Code of Alabama, 1975, as Amended.] 4 5 {Sponsored By: Councilor Starnes} 6
7 WHEREAS, an abundance of overgrown grass or weeds: 8 9 1. is injurious to the public health, safety and general welfare by providing a breeding 10 ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12
3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13 such property; and 14 4. may also pose a fire hazard and respiratory hazard; and 15 16
WHEREAS, the City Council of the City of Prattville declared in Resolution Book 2020, 17
18 Page 001, that the abundance of overgrown grass and weeds at various addresses in the 19 20 City of Prattville constituted a public nuisance and set a public hearing to discuss said 21
22 nuisances; and 23 24 WHEREAS, notice, as required by §11-67-62 of the Code of Alabama, 1975, as 25 26
amended, was provided in The Prattville Progress, by certified mail, and by signage on the 27 28 subject property; and 29 30 WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31
32 the property listed in Resolution Book 2020, Page 001, adopted on January 7, 2020, 33 34 and determined that the public nuisance still exists; and 35 36
WHEREAS, the City Council of the City of Prattville held the required public hearing 37 38 at 6:00 p.m. on February 4, 2020, permitting the owners of same property listed in 39 40 Resolution Book 2020, Page 001, to present evidence, objections and protest regarding the 41
42 proposed removal of weeds. 43 44 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 45 46
Prattville declares that the abundance of overgrown grass and weeds on the property 47 48 continues to be a public nuisance: 49 50

The Mayor shall have the overgrown grass and weeds on the property listed above cut or 55
56 removed using city forces or private contractors. Any property owner shall have the right to 57 58 have any weeds removed at his or her own expense provided the removal is done prior to the 59

commencement of work by employees or agents of the City of Prattville. The Mayor shall 61 62 keep an accounting of all costs related to the removal of overgrown grass and weeds and 63
report such cost to the City Council following their removal. 1

the City of Prattville to prepare and adopt a Master Plan for the physical development of the 12

city; and 14
15 WHEREAS, the Master Plan adopted by the City of Prattville was initially prepared in 16
17
1996 and updated in 1998 and 2010; and 18
19
WHEREAS, the City of Prattville Planning Department prepared a Request for 20
21
Qualifications from professional consultants interested in providing a Comprehensive Plan 22
23
Update and Zoning Ordinance Re-Write; and 24
25
WHEREAS, three (3) qualified firms submitted qualifications for said Comprehensive 26
27
Plan Update and Zoning Ordinance Re-Write; and 28
29
WHEREAS, City staff and administrators reviewed the submitted qualifications; and 30
31
WHEREAS, the review committee recommended a team led by KPS Group, Inc. to 32
33
provide the necessary professional services to complete an update of the Prattville 34
35
Comprehensive Plan and a Zoning Ordinance Re-Write; and 36
37
WHEREAS, §41-16-51(a)(3) Code of Alabama, 1975, as amended, allows 38 39 contracts to secure services with consultants possessing a high degree of professional 40
41
skill to be let without competitive bidding. 42 43 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 44
45
that RFQ No. 019-015 is hereby awarded to KPS Group, Inc. for the preparation of an update 46
47
to the Prattville Comprehensive Plan and a Zoning Ordinance Re-Write at a cost not to exceed 48

$220,000.00 and said funds are approved and appropriated from the FY2020 Budget 50

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to finalize and enter 54

WHEREAS, bids were let for the Parks and Recreation/Performing and Creative Arts 12 13 Division for the July 4, 2020 Fireworks Display Program; and 14 15 WHEREAS, one (1) bid was received, opened, and read in public on January 28, 2020 16
17 at 10:00 a.m. and J & M Displays, Inc. was the lowest responsible bidder at a cost of 18 19 $23,500.00; and 20 21
WHEREAS, said program is a budgeted expense of the Performing and Creative Arts 22 23 Division. 24 25 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 26

WHEREAS, said HVAC improvements are a budgeted expense of the Public Works/ 17

BE IT ORDAINED by the City Council of the City of Prattville, Alabama, as follows: 3 4 THAT the zoning ordinance of the City of Prattville, Alabama adopted on February 10, 5 6
1950, subsequently amended from time to time, and the zoning map adopted on the 1st day 7 8 of May, 1987, are hereby amended to reclassify the property described in Attachment “A”; 9 10 and 11
12 THAT this proposed ordinance and a synopsis was advertised for two (2) weeks in the 13 14 Prattville Progress, a newspaper of general circulation within the City Limits of the City of 15 16
Prattville, and that the City Council of the City of Prattville, at its Public Hearing on the 3rd day 17 18 of March, 2020 at 6:00 p.m., considered said proposed ordinance and that at such 19 20 time and place all persons who desired had an opportunity to be heard in favor of or in 21
22 opposition to such ordinance. 23 24 ALL other items and provisions of the zoning ordinance of the City of Prattville not 25 26

[To Authorize the Mayor to Enter into an Election Agreement between the City of Prattville, 3 the Autauga County Commission, the Autauga County Board of Registrars, and the Autauga 4 County Probate Judge at a Cost Not to Exceed $10,000.00 Per Election.] 5 6

8 WHEREAS, the City of Prattville, the Autauga County Commission, the Autauga 9 10 County Board of Registrars, and the Autauga County Probate Judge entered into an Election 11
12
Agreement in compliance with Section 11-46-4, Code of Alabama, 1975, as amended, on 13 14 July 15, 2015; and 15 16
WHEREAS, Alabama Ethics Commission Advisory Opinion No. 2018-3 provides that 17
18 counties and municipalities may enter into a contract through which the municipality 19 20 reimburses the county for the use of the county’s election equipment and county employees 21
22 who possess the requisite skill and knowledge to operate the equipment; and 23 24 WHEREAS, the City of Prattville, the Autauga County Commission, the Autauga 25 26
County Board of Registrars, and the Autauga County Probate Judge desire to enter into an 27 28 updated Election Agreement based on the requirements of said Ethics opinion; and 29 30 WHEREAS, Section 11-46-4, Code of Alabama, 1975, as amended, requires that said 31
32 agreement be completed at least 180 days prior to any municipal election; and 33 34 WHEREAS, the cost to reimburse the County for said services is not expected to 35 36
exceed $10,000.00 per election; and 37 38 WHEREAS, said expenses are a budgeted expense of the City Clerk’s Department. 39 40 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 41
42 hereby authorizes the Mayor to enter into said Election Agreement between the City of 43 44 Prattville, the Autauga County Commission, the Autauga County Board of Registrars, and the 45 46
Autauga County Probate Judge. 47 48 BE IT FURTHER RESOLVED that funds in an amount not to exceed $10,000.00 per 49 50 election are hereby authorized and approved to be paid to the Autauga County Commission 51
52 to reimburse the County for said services and said funds are approved and appropriated from 53 54 FY2020 Budget Line Item City Clerk/Election Supplies. 55
