1906-June 20Approved 7/18/19 Prattville Planning Commission June 20, 2019 Minutes Page 1 of 5 CITY OF PRATTVILLE PLANNING COMMISSION MINUTES June 20, 2019 Call to order: Vice-Chairman Reuben Gardner called the meeting to order at 3:00 p.m. Roll Call: The secretary called the roll. Members present were Councilman Richard Cables, Vice-Chairman Reuben Gardner, Chief Dallis Johnson, Mrs. Paula Carpenter, Mr. Seth Hayden, Mr. Martin Jackson and Mr. Mugs Mullins. Absent: Mayor Bill Gillespie and Chairman Tim Smith. (Quorum present) Staff present: Mr. Scott Stephens, City Planner; Mr. Austin Brass, Senior Planner and Ms. Alisa Morgan, Secretary. Minutes: Chief Johnson moved to approve the minutes of the April 18, 2019 meeting. Councilman Cables seconded the motion. The motion passed unanimously. Chairman Smith changed the order that the agenda items were heard. Old Business: 1. Zoning Amendment: PUD (Planned Unit Development) to B-2 (General Business) Location: McQueen Smith Road Petitioner: DHS Holding-3, Inc. Representative: Joe Turner The requested item was held at the previous meeting (May 16th) at the petitioner’s request. Mr. Brass presented the zoning amendment of the PUD to B-2. Joe Turner, petitioner’s representative, introduced the zoning amendment of the PUD to B-2. He stated that this is an extension of the HomePlace development with commercial property facing McQueen Smith Road and residential located behind the commercial development. He stated during the design of the PUD the previous city planner requested that there be no commercial in the PUD even though the zoning allows for a small amount of commercial in it. He stated that this zoning development will follow the same restrictions under the current HomePlace development requirements. He also stated that there is no proposed development for the property at this time. Vice-Chairman Gardner opened the public hearing. There were none to speak. The public hearing was closed. Mrs. Carpenter introduced a resolution recommending approval of the rezoning of property at McQueen Smith Road from PUD to B-2 and moved for its approval. Mr. Mullins seconded the motion. Mrs. Carpenter stated that extensive time and planning went into designing the PUD zoning. She asked what can’t be done in the PUD zoning that requires the developer to request B-2 zoning. Mr. Brass stated that the current PUD ordinance does allow for B-1 commercial uses, contingent upon the commercial area not exceed 1 acre per 100 dwelling units. He stated that it is possible to build some commercial in the PUD zone, but the commercial uses are limited. The B-2 zoning would give them more flexibility with the types of uses allowed. He stated that this parcel would be under the same restrictions as all of HomePlace. After no further discussion, the vote was called. The motion to approve passed by votes as recorded. Final Plat: Hedgefield Subdivision Plat 1 Location: McQueen Smith Road Petitioner: Lowder New Homes Representative: Goodwyn Mills & Cawood The proposed final plat was held at the previous meeting (May 16th) at the petitioner’s request. Mr. Jackson introduced a resolution recommending approval of the final plat of Hedgefield Subdivision Plat 1 and moved for its approval. Mrs. Carpenter seconded the motion. Max Vaughn of Goodwyn, Mills & Cawood, petitioner’s representative, presented the request for final plat approval of the Hedgefield Subdivision Plat 1. He stated that the road construction is almost complete. Mr. Brass and Mr. Stephens provided staff comments for the final plat of Hedgefield Subdivision Plat 1. Mr. Stephens stated that the plat will not be released for recording until it is complete. After no further comments, the vote was called. The motion to approve passed unanimously. 3. Councilman Cables introduced a resolution recommending approval of the time extension of the preliminary plat of Dawson’s Mill, Plat 1 and moved for its approval. Mrs. Carpenter seconded the motion. There was no further discussion, the vote was called. The motion to approve passed unanimously. 5. Preliminary Plat: Birdsong Plat 1-A Location: Lower Kingston Road & Birdsong Street Owner: Habitat for Humanity of Autauga & Chilton Counties, Inc. Representative: PLS Group, Inc. Mr. Hayden introduced a resolution recommending approval of the preliminary plat of the Birdsong Plat 1A and moved for its approval. Mr. Mullins seconded the motion. James Monk of PLS Group, Inc., petitioner’s representative, presented the preliminary plat of the Birdsong Plat 1A. He stated that three parcels will be platted with one common drive to serve the three parcels. He stated that this property has been presented to the commission before which showed more lots. Since then, the petitioner has requested to only divide into three parcels. He stated that there will be no additional access to Lower Kingston Road nor a requirement for a new street. Mr. Brass presented staff comments stating that the previous plat presented (sketch plan) that included five lots. He stated that Birdsong Street is adjacent to Lot 2 is a private street. He stated that the subdivision regulations does not allow access from private streets. He stated that Lot 3 will be served by an access easement and there will be no new drive way cuts off of Lower Kingston Road. Vice-Chairman Gardner opened the public hearing. Mary Ann Wingard, 107 Co. Rd. 29, spoke in opposition to the request to allow Habitat to build on the property. Belle Simmons, 136 Co. Rd. 29, spoke in opposition to the request to allow Habitat to build on the property. Ed Seamon, 926 Seamon Street, stated that he was not in opposition to the request. He asked if the water pressure was adequate to support the proposed parcels. He also stated concerns about the water run-off. Marvin Gentry, 1267 Adell Street, stated that he owns property at 895 Lower Kingston Road. He spoke in opposition to the request stating that there will be a decrease in property value. After no further comments, the public hearing was closed. Mr. Brass addressed the public’s comments stating that the property is zoned R-3 residential and any single family home is permissible by right. He stated that Habitat for Humanity is the property owner of the proposed development and can build on the lots as long as they met the zoning requirements. He further stated that the water pressure is regulated by Prattville’s Water Works Board. Mrs. Carpenter asked how the proposed lots compares to the existing lots on Lower Kingston Road. Mr. Brass stated that the proposed lots are larger than the existing lots. Mr. Mullins asked about the maintenance of the shared driveway. Mr. Brass stated that the driveway is a private drive that will be maintained by the property owners. Councilman Cables asked that a committee be formed to further review the preliminary plat. Vice-Chairman Gardner appointed Councilman Cables, Mr. Mullins and Mr. Jackson as a committee to further review the preliminary plat of Birdsong Plat 1A. Proposed Ordinance Amendment: Accessory Structures Chief Johnson introduced a resolution recommending approval of the proposed amendment to the ordinance for Accessory Structures and moved for its approval. Mr. Mullins seconded the motion. Mr. Stephens presented the request for the amendments to the ordinance to change the text in the section of the ordinance that affects accessory structures, fences, and home occupations. He stated that the changes are reflective of the committee members’ suggestions. After no further comments, the vote was called. The motion to approve passed unanimously. 8. Proposed Ordinance Amendment: Fences Vice-Chair Gardner introduced a resolution recommending approval of the proposed amendment to the ordinance for Fences and moved for its approval. Mr. Mullins seconded the motion. After no further comments, the vote was called. The motion to approve passed unanimously. 9. Proposed Ordinance Amendment: Home Occupations Mr. Jackson introduced a resolution recommending approval of the proposed amendment to the ordinance for Home Occupations and moved for its approval. Mr. Mullins seconded the motion. Mr. Stephens stated that the Home Occupations have been split into two tiers. The first tier is for home occupations that generate no traffic and the second tier is for home occupation that generate minimal traffic which would be referred to the Board of Zoning Adjustment for approval. Mr. Mullins moved to amend Tier 2 section b to include business cards be exempt. Chief Johnson seconded the motion. The motion to amend passed unanimously. After no further comments, the vote was called. The motion to approve as amended passed unanimously. Miscellaneous Business: Councilman Cables stated that consideration needs to be given to have a committee to address the Comp Plan. He asked that three Commissioners consider being part of this committee. ANALYSIS: Differences between PUD (Existing) and B-2 (Proposed) Zoning Districts: PUD, Planned Unit Development (Ordinance Standards) The purpose of the Planned Unit Development (PUD) is intended to provide flexible land use regulations by using a review and approval process to impose a mixture of standards from other zoning districts or to negotiate specific performance criteria. The overall character of the PUD District shall be compatible to surrounding neighborhoods and preserve valuable natural features while permitting greater variety in the type of design, siting of structures, and combination of uses. Commercial uses of the family shopping or convenience type such as those specified as permitted uses in the B-1 zone providing the maximum commercial area does not exceed one (1) acre per one hundred (100) dwelling units and site design stipulations as specified by the Planning Commission are met.  According to PUD Ordinance Agreement 2004-017, the HomePlace PUD shall be limited to residential land uses. These uses may be single-family units and multi-family units including apartments. MINIMUM YARD SIZE: None specified. MAXIMUM HEIGHT: 65 feet or 5 stories. Proposed Use: The Commission shall note that there is currently no proposed use for this property other than the B-2 rezoning proposal. Street Connectivity: Any proposed use at the site would have ingress/egress from McQueen Smith Road. Water/ Sewer: The proposed site is serviced by existing water mains & can be serviced by a sanitary sewer line to the east of the site. Staff Analysis: This zoning proposal is directly adjacent to a residential zoning district as part of the HomePlace PUD to the north. The proposal is also adjacent to an R-3 zoning district at the south abutting a common space/park within the Hedgefield residential subdivision currently under construction.
