Public Hearing District 1 Miscellaneous: Adjourn: Approved 12/19/19 Prattville Planning Commission November 21, 2019 Minutes Page 1 of 3 CITY OF PRATTVILLE PLANNING COMMISSION MINUTES November 21, 2019 Call to order: Vice-Chairman Reuben Gardner called the meeting to order at 3:00 p.m. Roll Call: Members present were Mayor Bill Gillespie, Councilman Richard Cables, Vice-Chairman Reuben Gardner, Chief Dallis Johnson, Mrs. Paula Carpenter, Mr. Seth Hayden, and Mr. Mugs Mullins. Absent: Chairman Tim Smith and Mr. Martin Jackson. (Quorum present) Staff present: Mr. Scott Stephens, City Planner, Mr. Austin Brass, Planner, and Ms. Alisa Morgan, Secretary. Minutes: Mrs. Carpenter moved to approve the minutes of the October 17, 2019 meeting. Mr. Hayden seconded the motion. The motion passed unanimously. Old Business: 1. Sketch Plan: Messiah Ministries of Alabama at Old Farm Lane Location: West side of Old Farm Lane Petitioner: Messiah Ministries of Alabama, Inc. Representative: Larry E. Speaks & Associates, Inc. The requested item was held at the previous meeting (October 17th). Since that time a request to withdraw the item from the agenda was made. (Letter made a part of the minutes). New Business: 2. Zoning Amendment: R-2 (Single Family Residential) to B-2 (General Business) Location: Northwest corner of Highway 82 and Washington Ferry Road and Johnson Street Petitioner: William Terry Stanfield The agenda item was requested to be withdrawn prior to the meeting. 3. Zoning Amendment: R-2 (Single Family Residential) and B-1 (Neighborhood Commercial) to B-2 (General Business) Location: Southwest corner of Highway 82 and Washington Ferry Road and Jensen Road Petitioner: William Terry Stanfield Chief Johnson recused himself citing a conflict of interest. Mr. Brass introduced the rezoning request for property located at the southwest corner of Highway 82 and Washington Ferry Road and Jensen Road. He stated that the property is split zoning of B-1 and R-2 and the petitioner is requesting to rezone all of the property to B-2. Mr. Stanfield, petitioner, stated that he is seeking to rezone the property to B-2 to allow for a restaurant business venture. Vice-Chairman Gardner opened the floor for public comments. Jon Lee Finnegan, 211 Deer Trace, stated that the Department of Transportation informed her that there are future plans for widening that portion of Highway 82. She asked if there are future plans to place a traffic light Approved 12/19/19 Prattville Planning Commission November 21, 2019 Minutes Page 2 of 3 at the intersection of Washington Ferry Road and Highway 82 after the road widening. She also inquired about the difference in the types of business allowed in the B1 and B2 zoning districts. Mr. Stanfield stated that he also owns the property directly across from the proposed lot. He stated that the state is making a proposal for a turn in/turn out lane when the road is widen. After no further comments, the public hearing was closed. Councilman Cables introduced a resolution recommending the zoning of property located at the southwest corner of Highway 82 and Washington Ferry Road and Jensen Road from R-2 and B-1 to B-2 and moved for its approval. Mr. Mullins seconded the motion. Mr. Brass provided the staff report for the proposed rezoning. He stated that the current Comprehensive Plan has a future land use classification of Mixed-Use-Residential for this location. This land use classification is recommended for housing of a variety of densities. He stated that rezoning of this property from B-1 (Neighborhood Business) & R-2 (Single-Family Residential) to a more intense business use classification, B-2 (General Business), would be contrary to the consistency of the Comprehensive Plan. He stated that in meeting with Mr. Stanfield, they discussed that the B-2 zoning is inconsistent with the Comprehensive Plan and that a restaurant at this location is a permitted use in a B-1 zoning district as a “Use on Appeal.” Mr. Stanfield stated that a residence would never be put on the existing R-2 portion of the property. After no further comments, the vote was called. Mr. Mullins moved to amend the motion recommending approval of rezoning the R-2 portion to B-1. Mrs. Carpenter seconded the motion. The motion to amend passed unanimously. After no further discussion, the vote was called. The amended motion to approve passed unanimously. 4. Sketch Plan: Lawrence Subdivision, Lots 1, 2, 3, 4 Location: West side of Bridge Creek Road, North of Bridge Creek Road & Upper Kingston Split Petitioner: Adam Lawrence Representative: Adam Lawrence Mr. Brass introduced the sketch plan of the Lawrence Subdivision, Lots 1, 2, 3, 4. He stated that the petitioner is proposing to develop four (4) lots out of the 15 acre parcel. He stated that the lots conform to the zoning ordinance. Adam Lawrence, petitioner, presented the sketch plan of Lawrence Subdivision. He stated that three (3) of the lots will be divided up into two acre lots and the fourth nine acre lot will remain undeveloped. Mrs. Carpenter introduced a resolution recommending approval of the sketch plan of Lawrence Subdivision, Lots 1, 2, 3, 4 and moved for its approval. Mr. Mullins seconded the motion. After no further discussion, the vote was called. The motion to approve passed unanimously. 5. Preliminary Plat: Durden Heights Plat 1A Location: South of Durden Road & Elizabeth Street intersection Petitioner: Katherine Church & Forrest D & Shirley A. McDonald Representative: Larry Speaks & Associates, Inc. Mr. Brass introduced the preliminary plat Durden Heights Plat 1A. He stated that it is a replat to divide three lots into two lots. He stated that there are existing homes on the proposed two lots. Vice-Chairman Gardner opened the floor for public comments. Annie Smith, owns property at 722 Gaddis Pit Road, was in attendance to gain clarity of the preliminary plat’s proposal. After no further comments, the public hearing was closed. Mayor Gillespie introduced a resolution recommending the approval of the preliminary plat of Durden Heights Plat 1A and moved for its approval. Mr. Mullins seconded the motion. After no further discussion, the vote was called. The motion to approve passed unanimously. Miscellaneous Business: Mr. Stephens stated that staff is getting close to rewriting the subdivision regulations. He stated that a committee would be needed from the Planning Commission to assist with this process.
