PH Minutes 2011-07-05PRATTVILLE CITY COUNCIL PUBLIC HEARING MINUTES TUESDAY, JULY 5, 2011 6:00 P.M. CALL TO ORDER: The Prattville City Council met in public hearing on Tuesday, July 5, 2011 at 6:00 p.m. in the Council Chambers at City Hall. Council President Mike Renegar called the meeting to order. Roll was called and all were recorded as being present. AGENDA 1. RESOLUTION: TO DECLARE VARIOUS WEEDED LOTS TO BE A PUBLIC NUISANCE AND ORDERING THEIR ABATEMENT PER TITLE 11, CHAPTER 67 OF THE CODE OF ALABAMA, 1975 AS AMENDED. No one appeared to speak in favor of this Resolution. Ms. Mary Voll, 620 Durden Road, appeared to express her opinion that the City’s weeded lot enforcement is selective and asked if an increase of $1,000.00 per occurrence would be more effective. City Planner, Joel Duke, explained that the City follows State law in addressing weeded lots throughout the city. Councilman Miller further explained that the discussion of an administrative fee of $1,000.00 would address repeat offenders. Ms. Voll stated that she had personally checked some of the lots that were advertised in the paper and they were not in as much disrepair as a number of other locations within the city. 2. ORDINANCE: TO AMEND CHAPTERS 26 (BUILDING; CONSTRUCTION AND RELATED ACTIVITIES) AND 105 (FIRE PREVENTION AND PROTECTION) OF THE PRATTVILLE CODE OF ORDINANCES. Fire Marshall, Dallis Johnson, explained that the purpose of this Ordinance is to stay in line with the State’s 2009 International Building Code and International Fire Code. The Fire Department has been in contact with local builders/contractors to discuss the effects on their businesses. City Planner, Joel Duke, presented a letter to the Interim City Clerk from United Heating & Air, which is made a part of the official record. Councilman Wood asked if a proposed amendment regarding the R-6 duct insulation is acceptable to what United is requesting. Fire Marshall Johnson stated that he believed it would. Mr. Larry Smith, no address given, homebuilder, questioned the criteria for Bed & Breakfast, and asked who decides what is historically significant. Fire Marshall Johnson stated that he believes it is the local Historical Society. The Code section which addresses this was amended in 2006. Mr. Duke further explained that the Planning Department serves as staff for the Historic Preservation Commission and historically significant is determined by them, or being located in an already designated historic district. Mr. Smith asked if that criterion could be included rather than the verbiage historically significant. ADJOURN: There being no further business to come before the council, Councilman Miller made a motion to adjourn and Councilman Boles seconded the motion.
