ROLL CALL: Present: Chairman Leo Jamieson, Mr. Jerry Crosby, and Mrs. Jerry Schannep. Absent: Vice-Chairman James Miles. Also present was alternate member Mr. Neal Parker. Quorum Present Staff present: Mr. Joel Duke, City Planner and Ms. Alisa Morgan, Secretary. Chairman Jamieson stated the governing rules for the Prattville Board of Zoning Adjustment according to the Code of Alabama, 1975 and the procedure of the meeting. MINUTES: Mr. Crosby moved to approve the minutes of the April 10, 2018 meeting. Mrs. Schannep seconded the motion. The motion passed unanimously. OLD BUSINESS: There was no old business to discuss. NEW BUSINESS: VARIANCE To allow a carport to encroach 24’ into the required 40’ rear yard setback. 132 Scott Lane R-2 Zoning District (Single Family Residential) Kerry H. Butler, Jr., Petitioner Mr. Duke introduced the request for a variance to allow a carport to encroach 24’ into the required 40’ rear yard setback on the property at 132 Scott Lane. Kerry Butler, petitioner, along with his representative, Robby Anderson, presented the request to place an attached carport in the rear yard on property at 132 Scott Lane. Mr. Butler stated that the house sits on a corner lot and the side yard has the same setback requirements as the front yard. He stated that a detached carport would not have an encroachment violation, but he wants an attached carport. Mr. Anderson stated that Mr. Butler is his relative and he assisted with the drawings. He stated that the roofline of the carport will have the same pitch as the existing home. Mr. Butler stated that water flow will run as it currently flows. He stated that the property is located on a corner lot and an attached structure is more aesthetically pleasing to the neighborhood. Chairman Jamieson opened the public hearing. Larry Youngblood, 141 Scott Lane, was not opposed to structure as presented. After no further comments, the public hearing was closed. Chairman Jamieson opened discussion for the board. He stated that there was no defined hardship. He stated that the additional setback required eliminates use of a good bit of his lot. Mr. Anderson stated that the proposed carport will be nice and within character of the neighborhood. It will be located behind the existing gate; only the roof will be seen. Mr. Butler stated that they wanted to maintain a continuous roof line to make it aesthetically pleasing. There being no further discussion from the board, the vote was called. Mr. Crosby moved to establish the findings of fact stating 1) that granting of a variance is in harmony with the intent and purposes of the zoning ordinance and 2) that a variance will not adversely affect the surrounding property, the general neighborhood, or the community as a whole and 3) that the special conditions and circumstances do not result from actions of the applicant. Mrs. Schannep seconded the motion. The motion to approve the findings of fact passed unanimously. The vote was called. Mr. Parker moved to approve the request as submitted based on the approved findings of fact contingent the carport is not to be enclosed without BZA approval. Mr. Crosby seconded the motion. The motion to approve passed unanimously. The BZA voted to approve the variance to allow a carport to encroach 24’ into the required 40’ rear yard setback on property at 132 Scott Lane with contingency. VARIANCE: To allow an awning to encroach 9’ into the required 10’ side yard setback. 104 Deer Trace R-2 Zoning District (Single Family Residential) Shirley Wesson, Petitioner Mr. Duke introduced the request for a variance to allow an awning to encroach 9’ into the required 10’ side yard setback on the property at 104 Deer Trace. He stated that the structure was installed prior to permit or variance request. He stated that a previous variance allows encroachment up to 7’ into the west side yard was granted in 1994. James Wesson, petitioner’s representative, presented the request to allow an awning on property at 104 Deer Trace. He stated that the awning has two gutters. Water will run as it currently flows. Chairman Jamieson opened the public hearing. There were none to speak. The public hearing was closed. Chairman Jamieson opened discussion for the board. There being no further discussion from the board, a vote was called. Mr. Crosby moved to establish the findings of fact stating 1) that granting of a variance will not confer a special privilege on the applicant that is denied by this ordinance to other lands, structures, or buildings in the same district; and 2) that the special conditions and circumstances do not result from actions of the applicant (self-imposed hardship). Mrs. Schannep seconded the motion. The motion to approve the findings of fact passed unanimously. The vote was called. Mr. Crosby moved to approve the request as submitted based on the approved findings of fact. Mrs. Schannep seconded the motion. The motion to approve passed unanimously.
