Zoning Amendment: R-2 (Single Family Residential) and B-1 (Neighborhood Commercial) to B-238 (General Business) 39 Location: Southwest corner of Highway 82 and Washington Ferry Road and Jensen Road 40 Petitioner: William Terry Stanfield 41 Chief Johnson recused himself citing a conflict of interest. 42 43 Mr. Brass introduced the rezoning request for property located at the southwest corner of Highway 82 and 44 Washington Ferry Road and Jensen Road. He stated that the property is split zoning of B-1 and R-2 and the 45 petitioner is requesting to rezone all of the property to B-2. 46 47 Mr. Stanfield, petitioner, stated that he is seeking to rezone the property to B-2 to allow for a restaurant business 48 venture. 49 50 Vice-Chairman Gardner opened the floor for public comments. 51 52 Jon Lee Finnegan, 211 Deer Trace, stated that the Department of Transportation informed her that there are 53 future plans for widening that portion of Highway 82. She also inquired about 55 the difference in the types of business allowed in the B1 and B2 zoning districts. 56 57 Mr. Stanfield stated that he also owns the property directly across from the proposed lot. He stated that the 58 state is making a proposal for a turn in/turn out lane when the road is widen. 59 60 After no further comments, the public hearing was closed. 61 62 Councilman Cables introduced a resolution recommending the zoning of property located at the southwest 63 corner of Highway 82 and Washington Ferry Road and Jensen Road from R-2 and B-1 to B-2 and moved for 64 its approval. Mr. Mullins seconded the motion. 65 66 Mr. Brass provided the staff report for the proposed rezoning. He stated that the current Comprehensive Plan 67 has a future land use classification of Mixed-Use-Residential for this location. This land use classification is 68 recommended for housing of a variety of densities. He stated that rezoning of this property from B-1 69 (Neighborhood Business) & R-2 (Single-Family Residential) to a more intense business use classification, B-70 2 (General Business), would be contrary to the consistency of the Comprehensive Plan. He stated that in 71 meeting with Mr. Stanfield, they discussed that the B-2 zoning is inconsistent with the Comprehensive Plan 72 and that a restaurant at this location is a permitted use in a B-1 zoning district as a “Use on Appeal.” 73 74 Mr. Stanfield stated that a residence would never be put on the existing R-2 portion of the property. 75 76 After no further comments, the vote was called. Mr. Mullins moved to amend the motion recommending 77 approval of rezoning the R-2 portion to B-1. He stated that the petitioner 89 is proposing to develop four (4) lots out of the 15 acre parcel. He stated that the lots conform to the zoning 90 ordinance. 91 92 Adam Lawrence, petitioner, presented the sketch plan of Lawrence Subdivision. He stated that three (3) of 93 the lots will be divided up into two acre lots and the fourth nine acre lot will remain undeveloped. 94 95 Mrs. Carpenter introduced a resolution recommending approval of the sketch plan of Lawrence Subdivision, 96 Lots 1, 2, 3, 4 and moved for its approval.
