding-4, Inc./Wm. Howard Murfee Irrevocable Trust Representative: Allsouth Corporation Joe Turner of Allsouth Corporation, petitioner’s representative, presented the request to amend the zoning of property located on Highway 82 at McQueen Smith Road. He stated that the property to the north of the proposed request will be developed as single family residential under the R-3 zoning requirements. He stated that contract negotiations has restricted the types of development for areas in the proposed B-2 zone. Chairman Smith opened the floor for public comments. Jon Lee Finnegan, 211 Deer Trace, asked questions about access to the property and asked for clarity of the parcels under restrictions. The public hearing was closed. Mrs. Carpenter introduced a resolution recommending approval of the zoning of DHS Holding 4, Inc. from PUD and FAR to B-2 and moved for its approval. Mr. Mullins seconded the motion. Mr. Brass addressed the types of uses restricted under the contract negotiations. He stated that those uses are permitted in the B-2 zoning districted. It was suggested that those negotiations be made part of the deed or covenants. Mr. Turner addressed the public’s comments on access. He also addressed the restrictions on the types of developments for the property stating that those restrictions will be a part of the covenants. He stated that the intent of the restrictions is to make it compatible with the residential development. Mrs. Carpenter asked if the PUD zoning would cover the type of uses that the developer was trying to create. Mr. Turner stated that the PUD zoning allows for 10 acres of the entire property be allocated for business. He stated that by zoning this specific portion to B-2 would create better control on where and how the property the property develops. Mr. Brass stated that in reviewing the PUD agreement submitted in 2004, the HomePlace PUD is limited to residential land uses. These uses may be single-family units and multi-family units including apartments. He stated that commercial uses allowed as those specified as permitted uses in the B-1 zone providing the maximum commercial area does not exceed one (1) acre per one hundred (100) dwelling units. After no further discussion, the vote was called. The motion to approve passed unanimously. Miscellaneous Business: Mike Vaughan, 1420 S. Memorial Drive, inquired about a possible time line for the widening of McQueen Smith Road. Mayor Gillespie addressed the inquiry stating that a start time is still to be determined.
