WHEREAS, the City of Prattville, Alabama, has certain items of personal property 7
8 which are no longer needed for public or municipal purposes; and 9 10
WHEREAS, §11-43-56, Code of Alabama, 1975, as amended, authorizes the 11

municipal governing body to dispose of unneeded personal property. 13

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville that 15
16
the following personal property owned by the City of Prattville, Alabama, is no longer needed 17 18 for public or municipal purposes and said property shall be removed from the inventory of the 19 20

[To Declare the Structure Located at 115 Isom Street to Be Unsafe and a Public Nuisance.] 3 4 {Sponsored By: Councilor Jackson} 5 6
WHEREAS, under the authority of Title 11, Chapter 53B of the Code of Alabama, 7
8 1975, as amended, on August 8, 2019, the City of Prattville Chief Building Official 9 10 declared the structure at 115 Isom Street to be an unsafe structure; and 11
12 WHEREAS, on December 30, 2019, the City of Prattville Code Enforcement Officer 13 14 sent notice ordering the repair or demolition of the structure at 115 Isom Street within 45 days 15 16
of said notice; and 17
18 WHEREAS, said notice was delivered by certified mail in accordance with §11-53B-3, 19 20 Code of Alabama, 1975, as amended; and 21
22 WHEREAS, Title 11, Chapter 53B allows the property owner or other interested 23 24 parties to file an appeal within thirty (30) days of the date of notice with the City Clerk 25 26
requesting a hearing before the City Council; and 27 28 WHEREAS, no hearing was requested within thirty (30) days of the date of notice; 29 30 and 31
32 WHEREAS, §11-53B-4, Code of Alabama, 1975, as amended, authorizes the City 33 34 Council to determine whether or not the building or structure is unsafe to the extent that it is 35 36
a public nuisance after the expiration of 30 days from the date of said notice; and 37 38
WHEREAS, no repairs have been made to the structure located at 115 Isom Street, 39 40 and the structure remains unsafe and a public nuisance. 41
42 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 43 44 that the structure located at 115 Isom Street continues to be unsafe and a public nuisance 45 46
that must be repaired or demolished. 47 48 BE IT FURTHER RESOLVED that the City Council instructs the Code Enforcement 49 50 Officer to provide a report of the cost to repair or demolish the structure located at 51

WHEREAS, under the authority of Title 11, Chapter 53B of the Code of Alabama, 7
8 1975, as amended, on August 15, 2019, the City of Prattville Chief Building Official 9 10 declared the structure at 111 Isom Street to be an unsafe structure; and 11

[To Authorize the Mayor to Enter into a First Amendment to Development Agreement 3 between the Alabama Public Heath Care Authority, the Commercial Development Authority of 4 the City of Prattville, and the City of Prattville.] 5 6

8 WHEREAS, in Resolution Book 2017-A, Page 298, on October 3, 2017, the City 9 10 Council authorized the Mayor to enter into a Development Agreement in support of Project 11
12
Platinum for the purpose of economic development; and 13 14 WHEREAS, on October 23, 2017, the Alabama Public Health Care Authority, the 15 16
Commercial Development Authority of the City of Prattville, and the City of Prattville entered 17
18 into said Development Agreement relating to the purchase, sale, and development of 19 20 approximately 12.5 acres of real property located in the Legends Park at Homeplace to locate 21
22 a State Health Laboratory, training facilities, and related facilities on said property; and 23 24 WHEREAS, the current COVID-19 Pandemic has and will continue to cause delays in 25 26
the construction and completion of said facilities and in bringing said facilities into service; 27 28 and 29 30 WHEREAS, all parties desire to amend the original Development Agreement to extend 31
32 and modify the In-Service Date for the completion of construction and for said facilities to 33 34 be placed in service. 35 36
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville 37 38 does hereby authorize the Mayor to enter into a First Amendment to Development Agreement 39 40 between the Alabama Public Health Care Authority, the Commercial Development Authority 41
42 of the City of Prattville, and the City of Prattville. 43 44 BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute any and 45 46

7 WHEREAS, an abundance of overgrown grass or weeds: 8 9 1. is injurious to the public health, safety and general welfare by providing a breeding 10 ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12
3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13 such property; and 14 4. may also pose a fire hazard and respiratory hazard; and 15 16
WHEREAS, §11-67-1 et Seq., of the Code of Alabama, 1975, as amended, permits 17
18 the City Council of the City of Prattville to declare an abundance of overgrown grass and 19 20 weeds to be a public nuisance; and 21
