(Sponsored By: Councilor Strichik) COMMENTS FROM PERSONS PRESENT: CLOSING COMMENTS: ADJOURN The next City Council meeting is scheduled for Tuesday, December 3, 2019 at 6:00 p.m. RESOLUTION 1 2 [To Declare Various Weeded Lots to be a Public Nuisance, Order Their Abatement and Set a 3 Public Hearing per Title 11, Chapter 67 of the Code of Alabama, 1975, as Amended.] 4 5 {Sponsored By: Councilor Starnes} 6 7 WHEREAS, an abundance of overgrown grass or weeds: 8 9 1. is injurious to the public health, safety and general welfare by providing a breeding 10 ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11 2. may cause the further spread of weeds; 12 3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13 such property; and 14 4. may also pose a fire hazard and respiratory hazard; and 15 16 WHEREAS, §11-67-1 et Seq., of the Code of Alabama, 1975, as amended, permits 17 18 the City Council of the City of Prattville to declare an abundance of overgrown grass and 19 20 weeds to be a public nuisance; and 21 22 WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 23 24 the property at the following address and determined the existence of an abundance of 25 26 overgrown grass and weeds: 27 28 • 104 Amelia Dr- Inglish, Gordon T., 104 Amelia Dr, Prattville, AL 36066 29 (19-06-14-3-001-042.000) 30 NOW, THEREFORE, BE IT RESOLVED that: 31 32 1. the City Council of the City of Prattville declares the abundance of overgrown grass and weeds 33 at the above listed address to be a public nuisance; and 34 2. the owner of said property, as he appears in the records of the Autauga County Revenue 35 Commissioners, is ordered to abate the abundance of overgrown grass and weeds; and 36 3. the owner of said property is ordered to appear before the City Council of the City of Prattville 37 at a public hearing at 6:00 p.m. on December 17, 2019 in Prattville City Hall. Notice of such 38 hearing shall be sent by certified mail to owner of said property. 39 40 ADOPTED THIS 19TH DAY OF NOVEMBER, 2019. 41 42 43 ________________________ 44 By: Albert Striplin, President 45 Prattville City Council 46 47 AUTHENTICATED THIS 19TH DAY OF NOVEMBER, 2019. 48 49 50 ________________________ 51 By: Cathy Dickerson 52 City Clerk 53 54 55 APPROVED: 56 57 58 ________________________ 59 By: Bill Gillespie, Jr. 60 Mayor 61 62 63 RESOLUTION BOOK 2019-A, PAGE _____ 64 RESOLUTION 1 2 [To Affix the Cost of Demolition of the Dangerous and Unsafe Structure at 3 325 Festival Drive.] 4 5 {Sponsored By: Councilor Starnes} 6 7 WHEREAS, §11-53B-1 through §11-53B-16 Code of Alabama, 1975, as amended 8 9 details process for the City of Prattville to declare certain unsafe structures a public nuisance 10 11 and order their repair or demolition; and 12 13 WHEREAS, §11-53B-3 Code of Alabama, 1975, as amended, requires that the city’s 14 15 order to repair or demolish an unsafe structure be sent to the owner of the property and those 16 17 having legal interest in the property; and 18 19 WHEREAS, §11-53B-3 and §11-53B-4 Code of Alabama, 1975, as amended, requires 20 21 the owners to repair or demolish the unsafe structure within forty-five (45) days of being 22 23 issued an order from the city or to request a hearing before the City Council of the City of 24 25 Prattville within thirty (30) days of the order; and 26 27 WHEREAS, §11-53B-3 Code of Alabama, 1975, as amended, permits the City of 28 29 Prattville to repair or demolish an unsafe structure if the owner fails to comply with the city 30 31 order; and 32 33 WHEREAS, §11-53B-5 Code of Alabama, 1975, as amended, permits the City Council 34 35 of the City of Prattville to adopt a resolution affixing the cost of demolition and establishing a 36 37 lien against the property; and 38 39 WHEREAS, the City of Council of the City of Prattville finds that: 40 41 1. The City of Prattville Building Official declared the residential structure at 325 Festival 42 Drive to be a dilapidated structure on July 30, 2018. 43 44 2. The City of Prattville Code Enforcement Officer issued an order to Jeremy Gardner, 45 Theresa Gardner, and Ameer Craion on December 13, 2018, to have the property 46 repaired or demolished within forty-five (45) days of the notice. 47 48 3. Jeremy Gardner, Theresa Gardner, and Ameer Craion did not request a hearing before 49 the City Council within thirty (30) days of the notice, nor repair or demolish the structure 50 within forty-five (45) days of the notice. 51 52 4. The City Council declared the structure located at 325 Festival Drive to be unsafe and 53 a public nuisance in Resolution Book 2019, Page 018, on February 19, 2019. 54 55 5. The City Council authorized the demolition of the structure and awarded the contract 56 complete demolition in Resolution Book 2019, Page 082, on June 18, 2019. 57 58 6. and 9 10 WHEREAS, the owner of said subdivision must maintain the public utilities, rights-of- 11 12 way, and easements in the subdivision until accepted by the City Council; and 13 14 WHEREAS, the owner of the said subdivision has maintained the public utilities, 15 16 rights-of-way and easements in the subdivision for the minimum period required by the 17 18 Prattville Subdivision Regulations (Article III, Section D (6) c.), and has corrected all 19 20 deficiencies presented by the Prattville Engineering Department; and 11 12 WHEREAS, the current contract awarded to Unifirst Corporation in Resolution Book 13 14 2016-A, Page 220, adopted on December 6, 2016, is due to expire; and 15 16 WHEREAS, UniFirst Corporation has the ability to provide said rental uniforms and 17 18 supplies through Sourcewell Purchasing Cooperative Contract No. 062415-UFC at an 19 20 approximate cost of $1,000.00 per week;
