RESOLUTION: To Declare Various Weeded Lots to be a Public Nuisance, Order Their Abatement and Set a Public Hearing per Title 11, Chapter 67 of the Code of Alabama, 1975, as Amended. (Sponsored By: Councilor Starnes) RESOLUTION [To Declare Various Weeded Lots to be a Public Nuisance, Order Their Abatement and Set a Public Hearing per Title 11, Chapter 67 of the Code of Alabama, 1975, as Amended.] {Sponsored By: Councilor Starnes} WHEREAS, an abundance of overgrown grass or weeds: 1. is injurious to the public health, safety and general welfare by providing a breeding ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 2. may cause the further spread of weeds; 3. may hide debris, such as glass or metal, that could inflict injury on a person going to such property; and 4. may also pose a fire hazard and respiratory hazard; and WHEREAS, §11-67-1 et Seq., of the Code of Alabama, 1975 as amended, permits the City Council of the City of Prattville to declare an abundance of overgrown grass and weeds to be a public nuisance; and WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected the properties at the following addresses and determined the existence of an abundance of overgrown grass and weeds: • 613 Mimosa Road – Adair, Larry and Paula, 613 Mimosa Road, Prattville, AL 36067 (19-02-04-4-004-018.000) • 199 Cynthia Street – Williams, Melody M., 199 Cynthia Street, Prattville, AL 36066 (19-06-23-2-003-001.00) • 616 Sunset Drive – Dedon, Gerald W. & Leslie H., 616 Sunset Drive, Prattville, AL 36067 (19-05-15-3-007-035.000) • 624 Sunset Drive – Farrah Homes, LLC, 420 East Drive, Maxwell AFB, AL 36113 (19-05-15-3-007-031.000) • Camellia Estates Plat 10 (Vacant Lot on Woodvale Road) – Thiemonge Frank L. & Peggy Jo, 124 Havenwood Circle, Daphne, AL 36526 (19-02-09-1-008-024.000) • 217 Jay Street – Randall, Luke G., 217 Jay Street, Prattville, AL 36066 (19-06-14-4-001-029.000) • 121 Gray Drive – In, Vichet B., 121 Gray Drive, Prattville, AL 36067 (19-04-20-1-004-009.000) • 202 Evergreen Street – Shaw, Anthony C. & Deborah A., 202 Evergreen Street, Prattville, AL 36067 (19-04-17-2-000-005.012) • 1820 Sanford Drive– Suhr, David L. & Rhonda I., C/O David & Rhonda Suhr, 104 Strodes Creek Circle, Prattville, AL 36066 (19-06-14-1-015-018.000) • 6th Street (Adjacent to 239 6th Street) – Smith, Launeal D, 135 Heritage Hills Drive, Prattville, AL 36067 (19-03-08-4-004-005.000) • 492 Mt Airy Drive – Abate, Antonina Marie, 492 Mt Airy Drive, Prattville, AL 36067 (19-02-04-3-001-018.064) • 465 A B Durden Road – Hunter, Jack Dwayne, 465 A B Durden Road, Prattville, AL 36067 (19-03-06-4-000-001.067) • 104 A Hwy 82 W – ARC FD34PCK001 LLC, 106 York Road, Jenkintown, PA 19046 (19-04-20-1-005-021.001) NOW, THEREFORE, BE IT RESOLVED that: 1. the City Council of the City of Prattville declares the abundance of overgrown grass and weeds at the above listed addresses to be a public nuisance; and 2. the owners of said property, as they appear in the records of the Autauga County or Elmore County Revenue Commissioners, are ordered to abate the abundance of overgrown grass and weeds; and 3. the owners of said property are ordered to appear before the City Council of the City of Prattville at a public hearing at 6:00 p.m. on June 18, 2019 in Prattville City Hall. Notice of such hearing shall be sent by certified mail to owners of said property.
