WHEREAS, the City Council of the City of Prattville has issued a State of Local 8
9
Emergency due to the Pandemic Emergency created by COVID-19; and 10
11
WHEREAS, Section 31-9-10 grants the governing body of political subdivisions to 12
13
impose a public safety curfew in the event of certain natural disasters or emergencies of 14
15
unprecedented size; and 16
17
WHEREAS, the City of Prattville has determined that a curfew is necessary to mitigate 18
19
the spread of infectious diseases by reducing the risk of exposure during a time of outbreak. 20
21
NOW, THEREFORE, BE IT RESOLVED this 3rd of April, 2020, by the City Council 22
23
of the City of Prattville, that due to the Pandemic Emergency created by COVID-19 and the 24
25
increased risk of infection by public gatherings, it is hereby ordered that a Public Safety 26
27
Curfew is imposed in the City of Prattville for the hours between 10:00 p.m. and 5:00 a.m. 28
29
seven days a week. This curfew is effective as of April 4, 2020 and shall continue in 30
31
effect until further notice. 32

(a) This curfew shall apply to all persons within the City of Prattville. During such curfew, no 34
persons shall be or remain in public places. Residents of the City of Prattville shall remain in 35
their places of residence, except as further provided in subsection (d) of this Order. 36

This curfew shall not apply to: 38
39
1. Public safety or emergency services activities, including but not limited to law 40
enforcement, fire and rescue services, and emergency management agencies. 41
42
2. First responders, crisis intervention workers, public health workers, emergency 43
management personnel, emergency dispatchers, law enforcement personnel, and 44
related contractors. 45
46
3. Persons employed by or contracted to utilities, cable, and telecommunications 47
companies and engaged in activities necessary to maintain or restore utility, cable, or 48
telecommunications services. 49
50
4. Persons providing fire, police, sanitation, wastewater, security, emergency and hospital 51
services, food delivery services and other deliveries of merchandise or mail. 52
53
5. Persons seeking essential services or commodities. However, persons who are 54
vulnerable to the most serious six effects of the COVID-19 disease must remain at 55
home, unless seeking medical treatment. 56

6. Persons supplying or restocking businesses in order to provide essential services or 58
products, i.e. home improvement, groceries, fuel delivery locations, pharmacies or other 59
retailers offering emergency supplies, transportation of fuels, movement of equipment 60
and personnel for the provision of humanitarian support, and movement of equipment 61
necessary for the protection of critical infrastructure or public safety. 62

7. Persons employed by the federal, state, county or city government or their agencies 1
working within the course and scope of their public service employment. Such 2
employees shall follow any current or future directives regarding performance of duties, 3
including working from home, issued by their respective employers. 4

8. Persons experiencing homelessness within the City. 6

(b) All public and private gatherings of 10 or more persons or of any size where a consistent 8
distance of at least six feet cannot be maintained are prohibited, except as to those exempted 9
activities further provided in this Order. 10

(c) Subject to exceptions further provided in subsection (d) of this Order, all travel, including, 12
without limitation, travel on foot, bicycle, scooter, motorcycle, automobile, or public transit is 13
prohibited. Transportation in Interstate Commerce is not governed by this Order. 14

(d) Exceptions. People may lawfully leave their residence while this Order is in effect only to 16
engage in the following activities: 17

1. Essential Activities. To engage in certain essential activities, including, without limitation, 19
visiting a health or veterinary care professional, obtaining medical supplies or 20
medication, obtaining grocery items (including, without limitation, canned food, dry 21
goods, fresh fruits and vegetables, pet supplies, fresh or frozen meats, fish, and poultry, 22
any other household consumer products and products necessary to maintain the safety 23
and sanitation of residences and other buildings) for their household or to deliver to 24
others, or for legally mandated government purposes. Additionally, any travel related to: 25
a. providing care for minors, the elderly, dependents, persons with disabilities, or 26
other vulnerable persons; 27
b. returning to one’s place of residence from outside the City; 28
c. travelling to one’s place of residence located outside the City; 29
d. travelling through the City from one location outside the City to another location 30
outside the City; 31
e. compliance with an order of law enforcement or court shall be exempt from this 32
Order; 33
f. travelling to or from a place of business which provides essential services by 34
owners and employees of such business; 35
g. legally mandated government purposes. Persons engaging in these essential 36
activities shall maintain reasonable social distancing practices. This includes 37
maintaining a distance of at least six feet away from others, frequently washing 38
hands with soap and water for at least twenty seconds or using hand sanitizer, 39
covering coughs and sneezes (into the sleeve or elbow, not hands), regularly 40
cleaning high-touch surfaces, and not shaking hands. These essential activities 41
are subject to change and are not limited to the activities listed in this subsection. 42
Individuals must use reasonable judgement as it relates to the many and various 43
circumstances during this time. 44

2. Work in Support of Essential Activities. To perform work providing essential products 46
and services or to otherwise carry out activities specifically permitted in this Order. 47

3. To care for or support a friend, family member, or pet in another household. 49

4. Providing any services, goods, or work necessary to build, operate, maintain or 51
manufacture essential infrastructure, including with limitation construction of 52
commercial, office and institutional buildings, residential building and housing; airport 53
operations, food supply, concession, and construction; port operations and construction; 54
water, sewer, gas, electrical, oil extraction and refining; roads and highways, public 55
transportation and rail; solid waste collection and removal; flood control and watershed 56
protection; internet and telecommunications systems (including the provision of 57
essential global, national, and local infrastructure for computing services, business 58
infrastructure, communications, and web-based services); and manufacturing and 59
distribution companies deemed essential to the supply chains of the industries 60
referenced in this paragraph, provided that they carry out those services and that work 61
in compliance with social distancing practices as prescribed by the Centers for Disease 62
Control and Prevention and the State Health Officer, to the extent possible. 63

Failure to comply with this Order is punishable by a fine of up to $500.00 and/or up to one 1
hundred eighty (180) days in jail. 2
