Minutes: None Old Business: 1.Preliminary Plat: Rochester Hills Location: Heather Drive Owner: Rochester Hill, L.P. Engineer/Representative: Larry Speaks & Associates (For clarity of records, this item was tabled at the November 20, 2014 meeting. Due to error in advertisement, it was re-submitted for another public hearing). Brad Smith, petitioner’s representative, presented the preliminary plat of Rochester Hills. He stated that the entrance to the proposed apartments was moved approximately .2 miles to McQueen Smith Road to force traffic use to that entrance instead of use through the Pecan Ridge subdivision. Chairman Smith opened the public hearing. Claire Smith, 845 Heather Drive, stated that she was pleased with the efforts made by the developers and the commission to develop a workable solution. Paul Gardner, 816 Dee Drive, stated that he was objective to the road extending Heather Drive. He stated that he would rather see the proposal of a lock gate for emergency use only. Chief Johnson addressed the use of lock gates being allowed for certain conditions. He stated that this proposal would not warrant the use for lock gate. David Dunigan, 1926 Tara Drive, spoke in concern of safety for neighborhood children. Eleanor Ballow, 814 Dee Drive, stated that she likes the proposed new road. She spoke in concern for school traffic flow. The public hearing was closed. Mr. McAuley introduced a resolution approving the preliminary plat of Rochester Hills and moved for its approval. Mr.Gardner seconded the motion. Councilman Boles stated that he would like to see an additional connection to Cobbs Ford Road for the apartment use only. Mayor Gillespie stated that he would like to hold the request to see if there is an overall plan that would be beneficial to all. He stated that he would like to know if a traffic light could be realigned near proposed connection to Cobbs Ford Road and connectivity that would encourage pedestrian crossing. Mr. Duke presented the staff report for the preliminary plat of Rochester Hills. He stated that the proposed plat meets regulations. Kevin Buckner of Rochester Hills stated that they have made several revisions to the initial preliminary plat to meet city requirements and appease the adjacent neighborhood. He asked that the council would hold the item to the end for further discussion to allow time for him to confer with his partners. Councilman Boles moved to hold until the end of meeting for further discussion. Mr. Gardner seconded the motion. The motion passed by 7/0 vote as recorded. Favor: Councilman Boles, Mr. Gardner, Mayor Gillespie, Mr. Nelson, Chief Johnson, Mr. McAuley and Chairman Smith. Oppose: None. Absent:Mr. Hall. At the continuation of the hearing for the agenda item,Mr. Buckner stated that they would be willing to meet in a work session. Councilman Boles moved to hold the request until the next meeting for a work session. Mayor Gillespie seconded the motion. Engineer/Representative: Larry Speaks & Associates Greg Gillian of Larry Speaks & Associates, petitioner’s representative, introduced the preliminary plat of Laney Property Plat 1. He stated that this plat was for the defining of the roadway to show the right-of-way agreement for Long Lewis’ property. Chairman Smith opened the public hearing. Jon Lee Finnegan, 211 Deer Trace,had questions on development procedures relative to platting of property. David Smith, 116 Ashton Oak Court, was concerned about changes to the plat after it is approved. Chairman Smith closed the public hearing. Chief Johnson introduced a resolution approving the preliminary plat of Laney Property Plat 1 and moved for its approval. Mr. Nelson seconded the motion. Mr. Duke provided the staff report for the preliminary plat of Laney Property Plat 1. He stated that in August 2014, as part of an economic development agreement with the City of Prattville and Autauga County, the Laney family agreed to provide sufficient right-of-way for an extension of Old Farm Lane from Alabama 14 East to Old Ridge Road at its intersection with Riverton Drive. The configuration and placement of the right-of-way roughly corresponds with the approved sketch plan. The proposed preliminary plat and the corresponding final plat show the basic subdivision created by the promised right-of-way.He stated that the larger lots can be divided into additional lots in the future.He stated that the proposed preliminary plat and final plat are recommended for approval. He stated that the plat is to divide two lots that shared a wall. Chairman Smith opened the public hearing. There were none to speak. The hearing was closed. Councilman Boles introduced a resolution approving the final plat of Glennbrooke Subdivision Plat 3C and moved for its approval.Mr. Nelson seconded the motion. Blake Rice of Barrett Simpson, Inc., petitioner’s representative, presented the final plat of Glennbrooke Subdivision Plat 3C. He stated that the 39 lot subdivision is not substantially complete and requested that the plat be approved with bond agreement to cover any outstanding improvements. Mr. Duke stated that the preliminary plat of Glennbrooke Subdivision Plat 3C is not substantially complete but the petitioner has requested approval with bond agreement. (See Memorandum RE: December 18, 2014-Agenda, Attachment F). Councilman Boles moved to amend to approve contingent upon bond agreement to cover any outstanding improvements. Mr. Nelson seconded the motion. The motion to amend passed unanimously. The amended motion to approve passed unanimously.(Absent: Mr. Gardner). 7.Final Plat: HomePlace South Plat 1 Location 790 Old Quarters Road Owner: McQueen Partners, LLC Engineer/Representative: Chambliss & Associates/Alabama Land Survey Councilman Boles introduced a resolution approving the final plat of HomePlace South Plat 1 and moved for its approval.Chief Johnson seconded the motion. Watson Brown, petitioner’s representative stated that the final plat of HomePlace South Plat 1 completes the road dedication. Mr. Duke provided the staff report for the final plat of HomePlace South Plat 1. He stated that the proposed final plat completes the public dedication of the two streets Flit Williams and Old Quarters Road.He stated that the staff recommends approval. The motion to approve passed unanimously.(Absent: Mr. Gardner). Miscellaneous Business: 1.Mr. Duke presented a request for consideration of final plat approval from the Broadway Group who missed the December submittal deadline. Mayor Gillespie moved to accept consideration of the final plat of the Broadway Group-Golson Road Subdivision. Mr. Duke stated that the proposed plat was approved in May 15, 2014 as Gentry Plat 1. Chief Johnson moved to approve the final plat of Broadway Group-Golson Road Subdivision. Mr. Hall seconded the motion. The motion to approve passed unanimously.Mr. McAuley abstained.(Absent: Mr. Gardner). 2. Mr. Duke discussed the meeting’s success of the Neighborhood Revitalization Plan of the neighborhood study for Martin Luther King Drive held on December 4, Thursday, 7 p.m.–8:30 p.m. at North Highland Community Center. Duke, City Planner RE: December 18, 2014 - Agenda Please accept this memorandum as the Planning Department staff report for items on the December 18, 2014 agenda. 1. Preliminary Plat: Rochester Hills – between west end of Heather Drive and McQueen Smith Road: This preliminary plat was initially reviewed and considered by the Planning Commission on September 18, 2014. Following a public hearing and discussion, the Commission voted 5-1 in favor of a motion to approve the plat as submitted. The plat was declared disapproved since it did not receive the required six affirmative votes needed to approval a subdivision plat. The applicant has reapplied for hearing and approval on November 20, 2014. At the November 20, 2014 Commission meeting, the preliminary plat for Rochester Hills was resubmitted for consideration. Due to an advertising error by the Montgomery Advertiser and a request for additional information, the item was held until the December 18, 2014 meeting. The required public hearing has been re-advertised for the December 18, 2014 meeting. In May 1992, Aronov Realty received approval of a sketch plan and initial zoning configuration for the Prattville East Addition subdivision, which would later be known as Pecan Ridge. The sketch plan included two connections to McQueen Smith Road – one at Tara Drive and one at Seasons Drive – and a connection to Cobbs Ford Road. The Planning Commission recommended a zoning scheme which divided the property into business, low and medium density single-family residential, and multi-family residential. The zoning plan was approved by the City Council in June 1992. Aronov Realty modified the December 16, 2014 Prattville Planning Commission Page 2 sketch plan in 1997 to eliminate a connection to Cobbs Ford Road and to extend the street developed as Heather Drive west to McQueen Smith Road. Of the initial sketch plan, roughly 25 acres in the northern portion of the subdivision has remained undeveloped for over 10 years. The primary zoning classification in the undeveloped northern section is R-4, Multi-family residential with a lesser portion zoned as B-2 and R-5. The current applicant, Rochester Hills, LP, is requesting approval to divide the remaining section of Pecan Ridge into large lots and to add approximately 1,590’ of new street connecting the western end of Heather Drive to McQueen Smith Road. The subdivision extends Dee Drive northward a short distance to create an intersection with the new Heather Drive section. The streets create a large lot (10.52 acres) north of the new street section corresponding to the R-4 zoning and leaves the remainder divided between R-3, R-5 and B-2 zoning. In April 2014, the Commission heard a request from petitioners MHL, LLC and TBG Residential to rezone a portion of the undeveloped Pecan Ridge subdivision for additional multi-family residential. Following a public hearing and a meeting with a Commission subcommittee, the rezoning application was withdrawn. The current petitioner, Rochester Hills, LP, is also a division of TGB Residential. (At the time of the September 18, 2014 preliminary plat review, no plans for development of lots in the proposed subdivision had been presented for permit. Plans for the Rochester Hill Apartments are currently under review by relevant city departments. A copy of the proposed apartment complex is included with this report as Attachment D) In the current preliminary plat proposal, the proposed street design, widths and locations correspond with the Aronov sketch plan approved in 1997 and meet city development regulations. By connecting to McQueen Smith Road, the proposed plat completes the planned street network and eliminates the single access violation of the city subdivision regulations and fire codes which has existed since development stopped in the subdivision over 10 years ago. The proposed connection to McQueen Smith Road will provide residents of Pecan Ridge secondary access and will reduce congestion at the Tara Drive/McQueen Smith Road intersection. A review of the subdivision plat by city staff generated several of technical comments and corrections. Staff recommends approval of the subdivision on condition that all staff comments and corrections are satisfied. Preliminary Plat: Laney Property, Plat 1 – Alabama 14 East at Old Ridge Road. On August 21, 2008, the Commission considered and approved a sketch plan for a 59 acre parcel located in the northeast corner of the Old Ridge Road/Alabama 14 East intersection. The sketch plan showed a primary street running north/south and connecting with the intersection of Alabama 14 East and the realigned and widened Old Farm Lane. In August 2014, as part of an economic development agreement with the City of Prattville and Autauga County, the Laney family agreed to provide sufficient right-of-way for an extension of Old Farm Lane from Alabama 14 East to Old Ridge Road at its intersection with Riverton Drive. The configuration and placement of the right-of-way roughly corresponds with the approved sketch plan. The proposed preliminary plat and the corresponding final plat presented as Item 3, show the basic subdivision created by the promised right-of-way. The street infrastructure and utilities will be provided by the City of Prattville, Autauga County, and the Prattville Water Board as a part of the development agreement. The lot layout incorporates a 10± acre parcel previously sold to Long Lewis Ford of the River Region and two large parcels created by the new street right-of-way. Other than the Long Lewis parcel, no development is proposed at this time. Documents for this plat were provided with the agenda packet. Staff recommends approval. 3. Final Plat: Laney Property, Plat 1 – Alabama 14 East at Old Ridge Road. See Item 2. 4. Preliminary Plat: EEDA LTD, Plat 1 – 136 & 138 West Main Street. In August 2008, EEDA Limited remodeled the two commercial buildings at 136 and 138 West Main Street. The buildings are currently occupied by Uncle Mick’s Cajun Café and Pizzazz Art Studio. Under common ownership, EEDA Ltd was permitted in the 2008 remodel to use a portion of the structure in 138 for restrooms serving 136. The proposed preliminary plat adjust the property lines to reflect the current configurations of the commercial spaces. No public infrastructure is impacted by the plat. Documents for this plat were provided with the agenda packet. Staff recommends approval. 5. Final Plat: EEDA LTD, Plat 1 – 136 & 138 West Main Street. See Item 4. 6. Final Plat: Glennbrooke Subdivision, Plat 3C – Old Ridge Road – Sydney Drive North: On August 15, 2013, Stone Martin Builders received Planning Commission approval for a preliminary plat containing 77, residential lots in the third phase of the Glennbrooke subdivision. The petitioner is requesting approval of a final plat, Plat 3-C, containing 40 of the approved lots. The subdivision is not substantially complete. The developer has requested that the plat be approved contingent on a bond or other approved surety being posted to cover the outstanding improvements. Final Plat: HomePlace South, Plat 1, McQueen Smith Road and Old Quarters Road. On May 17, 2012, DHS Holding-4. Inc. received Planning Commission approval for a preliminary plat creating two public streets and a three large parcels. Plat approval was sought in conjunction with development of the Villas at HomePlace apartments. The two public streets were constructed with the apartment construction. The proposed final plat completes the public dedication of the two streets Flit Williams and Old Quarters Road. Documents for this plat were provided with the agenda packet. The developer has been diligently working on this project and is going to be laying the curb and gutter next week (12-22 thru 12-26) for the roadways. Utilities have been installed and he expects to have it paved the first week of 2015. I understand this means the project will not be substantially complete at the time of the meeting, but the developer is willing to post a bond for any required infrastructure improvements not complete at the time of plat recording. I am requesting the Commission hear this agenda item and consider approving this Final Plat subject to a bond being posted for any incomplete improvements.
